of five in a community where everybody knows each other. playgrounds are empty, families are frightened, arming up. who a could murder children, kill a dad and stay-at-home-mom? new leads on a pickup truck seen that last. the last person to see little hayleigh cummings suddenly leaves town. the night he called misty, he called her 20 times and couldn't get ahold of her.

rule out is that there were no  gunshot victims in this incident. there was not a gun used. >> so, no one shot. we can only imagine how horrific that crime scene was and now we're hearing, also, about a mysterious truck spotted at the hom hours beforehand. as always, we take your calls 1-877-tell-hln. joining us to talk about it john lusage former criminal investigator also reverend dale badman. john, we're hearing, it's disturbing, john, to hear no one shot here so we can only imagine what they went through. that detail is gruesome as it could be, john, does that help us with who may have done this? >> well, they've got to take a look everything. number one just because there wasn't doesn't mean a gun wasn't used. something was used to subdue

them while they were tied up. it disturbs me a gun was not used because it may indicate these people were slowly tortured. i believe the cops will have a lot to go on. tler is a small community so people not from that area are readily stick out and people will start remembering things they see. >> good point there. the one thing we have to go on here is this mysterious truck. let me give out just a few details we have. gray primered truck either a ford ranger, cherve v s-10, chrome exhaust pipes coming out of the bed of this truck. as an investigator, john, something to go on. what do you do with it? >> absolutely. he have to get it out to the wires and they are doing that, asking people to look and help them identify this vehicle. remember they just didn't cordon off the one piece of property but beyond that one piece of property. they are looking for tire tracks that were from that particular vehicle, may have been to get a make and model of that vehicle, which can do from that and checking stores to see if anybody had any i.p. cameras

fixed in and out of that particular area. now, being a small community may not have that but there may be highway cameras by d.o.t., a lot to take look at for investigators to start identifying these people. >> let's bring in reverend badman. thanks for join us. you held a service yesterday afternoon. how is the town coping, such a tight-knit community, how are people taking this? >> well, they're devastated. this is a community of 200, you know, they didn't lock their doors, never had to. there's a lot of fear, there's a lot of uncertainty. but, yesterday, as the community gathered together in the church for prayer, there was a strong feeling of community and family. and they're all praying for one another and they're gathering together as a family and only in small rural towns can you have this kind of closeness.

>> yeah. >> and they were a family of faith, and so the faith community is with them. and we're all just supporting one another in love and in fellowship. >> dayle, these people look to you. what do you tell them? i mean, this is horrific, what has happened. and especially in a small town like this. you'd never expect it there, i'm sure. >> no. and you don't really tell them much. you just be there for them. and let them know that, even during whatever transpired in those walls of that home, that god was with them and that god continues to be with them and with the community. and the community will survive. and the family that remains will go on and we're going to stand behind them to help them do that. >> we wish you the best, again coming together in faith, so important. i want to listen now this is a

family friend talking about the dad, rick, let's give that a listen. >> just your typical working-class, you xhknow. ruth was a stay-at-home-mom. rick was working father. >> you can hear the emotions there. dayle, one more, did you know the family very well? >> i knew some of the family. they would come to church occasionally and, of course, being in a small community, you kind of know everybody. >> yeah. >> one thing that we are doing for the family is we are taking donations to help offset the expenses that will be significant. and, of course, we're continuing to hold the youngest member of the family in our prayers. >> yap. that's a 3-year-old who's clinging to life, we know, also attacked at this crime scene.

john, one more last one to you as we talk about we're just baffled as to who could have done this. small community. does that tell you maybe it was not random in a community like this? everybody knows everybody. >> yeah, i know the door was unlocked but there's no way i would be very, very surprised if they come back and said this was random. this was not something of opportunity. it was a crime of opportunity. i believe this was planned. these people were targeted. and they got in and out and without a lot of people, at least external evidence that readily available. i know they are going to find a lot of stuff at the crime scene. if they were in that long to kill five people and they didn't do it with a gun, there had to be a lot of interaction between these people and dn dna fingerprints and stuff will be found but i believe these people were targeted it will come out. >> sure seems. john, thank you. reverend you, as well. police finish searching rapist phillip garrido's property. we wondered, is he responsible for other missing children's

welcome back to "prime news" on hln. since we heard the terrifying story of jaycee dugard, kidnapped at 11, held for 18 years, many wondered, could her accused abductor phillip garrido taken other little girls? police in california just wrapped up a week orders long search at his home. those bones they found, turns out no definitive link specifically to two cases we've talked about -- taken late 1988/early 1989. the not linked -- no link at least right now. how are the girls' families

taking this news? that's the question we have. on one hand they want answers but on the other hand you don't want to find out your little girl is dead, something they don't want to deal with, as well. they are holding out hope here, as well. let's take your calls. 1-877-tell-hln welcome back henry lee reporter "san francisco chronicle" and former criminal investigator john lucic and also joining us wendy walsh. michaela garecht's mom, talked about being relieved. she's waiting here, yes, she wants answers, 0 years after a little girl goes missing. what is she going through? >> imagine the emotional work of a mother who hast lost a child. anyone who has lost someone close -- she was snapped back into bartering maybe if we search this house, maybe then she'll leave. she's going to be doing that work of mourning all over again. and every time there is a

