richard heene supposedly wanted to star in a reality tv show. nothing's more real than possibly going to jail. the federal aviation administration confirms it is also investigating last week's runaway balloon stunt.
2:06 pm
authorities were led to believe heene's 6-year-old son had flown away in that homemade jiffy pop looking thing. turns out the boy was never on. the heenes may have violated federal regulations barring people from flying balloons or kites within five miles of an airport. that balloon affected flights at denver international airport. so serious folks. in addition to the federal probe, the county sheriff says felony charges will likely be filed against richard and mayumi heene next week. john travolta's blackmail case in the bahamas could go to the jury as early as today. yesterday the prosecutor said the ambulance driver demanded money from the actor in exchange for a signed medical liability form. the defense called only one witness, an emt who was not at

the vacation home when 16-year-old jett died. the judge is expected to instruct the jury after the defense presents its closing today. some of your friends on twitter, facebook, some of the other social networking sites could be criminals in disguise. the fbi says cyber crooks are trolling the sites and hijacking people's profiles. you might get a message from someone posing as your friend asking them to wire you money or criminals might lure you to an official-looking site that tricks you into revealing passwords and some more of your private business. the fbi's advice always double-checks these sorts of requests in person. if your friend wants money tell them to ask you to your face. only the most energy efficient appliances are supposed to get the energy star label. that's not always what happens, though. allison is in the cnnmoney.com newsroom in new york. what do people need to know about that rating?
2:08 pm
i gravitate to those things. most people do. >> reporter: exactly. think about it. when we shop for new appliance, it's not just the color or the brand that matter it's that little energy star sticker on the appliances. but problems with the program could wind up undermining that consumer confidence that we have in that little sticker. one red flag is that manufacturers test their own products. so some companies could put stickers on products that don't qualify and it's happened before. the report finds one refrigerator company snitched to the energy department about a competitor, independent testing confirmed that the model in question made by lg electronics actually used double the amount of energy it claimed. to keep this from happening more often, the inspector general is calling for third-party testing of all energy star products and improved oversight by the energy department. >> what else does the energy department have to say? how do we know we can trust any of these labels?
2:09 pm
>> reporter: exactly. the department says it agrees with the report's findings and plans to do more independent testing and policing. it also says when companies misuse the logo, like the refrigerator example that we talked about the department does take action and it says it stands by the program. listen to this. >> there are 60 products that have the energy star logo and we have every bit of confidence when consumer s goshopping and by an energy star product compared to one that doesn't have the logo that it will save them money and help the environment. >> reporter: so the epa says if you buy energy star appliance, they'll wind up paying for themselves within five years and save the average home $75 a year. and we could see a lot more people shopping for them in the coming months thanks to the stimulus bill. $300 million worth of federal rebates will be available on many energy star product, up to $200 rebates on some appliances out there. we'll see if this report gets people to do a little more

homework before they shop. >> thank you for the heads-up. the family of this missing 7-year-old we've been talking about, somer thompson. this is like a bad dream, they say. a massive search is under way in orange park near jacksonville for somer. officials in clay county are something everyone to be on the lookout. the second-grader vanished walking home from school yesterday. officials say she was with other kids. she ran ahead of them. and her grandmother says she can't believe this is happening. listen to this. >> she's just a very very sweet child, very innocent. >> [ inaudible ]. >> everything. it's just been a roller coaster. we keep holding out and hoping that we hear something and someone will let us know. they're not telling us much
2:11 pm
whanchts sort of things did she like? is she a barbie person? >> not really a barbie person. she hangs around inside a lot. she doesn't even play outside very much. >> how's mom doing? >> mom is not doing very well. as each hour goes by she gets less and less hopeful. >> what did she about her dream -- >> she keeps saying that she wished she could wake up and it would have all just been a terrible dream. >> can you put into words your feeling for your granddaughter? >> you know, you think about this and you think, this can't be happening to me this can't be happening to my family. but it is, and it's very hard. that's all i can do. >> that is 7-year-old somer

thompson's grandmother. and this is the number authorities want you to call if you know anything about what has happened to her. she was last seen yesterday after school. the number is 1-877-227-6911. somer thompson. first carrie prejean lost her title as miss california usa. then she sued pageant officials. now they're countersuing. wait until you hear what the suit is demanding and what "showbiz tonight's" brooke anderson is saying about it.

