fast-moving wildfire. this thing is burning in southern california. the so-called sheet fire has already burned more than 7,000 acres. it is threatening dozens of homes, and san bernardino county. fire officials say between 4,000 and 6,000 people were told they had to leave. the resort town of wrightwood is under a mandatory evacuation order. it not optional. residents quickly gathered what they could, packed it in their vehicles and got out. >> everything we could think of. clothes, computers. pictures. albums. >> mostly clothes and valuables. stuff from my wife's family. >> we evacuated 40 head from my ranch last night. >> tough time for them. california governor arnold schwarzenegger declared a state of emergency noor county. ten area schools are closed because of this fire. we are keeping an eye on that for you. the man accused of secretly taping espn reporter erin andrews in the nude will go

before a judge in chicago today. michael david barrett is charged with interstate stalking, accused of recording videos way cell phone camera through ultra peepholes in hotel room doors. prosecutors say barrett tried to sell the videos to celebrity website tmz.com. the judge is expected to decide whether barrett should be sent to los angeles as a federal prisoner to face charges or released on bail. tmz is based in los angeles. the attorney for the cbs news producer charged with trying to extort $2 million from david letterman says we've only heard one side ever the story. joe halderman pleaded not guilty to attempted first-degree grand lawrenceny and now out on bond. earlier today his attorney made the morning show rounds, as it sometimes customary in high profile cases like this. in an interview on the nbc "today" show, he accused the host of manipulating the story. >> david letterman didn't give his side of the story.

investigators have several people under round-the-clock surveillance in connection to a plot to explode bombs from new york, that's from a source close to this investigation, saying some traveled to pakistan with najibullah zazi now back in the u.s. he faces conspiracy charges related to the bomb plot. he pleaded not guilty last week and a jury is considering more charges in the case. some really unbelievable numbers. nearly 1 in 100 kids in the u.s. has some type of autism disorder. startling. those are the stunning results of two new government studies. the finding is a big increase over previous studies based on a survey of more than 78,000 people and health records. researchers caution greater awareness and more accurate diagnostic techniques explains some of this increase. a newborn baby who was kidnapped from his mother in nashville then briefly reunited

with her a actually now in state custody. authorities also removed the baby's three siblings from her home for what they're calling safety concerns. police say a woman posing as an immigration worker went to her house tuesday, stabbed her eight times and took the four-day-old baby. they found yair anthony carillo. they charged a woman with kidnapping. they got to see their baby before taken into foster care. they're not elaborating. foster care is generally temporary. a man is in the hospital with significant injuries to his arms after being attack by a tiger at the kag calgary zoo. more information about what's

happening now. >> -- came into contact with our 2-year-old male tiger vitaly that had overnight access to the yard. the second went to the aid of his companion and they managed to get away from the tiger. security personnel were alerted to the incident when one called for assistance on a kren phone. the security officer received the call ran towards the tiger exhibit and encountered both men on a public path just east of the tiger enclosure. she took the men to the zoo security office, arriving at 1:07 a.m. a call was immediately placed to 911, requesting police and medical assistance. another member of the zoo security staff administered first aid to the injured man. the second man refused any first-aid treatment. paramedic arrived at the zoo security at 1:13 a.m. one man was transported to foothills hospital where his

injuries are being treated. the information we have is while his injuries appear not to be life threatening they are, however, quite serious. calgary police services is investigating with the assistance of calgary zoo staff. the director and zookeeper were called immediately after the incident and the tiger locked indoors while the investigation took place. the tiger enclosure is surrounded by two fences. one of them 42 inches in height. designed to keep the public from coming too close to the enclosu enclosure, and the second designed to keep the tigers inside their exhibit area. the second exhibit fence is 15 feet in height way three-foot overhang joined at a 90-degree angle to the top of the main fence. it also has a four-strand, 120 volt hot wire located about 16 inches from the end of the overhang. we currently have three adult siberian tigers at the calgary zoo. a 14-year-old female, a