glimmer of hope, people with missing children have to work through those same feelings of loss again. it's a very, very difficult road to walk. >> yeah. but, i mean, i spoke to her and she, you know, she's not backing away from the hope and the faith that michaela -- who can blame her. she is clinging to hope. >> listen, one of the things the example of elizabeth smart taught us all is to keep our eyes open and to continue to hope, you know, it's only when the hope and feelings of loss and depression make you dysfunctional in your life and unable to care for and be connected with the other people your lives who are still there and still definitely living. that's when it become as problem. otherwise holding on to hope is a good thing. >> wendy, looking at shots of phillip and nancy gur ga ree do and sharon murch says she would like to speak to nancy garrido, there she is, she may be a victim. do you recall think she could handle that? >> if obviously don't know the woman so i'm not sure. >> right. >> whether she could handle it

but it's interesting she wants to appeal on another woman on the scene also probably victimized and who has been there a lot longer than jaycee dugard, right. so she's able to maybe get information and facts. you know, this is a mom continuing her vigilance to be a detective to try to find out what happened to her missing daughter. >> exactly. henry lee, let's back up to the search. they searched, what, about a week, henry, and as you and i have talked, very extensive. we're talking ground-penetrating radar. and they've tested some of these bone fragments. what are they finding out, number one, the bones too old to have been at least the two cases we're talking about? >> that's right, mike. they have brought out a legion of an though poll gists, dogs of all types and what they have come to conclude is that those bones are many, many years older than the cases of interest that they're looking at, as far as the dublin and hayward cases and most likely animal in nature. >> okay.

john, what's the next step, an investigator digging up anything you can, no pun intended on garrido to find out what he is capable of. what's next, where do you focus next. >> the investigation's got to continue but like the investigators said out there, they've turned over every stone it is a huge process. not only did they use ground-penetrating radar but also excavated this. typically when they do that and grid that entire area out and they've got to actually grid out the area bigger than where they think people might be buried but where evidence would be. and they not only have to remove the vegetation but then they have to go centimeter by centimeter down through this each grid at a time and if they find anything, documenting all that where it came. from i think everybody is confident there is nothing on this particular property. remember they processed over an acre looking for these girls. that doesn't mean the investigation stops and it continues with him and all the evidence that was collected from that place. >> okay. guys, let's take a quick break.

she know the other two girls or have some knowledge in reference to those two girls? >> dorothy, you bring up a good point because a neighbor used the number five girls. so, let's clear that up. we're not certain on that. let's bring back henry lee, "san francisco chronicle." isn't that the account, a neighbor said they thought five girls were in this backyard? all we know of for sure is jaycee and her two daughters, right. >> that's right, mike. jaycee has preliminarily told investigators that she knows of no other potential victims. now, keep in mind we don't know who that fifth person was. it very well could have been phillip garrido's mother, suffering some illness or a neighbor child, we just don't know who that person was. >> good point. henry, how much contact has jaycee had with investigators, do we know. >> i'm sure it's been limited. we haven't been told how much she's told investigators, mike. obviously it's a sensitive time. they had to give her time to reun with her family before they ask her all these certainly very

specific questions they want answered. >> to wendy walsh on that, wendy, obviously jaycee dugard is a great source of information here but how long do you have to wait? when will she be ready to answer investigators' questions in full? >> the million dollar question. >> yamplts we really don't know. she's obviously feeling a lot of feelings of confusion right now. this guy functioned kind of as her father figure, her husband figure, grandfather, father, whatever to her children. and now, she's being reminded of his brutality and reminded of his awful side and to be able to -- and asked to testify against him. so, it's going to take some time for her to first of all trust her new world, right, which is her old world and then be able to talk and have some kind of -- make sense of it all because right now she's got what we call cognitive dissidence where it is not making sense with her feelings. >> i'm sure. we think back taken at age 11. she's again longer -- she spent more time with phillip garrido

than her own biological family. >> absolutely yeah. >> hard to fathom. john, with that said, we have to be very careful, the timing has to be right with jaycee, looking obviously at his property and hearing about documents, papers he gave to the fbi, documents at home. what are you doing with these papers, what are you looking for with garrido? >> well, it all depends on what documents they actually took. jaycee is definitely going to be a key part here because she lived with these people for 18 years. she's listened to their conversations. if these girls came up in conversations or places that this guy, came up in conversations during crucial times, this is going to be very, very crucial to this investigation. so, she is a major point here in moving this investigation forward. there's no doubt about it, when she develops evidence for them, it will be challenged in court as to her, you know, her credibility. but, you know, when it comes down to it because she went through a lot of stress. when it comes down to it, if the information she provided to investigators proves out then it's credible, regardless of how

