hello. rise and shine because thursday is connected to friday, right? i'm robin meade. morning, sunshine. here's what's going on today. for the first time in a year the dow hit 10,000. but traders are telling people not to get too excited about it. rush limbaugh was shown the door. the main investor trying to buy the st. louis rams says they're moving on without him. plus -- >> i don't know what they were trying to prove with this suspension. >> they find uniform implementation of the policy to be their best approach. >> a zero tolerance policy and this knife may have put an eagle scout's west point application in jeopardy. first though our top story this morning. you might call the dow industrials the comeback kids. the dow hit a huge psychological milestone yesterday crossing that 10,000 mark. and we haven't seen it that high

in a year. it's been that long. some people are taking it as a sign there economy must be recovering. >> the trend has been up the whole year as far as the market moving higher. again, the economy, i don't believe, is doing as well as the stock market shows but unfortunately, i believe we have a situation where our government does everything they can to backstop and prop this market up on a daily basis and it's not really something that you want to see but it certainly is in my opinion what's going on here. every day you get back stops, bailouts, all of these things that happened this year. without this market would not be doing nearly as well and we'd be in a situation where the market could build some stable support. i don't believe we're at that point now. >> this is what it means for you and it is good news in a bad economy. inflation is practically nonexistent nonexistent. you're working with tighter budgets and being very careful about what you buy. it makes it hard for stores to raise the prices.

today we're going to get a look at the consumer price index that will tell us how much prices went up last month. new this morning, the american dad arrested in japan for trying to take his kids back from his ex-wife has been released from jail there. japanese police say all charges against christopher savoie have been dropped. we have no word yet, though, on what will happen with the kids. savoie says his wife took them to japan. it appears rush limbaugh has been brushed out the door by the group trying to buy the st. louis rams. here is rafer with the big development on that story. okay. yeah, robin, limbaugh was to be a limited parter in a bid to buy the rams. a statement was relesased saying, quote, it has become clear that rush's involvement in our group has become a distraction to our intentions, engdangering our bud as such. we have decided to move forward without him."

at least 17 people are dead and an unknown number are held hostage. that's after gunmen, suicide bombers targeted three law enforcement sites. one blast hit a police station. militants also stormed two police training centers. pakistan says that the recent surge in attacks won't stop it from pursuing militants. the suspect in a vicious attack on a little girl 19 years ago in texas is there in texas, make that to face charges. dennis bradford arrived from arkansas. he is accused of kidnapping raping and slitting jennifer schuett's throat when she was just 8. she's now 27 and went public to help find her attacker. the fbi says dna testing led to the arrest. a 10-year-old texas boy used his cub scout training to save his teacher's life. sherry lowe says she was choking on a piece of apple when kyle forbes used heimlich maneuver to

save her. >> i was choking and he squeezed me like that. that was the first time i've ever saved someone's life in an accident. that's the first time i've ever done it. >> well kyle is also autistic and his father says this is proof kids with autism can do anything others can do. kids 10 and under may need two h1n1 shots to be fully protected. that's from the maker of the vaccine. a federal health official says this backs up their tests. what you're seeing in the video are kids getting the nasal spray version. the manufacturer tested the vaccine in almost 500 children and adults only need one shot. chew on this, gold teeth appear to be hot with thieves. police in seattle say burglars have raided more than 30 medical and dental offices. they've taken drugs too. and one office though, $10,000 worth of gold disappeared. high gold prices might be the reason.

weakening. about two minutes ago had a nice hook to it meaning there's definitely rotation there. not seeing that any longer. you get over to the east further, look at that shield of rain pulling through indianapolis and stretching in to central kentucky, tennessee as well. it's a quick moving low. it's going to start throwing rain around philadelphia new york city and boston later today. back side of that it's all snow. northern parts of minnesota, back in towards wisconsin, mixing out here. that whole batch is moving over to the east. some areas of showers popping up around the mid-atlantic. later today though, this afternoon and tonight, a lot of snow will develop mainly across northern pennsylvania. 12 inches of heavy, wet snow. we'll get to that coming up in about a half hour. >> oh, my gosh that's snow. >> yeah already. there you go. >> you can tell when i'm doing work and i look up ah! exactly. i'm being honest. a man was executed for setting a fire that killed his three daughters.