they say foster care is generally temporary. a 3-year-old is physically okay after something horrible. she was found in a house where her father was shot twice. and two other people were killed. authorities think the shooting was drug related. they say a group of men tortured the girl's father, a roommate and a woman visiting. they found this 3-year-old under the woman's body. >> they tortured him and said if you're going to sell drugs, you're going to sell our drugs, and, by the way, where's the $5,000? >> like i said, she's physically okay. the girl's father is in serious condition. police are still looking for the suspects. president obama is bringing in reinforcements to help him push for health care reform. doctors and nurses, the president says, they support plans to overhaul the system because they're the ones who know the system best. >> these doctors know what needs

swine flu continues to march across the united states, even though it regularly pa lly make headlines. our affiliate introduces us to one patient. >> reporter: heather lost her battle against h1n1 and now her 8-year-old son will grow up without her. >> i'd give anything to hold her and tell her how much i love her. >> reporter: deborah took her sick daughter to a local hospital on september 22nd. she had a high fever and a cough. she says doctors suspected swine flu, but they didn't give them a prescription for tamiflu. >> he said it was being used for hieb bris patients and felt my daughter would be okay to take tylenol. had sleep apnea, breathing difficulties and obese.

three things that puts somebody at high risk. >> reporter: they went home, two days later she called her primary doctor. her daughter wasn't getting better. she says he prescribed an antibiotic, still no tamiflu. that night she dialed 911. >> didn't know where she was. her lips were turning purple. >> on a ventilator eight days but didn't make it. now her family wonders if tamiflu could have saved her life. they hope their loss sends a message to other doctors and to hospitals. >> i think she would have had a better chance of fighting. you know? whether the outcome would be the same, god knows, i don't. but it would have given her a chance to fight. >> that report from our affiliate wfaa. heather was the sixth person to die of swine flu in dallas county. and some people will start getting the swine flu vaccine today. the first 600,000 doses are going to health departments in 21 states and 4 large cities. the very first batch will be

callaway. >> interesting how they're using canines. how accurate it is is the controversial about they're using bloodhounds to actually go through a lineup and sniff to see if evidence matches. the innocent project of texas says that an unknown number of people have been wrongly accused or convicted of dog scent lineup. it use the dogs to match the scent from evidence to the scent of a suspect. here's how it works. the dogs walk along a row of aluminum tin and each contains the scent of a different suspect and sniff to see which matches evidence. in 2006 a texas sheriff's deputy found himself a murder suspect because of the practice. his neighborhood been strangled to death with a rope and he repeatedly denied involvement to his police colleagues but the investigators sided with the dogs that made a connection.

a newborn who was kidnapped from his mother in nashville and then briefly reunited with her, the baby is now in state custody. authorities also removed the baby's three siblings from carillo's home from what they are calling safety concerns. that's all they are saying. a judge will review the case this week. police say a woman posing as an immigration worker went to carillo's home tuesday, stabbed her eight times and took her four-day-old baby. investigators found carillo friday night in a home in alabama three days after he had been abducted. they arrested 39-year-old tammy rene silus and arrested her with kidnapping. carillo got to see her baby before the children were put into foster care. authorities say the children were taken for safety reasons and are not elaborating and say it's generally temporary. a 3-year-old is okay

physically after her father was found shot twice and killed. authorities say it was drug-related. they say a group of mentor toured the girl's father, his roommate and a woman visiting. deputies found this 3-year-old child under a woman's body. >> they tortured him, and said if you're going to sell drugs, you're going to sell our drugs, and by the way, where's the $5,000? >> the girl's father is in serious condition. police are still looking for the suspects. it's been one year since president bush signed off on the $700 billion federal bailout, known as t.a.r.p. now the program's top cop says not everything we heard at the time was true. cnnmoney.com's poppy harlow is in new york with more on that. poppy, what did we not know? >> well, richelle, it's an interesting report out just this morning from cig t.a.r.p., they oversee the bailout program. the inspector general of

