police say they believe him but they may interview him again along with other family members tomorrow. we'll hear from the sheriff who will have a news conference. we'll carry it live. for more than 24 hours police and the national guard tried to figure out how to capture the runaway helium balloon because they thought a 6 year old was inside. the boy was hiding in the rafters of the family's garage. >> you guys said that we did this for a show. >> the family appeared on the tv network show "today." he became ill twice during an abc interview. he left the room to throw up. on nbc falcon didn't make it out

of the room and threw up on national tv. he said the comment referred to something that happened earlier in the day when he showed reporters his hiding spot. investigators won't talk to the heene family today and they are exhausted clearly and will try again maybe tomorrow. the family released a home video. we saw a bit of that clip a moment ago. it showed the balloon lifting off from the backyard and then unexpectedly it begins to fly away. here it is. >> three two, one. >> whoa. >> my god. okay. get the tether. >> i did! >> they were all there watching it go up. it would be five hours before falcon was found safe and sound hiding in the garage. a lot of callers, e-mails and tweets, and i-reports and facebook comments dwell on this incident. was it a hoax?

murder trial filed charges to drop against her. anthony's defense team and prosecutors went back and forth over evidence in the case. casey anthony has pleaded not guilty to charges in her daughter caylee's death. her remains were found close to the anthony home. a judge in jut gets a competence update today for one of elizabeth smart's alleged abductors. smart was abducted from her salt lake city bed when she was 14. she's now 21. her alleged captors have never been tried because they were deemed mentally incompetent. today utah state officials tell the court whether that conditions has changed for wanda barzee. smart testified at mitchell's competency hearing that she was tortured and raped throughout the ordeal. no more tlc for jon gosselin. the network that broadcasts "jon & kate plus 8" is suing gosselin

for breach of contract. he's appeared on other shows for pay and revealed unauthorized details about the show. gosselin's camp hasn't commented. crews are searching for a fighter jet pilot in the atlantic. two f-16 jets collided during a training exercise. one plane landed safely. the air force has been doing tests at night so pilot train with newt vision equipment. civil rights activists are calling for a judge to resign after he wouldn't give a marriage license to an interracial couple. he feels that interracial marriage doesn't last. the groom was angry with the judge's views. >> he's saying 99% of it wind up in divorce. how many people get married and wind up in divorce? white or black? >> the couple went to another justice of the peace and they were finally married.

suggested maybe he jumped out. we were kind of hopeful maybe that might have occurred. >> the balloon launch set off a two-hour plus ordeal as it flew across colorado on a beautiful day heading generally southeast from ft. collins wound up 75 miles away. now a lot of people are asking whether all of this was staged. a publicity stunt. during a televised interview this morning, falcon was asked why he hid in the attic of the family garage when everyone thought he was floating in a balloon. on cnn's larry king last night he said you guys said we did this for the show but the dad richard said his son was misunderstood. >> right when he answered i got this thing in my ear. i can hear you. i couldn't hear what he was saying. it was asked to us again. then i heard it more clear. wolf was asking us so any way after the first set of

interviews in the front yard, i told everybody to come in my wife and the kids. i thought that they were behind me. and i ended up walking to the garage, opening up the garage door and falcon is climbing in the joist showing the media, the garage door is wide open, and there's like 30 guys out there with cameras. somebody asked him if he would show them how he got up for some tv show. so he told me that that's what he was referring to when we were talking about it. >> the sheriff said that his investigation indicates it is not a hoax. again we're carrying the sheriff's announcement in about 30 minutes. 2:00 eastern noon mountain time just ahead. apparently it's not the first time this family has grabbed national attention and headlines. the dad is a former tv

moms and dads had to be glued to the tube yesterday, what if that balloon you was carrying their kid across the country. >> when i saw that little boy may have gone up in the balloon today and possibly have fallen from that balloon, when they found the balloon empty, i wondered if he might have not gotten on the balloon and i hoped, and it turned out that he hadn't gotten on it and he was safely at home hiding. that all makes sense to me because i had the same thing happen. my kid didn't go up in a balloon but he went out the back door when all of us were going out the front door. and he hid. he hid at the neighbor's house

behind the paper box that was on his porch. when we called after 15 minutes of calling and calling his name, we called the police and the neighborhood got involved. 45 minutes later, my wife found him on the porch behind the box. i said didn't you hear us calling you? he said he was afraid that he was in trouble and the longer it went on the more he felt he was in trouble. and the more he decided he would hide from us. >> our thanks for his thoughts. a lot of people probably feel the same. it hasn't taken at all long for the boy in the balloon story to get to cyberspace. what others are saying about it and how you can get a piece of yes, memorabilia. it is already out there.

the boy thought to be trapped on a runaway balloon, he is fine now. a lot of questions about what really happened. what are your views about this story? casey anthony returns to court. find out what the lawyers are pushing to drop the charges. and heart stopping video out of australia. apparently the baby in this carriage is fine after it falls in front of a moving train. i'm richelle carey. welcome to hln news and views. we have breaking news. we'll to go larimer's county. the sheriff's office holding a news conference about 6-year-old falcon heene who we thought you was in a balloon. >> we had an awful lot of people that were concerned, and emailed us with a number of suggestions. we appreciate. that i want to express my appreciation to the numerous agencies that participated in this event yesterday. clearly, the sheriff's office was involved and all. our divisions patrol, dispatch

pios, victim advocates search and rescue, possie, and in addition to that we had larimer county parks fire authority, fpt ft. collins police the fire authority sent people to help with the media. the united states forest service. we're missing some and i know we had national guard and media helicopters and the county sheriff's office and the adams county sheriff's office. there were a lot of people who put their heart and soul into this and we want to express our gratitude to them. the purpose of the press conference today is really to try to answer everybody's questions at once. we've been being inundated with phone calls and e-mails nonstop. and frankly, we need to somehow put an end to it so we can get about doing our business instead of answering all the media inquiries. hopefully we can resolve some of

