just how much did the white house know about the problems for the sign-up process for the health care law? libya's prime minister detained by gunmen. we are live with the latest developments there. >> shaky situation there and get to that in a minute. a lot going on this morning despite the fact it is wicked earliship i'm john berman. >> i'm zoraida sambolin. it is 4:01 in the east. take a look at the capitol this morning. the dysfunction beneath that dome that gave us the shutdown we are now under and not able to pay our bills. this morning, there are small, tiny signs of progress, maybe, that might at least keep the country from defaulting on its debt. 18 top republicans are said to visit the white house today to meet with the president. that as multiple republican

house members and sources close to house leaders tell cnn they are working on a proposal to raise the debt ceiling temporarily, perhaps four to six weeks. that could open the door to negotiations on a longer term solution. however, it is not all happy music and unicorns yet. it just deals with the debt part. this will be unwelcomed news to hundreds of thousands of federal employees not being paid right now, not to mention a lot of americans who depend on those services. let's get the latest from senior white house correspondent brianna keilar. >> reporter: finally, they are talking. house democrats met the president at the white house last night. >> we just had a very positive meeting with the president of the united states. >> reporter: president obama's message, he is open to a short-term deal to increase the debt ceiling for six weeks,

according to a lawmaker in the meeting. republicans are warming to the idea of a shorter deal, followed by negotiations with the president on reducing the debt and deficit. house budget committee chairman paul ryan penned an op-ed in "wall street journal" that did not demand to obama care but tea-backed party republicans still want that fight after a brief debt ceiling increase and arguing against ending the government shutdown. >> i would do a debt ceiling for six weeks so the president would negotiate with john boehner and keep the fight on the continued resolution and obama care. >> reporter:? buffs with local news stations, president obama was asked to explain his own vote against raising the debt ceiling in 2006. >> i voted against a debt ceiling increase at the time because i had some concerns about what president bush was do. >> reporter: specifically, the bush tax cuts. and he argued it's okay for certain republicans to protest policies with a no vote, but he

said there must be a vote. >> there should never be a proposition where the speaker of the house is not willing to put those votes to the floor right now. >> reporter: congress isn't faring well in this budget fight. a new gallup shows republicans with a 28% favorable rate, down ten points since last month, the lowest for any party since 1992. democrats slid four points to 43%. brianna keilar, cnn, washington. >> seven days to go before the u.s. hits that debt ceiling. jack lew is headed to capitol hill this morning and testify before the senate finance committee in a few hours. the secretary has already warned congress that the u.s. will not have enough cash on hand to pay its bills if the debt ceiling is not raised before october 17th. that could send the nation into default for the very first time in history. it's ten days since they

rolled out obama care and the online glitches are continuing this morning. many have tried to logon to health care.gov. we are hearing more this morning about just what the administration was told about potential problems with this site way in advance. cnn's brian todd has that. >> reporter: luke chung operates a database company in northern virginia. he's an expert on heavily trafficked web sites but even he is frustrated navigating health care.gov. >> this is interesting. >> reporter: what do you got? >> i don't know what i had. i just tried to log into my account that i have already established. >> reporter: and? >> and it says unexpected error. >> reporter: since the rollout last week chung is only trying to get quote on prices and not even to enroll. error messages and booted out of the system and other problems have exasperated hundreds of

thousands. one democratic ally of the administration congressman robert andrews, says he spoke to the white house months before the unveiling. >> i discussed with the white house people things they already knew which was undertaking of this size is going to be very complex. >> reporter: andrews believes the white house was on top of the situation. robert lachefski, disagrees. he says many of his clients had meetings with the administration ahead of the rollout. >> executives have been warning the administration bluntly that this whole system is not ready for prime time. it wasn't going to be ready on october 1 to appropriately enroll people. >> reporter: but he says the white house ignored them. >> the administration didn't seem to understand the seriousness of it. they were blase about it a. >> reporter: he says they were not about to delay the rollout.