t.a.r.p., kneel barofsky, saying the feds were not entirely honest with the public a year ago when the plan took under way. now, the report finds that of the nine biggest u.s. banks that were lent $125 billion, they were not as held knalthy as offs indicated. hank paulson was concerned that one of those banks might even, quote, outright fail. of course, when we look back, we know the driving force behind t.a.r.p. was get the banks lending again, stabilize the financial system. but barofsky says what happened was that the treasury painted an overly rosy picture. >> it raised unrealistic expectations by saying these are healthy banks, this money is going to help them lend. look, one of the main points which we describe in detail was to prevent a systemic collapse, to provide stability, to provide competence to the market. and the t.a.r.p. did help assist in doing all of those things. but restoring lending, it was just not a realistic expectation. and i think that the t.a.r.p. --

thank you. we know a lot of you have questions and concerns about h1n1, the vaccine, as well. so what we're going to do right now, because we've got so many questions and e-mails and we formed some questions from that. so we're going to try to get some of these questions answered for you. joining us from emory university is doctor carlos del rio, an infectious disease specialist. the point is, he knows how to answer these questions. so we're going to pose some of these questions to him right now. doctor, thank you so much for your time. we have narrowed some of the questions down. we're not going to be able to get to everyone's questions, but these are some of the most common questions. ready to get started? >> sure. pleasure to be with you. >> thank you so much. many viewers were concerned about this. if it someone already has a preexisting condition, either heart disease, cancer, something like this, if they were to want to get the h1n1 vaccine, would they be at any type of risk at all if they're already sick from something else? >> they should be okay. the people that need most the vaccine are, in fact, people like that who already have an underlying condition.

they would be at increased risk of morbidity and mortality if they were to get the disease. so the vaccine hopefully will prevent them from getting the disease. >> all right. we hopefully put someone's fears to bed with that one. charlotte in michigan wants to know this, once you get the h1n1 virus, is it possible to get it again, or do you build up an immunity once you already had it? >> you probably build up an immunity to the virus. the answer is not totally certain, but you probably whether an immunity to the virus, enough that if you get it again, it will be mild. that's a little of what the vaccine is doing for you. >> all right. got that one knocked out. we have another question. all right, this is one that keeps coming up. if someone is going to get the regular seasonal flu shot, does that give you any type of defense against -- against swine flu or -- excuse me, h1n1, let me get that right at all? or do you need to get both shots? what do you do? >> you need to get both shots if you want to be protected against both. there's not going to be protection from the seasonal vaccine against the h1n1 strain.

and i think it's important that people that have indications for both receive both. >> okay. you're mowing right through these. let's hop down to joanne's question from florida. and this was what joanne says. and we had a lot of people that had this concern. she says, since i'm allergic to eggs, can i still get the shot or the nasal spray and she wanted to make sure we really understood. she says, this can be a live or death situation for some. and make sure, doctor, the people understand why she brought up the point about the eggs. >> the vaccine is produced by culturing the virus inside of eggs, and no, if you are allergic to eggs, you should not get the vaccine that has been produced in had eggs. >> what else can she do? just the precautions? >> everybody needs to practice normal precaution to say protect yourself from this infection, which is covering your cough, covering your sneeze, be sure to wash your hands frequently, stay home if you're sick. so the most common precautions would be in place and i would encourage people to take them

regardless of whether they get the vaccine or not. >> okay, joanne, asked a very important question, and the answer is, if it you're allergic to eggs, you should not be doing it. and this question, is it a live or dead virus that is used in the h1n1 virus immunization that is being distributed now. so she is asking kind of a scientific question there. >> the nasal aerosol is a live, attenuated virus. the shots are with a dead virus that takes longer to develop the vaccine. so there are both types of viruses available. >> all right. and doctor carlos del rio answering some very important questions from emory university. doctor, we're about out of time, but one of the questions that came up earlier -- we are out of time, but i wanted to get this out. some people were concerned that it seemed to be rushed to market. do you think that's kind of overblown? >> i think it's actually amazing what has been done by the industry, by government, by researchers, to get this vaccine developed and distributed and getting the appropriate studies of safety ready for this vaccine

the black woman's health study just got a big financial boost that's making news in our new segment called "what matters," our partnership with "essence" magazine where we take a look at news making headlines in the african-american community that affects all of us. the national cancer institute has awarded boston university school of medicine $9.1 million to extend this study. this is what it does. the study followed 59,000 women from around the country since 2005 to see how breast cancer and other diseases like diabetes and lupus affect black women. the smithsonian is planning to preserve a piece of civil rights history, the casket that once held the body of emmett

indonesia has called off the search for survivors who may be still buried under all the rubble. buildings were toppled during the earthquake. rescue agencies are saying no one could have survived this long. workers are clearing the rubble now and the u.n. says it is focusing on relief for survivors.

