today our top story. it is a key day. we could see president obama's plans to overhaul your health care and take a small but significant step forward. live pictures right now from the senate finance committee as they gather for an important vote. it is supposed to start right now. you can see the energy as orrin hatch, senator from utah, sits down right now. it is expected to pass and that will send it to the full senate where more sparks are certainly going to fly. now, a couple reasons this version is a big deal today, the bill does not include the hotly debated public insurance option. it's the only bill democrats and republicans worked on together. so, does it have a chance? >> we're going to find out. we'll have a big debate in the senate and go on for many, many weeks and the american people will have an opportunity to weigh in. i do think the majority made a mistake in trying to jam it

through before anybody had a real chance of reading it. i do think they slowed the process down. people will have an opportunity to understand what's in it and how it will affect them. >> ten republicans, 13 democrats that will be debating this as we watch, again these live pictures dipping in throughout this hour as we follow this very key vote today on your health care. the southeast is getting soaked again this week. parts of georgia and alabama under flood warnings today and more heavy rains coming. the atlanta area was cleaning up from flooding three weeks ago. some of the pictures that killed nine people that flooding did. a huge storm on california, people are preparing sandbags throughout the state and the rain could cause mudslides especially in areas burned by wildfires and that is where we start with our dapper friend here bob van dillen. we're looking at major storms hitting the west. >> we have been watching this low pressure region richard deepen overnight. wind pops up and we're looking

at heavy rain, too. satellite radar picture and see the clouds extending through to the rocky mountains and notice the heavy rain. it is out there and coming down very hard around the bay area and just north of l.a. one aspect of the storm and the other one is the heavy wind out of the south. winds gusting to 65 miles per hour. that's what you have in areas shaded in red. good chunk of nevada parts of utah in towards oregon, as well. winds here 50 miles per hour. look at the wind. take you live to san francisco, tough morning commute and the rain has been heavy for the last couple hours and continue this morning looking for two to three inches of rain total today with more rain coming in overnight tonight and tomorrow. that's a look at the bay bridge it's a soggy one and the burned out areas south of there l.a. county mountains and around that region major mudslide problems starting tonight and tomorrow. radar north of san francisco and

official vehicles this one had the markings for the local school district there. the death rate for kids with h1n1 flu is at its highest since the outbreak began last spring. the cdc says 76 kids have died since april with the virus. 16 of them died just last week. most had an underlying medical condition, but not all of them and that's why doctors want you to watch your kids if they do get sick. get help if your kids have breathing problems. a bluish skin color is also an indicator here. they are not thirsty. they're not thirsty despite being sick or they are waking up easily. now, if they get better make sure theb fever does not return or their cough if it gets worse also look for fever with rash. those are some of the things to look out for. new this morning for you in other news, after more than a year of ugly end fighting martin luther king jr.'s children, now

they reached a settlement late last night. martin luther king iii and burr niece king sued brother dexter king last july accusing him of mishandling money from the family's estate. now, a temporary custodian will be appointed to run that. some civil rights leaders have a big beef with rush limbaugh. you probably heard the new michael jackson song by now, but you know he may not have written it alone.

well, the attorney for a u.s. dad says his client is being mistreated in a tokyo jail. the attorney claim christopher is being held without trial and denied treatment for high blood pressure and exposed to sleep deprivation. he is accused of kidnapping his

kids after his ex-wife took them to japan. a u.s. court had granted him sole custody but that's not recognized under japanese law. now to a crucial vote today that could shape your health care for decades. live pictures at the moment. the senate finance committee just kicking off in the last 15 minutes and expected to pass their health care bill, their form of it. we know the stuff is fairly complicated and here's why today's vote is important to many. this is the only bill that democrats and gop created together. you look, if you were to take a look at today's vote it is basically a litmus test to see how closely the sides are working together or are not. it's also the most conservative bill that democrats have to offer with no public option but with a co-op option instead. so far democrats have little public support and both sides accusing the other of not collaborating. meanwhile keep a close eye on moderate republican senator olympia snowe.

democrats need a yes vote from her known as an independent thinker, snowe's big concern here is the cost of health care reforms. her experiences with the health care system started early. she was orphaned at the age of o9 after losing her father to a heart attack and her mother died of breast cancer about a year earlier. she's been described as strong willed and tenacious. even though she has been pushed and wooed for her vote, she will likely go her own route along the way. prosecutors will seek the death penalty against some of the people accused of killing a florida couple known for adopting special needs kids. you might remember the surveillance video from byrd and melanie billings at the house the day they died. four of the eight suspects are facing the death penalty if convicted and that includes the suspected ringleader. they have pleaded not guilty in that. it's considered the biggest golf tournament in the country for the blind.