the white house insists it listened to insurers and knew about the problems. >> everyone was aware and we told you there would be glitches. >> reporter: what they are not telling you is exactly how many people have enrolled. they say they don't know the precise numbers. luke chung says. >> the data insists. i hope this has a database inside it that tells you everybody who is enrolled, much less the number of people who are enrolled. >> reporter: white house official tell us it's more complicated than that. they say they have to collect those numbers from several different sources and they have to make sure the numbers are accurate so they are sticking a plan to release the number of enrollments to once a month to ensure that accuracy. brian todd, cnn, washington. breaking news from libya now. cnn has learned the prime minister was apparently taken, taken from a hotel in tripoli by a large number of armed men. there is some confusion about

what is going on here so let's go live to tripoli where cnn's nic robertson has the latest developments for us. >> reporter: it is a developing story, john. about 3:30 a.m., gunmen went into a hotel and arrived in about 30 or 40 vehicles. the prime minister lives there. they went to his rooms and took him at gunpoint. no shots were fired. a group called the operations room of the libya revolutionary that claimed responsibility. they are portraying this as a legal move, saying that they have detained the prime minister and placed him in a jail in tripoli accusing him of crimes. we talked to the justice minister this morning and he says absolutely no way, no arrest warrant has been issued for the prime minister. the government is calling this a

kidnapping. they are meeting now to discuss what to do next. i met with the prime minister last night four hours before this kidnapping. he was happy. he was relaxed. he gave no indication that this might be about to happen. of course, many government officials ministers we have talked to have been concerned that the arrest of abu anas al libi, his arrest over the weekend was going to trigger some instability. this may be it, john. >> indeed. i mean, seizing him some 150 armed men is instability to say the least. any sign, nic there is a direct connection to the seizing of the libya terror suspect? does the prime minister have a close relationship with the united states? would be he an obvious target for retaliation? >> reporter: the prime minister has said that libya has a good relationship with the united

states. i was meeting with people in his office yesterday and the justice minister here who both said that libya signed a short range, long-range contracts with the united states to improve more enforcement here. these have been signed in the last few weeks. the prime minister has been saying despite the fact they are outraged what they call the abduction of abal libi, they say libya has good relations with the united states and the justice minister told me last night that perhaps he and and the prime minister had not been outraged enough with the situation of al libi. what we have heard from this group that claims to abducted the prime minister, the operations room of the libya revolutionists, they say there is no connection with the abduction of al libi. however, the reality is two days ago, they said on their facebook page that they would go out and hunt down and punish anyone connected to the government who

had been helping foreign intelligence services to capture al libi. so the connection is certainly there and it's whatever here believes to be behind all of this, john. >> last question here. it's kay hottic in libya right now to begin with. right now, the prime minister is in custody somewhere under armed guards. who is in charge? >> reporter: well, right now that would be the council administrators who are in charge here right now. right now, they are meeting to determine what their next move should be. but essentially this is going to come down to a standoff. this is a militia, the operations -- it is a militia that has been sanctioned by the government. the government here doesn't have a national security force. it's police is weak. there is no national army here. and the country is essentially,

to put it for want of a better word, a lawless place where large militias like this one has abducted the prime minister, have the writ to do what they will and what we have witnessed in the early hours of today is perhaps one of the worst examples of that so far, taking the prime minister, john. >> nic, in the wild west there in tripoli, appreciate it. abu anas al libi captured last week on the streets of tripoli is still held on a ship in the mediterranean. he has not been read his miranda rights yet. u.s. officials say he is being interrogated by a special team of agents from the california a pentagon and the fbi. anything he tells them cannot be used in court. once al libi is turned over to the justice department, he will be read his miranda rights and evidence gathering will begin

welcome back to "early start." 15 minutes past the hour. this morning it's another shocking twist in the case of a georgia teenager found dead in a high school gym. his family insists kendrick johnson was murdered and an intpt autopsy has now agreed. but police in georgia are refusing to open their investigation into what they call an accident. as victor blackwell reports johnson's family is dealing with the horror of what happened to their son's body before he was burie buried. >> reporter: the second time jacqueline johnson cried near the grave of her son. the first time he was being put into the ground and the second time, he was pulled out of it. in june, kendrick's body was sent to florida.