those issues today. we really don't have any new information, or a lot of new information. i do want to clarify a couple of things. obviously, yesterday i spoke about us having conducted a very thorough search of the house. obviously, it wasn't as thorough it's a we would have liked it to be because the boy was in fact hiding in the attic in the garage. i would like to explain that so we can get it clear. i think we searched the house three times. guys went into the crawl space they went into the attic, they looked every place except the one place where the boy was hiding. apparently there are some rafters in the garage and part of it is covered part of it isn't. there are no ladders to get into that attic portion. no stairs to get up there. and frankly looking at the debris in the garage, our personnel just didn't think it possible that a 6-year-old boy would be able to get up into that space so they didn't look there. and of course, that is the one

spot where the boy was. also i reported to the media yesterday that the boy was in a box in the attic. that was information that was related to me but it turned out to be erroneous information. as we got the text message, i got a page during the news conference yesterday that the boy had been found, i turned and asked our investigators to contact someone on the scene and verify that. by the time it went through you a couple of levels and the information got back to us i now believe that what was reported was that the boy had crawled on a box and then used that box to get into the attic. miscommunication occurred and i erroneously reported that the boy was in a box. there was not a box. there was a clear attic space that was flat. so hopefully that clears that up. there has been a lot of speculation. a lot of skepticism regarding this incident and whether it could have occurred as it was

reported. we did in fact yesterday during the course of this event, contact a professor at colorado state university with expertise, in determining the payload or the lift that a balloon of this dimension would support. and he informed us and reaffirmed that today, that a balloon of that size filled with helium would in fact handle payload before 80 pounds. we believe that the young boy who was missing was about 37 pounds, so it certainly you was conceivable at the time and remains conceivable today that the boy could have been in this device. i just wanted to say that because a lot of the speculation, a lot of the e-mails i've been getting have come from people reporting or suggesting that the balloon of that dimension would only be able to live five to 15 pounds. so therefore the father had to be lying. and i just wanted to disprove,

that at least based on the experts that we have talked to at colorado state university. the question remains, we were convinced yesterday. let me back up a minute. we were convinced yesterday after talking to the parents and having investigators on scene during the duration of this event, that the parents were being honest with us. they appropriately expressed statements, nonverbal communication, body language, and emotions during this event that were entirely consistent with the events taking place. believe me if the boy was in the aircraft, when it touched down and the boy was not found to be in there, there was a significant deflation i understand, of their emotional state. which our people didn't think could be faked or was being

faked. and again, you throughout the day as the events occurred all of their emotions and nonverbal communication was very consistent with what was taking place. this was as observed by investigators on scene who have some expertise in this particular area. if any of you saw some of the media interviews or activities at the scene immediately after the boy came out it was very evident that this boy is very hyperactive, to say the least. and the suggestion that to us that perhaps this boy had been coached, or coaxed by his parents to hide and remain still in this attic for five hours during the duration of this event just seems inconceivable. it seems much more likely that the boy was in fact frightened because he somehow thought that he was responsible for this device becoming untethered, and

therefore decided to hide. that seems like a very credible story. however, as you all also saw, there was an interview conducted lasted night, i believe by wolf blitz on cnn when he asked why he did this, and he responded we did it for the show or something of that nature. clearly that has raised everybody's level of skeptd six again and we feel it is incumbent upon us as an agency to go back to the family and attempt to reenter you view them to reenter view them and establish whether this is a home. certainly, people are free to speculate. they're free to be skeptical about it. those of us in the law enforcement profession to have operate on facts and what we can prove, not what the public might

that this thing was anticipated to rise and not come down any place near. if the boy was in fact in it he wouldn't have anyway to steer it or to operate any devices to lower it. >> we don't have any plans. we had hoped to do that today but quite frankly after watching some of the media interviews this morning, the boy being sick, the family suffering from a great deal of fatigue we think it would be in the best interests of the investigation to not tumor interview them today but perhaps to do that tomorrow after they've had a chance to settle town and get some rest. we just think for interview purposes, it would be much more productive to have them in that frame of mind than doing it when they're fatigued. >> you have you seen this home video they made during launch? you have you seen this tape yet? >> i'm afraid i haven't. it has been described to me you but i haven't seen it. i'm sure i will before the day is out. >> the garage. the garage in which the boy was

hiding yesterday there was police tape around the house. there are investigators in the garage the entire time. the boy said to the press that he was sleeping up there. half of the time that he was up there. looking into the garage, the garage was open. press you was around. it was very highly a lot of commotion going on. how likely is it that the boy could have been sleeping? with the stories that have been -- how likely is it? do you still believe he was sleeping? how will that play into your questions tomorrow when you interview the family? >> let me reverse it and say seeing how hyperactive this young lad was when he came out, how conceivable is it that he just sat up there quietly without being asleep or without being fearful to come out? i just can't see this particular boy being told, go sitd up there for five hours and be quieted. i just don't see that happening as hyperactive as he is. >> did the family call will --