and was wounded in iraq. he later admitted though, he has a mental illness and got caught up in a moment. welcome back, i'm richard lui. you're looking at right now john d. rockefeller the democrat from west virginia. we just heard from senator balks and grassley and going in rank order getting comments and we have seen some signs and people in the back there who are in this committee meeting saying single pair now i believe. four other congressional committees have voted on reform legislation but today's vote is a key one. here's why. you know, it is not only not only is the only one with a gop and democrats worked on together, but also the committee, this is the committee that is voting today and most closely resembled the full senate. 13 democrats and 10 republicans. very telling on how the entire

group could vote. we see senator oron hatch voting from utah and we expect the comments to go on for a good amount of time. 23 senators making comments. some real backroom brawling may begin as a senate finance committee bill is merged with a more liberal bill from another committee called help. a public option is included but not in the finance committee version which is being debated right now as we show you live pictures. so, expect a lot of rangling between democrats themselves and then with republicans about this, too. the issue that provoked so much hostility in some town hall meeting is not dead yet. another key difference, the bills do not agree on whether employers should be forced to provide health insurance for their employees. this could affect so many people from small business owners to rank and file workers and also the bills do not agree on how much government subsidies should help low and middle-income people pay for health insurance.

we stay on top of this live hearing this committee meeting and vote which we expect on this tuesday for you. in other news a florida teenager is in the hospital after someone set him on fire. police are holding three juveniles in connection with the attack. michael brewer was doused with gasoline and set ablaze. he ran through an apartment complex and jump under to the pool to put out the flames. he has burns on 80% of his body. >> this is the worst thing you could possibly do to a 15-year-old kid. >> not even animal you don't do this. you cannot put fire. >> the victim's family says that the attack was in retaliation because he got someone arrested for stealing a bicycle the day before. today a judge in l.a. will start hearing testimony about how anna nicole smith may have gotten the drugs that killed

her. a preliminary hearing that will decide if the case against her boyfriend, howard k. stern and two of her doctors will go to trial. they've all pleaded not guilty to conspiring to illegally providing her with controlled substances. the feds have a new tool to find fugitives and it's in your wallet. fbi agents in north carolina are scanning millions of digital driver's license photos with facial recognition software. it said it aufrld led them to a homicide suspect. federal long gives access to dmv databases and critics say it's like putting everyone through a virtual lineup. we talked about the west and how they're getting hammered or getting ready to be hammered again. bob van dillen continues with the rough weather this time in the south in texas. >> the southeast got hammered yesterday but it's going to change and i'll show you why. lots of energy wrapped up around deep south texas and all pulling up towards the north and drawing a lot of moisture out of the

we just learned the fbi says it arrested a suspect in the rape of a little girl that happened nearly 20 years ago. this is jennifer today.

she was attacked when she was 8 and kidnapped from her bedroom and raped and left for dead in a field. earlier she said dna evidence was being retested in her case. there's a news conference at noon eastern. normally we don't name sexual assault victims but she went public to try to catch her rapist. that is going live at noon. a girl is helping a 4-year-old friend with cancer by performing songs out on the street. 12 years old. abbey miller has raised thousands of dollars to raise money for her friend. she sounds great. taylor love has a cancer that affects her nervous system and miller also lets people write notes to taylor and says they're especially helpful. >> taylor gets excited for them and, like she loves getting them read to her because she likes knowing that people are supporting her and people are actually thinking about her.

>> future star. according to love's website, by the way, she is in remission but the type of cancer she has has a high chance of recurrence. we're just warming up for the noon broadcast right here on hln that will start in 1:15. a 6-year-old honor student suspended from school for bringing his camping tool to school. this is the your view question. richelle carry joins us for more of this story. >> he's going to reform school. 6 years old. for 45 days and you would think if a kid is going to reform school he must just be a terror and wreaking havoc on the school. nothing like this. this is a camping tool. the kid's name is zachary christy. he brought this camping tool that he got from the cub scouts to school. this is what it is a knife, a

fork and a spoon. the key is the knife. >> i think i had one like that. i was in the boy scouts for a little bit. >> you probably did. but the problem is the knife that is on this utensil he brought to school. it is probably two or three inches. well apparently that violates the school's no tolerance policy. parents know what this is. there are certain rules you cannot violate and if you do you have to go home. >> on the flip side, nobody could fault the reaction and being careful in terms of reacting to such things. >> that's what the school district says. the zero tolerance policy didn't come from no where. as a result, they say that zachary, as cute as he is he violated the rules by bringing this knife to school. so, right now, he's serving a 45-day suspension, supposed to be in reform school. his parents were home schooling him while we were sorting this out. the question we have, what do you think of the zero tolerance policies? some say they have gone too far.

