of pitches up in the zone. this three-game is a hanging change-up and ty able to double into the left field corner to get at least a potential tying run to second with nobody out. >> gary: so the orioles get in this case markakis up. markakis has popped out and struck out 1-6 in the series so far. and that is the strike on the outside corner. each team now has three hits in the ballgame. the orioles had a runner in scoring position 1st inning. could not get the hit. they had three chances in the second inning after a wieters lead off double and could not get the hit. now they get a shot again here in the 6th inning. 0-1 delivery. nice block made by moore. and a one-ball, one-strike count. >> jim: go back to the second inning, gary, the lead off double by wieters and garrett atkins couldn't get him to third. you don't want to really over if you are a hitter.

but in this case you would love to be a roll over and make sure you hit a ball to the right side because i would imagine don wakamatsu, he is going to bring the infield in. >> gary: you have to move him up to 3rd base here at a minimum from this at bat. big hole at short there as they move the shortstop over behind the runner wigginton. see both of them in the bottom of your screen. >> jim: it doesn't mean that you have to give yourself up. but you want to look for a pitch that you can hit for the right time. >> gary: markakis, .312 lifetime against seattle with a couple home runs against mariner pitcher. 1-1 delivery. that's outside. vargas has looked back a couple times after delivery as though he is catching his back foot on something on the mound. both times he has done that he has missed that strike zone by a lot. two ball 1 strike count.

the first two games in this series. it seems to me every time the orioles play the mariners, but ichiro has a few hits. >> he does because he is such a great hit are. he is a great contact hitter. the harder you throw the ball to him, the harder he hits it. it is so easy for him and a lot of great hitters in the ballgame. to look for hard stuff all the time and lay the head of the bat on it. you have to make a pitch like hernandez did like there to get this guy out. overall, it doesn't matter where you throw it. he takes that ball right off the bottom of the ground, almost bounces to home plate. he had such great hand-eye coordination that you absolutely have to make a perfect pitch on a guy like him to get him out. the orioles have to find a way to approach him because he kills us every time we see him. 20 game hitting streak against

the orioles. seven rbis. he has scored 15 runs. there is the lead off man causing havoc on the bases. four bases. a career .386 hitter against the " the amazing thing about ichiro suzuki if he wanted to hit 30 home runs eprobably could. if you have a guy like this that flat out owns you, how would you go about trying to get this guy out? >> i faced a lot of great hitters in my time, too, and you have to figure it out with experience. some of the great career hitters, all of a sudden one day, strictly by mistake, i watch the anatomy of a hitter. in order to get him out, you have to make him roll that top hand over. to power hitters, they swing the switch, but they have that little end where they roll the hand over. i did it a million times and i hit a million groundballs to shortstop. i once said to palmer who gave

up four hits to rod carry and and the harder he hit it, the better he got it. i said lob the ball up to home plate and see if you can make them use their top hand. right away he hit nine consecutive groundballs to 2nd base. the thing was he finally cut him down from one to ten. from that approach we god to wade boggs. he was another one, too. the slower are you throw it, the more power they to use their own power in the infield. and they get their base hits the opposite way. he started rolling over. we cut him down to .250. same thing with tony gwynn in the national league. i said to the pitchers, just lob it up there and we cut him down to .250 alsoments use that top hand, they are not going to hit much for average. >> i realize this guy does it against most of the opponents.

a lot in spring training about fundamentals, we are going to do them correctly, situational hitting, we are going to master that, we are going to get some runs, right now when the team is struggling, i am amazed at how little we are seeing that. jim pointed out at two at-bats we looked at during the game, matt wieters leads off, atkins comes up. but no attempt to hit to the other way by atkins. same thing happened to nic markakis in the 6th inning. wigginton led off with a double. i know markakis is an rbi guy. he is not exactly on fire right now. he doesn't pull the fly ball to center field. you have to get a guy to 3rd base with less than two outs. even with the team struggling, they are not even doing the fundamental things correctly to try to add on runs. >> i do agree in some respects. if the ball club was hitting, you have to have a guy like in this case markakis try to pull the ball and get a rbi. but in the situations that they are not scoring any runs, maybe

