police say they believe him but they may interview him again along with other family members tomorrow. we'll hear from the sheriff who will have a news conference. we'll carry it live. for more than 24 hours police and the national guard tried to figure out how to capture the runaway helium balloon because they thought a 6 year old was inside. the boy was hiding in the rafters of the family's garage. >> you guys said that we did this for a show. >> the family appeared on the tv network show "today." he became ill twice during an abc interview. he left the room to throw up. on nbc falcon didn't make it out

murder trial filed charges to drop against her. anthony's defense team and prosecutors went back and forth over evidence in the case. casey anthony has pleaded not guilty to charges in her daughter caylee's death. her remains were found close to the anthony home. a judge in jut gets a competence update today for one of elizabeth smart's alleged abductors. smart was abducted from her salt lake city bed when she was 14. she's now 21. her alleged captors have never been tried because they were deemed mentally incompetent. today utah state officials tell the court whether that conditions has changed for wanda barzee. smart testified at mitchell's competency hearing that she was tortured and raped throughout the ordeal. no more tlc for jon gosselin. the network that broadcasts "jon & kate plus 8" is suing gosselin

for breach of contract. he's appeared on other shows for pay and revealed unauthorized details about the show. gosselin's camp hasn't commented. crews are searching for a fighter jet pilot in the atlantic. two f-16 jets collided during a training exercise. one plane landed safely. the air force has been doing tests at night so pilot train with newt vision equipment. civil rights activists are calling for a judge to resign after he wouldn't give a marriage license to an interracial couple. he feels that interracial marriage doesn't last. the groom was angry with the judge's views. >> he's saying 99% of it wind up in divorce. how many people get married and wind up in divorce? white or black? >> the couple went to another justice of the peace and they were finally married.

it's one of the trending topics in twitter. you're looking at a feed posted by boy in the balloon. another popular feed was from somebody calling themselves i am falcon. there were countless real tweets as well. here's a few samples. one said balloon boy played hide-and-seek with a whole country. if i release my parents hot air balloon, i would hide in the attic too and balloon boy trend topic longer den he was fake missing. any time there's a story like this. someone on the internet will try to make a profit or in this case many someones. shortly after news outlets began carrying this story, t-shirts went up for sale and then mugs hats and other products added to the mix. more than 6,000 items were posted on one site alone by this morning. if you're a book lover, here's good news in a bad economy. there's a price war raging among online book sellers. walmart.com is getting in the

ten honorees. >> disabled children are really the forgotten ones in this war. i came to iraq as a civilian contractor. there were a lot of children that either dragged themselves on the ground or have to be carried. there were so many people willing to reach out and touch the lives of these kids. my name is brad blauser. i bring pediatric wheelchairs to iraqi people indeed. the wheelchairs are brought over and i distribute them to the different military units and help fit these children into the wheelchairs. there's no paycheck. it's not really safe here but i made a difference in the life of these families. definitely the sacrifice has been worth it.

pios, victim advocates search and rescue, possie, and in addition to that we had larimer county parks fire authority, fpt ft. collins police the fire authority sent people to help with the media. the united states forest service. we're missing some and i know we had national guard and media helicopters and the county sheriff's office and the adams county sheriff's office. there were a lot of people who put their heart and soul into this and we want to express our gratitude to them. the purpose of the press conference today is really to try to answer everybody's questions at once. we've been being inundated with phone calls and e-mails nonstop. and frankly, we need to somehow put an end to it so we can get about doing our business instead of answering all the media inquiries. hopefully we can resolve some of

those issues today. we really don't have any new information, or a lot of new information. i do want to clarify a couple of things. obviously, yesterday i spoke about us having conducted a very thorough search of the house. obviously, it wasn't as thorough it's a we would have liked it to be because the boy was in fact hiding in the attic in the garage. i would like to explain that so we can get it clear. i think we searched the house three times. guys went into the crawl space they went into the attic, they looked every place except the one place where the boy was hiding. apparently there are some rafters in the garage and part of it is covered part of it isn't. there are no ladders to get into that attic portion. no stairs to get up there. and frankly looking at the debris in the garage, our personnel just didn't think it possible that a 6-year-old boy would be able to get up into that space so they didn't look there. and of course, that is the one

