"early start" begins now. devastating one-two punch, a tornado touches down in florida as tropical storm andrea is just hours away. pummeling the state with wind, rain and floods. big brother watching, new reports this morning that the u.s. government could be keeping an eye on your phone calls. >> like all of them. and cry for help, michael jackson's daughter in the hospital this morning. after reported suicide attempt. good morning, everyone, welcome to "early start." i'm john berman. >> and i'm christine romans. we start with the first named storm of this year's atlantic hurricane season.

it is taking direct aim at florida right now, tropical storm andrea is starting to bear down on that state's west coast. it spawned at least one tornado so far. a tropical storm warning is in effect from just north of ft. meyers to south of tallahassee. george howell joins us live by phone from clearwater. how do things like right now. >> reporter: good morning. this is definitely a rainmaker. a lot of heavy rain coming down. so much to the point where we've had a trouble getting a live signal out. a lot of rain coming down from this storm right now. as you mentioned, the most immediate concern right now is the tornadic activity, rotation that started in the adamsville area, moved up the i-75 corridor and then headed towards tampa itself. again, meteorologists are tracking this rotation. they say that they believe a tornado touched ground from time to time, the local meteorologist, if you live in this area, important to have that noaa weather radio handy, also to monitor the local

affiliate coverage and this coverage as we continue to cover the storm, john. here's the thing. it's a weak tropical storm, certainly. but a lot of rain coming down from the storm. they think it could drop anywhere from 3 to 6 inches of rainfall, could cause coastal flooding and a storm surge at least 1 to 3 feet higher than the high tide. so that's the big concern is the sto storm parks itself over southern florida. the northeastern quadrant, the southeastern quadrant, really the worst part of storm over the state of florida as this storm continues to churn to the north, just a lot of rain, a lot of problems here. >> you talked about the storm surge. obviously that affects the beaches. this is a heavy time of year for tourism. are people being told to stay away from the beaches right now? >> john, absolutely. certainly a den the in tourism. there's a concern about rip

currents out here. with the choppy waters, no one would want to be out there. just a bad time if you booked a florida vacation is to be out on the beach. with this storm system there's a big concern of coastal flooding and rip tides out there, you just don't want to be in the water right now. >> george howell in clearwater, florida, stay dry, george, if you can. heavy rains in texas are causing several buildings to cave in. we're hearing that part of the roof at the lubbock hart hospital may have given in and water may have seeped into patient rooms. >> we're watching the tropical storm out there, remember this was actually tropical storm barbara in the pacific. once we move into the atlantic we deal with a different hurricane season. this is actually now tropical storm andrea. you can see the development here. seeing the steady winds right now, about 60 miles per hour. it's not expected to strengthen much. that is the good news. we are going to see it go right

into the panhandle here and continue right along the eastern seaboard, southern portions of georgia and the carolinas will be seeing heavy rainfall and eventually it will make its way up towards new york. a lot of rain expected over the next several days. we are watching storm reports of tornadoes. yes, once you get in the right quadrant, keep in mind the ocean is smooth once those winds make their way over ground, the friction spins up little tornadoes. they come with almost no warning for that reason. that's what we continue to monitor especially in the morning hours, expected to make landfall in late day. we are looking for 4 to 6 inches of rain, some areas may see up to 8 inches of rain. 2 to 4 inches of rain through new york. a lot of that tropical moisture enhances the rainfall out there. out towards texas, seeing heavier showers. >> 2 to 4 inches of rain, happy weekend northeast.

thanks, andrea, appreciate it. what is the government doing with your phone records? i mean a lot of them. the u.s. government reportedly attaining top secret court orders requiring verizon to turn over the telephone records of millions of americans to the national security agency. the guardian reports that the order was issued at the request of the fbi. and the information being turned over to the nsa includes originating and terminating telephone numbers as well as location, time and duration of all the calls. according to the report, the order does not require the content of the conversations be turned over. the aclu calls the secret court order alarming and beyond orwellian. last night, newt gingrich told cnn's piers morgan, there's only one thing that can justify this kind of government intrusion. >> i'd want to know this was walled off and i would want some kind of criminal sanctions against anybody who used this information for anything except