>> my understanding and i'm afraid i haven't seen the time line so i'll tell you what i believe to be the case today. our understanding is that the first call was to the faa, and that the second call was made to 9 news with the belief that they had a helicopter that might be able to assist. and some time afterwards they called 911. >> do you find that odd? >> i find it odd you but then as i reflected on it through the course of the evening and knowing where he's coming from as a sxins someone who does things with atmospheric things, the thought that the faa would have some control over the air space over ft. collins airport where this was headed that does seem credible. certainly when somebody calls a sheriff's office and says we think we have a balloon with a 6-year-old in it that's out of

control, really what resources does the sheriff's office or the that police department to have deal with that? in that aspect, i guess it seems credible to perhaps think of who has a helicopter or contacting the federal aviation administration. shortly after he came out and after the media arrived, he was in the process of climbing up there and slowing the media how that occurred. he was just chinning himself up to the bar after climbing on some of the boxes when his dad called him back. so it did seem from watching him that he was just about prepared to swing into the attic. >> how likely is it that the boys, not the parents, you how likely is it the boys might have set this up among the three of them? >> you're talking about a 6, 8 and 10-year-old. that does not seem very likely to me. >> did he characterize this as a

planned event? a planned launch? did he speculate that this was tethered and it mysteriously that -- >> they were planning on doing an sxeermt believed that it was tethered. the intent you was to have it tetheredand to rise 20 feet. and apparently one of the ropes either broke or became loose. that caused the other ropes to become loose. >> so he told you that he had planned some sorted of lift off that day. >> they had planned a lift-off to bring it to 20 feet. that was the whole purpose of the experiment yesterday. i'm sorry. if we could do one at a time it would be much more production tifr. >> the sheriff's detectives, will they interview the children separately? or you how will that work? >> we're still in the course of putting that together and we need to contact the family and

see if they'll even consent to an interview. let me say this to maybe satisfy some concerns. when he came out yesterday, he immediately, the family went nuts hugging, kissing, crying, and immediately, our investigators asked for permission to take the boy upstairs and interview him. gave the parents the opportunity to be present and they said no fine, go ahead and do it. so our two investigators interviewed him outside the presence of the parents. and i don't know at this stage of the game you how productive it would be to pursue interviews with him but we're having that dialogue today. we've had a lot of questions about the cost of the search effort and frankly we don't have a handle on that yet. we roughly came up with just on the larimer county side, probably 80 personnel involved.

i heard that shouteding. i didn't come out you because i thought he would yell at me and thought i would get in trouble. this started when his brother said he saw the little 6-year-old climb inside the balloon before it took off yesterday morning. police middle helicopters were tracking this balloon for 50 miles. cameras were rolling when the balloon finally came down right there in that field. of course, falcon was not inside. about two hours later, to everyone's relief he came out of this hiding place. if you were like a lot of people yesterday, you were on the edge of your seat wondering what in the world happened to this runaway balloon. remember, we thought a 6-year-old boy may have been inside? we'll talk about what you think about that.

colorado man who built the runaway balloon insists this incident was not a hoax. police insist they believe him. larimer county sheriffs say investigators spent the entire ordeal with the parents of

alderden said he's not finished with the investigation he wants to reinterview the family tomorrow. he also beliefs the version's family of events right now. ken lewis will not get any pay this year. nothing. but he's an exception to the rule. this year they were reporting billion dollar profits. that could mean fat paychecks on wall street. poppy, what are you hearing? >> we're in the middle of third quarter earnings season. the news that broke last night and really making headlines today is at the recommendation of president obama agreed to pay back all his earnings for 2009. that's over $1 million. this comes at the bank reports $2.2 billion quarterly loss.

they are still operating on t.a.r.p. funds. sacks goldman sachs, j.p. morgan have paid back their t.a.r.p. money. there's no restrictions there. we asked their top ceos what do they have to say about compensation, what's right and what is not. take a listen to what they told us. >> well, look the mistakes we made were in the way we rewarded our people. too many of our companies in this business reward people on a very short term basis. the one thing we can do is make sure our compensation is focused on a much long term basis versus short term. >> reporter: to be fair, morgan stanley is doing that. they have installed claw backs for for the next three years out, if it's too risky and the firm loses money they can claw back that compensation. we also talked to goldman sachs, the ceo this morning. asked him about compensation in

the long term and what might need to change. here's what he said. >> we're going to have to get the compensation system more aligned and of course whatever system we had in place which i thought was pretty good we'll tighten up. if you ask me would i have change it earlier had i had this kind of wisdom of course i would have. so the answer is there's room for changes. but, again i think this focus on compensation -- look, the incentive system matters. at the end of the day the failure here, the key failure not the only one but if i had to focus on a key failure, it was the failure of risk management. >> reporter: of course, a lack of risk management really got us to where we are now. as for the compensation portion of this, pay czar ken feinberg will be making compensation recommendations. that only applies to firms that have not yet paid back t.a.r.p.

doesn't think so. he says at this time there's no indication the heene family planned yesterday's wild balloon flight. 24 hours ago we were anxiously tracking the runaway helium balloon thinking the worse that a 6-year-old boy from colorado was on board. turns out falcon was at home hiding in the attic and afterwards he started having a good time. you can see there. today the investigation continues. police have cell phone the family. they hope the interview them again tomorrow. that's after watching a cnn interview last night, in this interview, falcon made a confusing reference about doing something for a show but it does not turn out -- if it does turn out it was a stunt the county will seek restitution for the massive rescue effort. >> we were convinced yesterday -- let me back up. we were convinced yesterday after talking to the parents and having investigators on scene during the duration of this event that the parents were

this baby has a bump on the head. that's it. show it to you again. you can't believe what you're seeing. officials say the stroller's safety restraint probably saved the baby's life. the stroller was found in pieces. three missing hikers have been found. they were stranded on a legislate above a waterfall. park helicopters spotted the san bernardino police officer and his two fellow hikers. they were on the live for three days. they lit a fire so they would be seen. they survived by rationing what little food they had. how about that. ate story that kept people glued to the tv set for hours as folks talked. a little boy trapped in some sort of runaway balloon. now that we know he's safe still questions about what actually happened. what we're saying about that next.

news outlooks carried the story t-shirts and mugs and all kinds of stuff. more than 6,000 items were posted on one site alone by this morning. it's been an upbeat week as wall street saw the dow recapture the 10,000 point mark for the first time in more than a year but the rally fade today. tell us why, alison? >> well, it was all about earnings today as two dow components bucked the trend of the better than expected results we've been seeing this week. the blue chips were in the red for the entire session, losing more than 120 points at their lowest level. at the close stocks broke through the 10000 level again but this time it was to the down side which is barely. the dow industrials fell 6 points ending at 9995. the nasdaq and s&p 500 were down a fraction.