♪ welcome to comcast local edition. i am donna richardson and my guest this hour is colonel george f. johnson iv superintendent of the maryland natural resources police. colonel, thank you for joining me. >> great to be here with you. >> in addition to being with the maryland natural resources you are president of the maryland police chief association, and who in addition to chief are your members? and who is working with you? >> it is comprised mostly of chief of police from all over the state and state government and law enforcement chiefs and county and municipalities that

exist in all of the state of maryland. >> i know as a group i know there are several initiatives taking place. there is a new one. checkpoint strike force. >> yes, it is a research based-multi-state situation where we pick and we go out there and we look for drivers that are impaired and work to get them off of the road and we do that through our sobriarity checkpoints and our saturation patrols. >> and so, which jerse - jurisdiction, one specific area or all of the jurisdictions now involved? >> all throughout maryland, the chiefs of police have signed on. every jurisdiction signed on in some way shape or form to participate in the checkpoint strike force. >> and so do you find that the checkpoints are helpful in hopefully lowering traffic

fatalities? >> absolutely. fatalities have been reduced 20 percent in the areas where we are doing the checkpoints . it proves to be extremely beneficial to us in many different ways. >> and do you find that the residents are supporting the checkpoints and do you have partner necessary this effort? >> yes, we do. as you know, it is a powerful organization of mothers against drunk drivers. we work with them chosely in this endeavor and other organizations. their surveys indicate 85 to 90 percent of the people they talked to support the checkpoints. >> do you do these at specific times of year or are the checkpoints ongoing initiative. >> they are ongoing initiatives. they will be taking place every week and everywhere and where you think that it is the best

possible opportunity to deploy the work force and effective use knowledge of our people in this endeavor. >> as you are having the checkpoints and i know initially you are looking for impaired drivers, but are you finding other things when you are pulling over the impaired drivers? >> oh, yes. people are very surprised what we run into on the checkpoints. the main focus is to get the impaired drivers that use alcohol off of the streets and identify them. but we are running into people who have warrants on them. their licenses are suspended, some people have drugs in the vehicle this we were able to detect and find. there is a whole gamut of things and seat belt usage. it helps us with the seat belt initiatives and child safety seat. we are able to make different

observations and of course, we put a lot of emphasis on the seat belt usage and child safety seat as well >> i know some jurisdiction or most of the them, there is zero tolerance if you don't have your seat belt on, it is amazing that people are still driving without them. >> it is with the seat belt usage, if you are involved in an accident with the impaired drivers that use alcohol that gives you that much more of a chance to survive. >> how can citizens assist with the checkpoint strike force? >> we need them to be our eyes and ears out there. as with many thing necessary law enforcement and we ask citizens to do. if they see a person driving erratically or aggressively and feel they are under the influence of alcohol. pick up the cell phone and dial the number 911 or what ever it is that they feel comfortable in

the street. sounds like the honeymoon is over between ron and misty. we also have this phone records reveal ron called home 20 times the night little haleigh disappeared but misty has said she was watching movies with the kids and everybody was in bed by 10:00. what really happened? do we know. taking your calls 1-877-tell-hln. welcome back former criminal investigator john lucich and producer from nancy grace show marlena schiavo. first, can you confirm she has left town? >> that's right, she is not anywhere in that jurisdiction. apparently there were witnesses that saw misty and ronald having a fight time around the time this pond was being drained, the search for in evidence this case and some witnesses say they saw ron throwing her belongings onto the lawn and she left. >> okay. so, the fight, is that what precipitated this? anything else that could have

led to this? there was just a search, a pond waug dragged, as well, right? >> the pond was drained. information came out her brother tommy said he went over to the house the night haleigh went missing and banged on the door and misty never answered. so, this is a big, you know, a big piece of information in this case. you know, but the family is also saying, mike, i have to say this fight never really took place. so, you know, there's two sides to this story. >> okay. who's she weather, who's the friend, marlena? >> an unnamed friend that she's out and about with. allegedly, i guess, ron was supposed to meet her out to wherever she is and spend some time with them but i'm told today that that's not going to happen. >> that's not going to happen. john, we know misty, excuse me is the last person to see little haleigh, as an investigator are you keeping tabs where she's at and you have to do at this point? >> oh, absolutely.

they will know exactly where she is and goes. you and i have followed this case since it first broke and everybody from the start suspected this woman but always have given ron the benefit of the doubt. but if this information is true, where he did call herp for 20 times during that night, which never came out early on and if it he did receive -- if did he make a call to somebody else to go over and check that -- that home and the guy banged on the door and nobody was home and that's just coming out now, then ron has been withholding information and they really need to go back to ron and find out what's going on because that  just doesn't wash. >> okay. i'm going to read a facebook comment hitting where you are talking about, john, from robin, chiming in on facebook, why are we just hearing about these calls now? this should have been turned over to investigators months ago. this whole thing is turning into a fiasco. had investigators known this all along and just leaking this now or is this new info to everybody? >> well, they are leaking this right now, actually, mike, because the investigators are

releasing a little bit more information than they were originally releasing because they are trying to put some pressure on misty with this whole thing about, you know, ronald calling 20 times and tommy's story. they want to put it out there because they want to see what misty will come back and say about that night. >> okay. john, do you like that strategy? does that put heat on someone like a misty cummings here. >> oh, absolutely. but you just don't put heat on her. you've got to put heat on ron, also and everybody involved in this particular case. you know, these cops do this. this is nothing knew because they've always had the phone records. as long as they did they knew these calls were made. ron never brought that out. that's a key part of what cops do. they don't want to release the information they have because they want to see if people will be forthcoming. obviously ron ront and neither was misty and both have travelled from show to show to show lying to the american people and the cops need to find out why. >> yeah. let's get a call in, tanya from new jersey, your comment or