understand your testimony to be that you are the department of justice is resisting allowing those people to respond to the u.s. commission on civil rights. islamic the authority of the civil rights commission as i of this and does not exceed the authority of the united states senate so we have spent considerable time attempting to work with the commission. that is why we've provided 4,000 pages such documents and i offered to come up. i have great respect for the institution of the civil rights commission and that is one reason why i am more than willing to come up and explain why we reached the decision that we reached but as you know, senator, that is why we have political leadership in place to come up and explain those things that we are treating the civil rights commission with great respect to get we apply the same dewey principal to them that we would apply to any request we would get from -- speed it still remains a concern about how the case was handled and i don't

with the education section and we will continue to monitor those and i would be happy to work with you on the underlying issue of ensuring that everybody going to school can have the reality of a learning environment that is nurturing, nondiscriminatory -- >> don't we have explicit laws against bullying people on race? >> defending the debate could another fact of the circumstances there may be local state laws or potentially federal civil rights law and again we've had cases before involving racially motivated violence committed by school-age kids. oftentimes it's been are some of schools and churches pretty

significant. >> i'm talking about bullying. right now title mine covers sex discrimination but while some have interpreted that to include discrimination on the basis of sex stereotypes not one circuit has found that to include discrimination on the basis of sexual orientation. >> that is correct. our theory was of gender nonconformity which is a form of sex discrimination. it wasn't of that based on the fact that somebody is gay. islamic i would like to work with you on this and -- >> i would be happy to. >> and explicit protections for folks on the lesbian gay and bisexual and transgendered for

kids. it is a very real thing that there is this bullying in school let's turn to a couple of other matters. as you know the u.s. commission on civil rights has founded by president eisenhower to promote civil rights. that may sound self-evident but let me list some of the recent actions by the commission and commission members. they include one testifying against the reauthorization of the voting rights act to opposing by majority the matthew shepard hate crimes act and three issuing a report questioning the academic and social benefits of school diversity. that's the u.s. commission on civil rights statement. i know as the authority and

jurisdiction but dustin nation's chief law enforcement officer for civil rights can you tell me what is happening here? and i would also love for you to talk about the voting rights act as realized in the [crying] are those pieces of legislation central to your mission? >> absolutely central to our mission. and we have in the voting context feverishly preparing for redistricting. senator sessions mentioned some voting cases but i look forward to giving him the full panoply of the voting cases that we are working on including a section eight case, section ii case and you could ohio a victory recently in a new york state

case and another case in shannon county sought dakota which is indian country making sure people with limited english percussions and in the in country can access the velte. so am proud of the work we've done and i look forward to ensuring that senator sessions has a full list of the cases that were actually working on an the obama administration. i also have great respect for the civil rights commission. i had the privilege during the transition center of overseeing the obama transition not all of the agency's that have a robust agencies such as the department of justice, hhs, hud, smaller agencies, eeoc and civil rights commission. i actually got a history lesson on the civil rights commission and the creation. civil rights has always been bipartisan in the country. i learned that from senator kennedy and you look at all the major pieces of civil rights legislation and they've been a function of bipartisan work.

i look forward to the 25th anniversary of the bill signed by george herbert walker bush this summer. and there was -- i have profound respect for the tradition and the history of the civil rights commission and that's why when they asked me to come over recently about the -- to talk about the work in the new black panther case of course i will come over and i will be over there in a few weeks to discuss options and i hope we can reach a point where we can return to our bipartisan routes because really civil rights is about bipartisan coalition building. that's what i've learned from the movement and as i study the history of the movement that is what it is and that is what i hope it will return to three >> thank you. thank you, mr. chairman. >> i would remind the senator he went 16 seconds over his

follow the provisional dollars or they didn't have to handle the provisional balad or whatever and where they were harassed to such a point they just left because the time problems they have been voting and i do check with our local law enforcement to see how many -- after every election there's always accusations people fraudulently voted and then we take a look at it and we don't find it and there have been a lot of studies done and a number of people who are fraudulently voting are miniscule compared to those who are eligible to vote or try to vote who either can't vote for their votes don't get counted properly. now i am for senator sessions point. i want the laws and forced to read don't get me wrong. but i would hope we would try to be in power and people to vote who are eligible to vote and spending our resources to do that and not try to spend a lot of effort with a problem that really does not exist or

