nach bowl la zazi will go before the judge along with his father. the third suspect, ahmad afzali is also a permanent u.s. resident. a muslim clearic and furn ral director in new york where he is scheduled for a court appearance this afternoon. all three are originally from afghanistan. they are charged with lying to federal agents investigating an alleged plot to explode bombs in the u.s. now, the younger zazi has publicly denied being involved in a terror plot, but prosecutors are saying he has admitted he got weapons training from al qaeda in pakistan. investigators say the man may have been plotting to attack subway, maybe commuter trains in new york. they say the plan was focused on building backpack bombs like the ones used to attack transit systems in london and madrid in the past. agents found backpacks and cell phones at a new york apartment.

investigators saying they found images of handbritain instructions for building a bomb on a lap-to-bip zazi. they found battery, a scale which can be used to make bombs with zazi's fingerprints on them. meantime, moving to florida, now, norts in florida looking for this man after finding his wife and five children dead in their apartment. the children were between the ages of 11 months and 9 years old. according to police, he board add flight on friday from miami to haiti where he has family. responding to a missing person's report entered the home in naples, florida, and they found the body. >> we are not going to get into the manner of death at this time due to it's investigation ongoing. but i can tell you that in no uncertain terms, this is the most horrific and violent event

this community has ever experienced. >> a spokesman for the sheriff's special investigation division says since 2000, police have been called to the couple's house several times for domestic disturbances. a 20-year-old man who rapped about the thrill of killing is a suspect in the deaths of a virginia pastor and three other people. richard samuel iii faces one murder charge. s himself syko sam. virginia police found the bodies of the patter and three others on saturday. police with search dogs back at the home of the california couple accused of kidnapping jaycee dugard are combing phillip and nancy garrido's property and the property next door for clues into the unsolved disappearances of two other girls in the late 1980s. earlier dogs trained to fine human remains and high-tech

radar equipment indicated bones may be buried underground. in another development, a law enforcement source says dugard told him phillip garrido did not molest the daughters she had with them. we take you to california with the latest of a briefing from law enforcement. >> -- sunday further debris clearing, further gp scanning and prep work for this morning's canine searches. the contra costa county fire department sprayed about 3,600 gal, of water on the cleared property. this is to keep the soil dust-free and moist and cool for the dogs, but i understand it also helps greatly in them locating scents. and one of the handlers likened it to a cup of soup, where if you open it, you can't smell very well when it's dry. but when you add water to it, it releases the scent, and that's thousand works for the dogs. we also had one of the dog

handlers go up in the helicopter to take aerial photographs to plan for this morning's search. also yesterday, an excavation specialist from the alameda county sheriff office coroner's bureau came out to check out the property to plan nowhere this afternoon's digging. this morning about 5:00 a.m., we had six canine search teams. they were from the alameda county sheriff's office search and rescue team, and those were cadaver dogs. from the santa clara's office, canine search team, two different dogs here. human remains detection dogs and historical human remains detection dogs. the handalers were very appreciative of changing conditions on the property. they had been here before. we're not confident in those searches. at conclusion of this morning's searches, they believe there's no need to bring the dogs back. that whatever alerts they got

this morning were what they're going to get on both properties. as far as the search this morning by the dogs, one of the dogs did alert in the same general area as last week's alert, which is also the same general area of the anomaly from the gpr scanning. that's going to be the area that we focused on this afternoon when we begin digging. today we're going to be briefed by bill silva on the gpr raurts from the weekend. there's a small section he needs to finish the gpr scanning, and then sometime this afternoon we estimate we will begin digging in that one area of interest. >> law enforcement in california are going over their plan to continue searching the property of phillip and nancy garrido as well as the neighbor's property trying to see if there's any evidence that would link them to the disappearance of two girls back in the 1980s. we, of course, will keep you posted on the very latest as we monitor developments out there. meantime, to the kennedy space center in florida where

the space shuttle "discovery" just landed ending its round-about trip home. piggyback style there. it was carried on a modified 747 for the last leg of a jurn they took it to the international space station as well as military bases in california, texas and louisiana on its way back. "discovery" wasn't able to make the space station mission a round-trip ticket, because weather issues last week in florida forced it to land in california. beautiful landing. at least two deaths now blamed on heavy downpours. severe thunderstorms soaking the atlanta area. the storms have dumped as much as 20 inches of rain across north georgia over just three days. high water has washed out roads, flooded homes and caused major problems on busy atlanta highways. schools in five north georgia counties closed today. forecasters have also issued flood alerts for parts of tennessee, alabama and north carolina. america's top commander in afghanistan warning of failure if more troops are not sent there.

