well, good morning just getting ready for this hour of the news. you're a multi-tasker too. you're probably guilty of the same thing. i think i see you watching your computer and the tv at the same time. morning, sunshine. i'm robin meade. here's what's going on today. for the first time in a year, the dow hit 10,000. whoo! but investors are saying don't get too excited about it. the st. louis rams says they're moving on along without rush limbaugh. the american dad arrested in japan for trying to take his kids back from his ex-wife has been released from jail there.

japanese police say all charges against christopher seboy have been dropped. we have no idea what will happen with his kids. his wife violated a u.s. custody agreement by taking them to japan. you might call the dow industrial average the comeback kid, right? the dow hit a huge psychological milestone yesterday, crossing that 10000 mark. do you know we haven't seen it that high in over a year? some people take it as a sign the economy is recovering but people who watch the markets say you shouldn't reedad too much into it right now. >> we want to break above this 10,000 level, we want to sustain it. there is still a major problem with the job market. everyone is expecting unemployment to hit 10 to 13% in the coming year so a dow is a six-month indicator of where things are going to be six months from now. we're still rebuilding, we still

have a long ways to go. >> this is what it means for you and good news in a bad economy. inflation is practically non-existent non-existent, so you're working with tighter budgets and watching what you're buying. that makes it harder for stores to raise their prices. today we're going to look at the consumer index. that will tell us how much prices wentd up last month. a suspect in a vicious attack on a little girl 19 years ago is in texas now to face charges. dennis bradford arrived from arkansas last night. he's accused of raping and kidnapping and slitting jennifer schuett's throat. dna testing led to the arrest. it appears rush limbaugh is being rushed out the door trying to buy the rams. this is a big change. >> it is a big change, robin, and it's shock tging it came from

fully protected. what you're seeing in the video are kids getting the nasal spray version. they tested the vaccine on 500 children and said adults only need one shot. we expect to find out this morning that you won't get a cost of living increase next year, but president obama is stepping in. yesterday he asked congress to okay a $250 payment in 2010 for seniors, veterans, retired railroad workers and the disabled. they also got one this year as part of the stimulus plan. four minutes after the hour. who has bad weather today? >> it's texarkana. it's really -- a developing low

pressure region over dallas, getting ahead of explosions right now. even a tornado warning earlier this morning iltst's expired but we did catch a couple sightings in oklahoma moving on down. right now it's a thurlt warning in texarkana, winds up to about 60 miles per hour. look at this solid sheet of rain in the midwest into the ohio valley penn state as well. the back side of that, the air is cold. you can see about one to two inches of snow north of minneapolis, and look at the light showers already developing ahead of that wave and it's right out of west virginia, northern west virginia maryland, new jersey and part of new york state. it's light right now, picks up in intensity this afternoon, and once that happens it's going to draw in some cold air. winter storm warnings in the northern part of pennsylvania.

six to twelve inches of rain in the higher elevations. it's going to start this afternoon and end up on saturday as it bovmmbs the jersey coast. wind today starting later this afternoon and tonight, gusting 60 miles per hour on the jersey shore and into jersey and maryland. it's moving away by the weekend but tough going for you today through saturday morning. more on that in just about half an hour robin. chew on this. gold teeth appear to be a hot item with thieves. police in seattle say burglars have raided more than 30 medical and dental offices since last month. they've taken drugs, too. at one office, $10,000 worth of gold disappeared. high gold prices might be one reason. >> they just kind of went through and ripped open -- they were looking for things. i think it's the economy. i think maybe people are getting a little more desperate.

it doesn't make it right but i think they're probably looking for ways to make money. >> the local media report says police are questioning two people on unrelated charges. there are signs of economy improvement, but it's still the worst of times for so. families. we're going to take a look at how many homes have been foreclosed on in the last month.

i'm richard lui. a man was executed for setting a fire that killed his three kids. now a controversy is raised over his conviction. they are slamming any suggestions here that tom willingham may have been innocent. >> willingham was a monster. this is a guy who murdered his three children who tried to beat his wife into an abortion so he wouldn't have those kids.

>> this is a fairly complicated case. let's get into the nuts and bolts. willingham was executed in 2004 for murdering his three daughters, but now forensic scientists say the fire may not have been arson. that would undercut the whole case certainly, but perthey say it's propaganda. here they are talking to the media. >> he was a loving father. he and his wife had a stormy relationship but he didn't try to beat her during an abortion. >> did he physically abuse his wife? >> yes, he d. butid. but she physically abused him. >> willingham consistently said he was innocent. the new york times said he was an unemployed auto mechanic with a history of doing time.

so they say he put flammable liquid near his kids' beds killing all three of his young daughters. willingham said he tried to save him but police doubted his story because his bare feet were not burned. his wife said he beat her several times while she was pregnant. over to bob van dillen now with your travel. hi, bob. >> already have a delay in atlanta because of the low clouds. it's only about 37 minutes but could grow more this morning. you also have rain and snow so that can't help you out. rain comes in over ohio stretches across philly new york and d.c. if you're traveling out to lax, things are looking a lot better today. you can see some fog, otherwise, the rainstorms are gone.