would have been eight to fen fate from the door plus this is not a big home we are talking about, not exactly, you know, soundproof. so, as far as the inconsistencies go from back in the day, you know, she said she looked under beds and that she, you know, she had gone to the bathroom and there is a bathroom in the room and then there's a bathroom across the hall. looking under bed is strange, too because the mattress is on the floor and in the other bedrooms, there really aren't any other bedrooms so, you know, there's a lot going on here. as far as propping the door open, they never really used that door, according to ronald. he said that door never opened, in that trailer only about seven months and he opened it maybe once he said. >> another call, gail in georgia, your thoughts here? >> caller: yes. i think the step-mother should step up to the plate. i think she's guilty. she knows something about it and she needs to step up to the plate. she was old enough to marry their dad. now she needs to step up to the plate and tell the truth and i blame ron for not listening to

rule out is that there were no gunshot victims in this incident. there was not a gun used. >> with that said, we can only wonder, speculate what they went through. must have been horrific at that crime scene. we're hearing, though, as we look for leads in this, about a mysterious truck spotted at the home hours before this may have taken place. we'll hash all this out for you. take your calls, your comments, theories at 1-877-tell-hln. back with us, psychologist, wendy walsh. also joining us, hln law enforcement analyst mike brooks. mike, start with you. let's start with what seems to be our only lead at this point, this truck. let me throw out a couple of details here. not much. gray primered truck, either ford ranger, s-10 pickup. if that's what you have, that's what you've got to go with, right? >> absolutely. get it out to local law enforcement, to the state law enforcement, and also to the feds just in case anything like that turns up in another state. you know, one other thing that

they're not really talking about. they were brought to this house by a 911 call at about 4:26 p.m., and we heard, we talked about yesterday, mike, that it was a call for a possible shooting. now, law enforcement is not saying too much about this 911 call. who made this 911 call? why was the call made? because we don't know exactly, the call was made at 4:26, approximately thereabouts, but we don't know when the family was murdered. and how long before the call was made was this truck seen in and around that community? it's a small community. we heard from the postmaster yesterday. not many businesses, no businesses there. we always talk about possible surveillance videos. but we might not get anything from this particular case. >> when you talk time line, mike, one thing in doing our research, that the family, one of the children last seen sunday, the kids, absent from school on monday. so this crime could have taken place, what, sunday night, right? >> it could have taken place. now that wee hear there was not a gunshot used, what was the

coughs of death? were they bludgeoned to death? blunt force trauma? stabbed? were they suffocated? we don't know. but with that many people killed in one location, you know, was there only one person? the way they were talking, they were talking suspect, not suspects. but could it be more than one? you know, we heard yesterday also that one of the boys was, you know, hoped to be a state wrestling champ. so was there any kind of violent struggle put up? that is what behooves me right now. >> you touched on it, mike, and we talked about it yesterday, this being such a small community. i want to bring in wendy walsh in on this. wendy, we're shocked when this happens anywhere. when we're talking about a community of 200, everybody knows everybody. what's going on in the minds of these people as they try and draw close to each other, draw strength from each other? >> the good news is, it is a small close-knit family. we had the pastor on the show earlier. some of that can sustain them. no doubt, mike, these guys are

scared to death. i mean, a small town of 200 people, where people rarely lock their doors. my only concern is that, while it's probably prudent to be somewhat careful now, and allow your fear to create behaviors like locking your doors, the people who are talking about sleeping with guns, whenever there's too much fear, i get scared that we're going to have guns shot at the wrong things. >> we're talking about a wide range of emotions here. we want to listen now to a family friend talking about the dad. you could hear the emotions in his voice. let's listen. >> it's difficult. stay-at-home mom. rick was working. father. >> fighting back the tears there. mike, okay, so community of 200 people. everybody knows everybody. does that lessen the thought

that this is random, right? if everybody knows everybody, this could have been a targeted attack, right? >> you know, mike, that's what we're talking about yesterday. that's what i was thinking. i don't think it was random. i think they probably had some kind of contact. you know, the suspect or suspects probably had some kind of contact with the family. now, they're going to go back, you know, he had apparently a construction business. lived in this house for 20 years. did he have any bad business dealings with someone? was there someone at the school? they're going to look the everything. but mike, i find it interesting, they're concentrating, apparently there was about 60 volunteers searching. concentrating on a bean field by the house. they seem to be concentrating some of their efforts there. what kind of evidence was found in that bean field? we don't know yet. did it happen outside? did it start outside and come inside? exactly, you know, as you were just talking about, putting together that time line, there's a lot of gaps right now. >> wendy, really, it's the base question that we're all hitting

around, who could have done this and why. we're talking about little kids. there's a 3-year-old in the midst of this fighting for her life. >> there's one surviving family member that we certainly know about, and that's the 3-year-old daughter. but i want to point something else out to you, mike, that the two eldest teenagers have a different last name. it's constant, not gee. obviously this mother was a single mother when she met gee. where's the father of those children? was she a widow? so the entire family is not gone at this point. and then, of course, the #-year-old. we can't speculate on who this was, how many people. i think the police are doing a phenomenal job of keeping all the details under wraps. because this is the way they can solve the crime, when somebody slips up somewhere about a crime detail. and almost all the time criminal minds hang themselves, so to speak. because it slips out somewhere. >> that's what we're hoping for. wendy, mike, we appreciate it. the latest on phillip garrido in the serve near his property coming up. @@@@@@@@@@@@@