the johnson's hired a he died as a result of a blow to the neck and not accidental asphyxia. but what dr. anderson did not find shocked them. >> we got the body for the second autopsy, that organs, the heart, lungs, et cetera, were not withed bot. >> reporter: the brain? >> the brain, they were all absent. >> reporter: every organ from the top of kendrick's head to his pelvis, gone, and his family had no idea. >> we have been let down again and when we buried kendrick, we thought we were burying kendrick, not half a kendrick. >> i'm not sure at this point who did not return the organs to the body but i know when we got the body, the organs were not

there. >> reporter: cnn contacted the two entities that had custody of kendrick's body and access to his organs. the georgia bureau of investigation, which conducted the first autopsy in january, and harrington funeral home, which the johnson's chose to embalm and prepare kendrick's body days later. the organs were record to be placed in johnson's body. the body was closed and then the body was released to the funeral home. state investigators say it's their normal practice, but what happened after his body arrived at the funeral home was anything but normal. what was in the place of the organs? >> newspaper. >> reporter: newspaper? dr. anderson showed me the pictures of kendrick's body he had taken during the second autopsy. >> jcpenney ad, yes. >> they stuck newspaper in him

like he was a garbage can inside his body. it's unbelievable. >> i'd imagine that that is a different kind of pain. >> yes. >> reporter: why do you think there would be newspapers stuffed in your child? >> i never heard of that before. never. >> reporter: neither had the founder of a national embalm be academy contacted by cnn. nor had the president of the national association of medical examiners who told cnn he's never heard of this practice. why would the funeral home discard his organs and stuff them with newspaper? >> the question is why didn't he tell us? >> reporter: so what exactly did the hairington funeral home do with kendrick's organs and why was he stuffed with newspaper? we went to their office and their response to, was, "no comment." but harrington funeral homeowner denied he received kendrick's

organs. he writes in part the following. it's another disappointing answer for parents determined to know what happened to their son before and now after his death. and they admit they're struggling. >> unbearable, just about. only thing that wakes you up in the morning is just to keep pushing. >> reporter: victor blackwell, cnn, valdosta, georgia. >> we are learning more and more details about that story and gets more unbelievable. >> i feel awful what that family is going through. a kidnapped california teen is revealing frightening new details about her kidnapping. the 16-year-old tells nbc that james dimaggio handcuffed her and bound her feet.

authorities killed dimaggio. >> the former army private who leaked thousands of documents to wikileaks is reportedly not pleased with people's impression of him. bradley manning who know goes by chelsea tells the guardian newspaper the leak was for more transparency and not an effort to influence the opinions of war. it is manning's comments since august since he was was sentenced to military custody. ahead of the release of the film "the fifth estate." it is about wikileaks and in his letter, asange. cumberland had to meet with assange before the movie.

americans under the president's health care law. >> i'm happy to negotiate on anything and have been willing to do so for the last year. what i've simply said is that there's no reason to have to negotiate with the government shutdown or with the prospect that we don't pay our bills. >> one thing that will now be paid, military death benefits. not by the government, though. a private charity has stepped in to restore the funds froze by the government shutdown. defense secretary chuck hagel announcing the agreement with fisher house. the families of four soldiers killed in afghanistan last weekend were forced to pay their own way to dover air base to meet the remains of their loved ones. fisher house will be reimbursed when the government reopens, if the government reopens. we are ten days into the shutdown now. aaron mcpike looks at the wide ranging impact of having the flow of government services shut off.