the husband, and children's father, has flown to haiti and is still being considered a person of interest. >> we certainly are interested in speaking with him for additional information. we submitted a national, or nationwide bolo for location and contact. >> reporter: now, the sheriff's office says they are working with the fbi and the immigration and customs enforcement office here in florida trying to find where mr. demot is. they say he is in haiti, but there's no word yet if haitian officials have been able to get ahold of him or exactly how extradition might work there. at this point she only considered a person of interest in the sheriff's office, since they aren't ruling out anyone else but are certainly looking at him. virginia? >> nicole, law enforcement mentioned there were previous incidents of domestic violence

najibullah zazi will go gf before any jauj judge in colora. the third suspect, ahmad afzali, is also a perm u.s. resident a muslim cleric and a funeral director in flushing queens, new york, where he's scheduled for a court appearance today. all three originally from afghanistan. they're charged with lying to federal agents investigating an alleged plot to explode bombs in the u.s. what kind of evidence has the fbi amassed against these three? we're going to run that down for you in full in just a couple of minutes. authorities in florida are still looking for this man, after finding his wife and five children dead in their apartment, the children were between 11 months and 9 years in age. according to police mesac dumas boarded a flight to haiti. on saturday police responding to a missing persons report entered the home and found the bodies. >> we are not going to get into the manner of dit at this time,

due to the investigation ongoing. but i can tell you that, in noen uncertain terms, this is the most horrific and violent event this community has ever experienced. >> a spokesman for the sheriff's special investigation division says since 2000, police have been called to that couple's house several times for domestic disturbances. police with search dogs are back at home of the california couple accused of kidnapping jaycee dugard back in 1991. combing phillip and nancy garrido's property and the property next door for clues into unsolved disappearance of two other girls in'80s. earlier dogging indicated bones may have been buried underground. police intend to focus on that spot again today. >> as far as the search this morning by the dogs, one of the dogs did alert in the same

general area as last week's alert which is also the same general area of the anomaly from the gpr scanning. that's going to be the area that we focus on this afternoon when we begin digging. >> in other development dugard told him, phillip garrido didn't poll molest the daughter she had with him. dugard gave with to both girls in her teens. the girls never went to school, never saw a doctor, raised in sheds and tents in garrido's backyard. phillip garrido's neighbors invented a device that allowed him to communicate without speaking. in reality it's a black box. with a plastic handle, metal switch, and jacks for plugging in headphones. garrido was so convince id hhis invention work he tried to have it pat ended. he had some sign declarations dlae dlae declaring the device worked.

they did it because they didn't want to hurt his feelings. the top u.s. commander in afghanistan says he needs a lot more troops, tens of thousands to overcome the insurgency. "the washington post" obtained a document in which general mcchrystal says if he doesn't get the troops the insurgents would very well win. the u.s. has about 62,000 troops of the ground in afghanistan, and plans to send at least 6,000 more by the end of the year. "the washington post" reporter bob woodward says at assessment is sobering. >> this is a striking thing for a general to say to the second of defense and the commander in chief, it really takes his finger and puts it in their eye deliver or this won't work, and he says if they don't endorse this full counterinsurgency strategy, don't even give me the troops because it won't work. >> the post agreed not to publish portions of the document

certain way. they have to be built up so when it does happen in this area, this neighborhood, floweding, which is prone to flood, you don't have this issue and homes get damaged. le i'll have the photographer go through, look to the back behind this home where we saw this couple, you can see them actually walking through to the back there, what they are looking at in their backyard is the river you mentioned, runs right behind all of these homes. this is, you know, atlanta, the best you can do to waterfront property, if you will. so the chattahoochie runs through the home. they are prone to flooding but the homes are built higher up. this gentleman said about his home you can literally take a boat and drive it underneath the house because it when it does flood it's concrete. so they're okay. a few other homes that weren't built in the past several years they don't have the same specification. these folks are doing it right, taking it in stride. but they will have a little damage to deal with, chuck. again, not an overwhelming

in a terror plot. prosecutors say he's admitted he did get weapons training from al qaeda in pakistan. investigators say they may have been plotting to attack subway and commuter trains in new york. they say the plan was focused on building backpack bombs, like ones used to attack transit systems in madrid and london. investigators say they found instructions for building bombs downloaded on to a laptop owned by najibullah zazi, in his own handwriting-they've done handwriting comparisons and found batteries and a scale, which can be used to make bombs with zazi's fingerprints. david paterson will run for leak the obama administration denies it. the paper says the president's political team and other party leaders are worried that paterson's unpopularity could cause problems for other democrats. patterson took office last year after eliot spitzer resigned in

happening now, deadly flooding across the southeast as much as 20 inches of rain dumped on georgia since friday. torrential downpours are blamed for two deaths, one near chattahoochee, and rescuers searching for a man who bragged that he could swim across a flooded ditch. two motorists were killed trying to drive through floodwater. hundreds of road georgia have been closed. several school districts canceled including gwinnett district in atlanta. trees are down and power has been cut to a lot of western north carolina.

police with search dogs are back at the home of the california couple accused of kidnapping jaycee dugard. they are combing phillip and nancy garrido's property and the property next door for clues in the disappearances of two other girls in the 1980s. earlier, dogs trained to find human remains indicated that bones may be buried underground. in a news conference today, police say they plan to focus on that spot again today. >> as far as the search this morning by the dogs, one of the dogs did alert in the same general area as last week's alert, which is also the same general area of the anomaly from the gpr scanning. that's going to be the area that

we focus on this afternoon when we begin digging. >> now, in another development, a law enforcement source says jaycee dugard told him, phillip garrido did not molest the daughters she had with him. the 29-year-old dugard gave birth to both girls while still in her teens. authorities believe those girls, now 15 and 11, never went to school or saw a doctor and were raised in sheds and tents in garrido's backyard. meanwhile, phillip garrido's neighbors say he invented a device that he thought allowed him to communicate without speaking. in reality, it's just a simple black box with jacks for plugging in headphones. garrido was so convinced his invention worked, he tried to have it patented. clients of his printing business say he often showed it off. he had some of them sign declarations at the time saying the device worked. but they say they did it because they didn't want to hurt his feelings. authorities in florida looking for this man, after