how are the girls' families taking this news? on the one hand they want answers. but you don't want to find out your little girl is dead. that's something they don't want to have to deal with as well. we're taking your calls, 1-877-tell-hln. joining us to talk about it, welcome back, help ri lee, reporter "san francisco chronicle." we also welcome back former criminal investigator john lucich. joining us, psychologist wendy walsh. wendy, michaele garecht's mom, she talked about being relieved. you know, she's waiting here, yes, she wants answers. this is 20 years after her little girl goes missing. what is she going through? >> imagine the emotional work of a mother who's lost a child. anybody who's lost somebody close is probably familiar with the denial, anger, bartering, depression and finally acceptance. she was snapped back into bartering. maybe if we searched this house, maybe there's a chance. maybe then she'll live. so she's going to be doing that work of mourning all over again.

and every time there's a glimmer of hope, people with missing children have to work through those same feelings of loss again. it's a very, very difficult road to walk. >> i spoke to her and she -- she's not backing away from the hope and the faith that michaele -- who can blame her? she's clinging to hope. >> one of the examples of the elizabeth smart taught us all is to keep our eyes open and to continue to hope. it's only when the hope and feelings of loss and depression make you dysfunctional in your life, and unable to care for and be connected with the other people in your lives, who are still there today, and still definitely living. that's when it becomes a problem. otherwise, holding on to hope is a good thing. >> when you were looking at shots here of phillip and nancy garrido, sharon murch said she would like to speak to nancy garrido, that nancy garrido might be a victim. do you really think she might be able to handle that? >> i obviously don't know the

woman, so i'm not sure she could handle it. but it's interesting she wants to appeal to another woman on the scene who has been there a lot longer than jaycee dugard. so she's able to maybe get some information and some facts. you know, this is a mom continuing her vigilance to be a detective, to try to find out what happened to her missing daughter. >> let's bring in henry lee on this. henry, let's back up to the search. they searched, what, about a week, henry? and as you and i talked, very extensive. we're talking ground penetrating radar. they've tested some of these bone frag also. what are they finding out? the bones are too old, right, to have been at least these two cases we've talked about? >> that's right, mike. they brought out a legion of anthropologists, ground penetrating radar, operators, dogs of all types. and what they have come to conclude is that those bones are many, many years older than the cases of interest that they're looking at as far as the dublin and hayward cases, and most likely animal in nature.

>> john, what's the next step? you're an investigator. you're digging up whatever you can. no pun intended on garrido, to find out what he's capable of. what's next? where do you focus next? >> the investigation has got to continue. but like the investigators said out there, they've turned over every stone. it's a huge process. not only did they do -- use ground ben traiting radar, but they also excavated this. typically when they grid that entire area out, they actually grid out the area bigger than where they think people might be buried, but where evidence would be. they not only have to remove the vegetation, but then they have to go centimeter by centimeter down through this, each grid at a time. and if they find anything, documenting all that, where it came from. so i think that everybody is confident that there's nothing on this particular piece of property. remember, they processed over an acre looking for these girls. that doesn't mean the investigation stops and it continues with him. and all the evidence that was collected from that place. >> let's take a quick break.

and i was wondering, wouldn't she know the other two girls? or have some knowledge in reference to those two girls? >> dorothy, you bring up a good point. because a neighbor used the number five girls. so let's clear that up. we're not certain on that. let's bring back henry lee, "san francisco chronicle." henry, isn't that the account, a neighbor said they thought five girls were in this backyard? all we know of for sure is jaycee and her two daughters, right? >> that's right. jaycee has preliminarily told investigators that she knows of no other potential victims. now, keep in mind, we don't know who that fifth person was. it very well could have been phillip garrido's mother, who was suffering from some illness, or it could have been a neighbor child. we just don't know who that person was. help ri, how much contact has jaycee had with investigators? do we know? >> i'm sure it's been limited. we haven't been told exactly how much she's told investigators, mike. obviously it's a very sensitive time.

she has to reunite with her family before they ask the very specific questions they want answered. >> let's go to wendy walsh on that. wendy, obviously jaycee dugard is a great source of information here. but how long do you have to wait? when will she be ready to answer investigators' questions in full? >> that's the $1 million question. we don't really know. she's obviously feeling a lot of feelings of confusion right now. this guy functioned kind of as her father figure. her husband figure. grandfather/father, whatever, to her children. and now she's being reminded of his brutality. and reminded of his awful side. and to be able to -- and asked to testify against him. so it's going to take some time for her to, first of all, trust her new world. right? which is her old world. and then be able to talk and have some kind of -- make sense of it all. right now she's got what we call cognitive distancing. >> she was taken at the age of 11. she's, again, longer, she expect

more time with phillip garrido than her own biological family. >> absolutely. >> john lucich, with that said, we have to be very careful, the timing has to be right with jaycee. looking obviously at his property. also we're hearing about some documents, papers he gave to the fbi, documents at home. what are you doing with these papers? what are you looking for with garrido? >> it all depends on what documents he actually took. jaycee is definitely going to be a key part here. because she lived with these people for 18 years. she's listened to their conversations. if these girls came up in conversations, or places that this guy went during conversations during crucial times, this is going to be very, very crucial to this investigation. so she is a major point here in moving this investigation forward. there's no doubt about it, when she develops evidence for them, that will be challenged in court as to her credibility. but when it comes down to it, because she went through a lot of stress. and when it comes down to it, if the information she provided to investigators proves out, then it's credible.