excesses in such a minor way of that we should be very surgical how we go about and i just think there are many who share my view on that and i didn't want senator sessions comments to go on without being responded to. >> senator, when u.s. me a fair lending question i said that consumer protection and preserving the sound lending climate go hand in hand. there's a tendency to create this unhealthy by an eerie world where you either do one or the other when you should be doing both. similarly, we can combat of voter fraud and we can ensure full access to the ballot. those are not mutually exclusive propositions and that is exactly what we are doing. there is a right way and a long way to enforce section 8 of motor voter is and we are preparing guidance of the states to the right way. similarly preparing guidance of the states enforce section 7 because frankly we have received

numerous reports about motor vehicle agencies, social agencies that are not doing their job of providing those materials and so we need to be vigilant across-the-board. >> thank you. i certainly support that. i want to ask one additional question, senator franken has a second round of we have time. i want to deal with the olmsted case dealing with people with disabilities. it was an expansion by the supreme court of the interpretation of title to in the act and it appears that we are making i think some significant progress on behalf of people with disabilities. georgia department of human resources did not segregate to women with disabilities in the state psychiatric hospital long after the agencies treatment professionals had recommended the transfer to come in to care. can you share with us what the priority in your department is in regards to the expansion of the rights of people with

disabilities? >> we have an active docket of cases and this is a situation that occurs in almost every state in the united states and the old paradigm of looking at people who are in the institutions was is the institution save? are the conditions constitutional? that is an important question to the second question that should be asked. the first that should be asked is are there people in this institution who shouldn't be there who can and want to live in the command his with the appropriate support so in every case we are now doing we are asking the two questions and get some push back from time to time from states saying it's too expensive. well with all due respect it's too expensive to warehouse people and institutions the average cost oftentimes was over $200,000 per person when you could live humanely and far more

expensively so we have a case in new york where we intervened a major case where we got a very good ruling from the court. we have the georgia case itself where i personally went down and sat with the governor. i did that because ten years after the olmsted case there was scant evidence of progress and so we had to file another lawsuit in order to move forward. the good news is we've been negotiating in good faith with the state and we are also doing similar negotiations elsewhere and i am confident that we can build a new paradigm so that people with disabilities to want to live in the study can do so because just as the segregation of people buy a race in the school is unconstitutional and a moral, the segregation of people, the on mrs. resegregation of people with disabilities institutions is equally illegal and must be

stemmed. >> thank you. senter franken. >> thank you, mr. chairman. mr. perez, part of your job is enforcing the freedom of access to clinic entrances act which prohibits -- unsury, protect americans' access to reproductive service providers. i know the attorney general holder asked the u.s. marshals service to help safeguard reproductive providers and facilities around the country after dr. george tiller is murder last year. hauer you working with u.s. marshals service to ensure ongoing protection for these providers and are you and attorney general elders still recommending increased protection or do you believe that the need was temporary? >> i don't believe -- will

conduct regular threat assessments. we have an active docket. the last thing i worked on before i left the clinton administration was the murder of the doctor and buffalo new york 3 miles from where i grew up. the first thing i was briefed on won by a ride back 11 years later for civil rights is a briefing on the murder in kansas. the more things change the more they stay the same and this threat is an ongoing threat and we take this seriously. we are constantly assessing and reassessing working not only with our partners at the marshall service but other wall enforcement. we are actively monitoring the kansas prosecution and i can't comment in detail but that investigation remains on going. we will continue to fully exercise our civil authority as well. we had a case last year in mexico involving an are some of the clinic that can to a successful prosecution.

these cases are among the highest priorities. >> thank you. i know that the department of justice has helped enforce the lpr of the vote act and has worked with polling places to ensure accessibility with individuals with disabilities. but although most polling places now have accessible voting machines that gao recently found that half of, quote, accessible voting machines may pose problems too many with disabilities such as those in wheelchairs. what actions has the civil rights division taken to address this problem? >> i'm familiar with that report and we are actively working jurisdiction by jurisdiction. it is because of the volume of the precincts and i know in my own state of maryland we had a number of precincts that were --