finding his wife and their five children dead in their apartment. the children were between the ages of 11 months and 9 years old. according to police, mesac nay damas boarded a plate to haiti where he has family. police responding to a missing persons report entered the home in naples, florida. and found the bodies. >> we're not going to get into the manner of death at this time due to the investigation ongoing. but i can tell you that in no uncertain terms, this is the most horrific and violent event this community has ever experienced. >> a spokesman for the sheriff's special investigation division says that since 2000, police have been called to that couple's house several times for domestic disancturbancdisturban. three men suspected of

plotting a terror attack making their first appearances in court today. 24-year-old najibullah zazi will appear, and so will his father. his son is a permanent resident. the third suspect, ahmad abzali is also a permanent resident, a muslim cleric and a funeral director in new york, where he is scheduled for a court appearance at this hour. all three originally from afghanistan, they are charged with lying to federal agents investigating an alleged plot to explode bombs in the u.s. now, the younger zazi has publicly denied being involved in a terror plot, but prosecutors say he has admitted that he got weapons training and al qaeda in pakistan. investigators say the men may have been planning to attack subway and maybe commuter trains in new york. they say the plan was focused on building backpack bombs, just like the ones used to attack transit systems in london and madrid in the past. agents found backpacks and cell phones at a new york apartment.

now, investigators say they found images of hand-written instructions for building bombs on a laptop owned by najibullah zazi. they say it appears to be his handwriting. they also found batteries and a scale, which can be used to make bombs, and those apparently had zazi's fingerprints on them. for nearly a week, parts of the south have been getting rain with little to know break. over the past few hours, things have gotten dangerous in parts of florida. at least two deaths being blamed on the weather. t.j. holmes just outside of atlanta in the suburb of smerna choing us now. t.j., wow, look at that water level. how bad is it where you are? >> reporter: we've got pictures, and we're going to show you and walk and talk and do this while it happens here, dear, because we have a mess going in this neighborhood. in particular, this home that i'm next to. take a look at it in the back. you can't see much of a backyard in a lot of these homes here, certainly the one that's next to me, you can't say their backyard at all.

and if you loo there in the distance, you see nothing but water. but literally, where these people live, i'm in vinings, a neighborhood just to the west-northwest of downtown atlanta. not a lot of waterfront property around the atlanta area. this is the best you can do, it's on a lake, or on the chat ahoochy river. and that's the river behind them, so they know living here, when it rains and when it comes down like this, and when it pours, they are at a risk for having flooding and that's exactly what they have right now. a lot of this water you're seeing in the backyard, certainly covering their backyard, is causing a mess back here. but in the front, we can take a shot as well, it does go out in the streets and cause a bit of an inconvenience for those trying to drive through it. a lot of these families know that they have to have these homes, build them to certain specifications. that is a pain in the butt sometimes to try to get a house built, but it also saves you during times like this. a lot of its homes you can see

in the neighborhood are built and lifted up. so most of them built to certain code, certain specifications. so when things like this do happen, the homes are a-okay. i talked to one homeowner at one of of those homes, the one i'm standing next to right now, supposed to move in the next six to eight weeks. and he actually and -- this is a direct quote says, "it's kind of fun." he's able to say that, because his home is doing exactly what it's built to do. all of this water is running straight through the bottom of his home, nothing but concrete, and he is a-okay. so sure, a lot of these homes, a lot of these homeowners in the neighborhood, it's inconvenience. you've got to drive around, maybe. but that's really not that big of a deal to a lot of homeowners, because their homes at this point are not going through a lot of flooding. other neighborhoods -- [ inaudible ] and built to specifications to withstand just this such thing. >> all right. t.j. holmes, a little bit of technical problem with your audio, so we're going to end it here. we can see the rain still setly

a legally insane killer who escaped from a washington state mental hospital last week is in jail. colleen o'brien with kxoy shows us how a nationwide manhunt came to an end, not far from where it began. >> it has been one of the largest man hunts in this region for the last many years. >> reporter: according to sheriff ozzy kenezovich, once he escaped from the fair on thursday, he duped a friend to driving him to stay with his family. but when his friend learned that paul was part of a nationwide manhunt, he quickly dropped him and called authorities. they found him on the side of the road, and when deputies approached him, with a helicopter monitoring from the sky, paul simply said, "i'm

done." >> he knew that he was -- he had been located. he had been feeling the pressure, the presence of the helicopter all day long, and he surrendered without incident. >> reporter: when they found paul, he had a red sleeping bag, a guitar, a backpack, and most disturbing a rusty sickel. >> this is a situation that, in my opinion, should not have happened. and i will be asking the state legislature, the governor, and the secretary of department of social and health sciences to help us change some laws so this does not happen again. >> reporter: more specifically, the sheriff wonders why nobody questioned paul when he packed a large bag with clothes, money and food to take to a fair. why the fair had no clue there were eastern state patients at family night. and why security from the hospital waited two hours to notify his department that a patient had escaped. >> it was very, very concerned

