sexual orientation. richard lui has the president's options to end the ban. good morning. >> good morning, robin. obviously to end don't ask don't tell would be to push a bill through congress. now, no such bill exists right now. key lawmaker saying he believes president obama will follow through on hoping to end don't ask, don't tell. getting military support is pretty crucial here. >> i think he will, and he can. i think it has to be done in the right way, which is to get a buy-in from the military, now possible. other militaries in the west, the british and other western armys have ended this discriminatory policy. it ought to be done with thoughtfulne thoughtfulness, care and buy-in from the military. >> some activists have accused him of putting gay rights on the back burner. when he talked about ending don't ask, don't tell, he did not put it on a timetable.

>> let's talk about people who oppose ending the ban. >> some say the military is just fine with don't ask, don't tell policy as it is, and the best thing to do is leave it alone. take a listen to another member of the senate armed services committee. >> we've got a program that's working within the military. it's been very effective, very accommodating for about 15, 16 years now. it's worked well. and i think there's no reason to change it. i get calls from military personnel on a regular basis every time this issue gets stirred up, and this is not a popular discussion within the military, i can assure you. >> more than 600 people were discharged from the military due to their sexual orientation. we'll talk about what the military is saying, retired military is responding to this. >> there will be more in the next half hour. thank you, richard. you'll have some important decisions to make this year as open enrollment begins at work.

♪ i can say i'm the light of your world ♪ >> that is the brand new michael jackson song "this is it." it was officially released at midnight on his website. the song will be in the new movie, the new jackson movie and a new double cd coming out this month. his brothers sing the backup vocals. an explosion near a marketplace killed at least 29 people today. pakistan authorities say the attack, which appeared to target a military vehicle, also injured about 45 people. this was in northwest pakistan where the army has been locked in heavy fighting against the

taliban. the insurance industries releasing a report today that slams the senate's health care reform plan. it says by the year 2019 a typical family premium would be $4,000 more than it would be under the current system. the white house is criticizing the report. the senate finance committee votes on the plan tomorrow. the space clown has landed. founder of cirque du soleil is safely back on earth after a trip to the international space station. some people call him the first clown in space because he wore a red spongy nose during the trip. that trip cost him $35 million. if you can, why not, right? those are some of the stories we're working on this morning. how is that oatmeal? i'm robin meade. morning, sunshine. a top health official says you're better off with the swine flu vaccine than without it. dr. ann shukitt of the cdc warns that the risks of not getting that vaccine are higher than any potential risks linked to it.

"time" magazine reports president obama could simply

tell the pentagon that investigating service members' sexuality is not in the best interest of the armed forces. harry truman used an executive order to end segregation in the military in the 1940s. >> one group is more likely to be kicked out of the military under the don't ask, don't tell policy. let's talk about that. >> women, robin, much more likely than men to be kicked out of the military under the don't ask, don't tell. more than a third of people discharged last year because of their sexual orientation were female. women only account for 15% of all active duty and reserve military members. a researcher saying a partial explanation may be homosexuality is more common among women in the service than males. it could also be from rumors. a bus carrying a high school band steered off a highway.

a band instructor died saturday and 44 students were injured. the head director says the driver slumped over just before the crash and the instructor grabbed the wheel. this band has played at a presidential inauguration and the macy's thanksgiving day parade. top senators are split on whether to send more u.s. troops to afghanistan. republican john mccain says anything less than 40,000 would be an error of historic proportions. that is what the top u.s. commander in afghanistan is requesting. democrat dianne feinstein says that president obama should take his general's advice, but the armed services committee chairman says he wants to focus on strengthening afghanistan's security forces. >> a dramatic shootout is caught on tape. look at this unbelievable surveillance video. this is what happened after a fist fight turned into a gunfight at a bar in toledo, ohio. people had already scrambled out

the gulf, riding into high pressure over the carolinas and raining out. you talk about heavy downpours. we have it right now. probably will see as much as three to five inches of rain in the areas sheaed in dark green today, flash flood watch areas. all those dark shaded green are the watches. warnings are all bright shaded greens. flooding occurring in those bright shaded green areas. yellow shield of rain, red, that's three to five inches, georgia, central and northern, lower arkansas, mississippi, three to five inches of rain in the next 48 hours. lot of rain potentially out there. that's one story. the other story we're waking up to, cold temperatures, freeze warnings in dark purple, also frost advisories into west virginia and western parts of virginia. 42 in boston. you get outside of bean town you're looking at cold temperatures in massachusetts. all right. heavy rain in the west. heavy rain has caused land

>> maybe a lot of people are thinking about it, but not wanting to. >> but the bed feels so good. >> yeah. this is a little more personal, though, than we're kind of used to. open enrollment season. you may be getting the envelope in the mail soon as your company talks about what kinds of health benefits are out there. l.a. time sincere reporting that if you want insurance, more companies are going to require you to take a risk assessment test. they're going to be looking right at you, measuring you, weighing you, taking your blood pressure, and look closely at your health, the risks and the risk that you may need costly treatment. and that way, you know, they're saying, well, they may ask you to meet some measures, lose weight or quit smoking. that could mean you get lower premiums so it may help to give you a real world incentive to do it. they may also give you a discount at the gym. if you don't meet the measure, that may mean you get stuck paying higher deductibles. it's like they're saying if you have higher risk and you're going to cost us more, we're going to ask you to pay more