counterterrorism. the problem is, given everything we've learned recently about the current bureaucracy, why would you trust them? >> cnn is working to independently confirm the authenticity of the court order on the guardian's website. verizon is refusing to discuss the story and the nsa, fbi and white house are all not commenting. overnight a dramatic rescuer as a survivor was pulled from the rubble of a collapsed building in philadelphia. six people were killed, 14 injured when this building which was in the process of being demolished collapsed on to a thrift store. a search and rescue operation continues this morning at the site. we get more now from chris welch. >> all right! >> reporter: a late-night breakthrough as crews on scene uncover a 61-year-old woman more than 12 hours after the collapse. >> they were digging and they felt her and she was able to respond. >> reporter: but others caught in the rubble weren't as lucky. >> our thoughts and prayers go out to those who lost their

lives and their families. and at the same time, we pray that those who survive will recover, not only physically, but certainly mentally from the trauma of being in a building and it suddenly collapses. >> reporter: harold corbin, a maintenance worker was there to help. >> we were on top of the roof pulling them out. they were on an angle. there was just a narrow space to climb in to help. when we got there, all you could hear was help and maybe see a hand or something through the rubble. that's when the guys kicked in. they ran straight up, jumped in and started moving stuff. >> reporter: at this point investigators kaen not confirm there is no one left inside, thus they're stressing the fact that this is still very much an active search and expect to continue through the night. reporting in philadelphia, i'm chris welch. arrests this morning in the gang rain of an american woman

in india. protesters have taken to the streets in recent days upset by a series of high-profile rains. in this case, authorities say three men in their early 20s were picked up for the crime. they apparently offered the woman a ride after she couldn't find a taxi early tuesday morning. staff sergeant robert bales admitted to the massacre of 16 innocent afghan civilians, most women and children. count by count he pleaded guilty yesterday to 340r than 30 criminal charges. he acknowledged he slipped away from his base in march 2012 going house to house on a killing spree, setting ten of the bodies on fire. bales said there's not a good reason in the world for the horrible things i did. but his attorney blames brain injuries, ptsd and steroids he says were provided by army special forces. the 39-year-old will escape the death penalty with the guilty pleas. the decision on life with or without parole is expected in august. life with parole would mean that he could serve as few as ten

years. collected and wasted. that's what they're calling today's house hearing on the irs spending scandal. jay russell george will be testifying. he's the treasury department inspector general whose scathing report detailed $50 million in irs spending an employee conferences from 2010 to 2012. two years, $50 million. and new this morning, the irs placing two employees on administrative leave for allegedly taking $1,100 in free food and other items during a 2010 conference in anaheim. that conference cost taxpayers more than $4 million. >> more of your hard-earned tax dollars at work here. this is another good one. employees at an epa warehouse in orlando, maryland, turning their facility into a playground. an inspector general's report found a personal rec room along with tvs, screens and refrigerators, as well as athletic equipment. it was all hidden from surveillance cameras using partitions and stacked boxes.

the epa has now severed ties with apex logistics, the contractor that ran that facility. a judge's ruling may help a 10-year-old pennsylvania girl to get a lung transplan the she desperately needs to save her life. children under 12 are not allowed on the adult transplant list. cnn's jason carroll has more. >> reporter: she's been on the children's donor list for 18 months. wednesday, her parents filed a lawsuit against the department of health and human services to get her included on the adult

list. current policy prevents children under 12 from being on the list. late wednesday, judge michael bailson issued a ten-day restraining order directing the department to immediately cease application of the under 12 rule as to sarah murnaghan so she can be considered for receipt of donated lungs from adults. >> the judge allowed her to be on equal ground with the adults. >> reporter: as sarah became sicker over the past few weeks, the murnaghans appealed to kathleen sebelius to change the policy. sebelius said it was not within her power to immediately change it. >> the worst of all worlds in my mind is to have some individual pick and choose to live and who dies. i think you want a process where it's guided by medical science and medical experts. >> reporter: secretary sebelius also saying there are 40 adults currently in murnaghan's region in need of a transplant.