spot where the boy was. also i reported to the media yesterday that the boy was in a box in the attic. that was information that was related to me but it turned out to be erroneous information. as we got the text message, i got a page during the news conference yesterday that the boy had been found, i turned and asked our investigators to contact someone on the scene and verify that. by the time it went through you a couple of levels and the information got back to us i now believe that what was reported was that the boy had crawled on a box and then used that box to get into the attic. miscommunication occurred and i erroneously reported that the boy was in a box. there was not a box. there was a clear attic space that was flat. so hopefully that clears that up. there has been a lot of speculation. a lot of skepticism regarding this incident and whether it could have occurred as it was

reported. we did in fact yesterday during the course of this event, contact a professor at colorado state university with expertise, in determining the payload or the lift that a balloon of this dimension would support. and he informed us and reaffirmed that today, that a balloon of that size filled with helium would in fact handle payload before 80 pounds. we believe that the young boy who was missing was about 37 pounds, so it certainly you was conceivable at the time and remains conceivable today that the boy could have been in this device. i just wanted to say that because a lot of the speculation, a lot of the e-mails i've been getting have come from people reporting or suggesting that the balloon of that dimension would only be able to live five to 15 pounds. so therefore the father had to be lying. and i just wanted to disprove,

that at least based on the experts that we have talked to at colorado state university. the question remains, we were convinced yesterday. let me back up a minute. we were convinced yesterday after talking to the parents and having investigators on scene during the duration of this event, that the parents were being honest with us. they appropriately expressed statements, nonverbal communication, body language, and emotions during this event that were entirely consistent with the events taking place. believe me if the boy was in the aircraft, when it touched down and the boy was not found to be in there, there was a significant deflation i understand, of their emotional state. which our people didn't think could be faked or was being

faked. and again, you throughout the day as the events occurred all of their emotions and nonverbal communication was very consistent with what was taking place. this was as observed by investigators on scene who have some expertise in this particular area. if any of you saw some of the media interviews or activities at the scene immediately after the boy came out it was very evident that this boy is very hyperactive, to say the least. and the suggestion that to us that perhaps this boy had been coached, or coaxed by his parents to hide and remain still in this attic for five hours during the duration of this event just seems inconceivable. it seems much more likely that the boy was in fact frightened because he somehow thought that he was responsible for this device becoming untethered, and

therefore decided to hide. that seems like a very credible story. however, as you all also saw, there was an interview conducted lasted night, i believe by wolf blitz on cnn when he asked why he did this, and he responded we did it for the show or something of that nature. clearly that has raised everybody's level of skeptd six again and we feel it is incumbent upon us as an agency to go back to the family and attempt to reenter you view them to reenter view them and establish whether this is a home. certainly, people are free to speculate. they're free to be skeptical about it. those of us in the law enforcement profession to have operate on facts and what we can prove, not what the public might

morning. anthony's defense team and prosecutors went back end forth over the evidence. casey anthony has pleaded not guilty in the case of her daughter's death. the state is seeking the death penalty. federal budget deficit may be starting to feel the effects of the so-called great recession. the government says the deficit is now at an all time high of $1.42 trillion. that's more than triple the budget deficit last year. explains the loss of tax revenues and massive spending to stabilize the economy. washington needs a plan for dealing with the deficit once the country puts the recession behind. that's something just in to hln. first potential cases of u.s. cases of h1n1 in swine. pigs in a minnesota state fair may have tested positive for it in a preliminary test.

officials at the agriculture department want to be clear further tests still need to be done to confirm that the h1n1 virus was found in pigs. they said the pigs did not show signs ever sickness and may have been exposed to a grouch kids that contracted the h1n1 virus. they did not say how many pigs have tested positive may have tested positive. more test is under way right now. results should be available in a matter of days. i could not exactly have been air sickness because he never really ever was in the balloon. that fact aside falcon heene had some rather upsetting moments on live tv this morning.

the interview. well no more tlc for jon gosselin the network that broadcast jon and kate plus eight. they are suing him for breach of contract. they said he hasn't met his obligations. they said he appeared on other shows for pay and revealed unauthorized details about the show. gosselin's attorney released a statement about this. he called the allegations feeble and baseless and contract unenforcible and unconscionable. there's the back and forth. crews have spotted debris and an oil slick off the south carolina coast. they are searching for a missing fighter pilot. two f-16s collided during training exercises last night. one jet landed safely. the coast guard and navy are hoping to find the pilot and other plane. the air force has been doing tests at night so pilots can train with night vision equipment.