wants not the breast implants back. they want the money back. "showbiz tonight's" brooke anderson is in l.a. all right, brooke. this is actually a countersuit. first of all, missed you while you were gone on maternity leave. happy to see you. >> thank you. let's dive in. my first story back with you richelle, and here we are talking about breast implants. it is a cross complaint. it is 45 pages long. so that is really just indicative of how much intense dislike there is between these two parties. former miss california usa carrie prejean, stripped of her title in june after she made that controversial pageant answer gave that controversial answer to the question on same-sex marriage. say they she was stripped of her title for other reasons, though. now here is this countersuit after carrie prejean had initially basically sued the miss california usa pageant

board for what she says is slander, libel, public disclosure of private facts, emotional distress t list goes on and on. in this cross complaint, they want their boobs back, you know not specifically -- she can keep the breast implants. but they do want the money back that they gave her for the surgery, the production company involved with the board says that it was her idea to get the surgery and they agreed to give her a loan of the money. she agreed to repay them. carrie prejean does not have a statement on this at this time. but, richelle, i don't know what you think. but to me this all seems pretty darn juvenile that they've sunk this low that now they're fighting over breast implants. >> it does seem a bit ridiculous. almost seems like a judge might go tell them both, you all need to go somewhere and work this out and you both need to drop your lawsuits. that's what it seems like this is headed to, to me. i like how you broke it down and
2:17 pm
you stop with the niceties and you just said boobs, good for you. >> richelle, i'm a nursing mother, so i speak freely about them right now. but, yes breast implants is probably the politically correct way to say it. >> no, this story deserves boobs for so many reasons. >> you're right. >> let's talk about george clooney, i don't know if he's just getting older and decides i'm going to put my personal business out there. but he's really opening up, isn't he? >> yeah, just laying it all out there about relationship challenges he's had in the past. >> i will add he seems pretty happy right now with 30-year-old elizabeta. >> i like to look at him too.
2:18 pm
>> who doesn't? >> thanks, brooke.

a recent study finds shocking racial disparities in heart health. african-americans develop heart failure at rates substantially higher than whites. in this week's health minute, melissa long looks at one doctor's creative attempt to reverse that trend. >> reporter: dr. ronnie whitfield isn't your typical physician. when he's not seeing patients he's doing this -- ♪ if you eat healthy there will be less for me to visit ♪ >> reporter: teaching young african-americans about stroke and heart disease. dr. whitfield also known as the hip-hop doc says he's being creative because traditional messages just aren't working and the grim statistics speak to those points.

>> the studio is all they care about -- i shouldn't say that. >> reporter: we'll see what the second weekend looks like. >> another story that's getting a lot of buzz at dot-com is some news related to ptsd. what's going on there? >> reporter: yeah, posttraumatic stress disorder. a lot of the men and women who have come back from afghanistan or iraq are suffering with ptsd. there's a new study out now showing that people who undergo surgery, if they have ptsd, they are more likely to die within a year after that surgery than those who do not have ptsd. so this is a rather revealing look at an area of ptsd that i think a lot of us haven't seen. people develop this anxiety disorder in response to a traumatic event. the symptoms include intrusive memories, social withdrawal. and here's one reason. they say the condition itself

which definitely stresses the body leads to a worse recovery from major surgery. the condition has been correlated with increased risk for alcohol and drug abuse, smoking, obesity, diabetes and of course if you think you're suffering from ptsd it's important to try and get some help. this is a correlation, richelle, that i think we had not seen before, that someone would have trouble recovering from a surgery, which seems unrelated to the ptsd, because of those symptoms. >> but the key is even if you suspect, you have to get help because the help is there. >> reporter: another reason to go and do that. >> thanks, reggie. an american father who was in jail in japan for trying to bring his two children home he is now speaking out about his time behind bars. he is back in the states. but where are his children?