this was a guy who murdered his three children who tried to beat his wife into an abortion so that he wouldn't have those kids. >> correspondent richard lui is joining us now. let's talk about why the execution itself is so controversial. there are questions of was this an innocent man. he said he was right before they -- right before he was put to death. >> that's correct. and then what happened thereafter makes this case somewhat complicated. let's get to the nuts and bolts. willingham was executed in 2004 for murdering his three daughters. well, now some forensic scientists say the fire may not have been arson that would undercut the whole case but governor perry says it's propaganda from death penalty opponents and he replaced several members of a commission looking into the case recently. willingham's stepmother talked to anderson cooper. take a listen. >> he was a loving father.

he and his wife did have a storm y relationship. but he didn't try to beat her into an abortion. >> did he physically abuse his wife? >> yes, he did. but she physically abused him. it was fair play i guess. >> and as you were saying interest robin, willingham consistently said he was innocent. >> richard, let's talk more about willingham. who was he and what happened the night of this horrible fire? >> we go to "the new york times" and what they're saying here is willingham was an unemployed auto mechanic with a history of petty crime. prosecutors say he poured flammable liquid near the kids' beds in 1991 killing all three young daughters. willingham said he tried to save them but police doubted his story because his bare feet were not burned. at trial willingham's wife denied he ever hurt her but acquaintances said he told her

nervous and upset this morning. the weather is so bad that the searchers cannot fly. it's an enormous search area full of rugged peaks and canyons. they were on a six-day hike through king's canyon national park. when they didn't return monday, the families called police. the paramedic accused of trying to extort $25 million from john travolta says his son jet had been dead for some time before an ambulance was called. the defense opened its case for a former bohemian senator claiming that a doctor told him to keep administering cpr even though jet was dead. the 16-year-old had a fatal seizure during a vacation in january. we told you about the woman who won a scholarship pageant. now she's apologizing. nicole churchill says that she regrets writing president obama after winning the miss hampton university crown. she asked the president to come

charlie davies is recovering in a hospital bed, well his teal is going out there trying to beat costa rica in a world cup qualifying match and fans showed their support, they held up his number 9 jersey. they had it on banners. there's his likeness. the players wore his number 9 jersey underneath their jersey as they were chanting usa. all the u.s. had to do in this one was tie it to qualify. they were down 2-0 until that header in the 95th minute to tie it. it's crossed to jonathan born stein for the header. the u.s. ties it so they win their group and there's altidor showing that jersey. nascar unveiled its first hall of fame class, five people including richard petty and the all-time leader in wins there with the sunglasses not wearing a cowboy hat for one of those rare moimts. dale earnhardt sr. tragically died, was on the list along with nascar founder bill france sr.

administration for the way it handled the response to the storm. those are some of our stories. i just wanted to say -- wait let me check in on you. okay, you're awake. i'm robin meade. back to news in the fast lane. the new edition of "people" magazine is in stores tomorrow with jaycee dugard on the cover. we first showed you the cover yesterday. it is the first time that we've seen her as an adult. after disappearing for 18 years. she also shares her first public comments about how she's doing. dugard tells people that she is so happy to be back with her family. >> i think it's an incredibly empowering moment for jaycee and her family. there's been massive media interest. we and others have counselled this family to maintain seclusion to deal with this difficult reunification process but i think this is a way of sending a message to the american public jaycee dugard is well, that she's progressing and i think it's not exploitive.

cameron todd willingham may have been innocent of the charges. correspondent richard lui joins us now. you're talking about an execution. this person is gone. >> yes. >> so let's talk about why it's so controversial now. >> the governor remains emphatic. recently perry replaced four members of a state commission just before they were about to review a report critical of the arson investigation used to convict willingham. now perry denies the replacements here were a political move. he says it was just process. he is currently running for re-election. perry denying a last-minute stay of execution for willingham back in 2004 and his office confirms to cnn the office received a five-page fax 88 minutes before which will ham willingham's execution. it said the fire was not deliberately set. >> 88 minutes before the man was put to death. back to the commission about to hear a report slamming the evidence used to convict this man. let's hear about that.