did she interact with george and cindy at all? tell us about it. >> reporter: when she first came in she did smile briefly at her parents but throughout most of the hearing today she was staring straight forward with a pen in her hand take something notes. the judge kind of made a joke during the hearing at one point and she did chuckle a little bit. i saw a lot of the cameras captured the snapshot of her smiling but really for the most part took straight forward, took some notes and rel didn't say much during the hearing. >> how about george and cindy? ? >> reporter: i saw them outside before i went in. they looked like they were smiling, talking with some of the reporters and some of the national news media guys there. didn't seem to be too distraught. i saw that cindy had a thing of tissues in her hand. i couldn't see from were i was sitting what they were doing but they usually get emotional these hearings. >> is there a lot coaching telling casey how to act,

whether to laugh or not a huge part of what's going on now? >> it could be. on these high-profile cases and i've had quite a few of these high-profile cases you don't want your client to act inappropriately or something they do to be taken as inappropriate. so, it's very difficult, a fine line to walk in terms of what you -- how you want them to act or not act so it's a tough thing to do to say hey, listen, don't smile, don't laugh look sullen. you know i don't know how much coaching is going on. i doubt there's a lot of it but i'm sure they're saying don't go off the boat. you know something like that but i don't think a ton of coaching is going on. >> the legal stuff, bradford we knew the criminal charges wouldn't be dropped. why would baez and his team waste their breath and everything asking? >> i think they are setting up any kind of possible appeal trying to exhaust every avenue. you know it's filed on a 3.910. we call it a c-4 -- so that's why we call it a c-4 motion if you see some tv on that. and the reason why he would file

investigation? >> well, it's part of the investigation is to find out if, in fact mr. ray and his company were, what they call criminally negligent in the death of these two individuals. what they are going to have to do look at how much did they know and the other issue is what they could have done to prevent this. clearly, did they ignore the dangers here? and, you know tom was mentioning they'll be looking into everything they did before. were these people already exhausted and dehydrated before they went into the sweat lodge. what kind of things were set up to make sure these people were healthy enough to endure 50 people in a room of high heat and what set-up for an emergency situation? how were people mon toymonitored? a lot of this will be looked into. the issue will be whether or not they so disregarded the dangers it is considered criminally negligent homicide. >> how important that they had some sort of a release form signed and people knew going in things can get dangerous? >> yes, absolutely. of course, if -- the defense, mr. ray, will say everyone was

welcome back. now our first glimpse of the horrific last days of anna nicole smith's life. one time supermodel reportedly so weak couldn't get out of bed reduced to drinking medialyte out of a baby bottle. lying in her own feces hearing that as well a detective investigating the case for years gave that disgusting account. we know howard k.stern, her lawyer slash boyfriend and two doctors charged in conspiracy in her death we want to know how people so close to her could let it happen or get to this point. russell, getting this account here, a sad account of final days how indicting is that against stern and the two doctors and how could it impact the case? >> definitely a sad account and will have an impact. this judge is hearing evidence that will determine whether this case goes to trial. that's what the preliminary hearing is for. so, the more gruesome evidence he hears and the more evidence

he hears the doctors and howard k.stern contributing to anna nicole's smith's drug use will be damaging and could lead to this going forward in the criminal process. >> i hear this as a human being and thinking, all right stern at least a boyfriend at at one time we thought and doctors supposed friends, as well. how could you let that happen? is that the way you go with this? or we're still -- have to prove the state has to prove the illegality of these drugs in her system and near her they got for her, right? >> right a couple things going on here. remember two sets of defendants, howard k. stern and the two doctors. so, in in some respects he wants to pit himself against those doctors by playing dumb. he wants to say, listen, i'm a lawyer. i'm not a doctor. and so, what these doctors were prescribing, i was just following instructions. but then a judge hears evidence of howard k. stern allegedly lighting up valium and injecting it into anna nicole smith's body