have accessibility issues so we are feverishly working to make sure not simply that the facilities are physically accessible but then working in issues involving some people in in vision impairment and we've read more about that or heard more about that recently bought there is a broad part of an overall agenda ensuring everyone eligible to vote can do so. >> that is so important and thank you mr. chairman. if i had known i would have to rounds i wouldn't have come down so hard on the ranking member who had an important armed services committee hearing and i apologize for that. that was uncalled for. >> mr. chairman if i could i just want -- my staff and me something i wanted to make sure was in the record relating to the fbi hate crimes report. according to the information i

received, the most recent fbi hate crimes report documents the since 2001 so the number reported in 2008 was 7783 which was up from 7624 in 2007 so that is the highest level since 2001 and i will be certain to share this information with senator sessions but i just wanted to make sure the record was complete regarding what the data shows and i can tell you from our own enforcement experience as i said at the outset the phone is ringing off the hook and the cases are more and more brutal and we got a lot of father-son teams, one in indiana, one in south carolina passing down their hatred to their children and it is remarkable. we sentenced a person to threatening the president last week in arkansas. we have a case pending involving threats against the heads of the

national council of la raza and when this person was pending trial he threatened the pretrial service officer in his case and he has now been detained. so there's a lot of dangerous people who want to divide this country along racial, ethnic and other lines. >> that is consistent with the information i think each of us have observed in our own communities and it's clearly a circumstance we need to take aggressive action and we think you for the manner in which you are receiving in this regard. i do send an open invitation to all of my colleagues on this committee we can get more reliable information to the fbi from local officials on these types of activities i figure would be useful and i did offer aid legislation to deal with homeless to get the information as we could act on whether the

significant problem, violence against people who are homeless and i did that not to initiate new policy but to find out what the facts are so we can try to develop the policies to protect people in the community and it was not received in a way that we could proceed in this committee and if there is an interest by the republicans to try to have the fbi have more reliable information in this area i can assure you i am very happy to work with any of my republican colleagues so we can have effective information to work on. absent that we do have the fbi information that shows the rise in hate crime activities and we do have local information from our local law enforcement and we also have the poverty center in which is produced a great deal of information in this regard all confirming there's been an alarming increase in hate crime type of activities in this country and we thank you for

bright side of things and doing a documentary on the strength of the country and we looked at a list of the country's strengths and they all seemed to fall into the same category of opportunity to read and we also heard the name the land of opportunity before so we decided the would be the title of the video. >> what type of opportunities do you think the united states has to offer? >> it has a lot of great opportunities and as we mentioned in the video there is freedom of rights, no cultural or religious restriction, safety, stable government, law, education, jobs and a lot more and true freedom, anybody and everybody is given an education and you can practice any religion and proceed your goals without be discriminated and you can also feel safe in this country as well. >> does your community reflect diversity? >> definitely. our small community reflects diversity and we have a lot of different ethnicities living together. there are mexicans, african americans, indians, bosnians and more and it's great to see different people of the world

living together peacefully. >> to enter bidding your documentary a former citizen of iraq. so how did you get the interview and what did you learn from her? >> when we were planning to buy gentry we've realized we wanted to interview someone with a powerful story could tell about how he or she feels in america and the but types of opportunities they are given. we had a few people that we were considering such as one of our custodians in our school who was from iraq. but her religion wouldn't let her be on camera so being in america we optus we respect her decision because she had the freedom to make that choice. but dima agreed to give interviews and we asked about her life iraq to see if she was the right candidate for the interview and once we heard her experience we knew that dima was able to tell how her real-life experience. >> what impact did her life experience of a document? >> it was unbelievable someone around my age had gone through those kind of the spirit i could never imagine myself in her situation. it was sad to hear about the

violence that occurs in iraq and how it affects everybody there. >> what did you learn from her and speaking with her? >> i've always heard people say we should be grateful for what we have in this country. the growing technology and advancements sometimes you forget how fortunate we are what you're in a -- hearing dima's story reminded me of the attendees and we are living the good life in america so while we have the opportunity to live such a great life we should take every chance we get and appreciate that we are so privileged to live in such a great country. >> you guys use a lot of creative elements in your documentary. how did you decide to use all of those? >> ever since the three of us begin producing videos we've always liked producing exciting and creating videos even though we are supposed to produce a documentary it doesn't mean it can't be creative and week thought that the idea of finding an old dusty book and writing about flout would be fun and also informational at the same time. we just thought it was a cool idea and would be a new learning experience to develop a read aloud session. >> what did you enjoy the most

tenet fogle of politico talking about fund-raising and campaign 2010. and let's look at the numbers here before we get started. according to the most money raised for the 2010 senate campaign has the massachusetts senate race at 25 million that was for scott brown the pennsylvania comes in second with 23 million, arlen specter running for that seat. florida, 22 million, nevada, 21 million, connecticut, 20 million. then we have on the house i the most money raised for 2010 house campaigns. south carolina, second district