trees are down, and some homes have lost electricity, meantime, in the western part of north carolina. forecasters have issued a flood alert for north carolina, georgia, parts of tennessee and alabama. president obama is backing an investigation into the a.c.o.r.n. scandal. now, you may recall, hidden camera catching a.c.o.r.n. workers, apparently advising a couple posing as a pimp and prostitute how to launder their money. president obama is saying what he saw on the video is inappropriate and deserves an investigation. fbi director robert muller has signaled a potential federal investigation of the organization. a.c.o.r.n. has also ordered its own independent investigation of these incidents. as a lawyer, the president represented the group in a 1995 lawsuit over illinois motor voter law. this just in to us to update this story. the top u.s. commander in afghanistan reportedly says he needs a lot more troops to overcome the insurgency. the "washington post" obtained a document in which general stan me mcchrystal says if he doesn't get the troops he needs, the insurgents could win. "post" reporter would be woodward says that assessment is sobering. >> this is a striking thing for a general to say to the secretary of defense and the commander in chief. it really takes his finger and puts it in their eye, deliver or this won't work. and he says if it they don't endorse this full counter insurgency strategy, don't even give me the troops. because it won't work. >> now, the "post" agreed not to publish certain portions of the document after consulting with the defense department. meanwhile, president obama is

said to be considering mcchrystal's assessments, but says he intends to make sure any troop increases he approves are justified. >> the first question is, are redoing the right thing? are we pursuing the right strategy? and once i have that clarity from the commanders on the ground, secretary gates, my national security advisor, jim jones and others, when we have clarity on that, then the question is, okay, how do we resource it? and that's what i will say to the american public, that's not going to be driven by the politics of the moment. it's going to be driven by the fact that, a., my most important job is to keep us safe, and al qaeda is still trying to do us harm. but b., every time i sign an order, you know, i'm answerable to the parents of those young men and women who i'm sending over there, and i want to make sure it's for the right reason. >> right now, the u.s. has about 62,000 troops in afghanistan, and there are plans in the works to send at least 6,000 more by the end of the year. we would like to hear from you

are. well, this guy actually did it. but he said the hardest part was just persuading his friends, not actually putting together the device. he did get a friend in on this, and in the end, these 20-year-old m.i.t. students, oliver yeah and justin lee successfully took photos from the edge of space and submitted them to i-report. they show everything from are their launch efforts to the curvature of the earth. now, they spend months researching how to pull it all off. in the end, here's what they did. they put a gps-enald phone and a digital camera inside a beer cooler, styrofoam and all, and then attached a balloon to it and let it go. total cost, as you mentioned, 148 bucks. >> we got the camera from ebay for 30 dollars. and then we got the boost mobile cell phone from radioshack for $49. and it had gps and web functionality. >> reporter: we actually interviewed them last week here at cnn.com.

really nice guys. they had to put the camera and a cell phone in a cooler, and then actually wrap that in hand warmers, because, of course, as you get higher, it gets a lot colder in the upper atmosphere. otherwise the electronics would have died if they didn't keep it warm. there is a time lapse video you're looking at now of all of the photos they took from the five-hour flight it was on. the gps phone allowed them to find the balloon after it fell back to earth. i find that to be almost the most amazing thing about this. and they have a new goal, virginia, and that is to put a rocket on that cooler, so after the balloon pops, it can keep going up. >> leave it to m.i.t. students to figure this out. right? >> i know you weren't thinking about that when you were at princeton. >> no, no. not about putting things up in space. >> you were too busy singing with the tigerettes or whatever it is. >> exactly. i was too busy entertaining folks than to think about this. emerging from a most unlikely place? >> reporter: this is actually taking place in pakistan ofment

and the woman woo they're we're featuring in this story is supposed to be the best squash player in that country. she has had to dodge a lot of land minutes, figuratively and literally. she is in a really disputed area, in waziristan, the suspected home of osama bin laden, and there are nearly daily attacks by extremists. so in all of this, maria has tried to persevere with her talent. she is 18 years old, as i mentioned, the top-ranked squash player. where she comes from, maria says they have no future, spend their lives locked in their homes. her dad moved her to a larger city. one month after her first squash match, she was the national under 13 champion, and she has a lot of confidence, she says i'm the best player in the world. her dad is continuing to foster that confidence. and he says, you know what, if everyone picked up a racket instead of a gun, we would be in a much better place. amen to that. >> yeah, absolutely.

"associated press" reporting haitian police have detained the florida man whose wife and five children were found dead in their home. the children were between the ages of 11 months and 9 years. police say mesac damas boarded a flight friday from miami to haiti, where he has family. saturday, authorities responding to a missing person's report entered the home in naples, florida, found the bodies of his family. we are still waiting for word from florida authorities to confirm these reports, but again, the "associated press" reporting that mesac damas has been taken into custody in haiti. so listen to this. people who are susceptible to colon cancer can cut their risk

in half by taking a daily dose of aspirin. at least that's the word from a new study in europe. researchers tested 1,000 people with the gene that counts for 5% of colon cancer cases. about half got aspirin daily, while the other half got placebos. researchers say six people in the aspirin group developed colon cancer, versus 16 in the group that got placebos. ab earlier study showed that aspirin may cut the odds of dying from the disease by 30%. also want to let you know today is world alzheimer's day. and this is a big problem, and it's getting bigger, because the number of people expected to suffer from the brain disorder is estimated to nearly double every 20 years. one reason is that, well, people are living longer. some causes of alzheimer's are thought to be genetic. but physical exercise and mental stimulation can help keep the brain healthy. it's expected that by next year, some 35 million people will be living with alzheimer's. so a man came to his wife's

situations. carol county authorities, that's about an hour west of atlanta, say a child vanished this morning when flooding ripped through the family's mobile home. in chattooga county they are still looking for a toddler. rescuers are searching for a chattooga man who bragged he could swim in a flooded ditch. trees are down. the lights are out in the western part of north carolina as well. flood alerts for that area as well as tennessee and alabama how long will the southern states be putting up with relentless storms? chad myers is tracking the weather system for us.