before we go further first fitnation dr. sanjay gupta from cnn introduce us to a woman crossing the border to slim down. >> reporter: 10:00 a.m. in san diego and sharon howell was just arriving on a flight from atlanta but not here for vacation, heading sought to tijuana to have laproscopic obesity surgery. >> -- back in the states and the insurance company made it extremely difficult. >> reporter: so, sharon decided to become a medical tourist. >> we all looked up the facility, the physician saw that he was highly credentialed. >> reporter: her experience so far? >> incredible. >> reporter: the price tag, about $6,000, less than a third of the cost in the united states, without insurance. >> it's different economy, different cost structure. insurance costs for the facilities for the doctors. a bunch of different factors that, if you add them up sum up

classmates go home kenneth and his 14-year-old sister stephanie, start their journey home. to skid row in downtown los angeles. where there's no escape from reality. kenneth and stephanie live here at the union rescue mission. what would you want people to understand about the struggles of their children? >> well, there are strugglings especially obviously financially like i would kill to have a house and my own room. >> this is my storage area where i keep most of my >> reporter: kenneth stephanie and their father, gordon, live in a tiny 250-square-foot room in the shelter in a special area designated for families with children. they ended up here after gordon who works as a day hire in the entertainment industry lost his apartment about the same time he won custody of his kids, even though kenneth lives in a shelter, he says it's so much better than what life was like before.

surprised. people are all pleased of course that he was found safe. that's what i know. >> let's -- let me ask you the question, we're not going to beat around the bush here. there are people, you heard it thinking speculating possible hoax here. your thoughts? knowing this family. again, no stranger to the camera. but seeing their emotions yesterday. what's your take on all this bob? >> it's not a hoax, i don't believe. i was heading for an appointment this morning -- yesterday morning late. and i heard some commotion in the backyard. as i was leaving to take something out to my truck, i noticed there was a fence that there was a lot of con consternation, and they were upset about something. the mother particularly was distraught. and there was no one to act for at that point. it was real.

that's what has people suspicious. when you heard that, do it for the show did you get suspicious at all? >> no. it's a 6-year-old. he was probably confused. that doesn't play for me. >> let's bring in mike brooks, investigator, has done interviews listened to interviews. mike, when you heard that what were your thoughts? >> he is a kid, but where does he pick this up? does he just make this up himself? you know, what bothered me, mike, as an investigator, just following up on the question, wolf asked the father what does he mean by that? he gets -- he's outraged that wolf would you know, have the audacity to ask him about that question. i don't think so. i think the sheriff and we heard from the sheriff today, they're going to go back and talk to the family too. even though the sheriff doesn't think that this was any kind of hoax, that it was real. but one of the other problems i have with this mike. the father was right there when this balloon took off. we're not talking in the middle of a field. we're talking in a backyard. you saw, it's not that large of an area.

he built the thing. does he know if there's a compartment there? i don't see any box on the bottom of this, whatever you want to call it. when it takes off out of the yard. you know then the father he calls the faa and a local tv station. hmm, before he calls 911. help me understand that one. >> okay. you mentioned the sheriff. let's make it clear at this point the sheriff, they're taking this as a real incident an accident, if you will that the little falcon was hiding. let's listen to the sheriff today. >> we feel its "incumbent upon us as an agency to go back to the family and attempt to re-interview them and establish whether this is in fact a hoax or if it's actually an event. we believe at this time that it's a real event. certainly people are free to speculate. they're free to be skeptical about it.

the suggestion this is somewhat of a setup or a hoax as mentioned, he seems to be getting more and more angry about it. we're finding out that this family's been on a reality show "wife swap" twice. he and his family have pitched a reality show. we know tlc, we got their comment and here's what tlc says, they approached us months ago and we passed on that. also pitched i believe to a couple of other reality show production companies. let's bring in our psychotherapist, stave si kaiser. from what you're hearing, you hear these interviews, see the dad's reaction hoax or not? >> i'm on the hoax bandwagon. they have patterns of behavior. this family is clearly dramatic and attention-seeking based on their storm chasing, based on the fact that they chose a reality show like "wife swap's" to be on. how many 6-year-olds would you know would sit in a box for

three hours without coming out? i don't know any. >> i don't know if he was in a box, mike brooks. i believe he was just in the attic, not in a box. still, he's a pretty active 6-year-old to be up there for three hours. >> still hard to buy. >> good point there. bob licko, a neighbor he's obviously siding with the heene family, does not believe this is a hoax saw their emotion. bob, about that attention-seeking, have you talked to them about that? have they been open about, hey, we're pitching a reality show? what can you tell us about that? >> well, i knew when they did the "wife swap" series, the two different programs, and he's put together some science programs trying to get them, and maybe some of them have been on cable tv before. so i can't deny that he's a bit of a -- an attention-seeker. >> did you ever ask him about the reality show?