bombers targeted new sites. one sdsuicide blast hit a police station. they also stormed some centers. a 10-year-old boy used his cubs scout training to save his teacher's life. she was choking on an apple and he used his maneuvers to save her. >> i was choking and he squeezed me like that. >> do you feel like a hero? >> i do. that was the first time i've ever saved someone's life in an accident. that's the first time i've ever done it. >> kyle is also autistic. his father says this is proof that kids with autism can do anything other kids can do. jen is still off today, so because of that i'm going to talk a little bit with you here. more than 900,000 homeowners got foreclosure letters in the past three months that makes it the worst quarter of all time.

that's according to realtytrac which monitors foreclosed homes. they said they were up a 23% from last year. however, government actions have delayed some filings. people in florida who say their homes and health have been damaged by chinese drywall may lose their homes and insurance, though drywall is under investigation for emitting possible fumes. is there anything your iphone can't do? what about an application that will lock and unlock your car and start the ignition? this is called the viper smart start. a receiver is installed in your car ask then your iphone works just like a key remote.

most of the pregnancy. she says he is her hero and she's lucky to have them. maybe you have someone in the service. cnn.com/robin. three hikers have disappeared in the california mountain. now their family is nervous. they were on a six-day hike in kings mountain national park. when they didn't return, family called police. a five-year-old boy fell asleep on a school bus and when he woke up he had no idea where he was. the driver drove home, parked and never knew the little boy was still there. mom is furious. >> anything could have happened to my child, period. >> what do you want to see happen? >> i want to see justice, and he shouldn't be able -- his license should be suspended, like

taken, everything. he should never drive a school bus ever again. >> when the little boy woke up, he knocked on the door until he got help. the driver has been suspended. the driver's license has been suspended, i would assume. regional airlines have gotten warnings about safety. it's to avoid crashes to blame on pilots who were too tired or inexperienced. pilot error contributed to three of the last six accidents in the united states, all of which involved the regional airlines. the regional airlines association has not commented. it's not entirely clear whether michael jackson's kids will be on a new reality show. it is reported that prince, paris and blanket will be included in a show on a and e but the network says it's only possible that other members of the jackson family could appear on the show. the show will focus on the lives

joining us now. why is this execution controversial now? i can't remember whether it was three girls or three kids. were they all girls? >> you got it right robin. recently perry replaced three who were suspicious over an execution. he pardoned a stay of execution back in 2004 and the office received a five-page fax 88 minutes before willingham's execution. it contained an arson expert's findings that the fire, robin, was not deliberately set. >> so back to this commission about to hear a report now slamming the evidence used to convict him. let's talk about them. >> more on that robin you're right. the dallas news looking into that. the fire expert hired to review the willingham case released a report that said the willingham fire slipshod.

governor perry says it's propaganda from capital death opposition. >> they have resulted in exxon rations. we could see arsons overturned because we know more about fires, we know more about arson so what experts say in the past no longer hold up anymore. >> willingham consistently said up to the time he was executed he was innocent. >> stories we'll be talking about for a while. richard, thank you. two airlines could be fined millions for possibly flying hundreds of times while violating safety standards. the faa says this involved eight us airways planes with some expected for a possible cracked landing gear part.

this was last fall and winter. the faa says one united airlines plane flew 200 times last year with a faulty pressure indicator. united airlines says it reported its problem and are making sure problems are met. us airways blamed its problem on the merger with american west operations. the latest member of the president's own party expresses his doubts about sending troops to afghanistan. president obama huddled with top advisers for the fifth time. they're debating on whether to send 40,000 more troops. the white house said yesterday's meeting focused on how to train afghan's security forces and help civilians. two men are on trial in the first critical case related to the mortgage crisis. prosecutors say the hedge fund managers saw problems looming with subprime mortgages but kept

an eight-year-old girl is getting a new look at the world after a unique surgery. she was legally blind. her doctor replaced a layer of

her cornea with donor tissue. he actually developed this technique. and now his patient is seeing some things for the first time. >> i can see more stuff up in the sky and i can sometimes see rainbows. >> just to watch the changes in her from then until now, it's just phenomenal. >> it's got to be something for that parent. the family has scheduled a second surgery now to repair her left eye. anna nicole smith's bodyguard is a key witness against her boyfriend and two doctors. he's testifying at a hearing to determine if howard k. stern and the doctors will face trial for allegedly providing smith with controlled substances. the bodyguard will be cross examined by defense attorneys today. he said he saw smith inject smith with medications five times. she died of an overdose in 2007.

well, now a controversy is raging about his conviction. texas governor rick perry is slamming any suggestions that cameron todd willingham may have been innocent. correspondent richard l ui why are some people criticizing the governor? >> well, robin because of this. recently perry replaced four members of a state commission just before they were to review a report critical of the arson investigation used to convict willingham. perry denies it was a political move. he says it was just process. he is currently running for reelection, by the way. perry denied a last-minute stay of execution for willingham back in 2004 and his office confirms to cnn the office received a five-page fax 88 minutes before willingham's execution and in it it had an arson expert's findings that the fire was not deliberately set robin. >> execution went forward. >> that's right. >> richard back to this commission to hear a report slamming the evidence used to convict him. let's hear more about them.