it tried to slide southwest. just didn't make. there's been a low to the west to western half of the u.s. for seven days. all of the humidity that hasn't been a hurricane yet got thrown up here in the southeast. the carolinas always the way back to texas have picked up between eight and now some spots doppler indicated 22 inches of rainfall in a week. and more still to come. this is what the computer thinks is still going to happen. from gainesville to atlanta. there still could be another four to six inches of rainfall. tonight and into tomorrow. here is the rain now. here's i-85. this is the big circle right here. that's atlanta. we know this as the perimeter. in d.c. it's called a beltway. here's i-85, i-75 and i-20. i-20 was closed for a while out here with water over the

roadway. the rain continues as this hour two to three inches of rain per hour. and it's not stopping, and it isn't moving very much. that's more of the problem than anything else. we have reynolds wolf up here. got him on the wall. he's standing in front of all of this water here. this is powder springs, georgia. water coming up about everywhere. it really is a problem with the river bay basin. here's atlanta, georgia. all the water, the beautiful homes along the river are in trouble today as flood waters from all the way up here, here's the national forest, keep going, though, you're eventually going to find lake lanier. lake lanier has been 17 feet below normal for a while this summer. now it's coming up. >> the average total is 42? >> somewhere around there.

that's a half year's rainfall in one week. three men suspected of pl plottiplo plotting terrorist attacks are facing their first day in judge. the elder is a natch lized u.s. citizen. his son, a 24-year-old is a r m permanent residenresident. the third is also a permanent residence. he's a funeral director in queens, new york. he was set for a court appearance today. it's already happened. all three originally from afghanistan. all are charged with lying to federal agents, investigating an alleged plot to explode bombs in the u.s. what kind of evidence does the fbi have against these three men? we'll run it down for you in a few minutes. >> a man wanted for questions

california home of the couple accused of kidnapping jaycee dugard. they're looking for clues in the unsolved disappearances of two other girls in the late '80s. earlier dogs trained to find human remains and ground penetrating radar equipment indicated bones may be buried there. police intend to focus on the the spot today. in another development a law enforcement source tells him dugard told him phillip garrido did no molest the daughter she had with him. she gave birth to both girls in her teens. they believe the girls never went to school, never saw a doctor and were raised in sheds and tents of garrido's backyard. the top commander in afghanistan says he needs more troops to overcome the insurgency in afghanistan. he says if he doesn't get the troops the insurgents could prevail. the u.s. has 62,000 troops on the ground in afghanistan.

the younger zazi denies being in a terror plot but admits he got weapons traing from al qaeda in pakistan. investigators say they may have been plotting to attack subway and commuter trains in new york. they said the plan was focused on building backpack bombs like the ones used to attack transportation systems in madrid and london. they found instructions for building bombs down loaded onto a laptop owned by zazi apparently in his own handwriting. they found batteries and a scale which can be used to make bombs with zazi's fingerprints on them. david paterson will be running for re-election in spite of word that president obama doesn't want him to. the white house urged the governor to withdraw from next year's race. the obama administration denies the report. the times says the president's political team and other reports are worried that paterson's popularity could cause problems for other democrats.

don't need them. >> most people don't need a living trust. they have a simple estate. it will quite frankly be cheaper for you than a living trust. there's no reason to go through the additional expense for a product you don't need when there are other better simpler cheaper alternatives. >> now these living trust kits which run about $2,000 are marketed by salesmen that may call you on the phone, show up at your door claiming that if you don't buy the trust your estate could be eaten up by taxes or it could take years for your estate to be given out. you may be invited to attend a free lunch seminar. beware. there's no such thing as a free lunch. you're getting the hard sale not only on living trust but also products like in annuities. only 5% of the population should get a living trust. >> what do people need to know about living trusts?

a man is now in plis custody in haiti for the killing of his wife and children. florida police are scheduled to hold a news conference at 4:00 eastern. according to police damas board ad plane on friday from miami to haiti where he has family saturday police entered the home in naples, florida, and found the body. a child welfare worker visited the woman and her five children three days earlier and found nothing unusual. a spokesman says since 2000 police have been called to the house several times for domestic disturbances. the children were between 11 months and 9 years old. a criminally insane prisoner recaptured in washington state after three days on the loose. during a field trip to the county fair hes caped. sheriffs found him with a deadly cutting tool in his backpack. he strangled and slit the throat

of a woman in 1987. the field trip he was allowed to go on has law enforcement outrage outraged. >> there was an extreme amount of anger that this event took place. we have learned several things throughout the investigation. my question is if somebody was noncompliant in taking medications, what makes them think he would be compliant at the fairground? this is a situation that should not have happened. >> authorities say he left the institution with a backpack full of clothes, food and a guitar. it looked like he wasn't planning to come back. the sheriff wasn't told about his escape until two hours later. the head of the state social services agency suspended all field trips for mental patients as the investigation continues. happening now, deadly flooding across the southeast. and it's not going to get better soon. 20 inches of rain has been