>> reporter: is this what it's come to? >> it's like a golf course around here. i've got over a hundred hours logged in eight days. >> reporter: with the national mall shut down, charleston, south carolina, resident, chris cox trekked up to washington to clean it up himself. >> i bought the blower and lawn mower and started cutting the grass this morning. at the end of the day, the citizens are the stewards of the memorials. >> i'm sorry the park is closed today. >> reporter: inside grand canyon national park, another problem. the park is closed and seasonal workers without pay are running out of money to buy food. local food banks are pitching in to help out. >> thousands of people inside the park without food or pay, this great nation we are having have charities deliver food to people who are trapped in the grand canyon. >> reporter: and back on capitol

hill, the gym where members of congress can work out? open for business. it was deemed essential for the members who voted to shut down the rest of the government. >> the electricity, the hot water, the towels, they are not provided by gym fairies! they are provided by taxpayers. >> reporter: though, some want to hold on to their exercise routine find it ironic to shut down the gym because it's where we come and talk about building relationships. there is no towel service. >> reporter: meanwhile, federal workers are getting whip lashed who is in and who is out on the essential list. tens of thousands have applied for temporary unemployment insurance. the intelligence community which furloughed 70% of its staff last week decided some cia staff are necessary after all. those who carry out, quote, core missions like foreign intelligence and covert actions.

don't know what is going on and try to figure out the situation. a tremendous amount of chaos in libya and further unsettle the situation. the word from militia he is in good condition, how meaningful is that? if you're seized by 150 gunmen. >> who storm a hotel room. at first we were calling this a kidnapping. no, they say he has been detained and crimes that are leveled against him. this is a tenuous situation. we have nic robertson who is covering this story carefully for us and we will bring you an update as soon as we get it. a gun battle in west virginia ending in the death of a former police officer. officials say the former officer armed with an assault rifle opened fire on a federal courthouse. he served on the force for 20 years and on wednesday he was killed by some of his own. >> responding officers engaged the gunman who was continuing to discharge that firearm. that person has incapacitated by

the gunfire from a wheeling police officer, as well as a court security officer who responded from across the street at the federal building. >> witnesses say bacard was firing round. two officers were treated for minor injuries. still no word on the motive. the jurors who decided to be in the jury of james holmes expect the process to take eight months. three months for jury selection and another five for the trial. the judge's estimate included an order released wednesday. jury selection is expected to begin in february. holmes has pleaded not guilty by reason of insanity to the 2012 rampage which killed 12 people and wounded dozens of others. to the latest in the teen rap case out of steubenville, ohio. a school technology indicted by a special garage pleaded not guilty to charges of tampering with obstructing justice and

providing false system. william rhineman is out on bond. the indictment claims he tampered with evidence where two high school football players raped a 16-year-old girl. prosecutors are planning to file a motion to remove the judge from aaron hernandez's case but not given a reason why. hernandez was called to the stand during a pretrial hearing on wednesday. the judge asking him about a potential conflict of interest. one of the lawyers works with the wife of one of the prosecutors. hernandez said he did not have a problem with that. a federal judge is sed to sentence kilpatrick on tax evasion among other charges. they want a minimum hall saying shal was for sale while he was in office and they want him to

pay back more than $10 million in profits he made steering city contracts to a friend. the father of a 9-year-old man who got past airport security and stowed away on a flight from minneapolis to las vegas is begging for help. the father who hid his face and not making his identity known told reporters that he has had issues with his son for years. one time, police returned him home only to threaten the father if he disciplined the boy. >> if i see you hit your son, we going to have to lock you up. i said, sir, what can i do? i've been asking for help. there's no one helping me. i'm in what you call a double jeopardy. if i whop, my son, i get locked up. if i let my son keep on doing what he is doing, i get in trouble. somebody please help! please! >> a plea there. the 9-year-old has a long history of run-ins with

bigger picture is this, that i do think the white house is right that you can't let people shut down the whole government and then selectively decide what they want to reopen. if do you, that you're going to have a shutdown every year. people who can't get what they want who refuse a budget negotiation will shut the entire government down and they will decide who to let up off the mat and that is most way to the run the government. if they finally come to a compromise after six and a half months, of course, we want to sit down and do it but there is no reason to keep all of these people laid off. i met with a bunch of employees and private contractors in my office today. they are all laid off and worried about their paychecks. why would we keep them laid off? they can come back to work and we can negotiate. >> on ac 360, this was a gripping interview with a survivor of the deadly terror attack in nairobi that left 67 people dead.