brothers kind of look both ways at the parents. what's your read on that? >> first of all, the boy sounds completely honest and sincere when he comes out with that. kids are not good liars. they usually reveal it by moving around too much or touching their face. this kid sounds sincere. and the parents' reaction really startled me, because they reacted in a way like, uh-oh. that made me think that boy had revealed something he wasn't supposed to share. >> the father is so outraged, mike, that -- what was he doing this morning? right back on the morning shows again. you know? the boy got sick. >> got sick on national tv like that. mike, as an investigator, we've obviously got a difference of opinion for folks out there. how do you investigate this? to really figure out whether it was a real event or not? >> yesterday i said when all this was ongoing you need to get the parents, separate them, find out exactly where they were, talk to the brothers. apparently law enforcement did take falcon take him upstairs and talk to him away from the parents yesterday.

so they probably got a pretty good idea of what the real story was. now after this comment law enforcement says they want to go back out and talk to them again. even though the sheriff was saying he believes, because of the emotions and investigators were on the scene yesterday thought that this was a real event. just because of the emotions of the parents. but you need to go back out and do the same thing again, sit down, say okay falcon, you know, here's what you said the other day. what did you really mean by that? because wolf tried to push that yesterday, but the father went no, no you're not going to ask him again. >> he's been consistently angry, i'll say that. elizabeth in texas, elizabeth go ahead. >> caller: i think the nutty professor needs to be investigated by the faa. when he was on "wife swap," he was verbally and physically abusive to his kids. i think he's pr known as a douche bag. >> we know how elizabeth feels. we want to know what you feel, 1-877-tell-hln. a comment from june, writing this. as soon as it was announced that the family was on a reality

did smile briefly at her parents. but throughout most of the hearing today, she was staring straight forward. she was taking some notes. the judge made a comment at one point and she did chuckle. the cameras captured that snapshot of her smiling. she really didn't say much during the hearing. >> how about george and cindy? >> i saw them outside before i went in. they looked about you know they looked like they were smiling. they were talking with some of the reporters and some of the national news media guys there. didn't seem to be too distraught. i did see that cindy had a thing of tissues in her hand. i couldn't really see what she was doing throughout the hearing. they do usually get emotional throughout the hearing. >> bradford is there a lot of coaching here telling casey how to act, not to act whether to laugh or not? is that a huge part of what's going on now? >> you know, it could be. on these high-profile cases, and

i've had quite a few of these high-profile cases where you don't want your client to act inappropriately. so it's difficult to fine line to walk in terms of what you want them, how you want them to act or not act. it's a tough thing to do to say listen, don't smile. don't laugh. you know, look sullen. you know i don't know how much coaching is going on. i doubt there's a lot of it. but i'm sure they're saying, don't go off the boat and start talking, you know something like that. i don't think a ton of coaching is going on. >> bradford we knew the criminal charges wouldn't be dropped. why would baez and his team even waste their breath and time asking? >> i think they're setting up any kind of possible appeal. i think they're trying to exhaust every avenue. you know it's filed on a 3.190. it's subsection c/4. that's why we call it a c/4 motion, if you see something on the tv on that. the reason he would file it is because he felt, i think, to put it out there in the public eye,

how innocent she really is. you know put some facts there. they don't have anything in regards to how the child died. or how she was -- what they're saying she was murdered. they don't have those facts. so you put that in a motion you let it float out there and maybe you can turn some public opinion. >> drew we're also gathering from the defense, they have evidence to clear casey. what evidence? any inkling at all? >> they haven't said. what i can gather, they're just going to use the crime scene -- you know, that stuff is so scientific when it comes down to it. with the experts dissecting each thing they found at the crime scene. you know, when it was first revealed by state experts they said the remains were there for months. >> hey, drew, more after the break. we'll talk about that.