precipitated this? anything else that could have led to this? because a pond was dragged as well, right, marlena? >> the pond was drained. there's been a lot of accusations, information came out, her procedure, tommy, said that he went over to the house the night that haleigh went missing, and he banged on the door and misty never answered. so this is a big, you know, a big piece of information in this case. you know, the family is also saying, mike, i have to say, this fight never really took place. there's two sides to this story. >> okay. who is she with? who's the friend, marlena?xx >> it's an unnamed friend. a friend that she is out and about with. allegedly, i guess ron was supposed to meet her out to wherever she is. and spend some time with them. but i'm told today that that's not going to happen. >> that's not going to happen? all right. john lucich, we know that haleigh -- misty, excuse me, is the last person to see little haleigh. as an investigator, are you keeping tabs on where she is? is that something you have to do at this point?

>> oh, absolutely. they'll know exactly where she is and where she goes. mike, you and i have been following this case, since this case first broke. everybody from the start suspected this woman. but we've always given ron cummings the benefit of the doubt. but if this information is true, where he did call her for 20 times during that night, which never came out early on, and if he did receive -- he did make a call to somebody else to go over and check that home, and the guy banged on the door and nobody was home, and that's just coming out now? then ron has been withholding information and they really need to go back to ron and find out what's going on. because that just doesn't wash. >> okay. i want to read a facebook comment.@@ hitting right where you're talking about, john. why are we just hearing about these calls now? this should have been turned over to investigators months ago. this whole thing is turning into a fiasco. let's hip this on a couple fronts. marlena, had investigators known this all along and they're just leaking this now? or is this new info to everybody?

front door, if misty was home, she would have heard it. if she was in the bedroom she would have been all but eight to ten feet from the home. this is not a big home we're talking about. it's not exactly soundproof. as far as the inconsistencies go, from back in the day, that she looked under beds and that she, you know, she had gone to the bathroom, and the bathroom in the room and there's a bathroom across the hall. no one is sure what bathroom she went to. but looking under beds is strange, because the mattress is on the floor. in the other bedrooms, there ú@ really aren't any other bed frames. so, you know, there's a lot going on here. as far as propping the door open, they never really used that door according to ronald. that door never opened, they were only in the trailer for seven months and he said he opened it once maybe. >> gail in georgia. your thoughts here? >> caller: i think the stepmother should step up to the plate. i think she's guilty, she knows something about it and she needs to step up to the plate. she was old enough to marry the

blocker for the huffington post. brenda wade, a clinical psychologist as well as art harris, investigative journalist. art's website, artharris.com, has become the source of record for the latest developments in the haleigh cummings case. art, what is the very latest? >> the latest i can tell you, jane, is that misty is on the run to parts unknown. she took off after a fight with ronald, her husband, and refuge, who has been her big defender, but he threw her clothes out last -- several days ago, and she ran out, kicked her out of the trailer they were living in. he then has a change of heart, chases her down, apologizes, brings her back, and then the next day, she gets in a car and takes off. >> tonya, is she allowed to do that? she hasn't been charged with anything, she has not been named a suspect. >> she hasn't been charged with anything, she is not yet a suspect. we don't know if she will be named a suspect. so she hasn't done anything wrong but it does raise some interesting questions about why

you would flee in the midst of this very critical investigation where she is at the very least somebody who, having seen -- been the last person to see haleigh alive, she should have probably stuck around. >> yeah. you have to wonder why did she leave. the timeline of the night that haleigh vanished doesn't make any sense, people. haleigh's great grandmother, annette sykes, says she saw haleigh about 7:30 that night. misty claims she put haleigh to bed at about 8:00 that night. we just heard her say it. misty's brother, hank croslin, who is now in jail on an unrelated charge, is telling cops that ron cummings asked him to go by the house where misty was and check on misty, haleigh and little ron jr. that night. hank says he did that at 9:45 p.m. and nobody was home. law enforcement sources say phone records show that ron tried unsuccessfully to reach misty 20 times over the course of the evening. but ron's lawyer says that ron did not ask hank to go check up

on misty. ron's lawyer claims ron and misty had been in touch during the evening. the lawyer says ron called hank's house at around 9:00 p.m. just to see if misty was there. well, here's what i don't understand, art harris. if ron had been in touch with misty, why was he calling around looking for her? why do records show reportedly he tried unsuccessfully to call her 20 times? it just doesn't make sense. what do you know? >> i don't have any information that he was talking to her. in fact, my sources say that he did not speak with her after 8:30. they had a fight on the phone. he did not speak with her until 3:00 a.m., when he came home. so you have all those phone calls, you have cell phone towers that put him at work and you have other towers that are now being investigated along with misty's telephone to see if, in fact, hers was off or if, in fact, she made other calls. >> what i don't understand, what do you mean, they are now being investigated? the big question is, if she went

out, where did she go, and who else knows where she went? how is it possible they're just checking now on her phone records? >> well, they have her phone records but you know, there's a gps issue, there are some cell towers concentrated in one area of the county and then there are sketchy ones elsewhere. so right now, they're trying to figure out if, in fact, she had it off or what happened with her phone. and right now, jane, i can tell you that she is under a lot of pressure and my latest on their relationship is ron has told her don't come back. >> tonight's big issue, keeping dark secrets. listen to what misty, the teen bride of haleigh's dad, said on the "today" show back in march. >> why were there inconsistencies? why did you say one thing one time and one time, the other? one thing the other? >> i don't know.