dumped on parts of georgia since friday. rescuers are searching for a man who bragged he could swim across a flooded ditch. a toddler whose family mobile home was torn apart by a flooded creek is now missing. hundreds of roads across georgia have been closed. several school districts have canceled classes. in chatooga county crews are working to fix a levy that failed. trees are down and some homes have lost electricity in western north carolina. forecasters issue ad flood alert for the area, as well as georgia, tennessee, and alabama. jacqui jeras has been out and about the metro area covering the severe flooding. >> just north of the downtown area where the creek has risen out of its banks. it was a rapid rise and caught

the folks off goord. you can see a car that tried to drive through the flooded streets and got stuck. the people were able to get out. nobody was injured in the situation. quite a few homes are being threatened. the water is like a river. also across the driveways cutting these people off from being able to get out. if the creek continues to rise we could see the water move into the homes. look how fast the water zf moving. a good example of how six inches of water can knock you off your feet. a lot of dangers. something else that's starting to happen. you can see a tree that's been down. the ground is so so much rated from seven contective days of rachl that the tree limbs and roof systems are being weakened. trees are starting to fall down. we'll be concerned about power outages and more downed trees in the coming days.

make sure any troop increase is justified. the u.s. has now about 62,000 troops on the ground. it plans to send 6,000 more to afghanistan by the end of the year. supporters are in the streets celebrating the news that he is back in the country. in an interview with our sister network, zelaya says he's in the embassy. he's returned. officials worry if that happens zelaya's supporters would stage violent protests. the number of people afflicted with alzheimer's is expected to rise dramatically in the coming year. what experts are saying about the coming crisis in the elderly population. us music]

"the new york times" reports the white house has urged paterson to withdraw from next year's race. the obama administration is denying that report.

the paper says the president's political team and other party leaders are worried paterson's unpopularity could cause problems for other democrats. paterson took office last year after eliot spitzer resigned. president obama visited a community college in new york state to highlight ways the government is working to reshape the u.s. economy. he talked up programs he said promote stable and sustainable economic growth including clean energy and green jobs initial e initiatives. >> having so many years of failing to act, there are those who now suggest there's really not much the government can or should do to make a difference. that what we've seen in places like troy is inevitable. that somehow the parts of our country that helped us lead in the last century don't have what it takes to help us lead in this one. i'm here to tell you that that is just flat-out wrong. >> the president is heading to new york city for the opening of the united nations general assembly and a round of middle east peace talks.

in the last minute, there were two filings by the parents in the ohio court. one for requesting dependency hearing which was a last-minute filing and also as was a procedural filing which was basically saying that they wanted -- the child was a habitual -- she was disobedient. these were just -- it's a criminal juvenile charge, but it's a procedural charge. there was concern in the courtroom whether this was just a procedural move so that the emergency jurisdiction here in florida to hold her here, this would be a move to get her moved to ohio so that then the case could be carried on further. the judge was -- wanted to say, halt, let's slow things down and let's look through this. let's go back and we'll talk to the courts in ohio and then we will make our decision. a hearing was scheduled and pushed until october 13th. at that point when he will decide on whether -- what

ultimately how they will proceed forward from this point on. >> in the meantime, do we know how rivka is doing and what she is doing right now? >> we know very little due to the fact she is in the custody of the florida department of child and family. being in state custody, very little information is available. we know she is with a foster family and that she was receiving visits from the pastor's family's children who originally she had ran away to where she had ran to. the judge did say today that since there was some newer charges filed that this family had some type of -- we don't know the exact details. it was a very last-minute filing by the parents minutes prior to this court hearing. we're waiting to find out exactly what the filing is. what the judge decided, no other visits from any of the family members should occur from this point forward. >> clearly to be continued in this case. john couwells in orange county,

florida. thank you. police with search dogs are back at the home of the california couple accused of kidnapping jaycee dugard. they are digging on phillip and nancy garrido's property, looking for clues in the unsolved disappearances of two other girls in the late 1980s. earlier dogs trained to find human remains and ground penetrating radar equipment indicated that bones may be buried underground. in a news conference, police say they intend to focus on that spot again today. >> as far as the search this morning by the dogs, one of the dogs did alert in the same general area as last week's alert, which is also the same general area of the anomaly from the gpr scanning. that's going to be the area we focus on this afternoon when we begin digging. >> in another development, law enforcement source says jaycee dugard told him that phillip garrido did not molest the daughters she had with him. the 29-year-old dugard gave birth to both girls while she was still in her teens.

authorities believe the girls now 15 and 11 never went to school, never saw a doctor and were raised in sheds and tents in garrido's backyard. meanwhile, phillip garrido's neighbors say that he invented a device that he thought allowed him to communicate without speaking. now, if you take a look, it's just a simple black box with a plastic handle, a metal switch and jacks for plugging in headphones. garrido was so convinced his invention worked, he tried to have it patented. clients of his printing business say he often showed it off. he had some of them sign declarations at the time saying the device worked. they say they did that because they didn't want to hurt his feelings. stocks played tug-of-war today as investors couldn't make up their minds about whether the recent rally will hold. the wrap on wall street. hey, felecia. >> hey, virginia. that's right. after posting gains in eight of their last ten sessions the blue chips finished lower today. investors took profits from the recent rally.