devastating quakes hit indonesia last week. more than 600 people died and one official says more than 300 are missing. that is down, though, significantly from earlier estimates that said the number of missing could be in the thousands. terrible flooding has forced about a million people to have to leave their homes. torrential rains are blamed for high waters in india. the death toll there is about 271. india's air force has been dropping food packets in part of the country that is under water. hundreds of thousands of people are having to stay in relief camps. mild winds and cooler temperatures are expected to help crews on the scene of a fast moving wildfire in southern california. they just can't seem to catch a break. the show called sheep fire has already burned more than 7,000 acres and is threatening dozens of homes in san bernadino county. fire officials say between 4,000 and 6,000 people are being told they got to leave. the resort town of wrightwood is under a mandatory evacuation

found the boat 150 feet from the water. the captain was thrown. some of the people were killed. a detective told local media the boat had to be going pretty fast to wind up that far on the marsh. four other passengers were seriously hurt. a couple pretty big setbacks for drew peterson, the chicago area cop accused of killing his third wife kathleen savio. not only did a judge reject a request to move his murder trial, he also said he would allow so-called hearsay evidence that could include savio's request for orders of protection and letters she wrote where she said peterson would kill her to shut her up. peterson's lawyer says this is not fair because there was no chance for the defense to cross examine and challenge the evidence. peterson pleaded not guilty to first-degree murder in the savio case. he is also a suspect in his fourth wife stacy's disappearance. he has denied any wrongdoing. tonight on hln "news and

near the library. a little while after that a passenger on a bus said i'm the suspect they're looking for. the bomb squad went through his belongings and police later said that admission was a hoax, a lie. after the first man was arrested the university issued a warning about another suspect wearing a black tank top and cowboy hat. he was seen on campus carrying a puppy and a large hunting knife. the school transit system was also shut down until the all clear was given and again, all clear has been given. a judge says there's enough evidence to continue the case against a 19-year-old accused of trying to blow up a dallas skyscraper. hosam smadi is charged with trying to detonate what he believed was a truck bomb beneath a 60-story building. smadi's former landlord said he never found anything suspicious about him. >> some people have told me that he was more a party animal than a philosopher. >> a couple weeks before his arrest smadi was pulled over for his string of traffic

violations. the dash cam video shows he was asking about the legal process. investigators have several people under around-the-clock surveillance in connection with a suspected plot to explode bombs in new york. that's when sources close to the investigation say some of them traveled to pakistan with najibullah zazi and are back in the u.s. now. zazi is facing conspiracy charges related to the bomb plot. he pleaded not guilty last week. a grand jury is considering more charges in the case. this weekend insurgents carried out the deadliest attack on u.s. forces in afghanistan in more than a year. at least eight americans were killed saturday when hundreds of militants attacked their outpost in the nuristan province. the military says after a 12-hour battle the militants were finally pushed back and today two nato service members were killed in southern afghanistan. one of them was american. last week the top u.s. commander in afghanistan, general stanley mcchrystal, made a public plea

different plan. alaska will give the first doses to preschoolers. pennsylvania will target grade school students. the first batches of the vaccine are in the form of a nasal spray and in about a week or so swine flu shots will be ready. we've been asking for your views on the vaccine. i put this question on my facebook page. got a lot of response, a little bit of debate. some of you are weary of this. thought about getting it because honestly i do not have insurance and i cannot afford to get sick, literally. i think i am more worried about the flu itself than i am about the vaccine. this one says, no, don't trust it. too early to be able to make a vaccine that works. they aren't even sure if the regular flu vaccine is the right one. it's always an educated guess. ashley feels this way. as a student pharmacist i will definitely be getting the vaccine and i encourage as many people as possible to get it as well. so she has no concerns about the vaccine at all. mandy feels this way. me and my family will pass. there are better ways to protect yourself. i plan to use common sense like