in tonight's spotlight, the clock is ticking for america's wild mustangs. they are a symbol of our freedom and the great american west. but the bureau of land management, dlm, keeps rounding them up and selling them off. right now as we speak, 57 stallions sit in pens at the base of a horse range where they once roamed free in wyoming and montana. the cloud foundation is fighting to keep these wild horses on public lands and to protect cloud, for example, a pale palomino stallion, and his herd. >> the noise from the trailer spooks cloud and the family bolts to freedom.

>> after a public uproar, the government freed cloud. but many of the other horses you see on that pbs show are going to be auctioned off in just days. where they go if they're not adopted is a huge controversy. here to talk about it is chantal westerman, who was the hollywood reporter at "good morning america" for 13 years and gave it all up to be an advocate for the animals. chantal, describe this dlm roundup of these horses. is it terrifying for the animals? >> it's devastating, jane. it's absolutely devastating. i went to the top of the mountain ridge which covers wyoming and montana and we were there as the horses, cloud's herd, would stand there very quietly and calmly around ponds and playing with each other, and out of the clear blue sky, literally, you hear that horrible pop, pop, pop, pop of a helicopter. the horses are absolutely

petrified, absolutely terrified. now, what happens is in a wild herd like this, they have bands or families that stay together and that means like there's a stallion, he has several mares, children, and they all stick together. but when they're frightened of something, they run, jane, and the helicopter, the purpose of the helicopter is to drive them down the range. now, if you can picture this, if you can imagine running down a mountain and they're at probably -- they are probably at a level of 8,000 feet and the helicopter drives them down to 3,000 so that the 5,000 altitude drop, horses running and for me, the most terrifying part was i would see mothers running alongside foals -- >> i want to jump in on that. the most heart-wrenching part of this roundup which is described as cruel is the baby horses, the foals, more than 140 animals captured, approximately 15 were

kudos to mackenzie for coming out and saying this, maybe what she's saying will help other people. it really is split right down the middle between those two opinions. >> yeah. and i keep going back and forth between those two opinions as i read more and more. i'm sure you do, too. in her book, mackenzie says of sex with dad, quote, there was a relationship that crossed the boundaries of love to break taboos, end quote. my father was not a man of boundaries. he was full of love and he was sick with drugs. i woke from a blackout to find myself having sex with my own father, end quote. she has said in the past, she looked up to her dad. listen to this. >> we have to remember that we are our children's role models, you know, and certainly, my role models, my role model was my father, who had hair down his back and was wearing a dress. you know. and said whatever turns you on. >> brenda wade, i honestly don't know what to make of this.

what concerns me is that the father is dead, he died eight years ago, so he cannot speak to defend himself. what do you make of it? >> you know, jane, i rarely see people come out with this kind of story just to sell books or just to make a name for themselves, because it's too shameful. it's very, very shameful and painful to think of having sexual intercourse with one's parent. people don't make that up randomly as a rule. and the thing that makes me believe that it's true is exactly what she just said. she said her dad had this belief that anything goes, anything's okay, and jane, you know as well as i know that when someone is addicted to drugs, the brain stops working properly. the judgment that we normally count on to keep boundaries, to keep relationships where they need to be between parents and children, all those boundaries break down and anything could happen. >> i say over and over again, i have said it to you, brenda, i

say it in my book, alcohol and drugs make you capable of things you would never, ever, ever be capable of sober. now, mackenzie phillips, mackenzie phillips also has a history of severe drug abuse, along with her dad, but she was kicked off the show, "one day at a time" because of her constant drug use. last year, we're just talking 2008, she was busted in the airport with cocaine and heroin. she told oprah about this arrest. listen. >> it was terrifying and the woman was like are you holding, are you holding, and i was like no, no, no. then finally she pointed down to my foot and i could see the baggie of drugs sticking out of the corner underneath my foot. and i, you know, at some point you have to give in and i said yeah, i am holding. i said but i'm somebody's mother, i'm somebody's mother, please don't bust me, please don't bust me. >> mackenzie says she is now sober. tmz reporting she will appear on vh 1's "celebrity rehab" as a

in a stunning twist, cops say jaycee dugard's alleged captor is not connected, not connected, to two other missing girl cases. this comes after human bones were discovered on phillip garrido's property. that is tonight's "top of the block." new charges today against anna nicole smith's boyfriend and lawyer. did howard k. stern keep her or help keep her stocked with the dozens of meds that killed her? he and two of anna nicole's doctors are accused of basically enabling her to death. they have all pleaded not guilty. the newest allegation against stern is that he scored opiates for anna nicole using aliases. court docs say 44 medications were prescribed for her under a number of names, including stern's. 44 medications. was this anna getting whatever she wanted because she was a celebrity and a potent sex symbol? anna nicole died in 2007, just

