than obamacare. >> the ploy to shut down obamacare at any cost with a possible government shutdown just days away. this morning, all of the progress to solve the stalemate. >> i was about to ask, what progress? >> zero. president obama caught candidly on open mike about the real reason he quit smoking. >> a good one. >> it is a good one. >> a big good one. >> good morning, everyone. >> you can probably guess, right? >> exactly. welcome to "early start." i'm john berman. >> i'm zoraida sambolin. it is 5:00 a.m. in the east on tuesday, september 24th. trying to get a handle on the deadly shopping mall in nairobi. a crisis in its fourth day. kenyan official say the situation is under control is what they say but they believe gunmen are still holed up inside. at least 62 killed by al shabaab terrorists who stormed the westgate mall this past weekend. authorities say three attackers killed and ten arrested and

kenya's foreign minister is telling pbs that two or three americans took part in this attack. cnn's arwa damon is live in nairobi this morning. give us a sense of the very latest. >> reporter: when it comes to those americans who may have been involved in this attack, the kenyan government is also saying they appear to have been of somali or arab origin. the state department is investigating that report. westgate mall is behind me around the corner. while the kenyan government is saying they do have the situation under control, that is all pretty relative. we heard frn explosion earlier and sporadic bursts of gunfire and seems they are going through to carry out the final sweep. an unknown number of gunmen inside there and various reports that parts of the building might be boobytrapped and snipers inside as well. the red cross is saying 65

people at this stage are either missing or unaccounted for. various volunteers that we have been talking to have been trying to also gain access into the buildings to try to clear out some of those bodies that may still be inside. we have also met a number of individuals, including one woman who was still searching for any information about her husband. a lot of the people we are talking to really just want to see the situation resolved as quickly as possible at this stage. >> more than 60 people still missing you're saying. is it still possible at this point there are hostages alive inside that mall? >> reporter: well, we are not really clear on what the possible fate of the hostages might be or how many could possibly, in fact, still be in captivity. the kenyan authorities, pretty much the last 36 to 48 hours, have been fairly quiet about the fate of the hostages themselves. the last we heard, some two days

ago, there was maybe ten that were still being held. but given the number of missing people, a lot of those who are looking for their missing loved ones are hoping that maybe somehow they have managed to shelter themselves, keep themselves safe while all of this was going on. really hoping that their loved ones are still alive inside, but still a lot of unanswered questions at this stage. >> the siege to take back this mall still ongoing. arwd damon in nairobi, thanks. in an interview with chinese state television, assad warned united nations inspectors that rebel forces in his country might attempt to disrupt their work. he is, again, blasting the united states and other western nation for proposing a u.n. resolution that calls for the use of force against syria if the government fails to turn over its chemical weapons. egyptian court has moved to

ban all activities of muslim brotherhood and the group's funds have been ordered seized. this is part of a widening military government to wipe out the islamic movement to give the president morsi. >> no concern about north korea nuclear program. they would eliminate the need for imports is one of the way to monitor the country's secretive work. to washington now. the shutdown, showdown playing out in congress. the gamesmanship or brinksmanship could topple the government. they must proof on a plan the next six days to keep the federal government up and running. they do not agree in a major way. one republican senator who almost single handedly ignited

miffed it has gotten personal. bob corker said i can count. they don't like what you're doing. they don't like what you're putting them through. these are fellow republicans. >> well,, you know, individual politicians can choose to say whatever they want and launch whatever personal insults they want. i would note the house, the republicans, including those who have criticized me, voted to defund obamacare. and in the senate, i think the votes are very fluid. >> reporter: to be sure among many grassroots conservatives, cruz is a hero but in the senate he has rubbed gop veterans the wrong way. mccain called him a whacko bird and cruz is now embracing that. >> if they want to insult me, they can knock themselves out. my focus is on the substance of stopping obamacare. why? it's hurting the american people. any senator who votes for closure on this bill is voting

to give harry reid the authority to fund obamacare with just 51 votes. >> reporter: dana bash, cnn, capitol hill. a former fbi agent agreed to plead guilty to leaking information about a foiled 2012 bomb plot in yemen to the associated press. donald sakulaman to the leak after obtaining the phone logs to the report. he is expected to be sentenced to 43 months in prison for that leak. in a separate case, he will plead guilty to federal child pornography charges that will bring him an additional eight years behind bars. other news now. lois lerner is retiring. she revealed the irs targeting of conservative and tea party groups. she has been on administrative leave with pay since refusing to answer questions from congress back in may. at that hearing, lerner defended her work with the government

about washington. he would love to go to place other than washington. people are spending a ton of money on education to get their kids in a work force ready a. i will have a whole interview with the secretary duncan coming up this saturday on "on your money." >> we spend a lot of money on education more than other countries but nothing to show for it when you look at the results. >> they are doing a lot of early childhood ed. they realize people need to send their children to learn more. by age of 5 a child could be behind at the age of 5 when they start in kindergarten. what he is concerned about right now is washington. like they -- we need a longer school day and make 100,000 schools and make them like learning centers all year-round for all different ages of children. >> i agree with that. year-round is a good solution. when you look at what that would mean for a child and how much

the vice president touring all of the damage there. and laying out really rough road to recovery. the new definition of big gulp. how about huge? wicked huge gulp. no slushy. that is a bear headed to a convenience store not seen here. >> so adorable from far away, aren't they? >> eating you and following you. >> exactly. you're being mauled. bears are adorable. welcome back. i'm zoraida sambolin. >> i'm john berman. we start with a deadly standoff in nairobi, kenya. it is continuing this morning. day four after a terrorist salt left 62 people dead, nearly 200 injured. an explosion and gunfire was heard overnight and it's coming from the westgate mall. several of the attackers may still be holed up in there. the kenya's foreign minister say some are american. it is not clear if any hostages are still being held.