"the dallas morning news" says the commission was to hear from a nationally recognized fire expert hired to review the cameron todd willingham case. his report released in august called the willingham fire investigation slipshod saying it was based on wives tails about how fires behave and possible arson evidence. governor perfectry says this is propaganda from death penalty opponents. listen to this. >> just as a lot of advances in technology have resulted in exonerations related to dna evidence, new advances in arson science could result in the same thing. we could see some arson cases being overturned because we know more about fires. we know more about arson and so what experts thought to be true in the past doesn't necessarily hold up anymore. >> willingham, robin consistently said he was innocent. >> right until moments before. richard, thank you so much.

an ohio woman will have to have a mental evaluation after she allegedly went to a store saying i'm going to pay for everybody's stuff because she had won the lottery. well she was in court yesterday morning on unrelated charges. her daughter says the woman's intentions were not malicious but her mom has mental problems. >> if somebody comes in your store, i won the lottery, let everybody buy what they want. that's ridiculous. >> well, police say that hundreds of people then came to the store looking for free stuff. they were called in, police were, once it became clear that the suspect did not have the money to pay for the items. 35 minutes past the hour. okay. let's start in a place where there is a line between snow and rain. who is right on that line? hi, bob. good morning robin. right now it's where you think it would be. northern parts of minnesota into

wisconsin. you usually see snow beginning to fall this time of year but that snow line is going to work in towards western and central pennsylvania by late this afternoon, tonight, through tomorrow morning so, yeah we're going to see the snow early right across basically the poconos and the allegheny. a low-pressure center caught up in the jet stream pushing a good shield of rain out ahead to the ohio valley and down in towards tennessee. we have the convergence of jet streams going on in the lower levels. look at these big thunderstorms beginning to pop up around southeastern oklahoma western parts of arkansas and getting in towards almost near shreveport later this morning. we also had a couple funnel clouds across southeastern oklahoma early this morning. no touchdowns. no tornado reports yet but the severe thunderstorm warnings are out there. those are the orange boxes all drifting to the southeast at about 15 miles per hour so it's going to rain over you for a longer period of time since they are not moving very fast. look at the rain coming in to ashland, towards wheeling. heavy downpours and lots of snow across minneapolis with no warnings but that rain is all headed over to the east.

a new look at the world after a unique surgery for a girl legally blind. her doctor replaced a layer of her cornea with a donor tissue. he actually developed that technique. and now his patient is seeing some things for the first time. >> i can see more stuff up in the sky and i can sometimes see rainbows. >> just to watch the changes in her from then until now is just phenomenal. >> oh, must be so moving for that parent. the family is scheduled a second surgery to repair the girl's left eye. you know a family in texas really got a shock when they bought a cell phone at the mall for their 11-year-old son's birthday and then they found a naked picture after woman on it. michelle hughley said she thought the phone was new. well at&t says that the used phone was mistakenly sold and

that a new one will be sent immediately. the agency that insures your bank deposits is running out of cash. sheila behr says it will likely stay in the red until 2012. 98 banks have failed this year. the agency has $10 billion left down from $45 billion a year ago. it doesn't mean your money is in any danger. the banks may be asked to repay insurance premiums to repay cash. how many vacation days do you get? two weeks, maybe none at all. some people get eight weeks off. people in brazil and lithuania get an average of 41 days off including holidays. that's according to the mercer consulting firm. the french get 40 days. in the united states an average of 25. canada has the worst with 19 days off. we've been telling you about reasons to get a flu shot this year but what if not getting vaccinated could cost you your

okay. quarter to the hour if you're just waking up. a judge in new york would not stop the state from forcing health workers to get flu shots. now some health workers wanted a restraining order to postpone the requirement they get vaccinated or lose their job. they don't want the government running their lives, they say. >> i have an issue with the government mandating me to get these vaccines and telling me that if i don't comply then i don't have a job. the seasonal flu and h1n1 this year. what will the government then have the right to say they want to inject us with next year? >> the court did say they may hold another hearing about the rule next week. let's talk about our travelers right now. well let's not talk about it.

insurance industry after an insurance group report attacked the bill. you know this is a big development. the group trying to buy the rams has dropped rush limbaugh after all that talk. i guess it was too much talk. hi, rafer. and they're still moving forward to try to get the team. sources told si.com that rush's partnership had zero chance of being approved. they would be on pins and needles while he was on the air afraid he was going to say something offensive. the man leading that group re released a statement saying rush's involvement had become a distraction and they are moving forward without him. limbaugh responded by blaming it on the left trying to destroy conservatism and we want to know what you are saying about this. this is a polarizing issue. seth wrote don't give up rush. keep trying until you get what you want. i'm afraid it's probably over though. did you know that cher watches our show?