made it hope. the mother stopped by the clay county deputy and we began our investigation. a couple raw facts real quick like. today we've been concentrating on the wooded areas in this residential neighborhood. we've had horsebacks from the jacksonville sheriff's office. we've had k-9s from the florida department of corrections out of cross city, the st. john's county sheriff's office and jacksonville sheriff's office. as of 3:00 p.m. today we have received approximately 150 leads. we have followed up on approximately 80. here again our search is the primary focus today. we are following up on leads, but the search is the primary effort. to date we have completed 57 sexual predator offender verification interviews in a three-mile radius. currently as we speak we're extending that to 37 more in a five-mile radius which extends two miles into the jacksonville area and the jacksonville

sheriff's office is assisting us with that. the fbi and the florida department of law enforcement has teamed with us. we have activated our internal child abduction response team as well as team one child abduction response team for the florida department of law enforcement. we have moved into a 7:00 to 7:00 shift. we'll be operating on 12 hours and rotate on the 7s. we have had helicopters from the jacksonville sheriff office, game and fish, st. john's county sheriff's office. we've had dive teams from jacksonville sheriff's office and st. john's county. we had numerous retention ponds and a little small lake. they're assisting us with that. obviously we have numerous command centers here. at this time i'll take any questions. >> reporter: sergeant, you specifically -- in fact the sheriff said earlier there were very good leads. those are leads pointing to a person or a location? >> our leads right now are being followed up on.
3:53 pm
we have some leads that we are concentrating on. however, we do not have a person of interest at all. >> do you believe she was abduct? >> at this time she's an endangered missing child. due to her age due to the climate conditions last night for a small child like that it would be very very tough for her to be out there. she's definitely endangered. we do suspect foul play. >> you're searching ponds and water. do you have any reason to believe she's there? something told you to search there? >> no, this is an all-out search. it's been go time for us all night last night, all day today. we're searching anything and everything that we possibly can. >> we were under the impression that she walked with her relatives from the school, but you're now saying she met them as opposed to leaving the elementary school with them? >> correct. she left the school at approximately 2:50 and she met up with her siblings about 1100 block of gaino avenue. obviously we expect foul play in the fact she did not come home last night. this is totally out of character for her and due to the climate
3:54 pm
conditions and the age and the size of that child, it would be very, very tough for her to survive. [ inaudible question ] >> what has changed since 11:30? >> other than the raw information i just gave you, today's big focus has been to recover all of the areas that we searched last night utilizing the sunlight today. that's our primary focus is to continue to search. >> have you found any evidence that suggests foul play or is that just a suspicion? >> obviously we believe it's foul play due to the fact this she did not return home. >> how wide of a wooded area are you guys searching and how many different lakes ponds in this area? >> there is one retention pond and one small lake to the west of our location here. it would be just south of the victim's home residence. >> and in terms of last night and then today, are you any

marijuana supporters are pleased with a new obama administration policy that eases up on federal prosecution of medical marijuana. a justice department memo released yesterday says u.s. attorneys shouldn't waste their time targeting people who use or sell medical marijuana in compliance with state laws. but the memo does tell them to pursue marijuana cases which involve illegal guns, violence, selling pot to minor, or involvement in other crimes. federal agents are also being encouraged to bust dispensaries that are using medical marijuana as a front for traditional drug dealing. this has been our "you're views" question of the day. most of our callers and e-mailers agree with the attorney general's decision, but we want to get both sides. you have been leaving a lot of comments on my facebook page all day. quite a few.

all right. kathy says legalize it. it is long overdue. this is a great leap in the right direction. lewis says it's a bad explanation. growing up in a drug infested neighborhood i know the dangers of marijuana use. i have watched dozens of my own family abuse marijuana for years. it's definitely a gateway drug to more dangerous drugs. even if users don't advance to more powerful drugs, they still end up abusing marijuana heavily. if the government chooses to go down this road, i hope they can deal with the medical and social fitfalls that come with it. it is really a sad state when our government feels it can't stop crime so they'll just legalize it instead. all right, lewis thanks. brian also left a comment. he says there's a major difference in between a casual smoker and being a dealer. a casual smoker isn't going to have 200 pounds of weed in their vehicle. will the government just do like mexico did and just go aefer the big dogs? i promise the first state that makes it legal will be a larger