used his name, his name spelled s-t-e-a-and it has no "a" in it to score drugs and taking it to anna nicole in the bahamas and studio city but the one that sticks in my head is the fifth one, that is administering, prescribing or dispensing narcotics or controlled substance to an addict and the interesting thing is remember we talked about it yesterday, there's a really gruesome thing inside the documents that talks about taking medication, crushing it up, heating it up into liquid and injecting it into anna nicole. him and eroshevich. that's what i see when i look at it. but i got to say really quickly, the zinger today in court was on the way out, his attorney decides to stop and do a press conference and you guess what this guy says. he says anna nicole smith wasn't an addict. and tries to call the charges b.s. now, whether the charges are b.s. or not, i dare anyone on this panel or -- >> whoa, whoa, whoa. who said that anna nicole is not an addict? >> howard's lawyer said that on the way out of the courtroom. we livestreamed it here on our

website. it just happened on the way out. if that's your excuse that you tried to claim that anna nicole and that's your defense, wasn't an addict, i dare anybody to explain that to me. go ahead and roll the videotape of her in the clown outfit and face paint and all the times that we've seen her on red carpets and anything, and tell me, and then read the documents and tell me anna nicole smith didn't have a drug problem. you're crazy. >> yeah. and i have to say that stern has pleaded not guilty and his attorney wants all the charges dismissed and we are going to say that any time howard stern wants to come by and appear on "issues" and tell his side of the story, we are very, very, very happy to have him. stern denies all the accusations and says anna nicole was his world. that world included off the wall apparent seeming drug-induced scenes like this. all right. >> this is worth money. >> why?

>> now, i think that is pretty powerful evidence that at least anna nicole was high on something, at least at the time. now, if you ever saw her tv show, she also appears high at that time. brenda wade, if it looks like a duck and quacks like a duck, can we assume that yes, it is a duck? >> it's a duck. it's a duck, jane, we all know that. the thing that i want people to take away, because addiction is rampant in america. you know that. and one of the things that's important is to know that there are ways to intervene and get people into treatment. but if you're a pusher, your motivation is to keep making money off the person getting the drug. if you're the enabler, you've got your own motivations for crushing up drugs and injecting it into somebody's veins. but if you want to help someone, there are many, many, many fine

services for doing an intervention. we have free 12-step programs in every church basement and synagogue basement all over the country. for god's sake, we need to address this. >> is it possible that howard k. stern was your classic enabler, co-dependent, who thought that he was doing what anna nicole wanted? >> absolutely. he believed that he was doing what she wanted. but the bottom -- the fact of the matter is that he enabled, he facilitated, and he conspired to ultimately lead to her death through criminal negligence. so yes. >> yeah. this -- >> i also think he had some motivation of his own here, jane. i don't think enablers are just doing what they think the other person wants. most enablers continue to enable because they're getting something, too. >> or they're in denial. addiction is at the heart of the anna nicole tragedy and so many other stories, including my own. it is national recovery month. great time to get sober. i also want to urge you to buy my new book, "i want." you will learn so much about my

thing here is that this notion that they're going to go down this road of suggesting that he was somehow innocent and didn't know that she was an addict when by the same token he's being charged with using aliases to get her drugs and participating in her drug habit while she was pregnant, i just don't think that's going to go very far. so i don't think this is going to be a very fruitful line of defense for him. >> well, let's talk about the doctors who are involved. because he's not the only one charged. there are shocking new allegation that's anna nicole had sexual contact with her doctors. >> yes. >> court documents cite some really, and i mean really racy photos of anna nicole with her psychiatrist and neighbor dr. kristine eroshevich. now, these pictures apparently allegedly -- i have not seen them -- show the two naked and embracing in a bathtub two months before anna died. the documents also allege dr. sandeep kapoor had some kind of sexual contact with anna. there he is. tmz has this photo of her with a

shirtless dr. kapoor. the doctor's attorney, however, told "issues" no way, jose, my client is openly gay. so i've got to go back to mike walters on this. if he's openly gay, he's not having sexual contact probably with anna nicole. so let's talk a little bit about the other one, the female psychiatrist. >> well, yeah. i mean, the one thing in the documents that doesn't -- when this story came out in the news, in the media, they didn't really get into detail. i mean, in a bathtub with topless or something like that doesn't sound as bad. but there are several photos, and they are very racy. we're talking totally nude -- >> have you seen them? >> i have not seen them personally, but they are described in very specific detail. if you read the full documents, it goes into very specific detail as in fully nude on a bed, crotch area, open legs, stuff like that is in these documents. so they are very racy. and i have to go back to the fact that they're doctors. so again, this is an inappropriate relationship, whether they're playing and

having fun or sandeep kapoor is openly gay and he's nuzzling her neck at a nightclub. and you saw the photo. that was actually a gay pride parade they were at at the end of the night. but that doesn't matter. he's her doctor on paper. he's prescribing medication. and that's inappropriate either way. >> brenda wade, what are the rules for doctors and their patients? >> jane, you take the hippocratic oath, and in this case i think these doctors took the hypocrite's oath. >> that was a good one. >> the oath says you are to protect your patient, you are to help ever, hurt never. always do those kinds of things that empower and help people. in this case clearly the doctors aren't helping. they knew it. they were hurting her. and in terms of relationship, there's professional distance. it's not professional to nuzzle your patient's neck or -- >> i think we're going to have to leave it with that brilliant line. as they say, first do no harm. thank you, fabulous panel. remember, click on cnn.com/jane.