red cross officials in kenya say 65 people remain unaccounted for as well. cnn's arwa damon is live in nairobi. what is the latest there, arwa? >> reporter: the westgate mall is just down the road and around the corner. earlier this morning, we heard an explosion there. there have been sporadic burst of gunfire. authorities were trying to sweep through the mall and repeatedly saying they are are in full control of the mall but that seems to be a relative term. we are hearing reports from them they are still trying to track down some of these gunmen that remain holed up inside there. there are various reports, concerns that part of the building might be boobytrappe r and gunmen may still be inside the building. we don't know how many but three have been killed according to kenyan authorities. you were speaking about some of them possibly be americans.

the kenyan foreign minister saying that they also appear to be perhaps somalia or arab origin. the u.s. state department saying it is investigating that report. we are continuing to hear stories from those who survived the attack. >> hearing a blast and followed by gunshots and i happened to be very close to the door. i just reached over, grabbed my daughter, just ran out the front door of that cafe. >> reporter: amid all of the horrific stories, we are hearing incredible stories of great heroism. people trying to use their own bodies to shield those of children. we have also spoken to a number of individuals that naturally remain traumatized including a couple caught up in the attack along with their child. the mother took a bullet that grazed her skull. she ended up drenched in blood

and holding her baby drenched in blood. this is a country that really wants this ordeal to be over, that really wants to deal with putting itself back together again but it's going to be very, very difficult. >> when we talked to you yesterday, arwa, you had run into a many woman who was looking for one of her loved ones. have you run into any more people like that that have actually found their loved ones? >> we have not directly. we actually stayed in touch with that woman throughout the night last night and she still hadn't had any word from her husband. he worgeked in the grocery stor in the mall. they were 24 when they were married and when we met her she was cradling her grandchild. we visited one of the morgues here when we were there and no one claiming some of the bodies but some of the morgue officials told us some had come in and identifying their loved ones. the other great concern is, of

course, the 65 poeople that remain missing or unaccounted to. some volunteer workers we spoke to said bodies need to be recovered from inside the mall itself. >> we don't really have an official number on how many hostages are still inside. happy to have you there, arwa. that you have. the fbi is investigating the reports that americans were involved in that mall attack in kenya. federal authorities have been concerned about efforts by al shabaab, the terrorist group, to recruit here in the u.s. particularly in the minneapolis area where there is a large community of somalia-americans. cnn's brian todd spoke to one family who lost a son to that terror group. >> reporter: it was thousands of miles away on her tv screen but it might as well have been at her front door. the attack in kenya has torn open this lady's deepest wound.

>> translator: i got traumatic memories of my son and what has happened to him. >> reporter: her son jamaal, a handsome 19-year-old college engineering student in minneapolis. his family says he gave up everything to fight with al shabaab in somalia. he was one of dozens of young somaliian men in the minneapolis area secretly targeted by the trest group in recent years. in 2009, jamaal, like many others simply disappeared one day with no warning. a few days later, his mother said, he made his only call home. >> translator: he called me saying, mom, i'm in somalia. i said, why? what are you doing there? why did you go? and when? he said i will tell you. i just wanted to let you know that i'm okay. >> reporter: within days, his family saw a picture of him on the internet dead in the streets of mogadishu from a bullet wound to the head. to this day his mother doesn't know how the al shabaab recruiters lured him away. community activists here who

lost his nephew to those recruiters say one way they do it. >> tends to be a nice person comes and protects him out to the new york american having play games and take him to the movies and gets him touring and helps him in school. >> reporter: that's what they do? >> that's what they do. and anger at what they want. >> reporter: bihi say and others in this community have created mentorship programs for young somaliians here and have repeatedly shown them tv images of al shabaab terrorist attacks to counter the recruiting but he says the recruiting is still going on. emotional torture for one mother. what did they take from you when they took this boy? >> translator: they took my heart. before he left, i was a whole person. he was very active in doing everything for herself, raising a family. since he left, up to today, i'm on medication. i live by medication.

>> reporter: ahmad has testified against her son's recruiters and some have been recruited and indicted in in prison the last few years but the threat of young somaliians coming to this city and launching an attack on a soft target like a shopping mall is as one federal law enforcement told us what keeps us all up at night. brian todd, cnn, minneapolis. vice president joe biden getting a good look at colorado and all of the flood damage there. biden and colorado governor and others touring the state. biden reassured that aid won't be affected by the looming government shutdown. >> i don't want folks who had here in shelters or watching on tv seeing the dysfunction of congress and thinking that all, all of the relief efforts that they are now benefiting from or

the adoptive couple was ruled to have the child in the garagrand jury. >> he let me know that he wanted to sign his rights away. and that he had spoken to his family and they had all agreed that it would be best for him if that is what he did. >> reporter: you saved that? >> yes. it broke my heart. >> the girl was initially given back to her father because of the indian child welfare act which is in place to promote the stability of indian tribes and families. that is her biological father she is with right now. very implicated and a lot of players involved but until the end she is given to the adoptive parents. >> hopefully, there will be able to figure this out by the end of