you can pass on some information that's coming into the newsroom. executions are now on hold in the state of ohio. a federal appeals court blocked them today, three days before the scheduled execution of the convicted murderer. his name is lawrence reynolds jurn junior. he was going to die by lethal injection and the governor says the state needs more time to thoroughly conduct a comprehensive review of the execution procedures regarding lethal injection. they brought up a case we

actually told you about, a case where an executioner had a problem accessing the veins of a different ohio death row inmate last month. technicians tried for a couple hours to find suitable veins to carry out the lethal injection. so the state's next two executions have been put off until next year. lethal injections on hold in the state of ohio. well, a federal judge has released with restrictions the man accused of secretly taping espn reporter erin andrews in the nude. michael david barrett is under home confinement and has to wear an electronic monitoring ankle bracelet. he cannot use the internet and he has a 9:00 p.m. curfew. he is facing interstate stalking charges accused of recording andrews with a cell phone camera through altered peepholes in hotel room doors. prosecutors say barrett tried to sell the videos to the celebrity

website tmz.com. barrett is due in a courtroom later this month. andrews may not be the only person he is accused of doing this to. prosecutors say he uploaded video of other women to the internet as well. we know police dogs can be used to sniff out drugs, track scents, but in some counties they are given a much larger and controversial role in crime fighting -- sniffing out suspects in police line-ups. the problem is, they can be wrong sometimes. this is getting a lot of attention at cnn.com today. let's turn to dot com live anchor virginia cha for more on this story. this is very interesting. >> it really is. very high emotions. a lot of buttons pushed here, richelle. the innocence project of texas says it's not clear how many people have been wrongly accused or convicted by these so-called scent lineups but they call it junk science.

now, basically the practice uses blood hounds to match the scent from evidence to the scent of a possible suspect. it's a dog scent lineup. they use dogs to walk along a row of ten cans containing the scent of individuals and the dogs try to sniff out which may match evidence from a crime scene. here's one reason why it's so controversial. in 2006 a texas sheriff's deputy found himself to be a murder suspect at that time because of a dog scent lineup. now, his neighbor had been strangled to death with a rope. he repeatedly denied involvement in his neighbor's death but investigators sided with the dog who picked his scent out. but then dna evidence implicated another man who pleaded guilty after five difficult months the deputy was finally cleared. >> i've cried myself to sleep enough times and had enough nightmares about it.

to finally be able to stand here and talk to you about it. >> reporter: to tell you the dogs are credited with cracking a lot of cases, they're held in high regard by the forces that use them, but there are calls for the practice to be banned or at least regulated better. in fact, one police dog trainer says that the accuracy of the dogs should be tracked. he also says that it's very lacking in terms of standards and he calls it, quote, pathetic. to learn more about how this works go to cnn.com/crime. >> you would think there would -- the accuracy would be of utmost importance when it comes to something like this. i'm sure people will check it out. okay. the supreme court, back in session. new term. they're still going to be grappling with separation of church and state? >> yeah, absolutely. here's where this begins. there is an eight-foot cross planted in the rocks below the mohave desert. that cross was put there back in the 1930s as a war memorial to honor veterans. it is on the mohave national

preserve. it's an area very remote. even the cross's caretakers are 160 miles away, but because it sits on federal land, this is the problem. a park ranger or retired park ranger filed suit and a federal judge ordered the religious symbol be covered up. the ranger himself is actually a veteran and a catholic but he says that it violates separation of church and state. a proposed land transfer to make the acre around the cross public land was denied by an appeals court. the case is going to be heard wednesday by the high court. as for the obama administration, apparently they are going to be arguing in favor of the cross and they're going to be arguing in favor of the land transfer to go through and of course we'll keep following it and keep everyone posted. >> an interesting case for sure. all right. virginia, appreciate it. >> you bet. ex-cop drew peterson will fight charges that he killed his third wife but a judge now says his murder trial will include