>> no. no way to turn it. >> doesn't know,000 land it or anything? >> no. no. it's supposed to be in the backyard. >> yes. >> okay. hang on just a second. don't hang up. >> sir, we already contacted the faa. they are aware of it. i'll go ahead ahead and call the loveland airport and let them know as well. okay? >> that 911 call was actually the third call the family made. first they called the faa. then the sheriff says a second call was to a tv news station. the family said they did that because the news station had a helicopter and they thought that that could help track the balloon. well the judge in a casey anthony murder trial rejected a motion to drop the first degree murder and aggravated child abuse charges against her. her lawyers presented their arguments during a hearing this

morning. anthony's defense team and prosecutors went back end forth over the evidence. casey anthony has pleaded not guilty in the case of her daughter's death. the state is seeking the death penalty. federal budget deficit may be starting to feel the effects of the so-called great recession. the government says the deficit is now at an all time high of $1.42 trillion. that's more than triple the budget deficit last year. explains the loss of tax revenues and massive spending to stabilize the economy. washington needs a plan for dealing with the deficit once the country puts the recession behind. that's something just in to hln. first potential cases of u.s. cases of h1n1 in swine. pigs in a minnesota state fair may have tested positive for it in a preliminary test.

officials at the agriculture department want to be clear further tests still need to be done to confirm that the h1n1 virus was found in pigs. they said the pigs did not show signs ever sickness and may have been exposed to a grouch kids that contracted the h1n1 virus. they did not say how many pigs have tested positive may have tested positive. more test is under way right now. results should be available in a matter of days. i could not exactly have been air sickness because he never really ever was in the balloon. that fact aside falcon heene had some rather upsetting moments on live tv this morning.

the heene family has released a home video they say shows the balloon lifting off from their backyard that unexpectedly, you'll see that it starts to fly away. look at this. >> whoa. >> oh, my god. okay. tether. >> i'll get it. >> and it would be five hours before falcon was found safe and sound and he had been in the garage. . since the whole balloon story unfolded yesterday, falcon heene has been on countless tv programs. this morning maybe it just got to him. he is just a child. he walked out of this interview right here. this is on abc. he got sick off camera. then live on nbc during an interview he got sick while he was on camera. and his dad just carried on with

the interview. well no more tlc for jon gosselin the network that broadcast jon and kate plus eight. they are suing him for breach of contract. they said he hasn't met his obligations. they said he appeared on other shows for pay and revealed unauthorized details about the show. gosselin's attorney released a statement about this. he called the allegations feeble and baseless and contract unenforcible and unconscionable. there's the back and forth. crews have spotted debris and an oil slick off the south carolina coast. they are searching for a missing fighter pilot. two f-16s collided during training exercises last night. one jet landed safely. the coast guard and navy are hoping to find the pilot and other plane. the air force has been doing tests at night so pilots can train with night vision equipment.

with them. >> okay. what are in the neighborhood saying? >> i think they are surprised. people are all pleased, of course he was found safe. and that's you know that's way know. >> okay. let's -- let me ask you the question, bob, we're not going to beat around the bush here. there are people you've heard it thinking speculating possible hoax here. your thoughts knowing this family, again no stranger to the camera but seeing their emotions yesterday, what is your take on this, bob? >> it's not a hoax i don't believe. i was heading for an appointment this morning -- yesterday morning late and i heard some commotion in the backyard as i was leaving to take something out to it my truck, i noticed over the fence that there was a lot of consternation and they were upset about something. and -- and the mother particularly was distraught. and there was no one to act for

>> okay. there you have it. bob, i'll ask you because that's what has people suspicious. when you heard that "do it for the show" did you get suspicious at all? >> uh no. it's a 6-year-old. he was probably confused. that doesn't play for me. >> okay. let's bring in mike brooks, investigator has done interviews and listened to them. mike when you heard that, what were your thoughts? >> you know, yeah, he is a kid but where does he pick this up? does he just make this up himself? what bothered me, mike, as an investigator then wolf just following up on the question asked the father well, what does he mean by that and then he gets, look you know he's outraged wolf would you know, have the audacity to ask him about that question. i don't think so and i think the sheriff, we heard from the sheriff today, they are going to go back and talk to the family too even though the sheriff doesn't think that this was any kind of hoax that it was real. one of the other problems i have with this, mike. the father was right there when this balloon took off. we're not talking in the middle of a field we're talking in a

backyard, you saw not that large of an area. and, he built the thing. does he know if there's a compartment there? we heard about a box. i don't see any box on the bottom of this whatever you want to call it. when it takes off out of the yard. you know then the father he calls the faa and a local tv station, hmmm before he calls 911. help me understand that one. >> you mentioned the sheriff. and let's make it clear at this point the sheriff, taking this as a real incident, an accident, if you will, that the little guy, little falcon was hiding. let's listen to the sheriff today. >> we feel it's incumbent upon us as an agency to go back to the family and attempt to reinterview them and establish whether this is in fact, a hoax or if it's a actual event. we believe, at this time that it's a real event. certainly, people are free to speculate. they're free to be skeptical