now. it's getting soaked again this week. parts of georgia and alabama were under flood warnings yesterday, and there are more heavy rains coming. the atlanta area was just cleaning up from flooding that happened about three weeks ago. after spending the past 40 years in cuba a suspected hijacker is expected to be formally -- suspected is expected to be formerly charged today in federal court in manhattan. luis armando pen yea soltren charged with hijacking a pan am flight and forcing the plane to land in cuba back in 1968. he surrendered to authorities sunday at jask after getting off a flight from havana. if convicted he could spend life in prison. the four people accused of feeding an nana coal's drug addiction will be in court today. the judge will decide if there's enough evidence for them to stand trial. she was 39 years old when she died of a drug overdose.

that was 2007. two doctors and howard k. stern, her boyfriend, pleaded not guilty to conspire to provide her with illegally controlled substances. larry birkhead the father of anna nicole's daughter is expected to testify later this week. county safety officials say that sweat lodge people got sick and two later died did not have the needed building permit. he says that structure at a resort in sedona, arizona, was taken down before it could be inspected. the sheriff says criminal negligence may have played a role in the deaths we're talking about. sweat lodges are used for cleansing rituals. the fire chief says most hold up to maybe a duszen people. this one held as many as 65. the owner of the resort where this happened wouldn't comment. authorities in galveston county, text, are hodding a news conference about the arrest of a suspect in a 20-year-old rape case. the alleged victim also is expected to make a brief statement.

let's go ahead and listen right now. >> -- agents from the fbi and the sheriff's office galveston county district attorney's office with the assistance of a very strong, very determined and very lovely young lady, the survivor in this case ms. jennifer shoette. i'm going to read a brief statement. after the statement i'm going have my colleagues come up and say a few words, and after that we're going to be taking your questions. on august 10, 1990, a horrific crime was committed in dickinson, texas. it shocked our close-knit community. and the officers who responded to the crime scene. a young girl only 8 years old at the time was abducted from the bedroom of her apartment. located not too far from here. once inside the apartment, the abductor grabbed her from her bed, picked her up and took her to his car.

eventually this little girl was take ton a field just a couple of miles from this office. this individual then sexually assaulted her, vile lnt e cutting her throat from one side to the other and then left her there in that field to die. this little 8-year-old girl defied all the odds. through her strength determination and with the help of nearby citizens, who found her some 14 hours later, she miraculously survived this brutal attack. over the years this case has been worked by the dickinson police department with the assistance of our partners in the fbi and the sheriff's office, but with few leads to go on, little progress was made. about a year and a half ago we again asked the assistance of the fbi. dickinson police department detective tim chromy fbi agent

richard and others were to endlessly breathe new breath into this, into the life of this investigation and develop new leads. because of advances in technology the decision was made to send key pieces of evidence from the crime to the fbi's laboratory for advanced testing. the testing was successful. a male dna profile was extracted from the evidence. the profile was run against existing fbi data bases, and a match was found. further investigation revealed this person resided in our community at the time of the crime. a copy of his texas driver's license valid at the time was obtained from the texas department of public safety crime records service division. we have a copy of that photo from that license for you to see. adjacent to the sketch made by lois gibson on august 14 1990

from jennifer's description of her abductor. if you would, captain. you can compare this for yourself. we find them remarkably similar. based on all the evidence it is with great satisfaction and great pride that i announced to jennifer and our community that at 6:50 this morning detective tim chromy and agent reticent with the fbi with the assistance of the local police and the fbi in little rock arkansas, arrested dennis earl bradford without incident. mr. bradford is charged in gal verifyton county with attempted capital murder in this case. my only recigarette that jennifer's grandfather is not here with us today. i've known him for some time. jennifer's grandfather, there wasn't a month that went by that jennifer's grandfather didn't come by my office or run into

a 6-year-old boy from delaware suspended from school and faces 45 days in reform school. he said he was 6. his name was zachary kristy. why he got in trouble. he took a camping utensil. the common fork knife spoon thingamajigs. his parents say he was excited about joining the cub scouts and wanted to show off the gadget. the school district says the folding knife, that's the part that got him in trouble is banned as a dangerous instrument under the zero tolerance policy. on the cbs "early show" little zach talked about his punishment i. definiteliy glee with them, that they shouldn't bring dangerous weapons to school, but i shouldn't -- i don't think that the punishment should be

sketch they waibel to make that and combination with dna they were able to arrest this man in arkansas. 19 years after they say he raped her and tried to kill her and left her in a field to die for 12 hours at the age of 8 years old. so jennifer shoettechuett chose to come forward to say she is not a victim. she is victorious. police believe they had solved the case after 19 years. all right moving on with more of the day's news. after more than a year of fighting martin luther king jr.'s children won't be airing their family's differences in court. they reached a settlement late last night. martin luther king iii and bernice king had sued dex tr king. that was last july. they accused him of mishandling funds from the family's estate. now a temporary custodian will be appointed to run it.

authorities in galveston county, texas just announced a little while ago, you saw this, an arrest ending a 19-year-old rape case. they say the suspect's name is dennis earl bradford. they say he abducted jennifer schuett from her bedroom when she was 8 years old.