suing concert promoter aeg for the wrongful death of her father. twice she's been questioned. >> paris jackson was asked intimate details about her father and her father's death. >> reporter: a tough situation for any kid, tougher yet for one who has spent so much of her life in the spotlight. miguel marquez, cnn, los angeles. overseas, the fearest protest turkey has seen in decades rages on this morning. police are cracking down on social media as well. 25 people have been detained so far for using sites like twitter to allegedly send false information about the protests. and police reaction to them. that is according to authorities. demonstrations now entering their tenth day. protesters give the government a list of demands yesterday. it all began as a small sit-in to protect the last green space in central istanbul. it's stemmed into widespread anger over government policies. two people have been killed so far. more than 2,300 others injured.

russia may be defying the united states request not to make a shipment to the region. officials say they did not see any evidence of helicopters that syria has been seeking to beef up its military. meantime, arizona senator john mccain gives a major address later today where he's expected to talk about his latest trip to the region where he met with syrian rebels. lawyers on both sides in the murder trial of george jimmer man will be back in court today for a hearing on the ed admissibility of now voice technology analysis. zimmerman is accused of second degree murder in the shooting death of 17-year-old trayvon martin. eric holder is in the hot seat today. the embattled attorney general is appearing from the senate appropriations committee to discuss the justice department's budget for next year. holder is asking for a 3% increase over 2012 but is also

welcome back to "early start." minding your business this morning, stock futures are not rising but not enough to keep up with yesterday's sell-off. the dow fell more than 200 points putting it below 15,000 for the first time in a month. all dow 30 stocks fell yesterday. the nasdaq posted its biggest decline in almost two months. all ten sectors in the s&p 500 opped. a new report says the federal reserve is describing this economy as modest, moderate and mild. >> oh, my. >> this past month, wall street is showing it's clearly worried about the fed and what it will do next. will it keep throwing billions of dollars into the economy to keep it moving? the mere uncertainty causing mortgage rates to jump. 30-year fixed is above 4% for the first time in a year. the data shows that's scaring away some buyers. there's a new number one.

baseball's new drug cheating scandal. he's expected to talk to investigators tomorrow. major league baseball is said to be considering suspensions for 20 players. that's a lot, including huge stars, alex rodriguez and ryan braun. they want to know if the players used performance-enhancing drugs from bosch's anti-aging children nick florida and then, of course, lied about it. joe carter with the latest. >> reporter: a few months ago around march, shortly after major league baseball filed a lawsuit against tony bosch, bosch decided to go to alex rodriguez and ask him for money. according to the daily news, when bosch asked a-rod for money, he asked for hundreds of thousands of dollars. a-rod said no to bosch. major league baseball got word of this and they became concerned that bosch might turn to other players for financial help. that's when they decided to step in and strike a deal with bosch. baseball and bosch are expected to talk about tomorrow. baseball officials are certainly hoping he's going to provide them with enough evidence to

suspend alex rodriguez, ryan braun and possibly 18 other players. we've got new video from yesterday in tampa, florida, a-rod has been in tampa rehabbing from left hip surgery. he didn't speak to fans. he didn't speak to media after his workout. but his teammates who played an afternoon game in new york did go to his defense. >> he's like a brother to us. he's been here for a long time. we'll let that whole situation play out however it's going to play out. until everything is said and done and the facts come out, we're not going to jump to conclusions. >> everybody makes mistakes, you know. just have to wait and see, like i said. but i think there will be nothing but love and support here. >> whenever they reach a decision, we'll face the facts when the time comes. but for right now, you know, we'll support him and stay in touch with him and, you know, hopefully his rehab is going well. right now i know he's focused on getting back on the field. >> there is no specific time

line as to when a-rod is expected to rejoin the yankee. they say sometime after the all-star break in early july. at this point, no timetable for his return. this is all spend pending on whether or not baseball comes back with a suspension. >> the yankees were supportive but it seemed like qualified support. they have to be exhausted by answering questions about a-rod. what else have we been hearing players and managers say about the scandal? >> the word we're getting is that players want to get past this. they've seen enough and heard enough, they want the violators, whoever they are, punished. they're not actively rooting against those on that list but the feeling is they want to move past this whole steroid era, this whole steroid thing. players have made concessions, they've done hgh blood testing. baseball was behind the 8 ball per se but they're starting to get in front of this. all this news, this list, tony bosch, the entire situation