many 6-year-olds do you know would sit in a box three hours not coming out. i don't know any. >> let's clarify that. i don't know if he was in a box. mike brooks i believe he was just in the attic, not in a box but still a pretty active 6-year-old to be in the attic three hours. >> so hard to buy. >> good point there. bob licko neighbor obviously siding with the family and doesn't believe this was a hoax and saw their emotion. bob, about that attention seeking, have you talked to them about that? have they been open about hey we are pitching a reality show? what can you tell us about that? >> well, i knew when they did the "wife swap" series the two different programs. and he's put together some science programs trying to get them and maybe some of them have been on cable tv before. so, i can't deny that -- that he's a bit of an attention seeker. >> did you ever ask him about

stacey, you see that, you see mom in there, the two brothers kind of look both ways at the parents? what's your read on that? >> you know, i had a couple reactions to that. first of all, the boy sounds completely honest and sincere when he comes out with that. kids are not good liars. they usually reveal it by moving around too much or touching their face. this kid sounds sincere and the parents' reaction really startled me because they reacted in a way like, uh-oh and made me think that boy revealed something he wasn't supposed to share. >> and the father is so outraged, mike you know what was he doing this morning? right back on the morning shows again. >> yeah. >> the poor boy gets sick on national tv like that. as an investigator obviously a difference of opinion for folks out there. >> sure. >> how do you investigate this to really figure out whether it was a real event or not. >> yesterday, i said when all this was ongoing you need to get the parents separate them you know finds out exactly where they were talk to the brothers. well apparently law enforcement did take falcon take him

upstairs and talk to him away from the parents yesterday. so, you know they probably got a pretty good idea of what the real story was. but now after this comment, law enforcement says they want to go back out and talk to them again. you know even though the sheriff, we're seeing he believes, because of the emotions and the investigators who were on the scene yesterday thought that this was a real event just because of the emotions of the parents. but, you need to go back out and do the same thing again, sit down, say, okay, falcon you know, here's what you said the other day. what did you really mean by that? because, wolf tried to push that yesterday but the father went no, no you're not going to ask him again. >> consistently angry we'll say that. elizabeth in texas go ahead. >> caller: i think the nutty professor needs to be investigated by the faa when he was on "wife swap" he was verbally abusive to his guest and i think he's a tool better known as a douche bag. >> whoa. we know how elizabeth feels. here's a facebook comment from

did she interact with george and cindy at all? tell us about it. >> reporter: when she first came in she did smile briefly at her parents but throughout most of the hearing today she was staring straight forward with a pen in her hand take something notes. the judge kind of made a joke during the hearing at one point and she did chuckle a little bit. i saw a lot of the cameras captured the snapshot of her smiling but really for the most part took straight forward, took some notes and rel didn't say much during the hearing. >> how about george and cindy? ? >> reporter: i saw them outside before i went in. they looked like they were smiling, talking with some of the reporters and some of the national news media guys there. didn't seem to be too distraught. i saw that cindy had a thing of tissues in her hand. i couldn't see from were i was sitting what they were doing but they usually get emotional these hearings. >> is there a lot coaching telling casey how to act,

whether to laugh or not a huge part of what's going on now? >> it could be. on these high-profile cases and i've had quite a few of these high-profile cases you don't want your client to act inappropriately or something they do to be taken as inappropriate. so, it's very difficult, a fine line to walk in terms of what you -- how you want them to act or not act so it's a tough thing to do to say hey, listen, don't smile, don't laugh look sullen. you know i don't know how much coaching is going on. i doubt there's a lot of it but i'm sure they're saying don't go off the boat. you know something like that but i don't think a ton of coaching is going on. >> the legal stuff, bradford we knew the criminal charges wouldn't be dropped. why would baez and his team waste their breath and everything asking? >> i think they are setting up any kind of possible appeal trying to exhaust every avenue. you know it's filed on a 3.910. we call it a c-4 -- so that's why we call it a c-4 motion if you see some tv on that. and the reason why he would file

it is because he felt, i think, to put it out there in the -- in the public eye how innocent she really is, you know put some facts there they don't have anything in regards to how the child died or how she was -- what they're saying that she was murdered. they don't have those facts. so you put that in a motion and let it float out there and maybe can turn some public opinion. >> drew we're also gathering from the defense they have evidence to clear casey. what evidence? do you have any inkling at all? >> they haven't said. what i can gather, they are just going to use the crime scene. you know that stuff is so scientific when it comes down to it with experts dissecting each thing that they found at the crime scene and, you know, when first reviewed by state experts, they say the remains were there for months before --

welcome back. terrifying new video here, a mom takes her eyes off her baby for a split second then the most horrifying thing. mom's at a train station her six-months-old strapped in the stroller n. that split second the stroller starts to roll towards the end and goes over the negligence fronts of the

oncoming train. hard to watch what happened next. here dean felton from 7 network in australia. >> a young mother arrives in ashburton station. in the windy weather fusses with the child and even pulls the program from the edge of the platform but doesn't apply the brake. in a split second her six-months-old boy rolls off the platform into the path of the train. >> the baby somehow managed to escape with just a cut to the forehead we're told an absolute miracle. >> the city-bound train comes to a stop 307 meters further along the tracks. the baby underneath shielded only by the pram. mother and child taken to the hospital but released soon afterwards. shaken but unhurt. police say the mother did nothing wrong. workers back at the scene find the pram in pieces and belongings scattered as far along as the second carriage. signage and supervision on

platforms are said to be adequate but this is a startling reminder how easily tragedies can happen. >> -- especially with toddlers they tend to wander off especially with multiple kids as well. >> the day after the launch of a public awareness campaign warning of the danger of prams on platforms. dean felton, 7 news. >> wow, thank fleef the little one is okay. this tragedy did not end so well. two people dead at a sweat lodge in arizona. this case now treated as a homicide investigation. more than 50 people packed into a cramped sauna-like structure last week. it doesn't even begin to tell how hot it was in there. they spent hours in trying to get spiritual cleaning. these people paid nine ten grand to attend this retreat, not cheap yet 19 had to go to the hospital. one person still in critical condition.

