time. >> i remember that story very well, and i don't begrudge president reagan for wanted to do that. but i do remember that extremely well. i didn't agree with chairman fowler on much, but i did appreciate the fact that the president can't talk to someone serving during his administration. did the fcc follow the process used by both democrat and republican commissions when crafting the open internet or? >> the processes remained unchanged. >> so i want to make clear the fcc has done precisely what congress intended the commission to do, classify broadband internet access service according to its best understanding of the technology of that day and how consumers use that technology. and i am confident that that is how you are proceeding come everything to do you for that. i think the commission for that. i'm also pleased with the recent

steps that the fcc has taken to increase consumer privacy protections as part of the commissions correct decision lets you do we classify broadband title ii. the commission wisely chose to apply section 222, to broadband extending the duty to protect the privacy of information that internet service providers collect about their customers because of the unique carrier customer relationship. i believe isp has a duty to protect the privacy of consumers who use the companie company's d wireless infrastructure to connect to the world. senator booker, senator blumenthal and i have written to the commission urging the commission to initiate a rulemaking to protect the privacy of consumers who use the broadband. entity believe you should have a comprehensive definition of customer proprietary network information to ensure

transparency, require consumer consent if information is going to be used so that privacy is protected. and protect consumers information by requiring isps to implement strong data security measures. can you give us some idea, mr. chairman, up when you plan on moving forward on rulemaking, on broadband practices? >> i hope it's very soon, and that includes this month. >> that includes this month, excellent. and i also sent you and other senators a letter on the proposed acquisition of time warner cable and broadcast networks by charter communications. and my hope would be that the commission would look at it, ensure that the guiding principles are competition, competition, competition, as you've said repeatedly, mr.

chairman, and that you ensure it gets the kind of review that ensures that the proper protections are in place for the competitive marketplace which we need. >> thank you, senator. >> tremblant. >> thank you. senator markey. >> just a couple of final points i would like to make. one is i want to say that as i mentioned earlier that this committee will be marking up a bipartisan mobile now act to more which will help advance wireless innovation, key provision of ranking member nelson's and my bill focus on bands of the critical for next wireless services. our legislation intentionally builds upon the good work that the commission is doing in spectrum frontiers proceeding. i was glad to hear earlier today that chairman wheeler expects this order by summer.