really kind of damages the credibility of this new drug testing program in baseball. >> i think they're just sick of talking about it, sick of being asked about it and there are still people in the game trying to get around those rules. thanks, joe. people in the tampa bay area starting to feel the affects of tropical storm andrea. the outer bands are coming ashore and already a tornado has hit the ground in manatee county. a tropical storm warning is in effect from north of ft. myers to south of tallahassee. >> storm activity overnight is causing road closures and forcing evacuations in sandy springs, georgia, part of a road has been shut down as workers try to stabilize a nearby dam damaged by the storm. the severe weather also caused a gas leak which forced officials to evacuate 100 residents from an apartment complex. the red cross is on the scene helping those displaced by the storm. let's get more on all this weather.

>> remember we had tropical storm barbara on the pacific, now that residual moisture that made its way into the gulf has formed tropical storm andrea. that's what we're currently watching. steady winds at 60 miles per hour. heading toward the big bend. it will start to make a northeastly turn, expected to make landfall later today. it makes its way up the eastern seaboard, eventually becoming a depression. bringing heavy rain with it all along the way. florida has had so much rain out there. this is a tough situation with a lot of flood watches. also the threat will be tornadoes. we've sean a couple reports of tornadoes already in the area. the reason for this, that right front quadrant, remember it goes over clear, glassier conditions on oceans. a lot smoother once it hits land, encounters friction. that spawns up tornadoes, usually without warning. a tough situation. we are watching 4 to 6 inches of rain, isolated amounts of 8

inches of rain, then it's going to make its way up the coastline. the tropical moisture enhances the thunderstorm activity. heavier rainfall amounts will make its way up there. 2 to 4 edges of rain still expected. we had the storm surge amounts as well. anywhere from 2 to 4 feet. a lot more going on. >> that looks like a mess, a lot of rain coming our way. new this morning, north korea offering an offive branch not south. a state-run media reporting pyongyang has proposed restarting operations at the shared industrial zone. it welcomes the talk s as a joit opportunity to build trust. images from the sandy hook school shooting may be blocked. the bill extends those same

you are calling as well as location, time and duration of the calls. according to the report the order doesn't require the content of the conversations to be the turned over. the aclu calls the secret court order beyond orwellian. are we hearing anything from the white house on this? it seems an enormous number of records. >> nothing from the white house so far. it is an enormous number of records. watch what you say on the phone this morning. national security agency collecting call detail records and much more from customers of the telephone giant verizon business network services since april 25th according to what appears to be this top secret order filed on that date and signed by a judge of the united states foreign intelligence court. this was first made public by

the guardian. the company was supposed to hand over listings about who the calls were to or from inside and outside the united states. the order also allows the government to collect information about local telephone calls as well as meta data for things like fax machines and all kinds of other telephone devices. not the content of the communications but where the communication originated and the number where the communication was received. so this order was requested, we are told, by the fbi. it's top secret and virtually no one is allowed to disclose the existence of it unless the director of the fbi said it is okay to do so. the order is supposed to be in effect for three months from july 19 of this year. we contacted verizon last night about the document and spoke to ed mcfadden who told me all he could say is "no comment." the order appears to be

authorized under the patriot act. not the first time questions have been raised about domestic surveillance in the united states. there you see part of the order. it is interesting also to note that while this kind of thing came up during the bush administration it's the first the time it's come up with the obama administration. no federal government authority has commented on the record. the reactions outside the government have come quickly. al gore tweeted that in a digital privacy era, privacy must be a priority. sit just me or is secret blanket surveillance obscenely outrageous. newt gingrich called it a problem of a giant government. >> this did go on during the bush administration as well. what exactly if anything is different about this. congress has voted to authorize this type of thing, correct? >> yeah. what you're talking about here

george howell is in clearwater, florida, for us bright and early -- dark and early for you. good morning, george. >> reporter: christine, good morning. gusty winds come and go. we are in a lull now. also the torrential rainfall hits us and moves down the line. that's what the day will be like here throughout the next several hours along the florida coastline. what we are seeing now, this storm, the meteorologists here, the local affiliates have been talking about tornado warnings. that's really the big concern. just an hour ago they were concerned about a center of circulation moving up from adamsville into the tampa area. again, they are watching tornado warnings as they come and go. our meteorologists can give us the latest on that. here is the concern with the storm. as it continues to track to the north, to the northeast, they are worried about obviously how much rain could fall. anywhere from three to six inches of rainfall causing