two people died we know that james shore age 40 and 38-year-old kirby brown as well avid surfer, hiker, in top shape. let's get more on. this joining me to talk about this tom mcfeeley kirby brown's cousin welcome back and gary former prosecutor -- he's not with us. we'll hope to get to gary in a moment first, tom as this is moving forward and you are now hearing homicide investigation what are authorities telling you as to why they are labeling it as such now? >> well authorities here have been in touch, for sure, and thank you for having me mike. we're in good touch with the authorities. you know, we've heard a lot from other victims and every day and every detail comes another person who gets the courage to good give us a call and tell us what really happened in that lodge and furthermore what happened the entire week that led up to that because we believe that's as important. so, we know something criminal happened in there. we know our kirby was murdered.

anyone who knew kirby the second they heard it it was such a triteful accident knew this had to be an act beyond her control. >> let's listen to the sheriff steve waugh, basically talking about that those who ran this who organized this sweat lodge should have known it could be dangerous. let's listen. >> i don't know if they knew that people would be killed, but based upon some information that we have is that people have become very sick in these activities before and as a result, they should have had some pre-information about preparing for certain kinds fof uh, human responses to being in a building with no ventilation and heat. >> gary as you listen to that, that people have been sick before at a james ray sweat lodge, is that the key opening here as to why we're calling it now or labeling it a homicide

investigation? >> well, it's part of the investigation is to find out if, in fact mr. ray and his company were, what they call criminally negligent in the death of these two individuals. what they are going to have to do look at how much did they know and the other issue is what they could have done to prevent this. clearly, did they ignore the dangers here? and, you know tom was mentioning they'll be looking into everything they did before. were these people already exhausted and dehydrated before they went into the sweat lodge. what kind of things were set up to make sure these people were healthy enough to endure 50 people in a room of high heat and what set-up for an emergency situation? how were people mon toymonitored? a lot of this will be looked into. the issue will be whether or not they so disregarded the dangers it is considered criminally negligent homicide. >> how important that they had some sort of a release form signed and people knew going in things can get dangerous? >> yes, absolutely. of course, if -- the defense, mr. ray, will say everyone was

welcome back. now our first glimpse of the horrific last days of anna nicole smith's life. one time supermodel reportedly so weak couldn't get out of bed reduced to drinking medialyte out of a baby bottle. lying in her own feces hearing that as well a detective investigating the case for years gave that disgusting account. we know howard k.stern, her lawyer slash boyfriend and two doctors charged in conspiracy in her death we want to know how people so close to her could let it happen or get to this point. russell, getting this account here, a sad account of final days how indicting is that against stern and the two doctors and how could it impact the case? >> definitely a sad account and will have an impact. this judge is hearing evidence that will determine whether this case goes to trial. that's what the preliminary hearing is for. so, the more gruesome evidence he hears and the more evidence

he hears the doctors and howard k.stern contributing to anna nicole's smith's drug use will be damaging and could lead to this going forward in the criminal process. >> i hear this as a human being and thinking, all right stern at least a boyfriend at at one time we thought and doctors supposed friends, as well. how could you let that happen? is that the way you go with this? or we're still -- have to prove the state has to prove the illegality of these drugs in her system and near her they got for her, right? >> right a couple things going on here. remember two sets of defendants, howard k. stern and the two doctors. so, in in some respects he wants to pit himself against those doctors by playing dumb. he wants to say, listen, i'm a lawyer. i'm not a doctor. and so, what these doctors were prescribing, i was just following instructions. but then a judge hears evidence of howard k. stern allegedly lighting up valium and injecting it into anna nicole smith's body

via her bloodstream that doesn't sound like something doctors are recommending. >> no exactly. and this is the video that always sets the table for us when we go after howard k. stern for lack of a better term the clown video. let's show that once again as anna nicole smith is pregnant. she seems out of it if we could get that video up there she is in clown face and howard k. stern is filming this. let's listen to just five seconds of this. >> okay. there it is again. is this something that'll be introduced? is this something that is at the state's disposal or not russell? >> even if it's not introduced i find it hard to believe the judge hasn't seen this. i mean, this is a video that attorney general jerry brown has referenced before as evidence that this is a woman who clearly was on drugs in front of the public eye. so, this video could be very

powerful. but, even if they don't have this video there's lots of other powerful evidence the judge is hearing. >> what's the most powerful, russell? >> these details about anna nicole smith some unfortunate details about having bowel movements in the pool and howard k. stern like i said before injecting volume after lighting it up with a cigarette lighter into her body and evidence of her having infections. i mean the testimony, also about her just being in a depressed state for many months following her son's death. a lot of it paints a picture of a very tragic figure. and then, the people around here, what were they doing? >> what were they doing, right. >> that's what this case is all about. >> we'll talk again in a couple minutes about this. tlc going to war with jon goslin will file a breach of contract against him. you better believe tlc will fight. who is standing on stronger legal grounds? we'll take your calls, 1-877-tell-hln.