this armed militia that took the prime minister this morning. about a hundred to 150 heavily armed militia men turned up in his hotel where he lives in the center at tripoli here, a heavily secured hotel, went into the hotel and abducted him. no shots fired, we're told, but they say they have done it on the pretext, on a legal pretext. the government, the justice minister saying that is absolutely rubbish, that no one has issued an arrested warrant for the prime minister. it appears in most people's minds here it seems to be linked to the u.s. arrest of al qaeda suspect here over the weekend. he was suspected and involved in the bombings in 1998 in tanzania. this is an ongoing and fluid situation. indications are, it may, i stress may come to an end soon but it is fluid and ongoing. >> in the meantime, i know you were chatting with us earlier about this. the question is what is happening with the government

the tricks in his bag and october 17th one week is the day when the government won't have enough cash to pay all of its bills. it's going to be interesting to see if he hints at any wiggle room some are calling the x-state. one part of the market is showing stress and it's short-term treasuries. the t-bills are used by companies and banks to stash cash in the short-term basis and the rates on bills due for redemption around the middle of the month have spiked five-year highs. a sign that lenders are nervous. the chart you're seeing there might not look like much to you but people are just poring over this chart because they are worried it's showing the cracks in the financial system. headlines wednesday that fidelity was dumping all of its u.s. treasury bonds and bills due in late october and early november seem to send a chill through the credit markets and there was word the decision not to pull back on the federal

>> i'm zoraida sambolin. 31 minutes past the hour. this is a strange morning we have been having in libya. getting word now the prime minister has now been relieved. hours after being taken from a tripoli hotel by members of a militia group, dozens and dozen of them who stormed this hotel overnight and walked out with the prime minister. the government there called it a kidnapping. now they are saying he has been relieved. our senior international correspondent nic robertson is live in tripoli this morning. he has been reporting all of the twists and turns in this story. nic, what is the latest? >> reporter: well, the prime minister now on his way to government offices we are told, john. he was held about eight hours. there have been many, many twists and turns. claims he had been arrested for actions against the interests of the state. claims that there were -- there was no arrest warrant issued follow. what all of this shows right now is that libya is in a very

precarious stability and it is is not guaranteed. there are many peer linking the kidnapping of the prime minister with the arrest of abu anas al libi, the al qaeda terrorist over the weekend suspected in his involvement in the 1998 attack on u.s. embassies on kenya and tanzania. what appears to have happened is the group that took the prime minister has come under huge and intense pressure, is what sources have been telling me, huge and intense pressure to release him. the group that took control of him, guess what? they are a government sanctioned militia. the government here does not have a national army, does not have a strong national police service. it is militias, independent ma liberias a that are the rule of law here. one of them this morning took the prime minister. they just relieved him. john? >> how on earth does this say about the prospects for this nation if the prime minister can

just be kidnapped willy-nilly held for a few hours and then relieved? how on earth can he possible govern in the coming days and weeks? >> reporter: this is one of the richest country and it has huge oil resources. there are many ma liberias a here and some are islamic ma liberias and some tied to al qaeda. they threaten the security of europe. that is the analysis of security experts. and this nation is very, very close to europe. it's on the edge of europe. how does this speak to how the prime minister can rule a country in the coming weeks and days? that isn't clear. but what is clear when, i interviewed the justice minister last night in the hotel where the prime minister was kidnapped, i saw the prime minister at that time as well last night, the justice minister told me that the country he felt was close, close, he said, to becoming a failed state. he said he hoped the government could turn it around.

it wasn't going to be ready on october 1 to appropriately enroll people. >> reporter: but he says the white house ignored them. >> the administration didn't seem to understand the seriousness of it. they were blase about it. they continue to assure the industry there weren't going to be any problems. >> reporter: he says they were not about to delay the rollout. the white house insists it listened to insurers and knew about the problems. >> everyone was aware and we told you there would be glitches. >> reporter: what they are not telling us is exactly how many people have enrolled. they say they don't know the precise numbers. luke chung says. >> the data insists. >> the data exists. this i hope it has a database in it tell you everybody who is involved, much less the number of people who are enrolled. >> reporter: white house officials tell us it's more complicated than that. they say they have to collect those numbers from several