coastal flooding throughout this area. also, storm surge. keep in mind the storm surge could be anywhere from one to three feet above the average high tide. they are watching for the threat of flooding throughout this area. keep in mind when you look at the radar, we are on the eastern side of the storm, the northeast quadrant, the southeast quadrant, the worst part of the storm to be in as it churns rain throughout the wrar. >> george howell, still dark and rainy there. we'll see how it progresses when the sun comes up. >> heavy rains in texas causing several buildings to cave in. part of the roof collapsed at a lubbock motor inn motel. we are hearing part of the roof at the heart hospital gave way and the rain may have seeped into patient rooms. no one was injured. for more on the storms andrea peterson is tracking the storms. >> we are dealing with tropical

storms from what was tropical storm barbara. that went into oh the gulf, dissipated, but the moisture is out there and has formed tropical storm andrea. that's what we are watching, currently seeing steady winds. not expected to strengthen much. we are looking at it to make a northeasterly turn starting to impact the big bend area of florida up the eastern seaboard. lots of rain in the forecast, the kicarolinas up and through w york. heavy rain. the other concern we have are the tornadoes. once you have the glassier conditions and you see the waves over land you have friction causing tornadoes out there. there is a tornado warning west of miami. pay attention in that area. listen to the noaa weather radio for that. up to eight inches of rain possible. flooding has been a concern. flood watches for the next two days or so. we are talking about a foot of rain in florida. something they do not need. heavy rainmaking it up the

good morning. the dow is below 15,000 for the first time in a month. it hit that mark yesterday even though we are expecting a higher open today. probably not enough to get back above 15,000. wall street plagued by fears about the slowing economy and when the federal reserve will stop its really aggressive stimulus plan. the dow is up 14% this year. so many are telling me a pullback is warranted and necessary. here is an odd sign that the stock market is up. you're getting more spam e-mail. a new mcafee study says 2 million spam messages were sent out in march, double the amount in december. it's a change from the past three years when spam mail declined or held steady.

sensational murder trial in kansas. attorneys for ex-cop brett seacat accused of killing his wife and setting fire to their home are laying out the case. they say side effect of a weight loss hormone led her to commit suicide. >> reporter: former sheriff's deputy brett secat watched and came up with his own questions for lawyers to ask as the defense team pressed the case wednesday. one of the defense witnesses, an alternative medicine special advised his wife to take the hormone hcg to help lose weight. the defense is trying to get jurors to believe the hormone may have caused the 34-year-old mother of two to take her own life. >> when you use hcg it is a hormone. it manipulate it is body into usinging body fat as stored energy under certain circumstances.

there was a lot of skepticism in the medical community about this. that is now finally turning around. >> reporter: on wednesday a defense handwriting expert testified this suicide note was, in her opinion, real. the note includes messages for the couple's two sons ages 4 and 2. the prosecution's handwriting expert said it was a fakes last week. >> after exam ing, re-examining and taking in the different scenarios it came back to the same thing. this was either a tracing or a simulation. >> reporter: brett was served with divorce papers three days before her death. the prosecution says the prospect of losing his wife drove him to shoot her in the head with this .44 caliber magnum handgun and set the family home on fire to destroy evidence. because of the fire and the condition of the body, the coroner testifies she could not determine if it was a homicide or a suicide.

alex rodriguez before he struck a deal to speak with major league baseball. joe carter has more. >> good morning. this is all according to a new york daily news report. tony bosch went to alex rodriguez and asked for hundreds of thousands of dollars. a-rod didn't give him any money. major league baseball became concerned about the relationship between the two and that bosch may ask other players for money. they stepped in and decided to strike a deal with bosch. he's supposed to come to them this week with tons of evidence to suspend 20 players including alex rodriguez. this is video of him yesterday in tampa, florida. he's been there for five weeks. he's rehabbing a left hip he had surgery on. he didn't speak to the media or fans, but his teammates who played an afternoon game in new york went to rodriguez's defense.