before we go further first fitnation dr. sanjay gupta from cnn introduce us to a woman crossing the border to slim down. >> reporter: 10:00 a.m. in san diego and sharon howell was just arriving on a flight from atlanta but not here for vacation, heading sought to tijuana to have laproscopic obesity surgery. >> -- back in the states and the insurance company made it extremely difficult. >> reporter: so, sharon decided to become a medical tourist. >> we all looked up the facility, the physician saw that he was highly credentialed. >> reporter: her experience so far? >> incredible. >> reporter: the price tag, about $6,000, less than a third of the cost in the united states, without insurance. >> it's different economy, different cost structure. insurance costs for the facilities for the doctors. a bunch of different factors that, if you add them up sum up

to lower cost but it does not, in any way affect the standards of quality. >> reporter: but there can be risks when seeking care abroad. so says emory university's dr. john sweeney. >> the issue is the long-term follow-up and continuity of care that is going to be difficult to achieve. >> reporter: also, it is important to research the types of certifications both the hospital and the surgeon hold. and patients should be prepared to pay out of pocket for complications that may arise once they return home. those who receive poor or damaging treatment abroad often have no legal recourse. but sweeney does note just because a hospital is outside u.s. borders doesn't mean it's bad. >> we tend to be very close-minded and not realize that, hey there's countries outside the united states that do this as well as we do or better. >> reporter: as for sharon? she says all the travel has been worth the cost savings. >> i mean, i work in a hospital institution and this is very well run. >> reporter: doctor sanjay gupta, cnn, reporting.

classmates go home kenneth and his 14-year-old sister stephanie, start their journey home. to skid row in downtown los angeles. where there's no escape from reality. kenneth and stephanie live here at the union rescue mission. what would you want people to understand about the struggles of their children? >> well, there are strugglings especially obviously financially like i would kill to have a house and my own room. >> this is my storage area where i keep most of my >> reporter: kenneth stephanie and their father, gordon, live in a tiny 250-square-foot room in the shelter in a special area designated for families with children. they ended up here after gordon who works as a day hire in the entertainment industry lost his apartment about the same time he won custody of his kids, even though kenneth lives in a shelter, he says it's so much better than what life was like before.

the garage. >> now we have what you're seeing here dramatic home video. here's the family shows the terrifying moments as the balloon took off. again, we now know little falcon heene was never in that balloon. the family, no stranger to the camera here. not only yesterday, but prior to that. they've been on abc's reality show "wife swap" twice. now many people are wondering was this all a hoax? we'll take your calls, 1-877-tell-hln. joining me to talk about it bob licko, a neighbor of the heene family. also with us psychotherapist stacey kaiser and mike brooks law enforcement analyst. call in, 1-877-tell-hln. bob, let me start with you. you're there at ground zero. have you talked to the family? >> no, i haven't talked to them. i said hello to them this morning at the house briefly right after the -- a live interview for the "today" show. other than that, i haven't spoken with them. >> what are people in the neighborhood saying? >> well i think people are

surprised. people are all pleased of course that he was found safe. that's what i know. >> let's -- let me ask you the question, we're not going to beat around the bush here. there are people, you heard it thinking speculating possible hoax here. your thoughts? knowing this family. again, no stranger to the camera. but seeing their emotions yesterday. what's your take on all this bob? >> it's not a hoax, i don't believe. i was heading for an appointment this morning -- yesterday morning late. and i heard some commotion in the backyard. as i was leaving to take something out to my truck, i noticed there was a fence that there was a lot of con consternation, and they were upset about something. the mother particularly was distraught. and there was no one to act for at that point. it was real.

this is not a hoax. >> okay. so the emotion that's what's telling you, the emotion you saw was not fake? >> no. it was genuine. >> okay. leslie let's get the sheriff ready. we're talking about the sheriff and we'll also hear from falcon himself. first let's listen to falcon. this has really what spurred on the talk of it possibly being a hoax. the heene family was on larry king last night. and little falcon spoke talking about why he wouldn't come out when he heard his name called. let's listen to that. >> falcon did you hear us calling your name at any time? >> mm-hmm. >> you did? >> you did? >> why didn't you come out? >> um i said we did this for a show. >> no. >> okay. there you have it. bob, i'll ask you, because

that's what has people suspicious. when you heard that, do it for the show did you get suspicious at all? >> no. it's a 6-year-old. he was probably confused. that doesn't play for me. >> let's bring in mike brooks, investigator, has done interviews listened to interviews. mike, when you heard that what were your thoughts? >> he is a kid, but where does he pick this up? does he just make this up himself? you know, what bothered me, mike, as an investigator, just following up on the question, wolf asked the father what does he mean by that? he gets -- he's outraged that wolf would you know, have the audacity to ask him about that question. i don't think so. i think the sheriff and we heard from the sheriff today, they're going to go back and talk to the family too. even though the sheriff doesn't think that this was any kind of hoax, that it was real. but one of the other problems i have with this mike. the father was right there when this balloon took off. we're not talking in the middle of a field. we're talking in a backyard. you saw, it's not that large of an area.

he built the thing. does he know if there's a compartment there? i don't see any box on the bottom of this, whatever you want to call it. when it takes off out of the yard. you know then the father he calls the faa and a local tv station. hmm, before he calls 911. help me understand that one. >> okay. you mentioned the sheriff. let's make it clear at this point the sheriff, they're taking this as a real incident an accident, if you will that the little falcon was hiding. let's listen to the sheriff today. >> we feel its "incumbent upon us as an agency to go back to the family and attempt to re-interview them and establish whether this is in fact a hoax or if it's actually an event. we believe at this time that it's a real event. certainly people are free to speculate. they're free to be skeptical about it.