6 million, pennsylvania 12th district is totaling about 5 million so far, minnesota's six the district, 4 million, ohio and florida, 13th and eighth districts respectfully coming in about 4 million. that is right now those numbers change but where are we headed for 2010 as to how much the senate seats or going to cost this time are not? >> we are headed toward a super expensive election cycle and that is not only because getting more expensive to run a competitive race particularly statewide for the senate and some of the states that have a larger media markets but also because we are going to see some experts predict unprecedented spending by outside groups particularly corporations or nonprofit groups that are incorporated as well as unions facilitated by this recent supreme court decision back in january citizens united versus federal election in that case the supreme court struck down the gates of law and rules that

prohibited corporations and unions but we explicitly support or oppose candidates and we are already seeing that 527 eckert some of the offside groups the u.s. chamber of commerce which is affected by this juror up for extremely expensive aggressive campaigns that are sort of outside of the direct fund-raising that we are seeing here. so candidates are going to feel the pressure to keep up their fund raising so that they can compete and answer in some cases some of the negative attack ads they will be seen from some of these outside groups. so really a combination of factors very competitive election cycles hysterically to read the first midterm election of president particularly when the president's party controls both chambers of commerce is going to be free competitive and expensive election cycle in this case republicans gearing up for what they think are going to be

significant gains in both chambers of commerce combined with the supreme court decision combined with escalation in their races is going to make for a very expensive 2010. >> host: before we get to the outside groups an overview from open secrets bought or about fund-raising. democrats have raised about 267 million. they've spent about 152 million have cash on hand about 222 million. and republicans in the house, to under 43 million raised. they spent 128 million about 172 million cash on hand. and then democrats in the senate have raised on hundred 41 million, 76 million spent, and they have about $116 million cash on hand so far. and then the republicans, 141 million, and not as the democrats that they have raised, they've spent 61 million, a little bit less, and they have the same amount of cash on hand,

about 116 million. so what is happening here in the senate with the same amount of fund raising versus the house? >> guest: the house democrats have long had an edge in cash on hand of fund-raising which republicans cut into just on the first quarter a public interest in million dollars more than democrats and they now even that 435 districts that is not a whole lot but it is demonstrating something close to power in the fundraising in these cases and it's a little surprising given that is such a -- the factor is to be more energized and take more advantage of the opportunities in this election cycle and democrats are keeping up including the democratic national committee almost being on par with republican national committee which is very surprising the republican national committee is traditionally of frist democrats sempre knous decatur's raising

efforts pointing to some of the problems republican national committee chairman michael steel has had in the republican national committee under his tenure for dissuading large donors who do make up an enormous share of the national party fundraising from giving as much as they might otherwise be doing to the republican national committee where there are outside groups picking up the slack including republican defenders association which doesn't final reports of the federal election commission which is what we are dealing with here when we talk about fund-raising in the first quarter as well as some outside efforts during up to kind of compete with the rnc republican fund-raising supremacy and republican to be the kind of campaign arms as you will love republicans we're the ones being pushed by karl rove and well-connected republican operative some washington, d.c. called american crossroads so these are all things to watch it

into what is going to be again an intense election cycle. this first quarter of the year does seem to be important so there are some initial preliminary judgments we can make including democrats have done a fairly good job of keeping that with republicans except we should point out in a few races on the senate side you mentioned some of the senate races among the most expensive and among some of the races we see republicans out raising democrats including pennsylvania where pat is gearing up the challenge of the respecters to raise more money, florida where the republican superstar two-party heroes raised 3.5 million in the first quarter, very impressive for him. massachusetts you mentioned scott brown did surprisingly well for at that time a relatively unknown candidate against a very well-known the