♪ welcome to comcast local edition. i am donna richardson and my guest this hour is colonel george f. johnson iv superintendent of the maryland natural resources police. colonel, thank you for joining me. >> great to be here with you. >> in addition to being with the maryland natural resources you are president of the maryland police chief association, and who in addition to chief are your members? and who is working with you? >> it is comprised mostly of chief of police from all over the state and state government and law enforcement chiefs and county and municipalities that

exist in all of the state of maryland. >> i know as a group i know there are several initiatives taking place. there is a new one. checkpoint strike force. >> yes, it is a research based-multi-state situation where we pick and we go out there and we look for drivers that are impaired and work to get them off of the road and we do that through our sobriarity checkpoints and our saturation patrols. >> and so, which jerse - jurisdiction, one specific area or all of the jurisdictions now involved? >> all throughout maryland, the chiefs of police have signed on. every jurisdiction signed on in some way shape or form to participate in the checkpoint strike force. >> and so do you find that the checkpoints are helpful in

hopefully lowering traffic fatalities? >> absolutely. fatalities have been reduced 20 percent in the areas where we are doing the checkpoints . it proves to be extremely beneficial to us in many different ways. >> and do you find that the residents are supporting the checkpoints and do you have partner necessary this effort? >> yes, we do. as you know, it is a powerful organization of mothers against drunk drivers. we work with them chosely in this endeavor and other organizations. their surveys indicate 85 to 90 percent of the people they talked to support the checkpoints. >> do you do these at specific times of year or are the checkpoints ongoing initiative. >> they are ongoing initiatives. they will be taking place every week and everywhere and where you think that it is the best

possible opportunity to deploy the work force and effective use knowledge of our people in this endeavor. >> as you are having the checkpoints and i know initially you are looking for impaired drivers, but are you finding other things when you are pulling over the impaired drivers? >> oh, yes. people are very surprised what we run into on the checkpoints. the main focus is to get the impaired drivers that use alcohol off of the streets and identify them. but we are running into people who have warrants on them. their licenses are suspended, some people have drugs in the vehicle this we were able to detect and find. there is a whole gamut of things and seat belt usage. it helps us with the seat belt initiatives and child safety

seat. we are able to make different observations and of course, we put a lot of emphasis on the seat belt usage and child safety seat as well >> i know some jurisdiction or most of the them, there is zero tolerance if you don't have your seat belt on, it is amazing that people are still driving without them. >> it is with the seat belt usage, if you are involved in an accident with the impaired drivers that use alcohol that gives you that much more of a chance to survive. >> how can citizens assist with the checkpoint strike force? >> we need them to be our eyes and ears out there. as with many thing necessary law enforcement and we ask citizens to do. if they see a person driving erratically or aggressively and feel they are under the influence of alcohol. pick up the cell phone and dial the number 911 or what ever it is that they feel comfortable in

a man wanted for questioning in connection with the killings of his wife and their five children now in police custody in haiti. florida police are scheduled to hold a news conference on this case any time now. according to police, mesac damas boarded a flight friday from miami to haiti where he does have family. saturday police responded to a missing person's report. they endered the home in naples, florida and found the bodies. a child welfare worker visited the wife and her five children three days before they were found dead. at the time said they found nothing unusual. a spokesman for the sheriff's special investigation division says since 2000 police had been called to the couple's house several times for domestic

distur benss. the children were between the ages of 11 months and 9 years. police with search dogs are back at the home of the california couple accused of kidnapping jaycee dugard. they are digging up phillip and nancy garrido's property for clues into the unsolved disappears of two other girls in the late 1980s. early dogs trained to find human remains as well as ground penetrating radar equipment indicated bones may be buried underground. in a news conference earlier, police say they intend to focus on that spot again. >> as far as the search this morning by the dogs, one of the dogs did alert in the same general area as last week's alert which is also the same general area of the anomaly from the gpr scanning. that's going to be the area that we focus on this afternoon when we begin digging. >> in another development a law enforcement source says jaycee dugard told him phillip garrido did not molest the daughters she had with him.

the 29-year-old dugard gave birth to both girls while she was still in her teens. authority the believe the girls now 15 and 11 never went to school or saw a doctor and were raised in sheds and tents in garrido's backyard. meantime, phillip garrido's neighbors say he invented a device that he thought allowed him to communicate without speaking. take a look. it's just a simple black box with a plastic candle, metal switch and jacks for plugging in headphones. garrido was so convinced his invention worked he tried to have it patented. he had clients of his printing business sign declarations saying the device worked. they said they did that because he didn't want to hurt his feelings. rescue crews searching for a toddler swept away by a flooded creek in west georgia, one of several dire situations caused by the heavy rain and thunderstorms across the southeast. caroll county authorities say the child vanished earlier this

morning when flooding ripped through the family's mobile home. in chattooga county, crews working to shore up a levee that's threatening to fail. near atlanta, two drivers killed trying to cross flooded roadways. high water has washed out roads, flooded homes. rescuers are searching for a chattanooga man who witnesses say he bragged he could swim a flooded ditch. schools in five north georgia counties closed today. one atlanta couple's frontward lo frontwardyard looks more like a lake. >> this is probably the worst of it. that house next door is not built to withstand it. you nour required to build it as if it were in venice so the river can flow underneath the lower level. >> trees are down, lights out in the western part of north carolina. forecasters have issued flood alerts for that area as well as parts of tennessee and alabama.