the suggestion this is somewhat of a setup or a hoax as mentioned, he seems to be getting more and more angry about it. we're finding out that this family's been on a reality show "wife swap" twice. he and his family have pitched a reality show. we know tlc, we got their comment and here's what tlc says, they approached us months ago and we passed on that. also pitched i believe to a couple of other reality show production companies. let's bring in our psychotherapist, stave si kaiser. from what you're hearing, you hear these interviews, see the dad's reaction hoax or not? >> i'm on the hoax bandwagon. they have patterns of behavior. this family is clearly dramatic and attention-seeking based on their storm chasing, based on the fact that they chose a reality show like "wife swap's" to be on. how many 6-year-olds would you know would sit in a box for

three hours without coming out? i don't know any. >> i don't know if he was in a box, mike brooks. i believe he was just in the attic, not in a box. still, he's a pretty active 6-year-old to be up there for three hours. >> still hard to buy. >> good point there. bob licko, a neighbor he's obviously siding with the heene family, does not believe this is a hoax saw their emotion. bob, about that attention-seeking, have you talked to them about that? have they been open about, hey, we're pitching a reality show? what can you tell us about that? >> well, i knew when they did the "wife swap" series, the two different programs, and he's put together some science programs trying to get them, and maybe some of them have been on cable tv before. so i can't deny that he's a bit of a -- an attention-seeker. >> did you ever ask him about the reality show?

like richard, how do you guys put yourselves out there like that? not once but twice. have you had that conversation? >> i haven't asked that kind of question, no. >> okay. well let's -- stacey i'd like to listen to falcon again with wolf blitzer last night. have you listened to it as well is this as we watch it, and listen to it again, what you might pick up on to tell you i'm guessing you're thinking hoax here. but let's watch that again. this is falcon last night talking with wolf blitzer on "larry king live." let's listen. >> falcon, did you hear us calling your name at any time? >> mm-hmm. >> you did? >> you did? >> why didn't you come out? >> um i said that we did this for a show. >> man. >> no. >> stacey you see that. you see mom in there the two

brothers kind of look both ways at the parents. what's your read on that? >> first of all, the boy sounds completely honest and sincere when he comes out with that. kids are not good liars. they usually reveal it by moving around too much or touching their face. this kid sounds sincere. and the parents' reaction really startled me, because they reacted in a way like, uh-oh. that made me think that boy had revealed something he wasn't supposed to share. >> the father is so outraged, mike, that -- what was he doing this morning? right back on the morning shows again. you know? the boy got sick. >> got sick on national tv like that. mike, as an investigator, we've obviously got a difference of opinion for folks out there. how do you investigate this? to really figure out whether it was a real event or not? >> yesterday i said when all this was ongoing you need to get the parents, separate them, find out exactly where they were, talk to the brothers. apparently law enforcement did take falcon take him upstairs and talk to him away from the parents yesterday.

so they probably got a pretty good idea of what the real story was. now after this comment law enforcement says they want to go back out and talk to them again. even though the sheriff was saying he believes, because of the emotions and investigators were on the scene yesterday thought that this was a real event. just because of the emotions of the parents. but you need to go back out and do the same thing again, sit down, say okay falcon, you know, here's what you said the other day. what did you really mean by that? because wolf tried to push that yesterday, but the father went no, no you're not going to ask him again. >> he's been consistently angry, i'll say that. elizabeth in texas, elizabeth go ahead. >> caller: i think the nutty professor needs to be investigated by the faa. when he was on "wife swap," he was verbally and physically abusive to his kids. i think he's pr known as a douche bag. >> we know how elizabeth feels. we want to know what you feel, 1-877-tell-hln. a comment from june, writing this. as soon as it was announced that the family was on a reality

did smile briefly at her parents. but throughout most of the hearing today, she was staring straight forward. she was taking some notes. the judge made a comment at one point and she did chuckle. the cameras captured that snapshot of her smiling. she really didn't say much during the hearing. >> how about george and cindy? >> i saw them outside before i went in. they looked about you know they looked like they were smiling. they were talking with some of the reporters and some of the national news media guys there. didn't seem to be too distraught. i did see that cindy had a thing of tissues in her hand. i couldn't really see what she was doing throughout the hearing. they do usually get emotional throughout the hearing. >> bradford is there a lot of coaching here telling casey how to act, not to act whether to laugh or not? is that a huge part of what's going on now? >> you know, it could be. on these high-profile cases, and

i've had quite a few of these high-profile cases where you don't want your client to act inappropriately. so it's difficult to fine line to walk in terms of what you want them, how you want them to act or not act. it's a tough thing to do to say listen, don't smile. don't laugh. you know, look sullen. you know i don't know how much coaching is going on. i doubt there's a lot of it. but i'm sure they're saying, don't go off the boat and start talking, you know something like that. i don't think a ton of coaching is going on. >> bradford we knew the criminal charges wouldn't be dropped. why would baez and his team even waste their breath and time asking? >> i think they're setting up any kind of possible appeal. i think they're trying to exhaust every avenue. you know it's filed on a 3.190. it's subsection c/4. that's why we call it a c/4 motion, if you see something on the tv on that. the reason he would file it is because he felt, i think, to put it out there in the public eye,

how innocent she really is. you know put some facts there. they don't have anything in regards to how the child died. or how she was -- what they're saying she was murdered. they don't have those facts. so you put that in a motion you let it float out there and maybe you can turn some public opinion. >> drew we're also gathering from the defense, they have evidence to clear casey. what evidence? any inkling at all? >> they haven't said. what i can gather, they're just going to use the crime scene -- you know, that stuff is so scientific when it comes down to it. with the experts dissecting each thing they found at the crime scene. you know, when it was first revealed by state experts they said the remains were there for months. >> hey, drew, more after the break. we'll talk about that.