and take a look. we are some new video from the atlanta area. showing you just how treacherous the conditions have become after all this rain. these are pictures of the i-75/i-85 interchange in downtown atlanta. this interching near freedom parkway appears to be flooded on a major highway. several other roads under water today including a portion of highway 92. look at that. see the cars? up to the bumpers. high waters aren't the only danger for motorists either. a mudslide took out one road earlier today in cherokee county. one sinkhole has opened up on a heavily trafficked road. downed trees are blocks some streets. some of those streets are toppling over not because of high winds but the ground became so saturated after days of rain that the roots are no longer able to hold them in place any longer. legally insane killer who escaped from a washington state mental hospital last week is back in custody. colleen o'brien of spokane

affiliate kxoy shows us how a nationwide search came to an end not far from where it began. >> it has been one of the largest manhunts in this region for the last many years. >> reporter: according to the sheriff, once paul escaped from the fair on thursday he duped a friend into driving himself to goldendale to stay with his family. when his friend learned paul was part of a nationwide manhunt he quickly dropped him and called authorities. they found him on the side of the road. when deputies approached him, with a helicopter honoring from the sky, paul simply said, i'm zone. >> he knew he was -- he had been located. he had been feeling the pressure of the presence of the helicopter all day long, and he surrendered without incident. >> reporter: when they found paul he had a red sleeping bag, a guitar, a backpack, and most disturbing, a rusty sickle. >> this is a situation that, in my opinion, should not have

happened and i will be asking the station legislature, the governor and the secretary of department of social and health sciences to help us change some laws so this does not happen again. >> reporter: more specifically, the sheriff wonders why nobody questioned paul when he packed a large bag with clothes, money, and food to take to a fair. why the fair had no clue there were eastern state patients at family night, and why security from the hospital waited two hours to notify his department that a patient had escaped. >> it was very, very concerned about this situation. there was a lot of fear in the community. people locking their windows. i want the citizens of spokane county no know tonight they can sleep in peace. >> our thanks to colleen o'brien for that report. a judge ordered phillip paul today to return to the state mental hospital. three men suspected of plotting a terrorist attack making their first appearances in federal court today.

the top u.s. commander in afghanistan reportedly says he needs a lot more troops to overcome the insurgency. the "washington post" o obtained a document in which stanley mcchrystal says if he doesn't get the troops he need the insurgents could win. "post" reporter bob woodward says that assessment in sobering. >> this is a striking thing for a general to say to the secretary of defense and the commander in chief. it really takes his finger and puts it in their eye. deliver or this won't work and he says if they don't endorse this full counterinsurgency strategy, don't even give me the troops because it won't work. >> we should tell you the "post" agreed not to post certain portions of the document after consulting with the defense department. president obama is considering mcchrystal's assessments but intends to make sure any troop increases he approves are justified.

>> the first question is, are we going the right thing? are we pursuing the right strategy? once i have that clarity from the commanders on the ground, secretary gates, my national security adviser, jim jones and others, when we have clarity on that, then the question is, how do we resource it? what i will say to the american public is not going to be driven by the politics at the moment. it's going to be driven by the fact that "a" my most important job to keep us safe and al qaeda is trying to do us harm. as a pimp and prostitute and how to launder their money. president obama says the video deserves an investigation. a potential federal investigation of the organization may happen. a.c.o.r.n. has ordered its own independent probe of the incidents. as a lawyer the president represented that group in a illinois lawsuit illinois voter law. an arizona couple who lost custody of their daughters after a month after developing pictures of them taken during bath time is fighting back. our affiliate has their story. >> you've told them nobody will ever do anything to you. mommy and daddy will always be here. you wonder if your kids can ever trust you. >> reporter: list is and anthony have three young daughters. last year they went to a walmart to develop pictures of their daughters, including some of bath time in which the girls were naked and their private

parts visible. >> girls getting out of the bathtub. >> reporter: a walmart called the police department who produced the incident report saying there were a total of 13 photographs that could commonly be classified as child erotica. the report even says one of the girls appears to have been posed for the photograph. the attorney told us tonight, though, whoever wrote that must have been looking at different pictures. >> no, there's nothing explicit. >> reporter: neither parent was charged with anything. but during the investigation of the bath time photos, child protective services temporarily took custody of the kids. >> here we were forced to sit and watch helplessly as they ripped our crying, screaming, terrified children away from us. >> we now realize how much control the state has and that they can pull any one of your

children out of your home right now. >> reporter: for that reason, they are suing walmart, the department of economic security who oversees cps, the ag and the peoria police department. update on a colorado man suspected of plotting a terrorist attack. 24-year-old najibullah zazi appeared before a federal judge and ordered held penting a detention hearing on thursday. his father appeared before a judge but the associated press reports he could be released within 48 hours. the elder zazi is a naturalized u.s. citizen. his son a permanent resident. another suspect, afzali, is a permanent resident on all three charged with lying to federal age agents, investigating an alleged plot to explode bombs in the u.s. here it is a scary prediction. the number of people aapplicanted with alzheimer's disease could raise dramatically in the coming years. what experts are saying about
