these pictures could spell trouble for a pretty well-known chicago bar. find wlut was different when a black student and a white college student try to get in dressed in the same outfit. more controversy surrounding michael jackson this time over rehearsal scenes for what was supposed to be his last concert. is it really the king of pop performing? and parents who bought baby einstein dvds could be in line for rebates or exchanges. i'm richelle carey. welcome to hln "news and views" on this monday. let's get started. it's been a horrible day for the u.s. mission in afghanistan. 14 americans were killed and in
12:01 pm
two separate helicopter crashes. the heaviest one-day loss of life for americans in more than four years. the first incident a chopper went down killing seven u.s. troops three civilians believed to be dea agents. the helicopter had just left the scene of a firefight. now, in the southern part of the country, four u.s. troops were killed when two choppers collided in midair. students from a college in st. louis say racism kept them out of a chicago bar. nearly 200 students, had gone to chicago on class trip they went to this bar. all the white classmates got in. all six black students were not allowed in. they say they were told they didn't meet the dress code because their pants were too baggy. so the students cooked up a little experiment. >> he's actually wearing my pants. he actually later on went back to the hotel he did a switch of pants and he put my pants on.
12:02 pm
keep in mind this guy's about three inches shorter than me and probably close to 40 or 50 pounds lighter than me. but he went back to the bar late other than that evening with the same manager same bouncer at the door, and was annal to walk in. while actually making jokes with the bouncer about not paying for the people behind him. >> a spokesperson for the original mother's bar the place they went told the "chicago tribune" the bar is taking this issue seriously and is doing an internal investigation. an 18-year-old wom who turned up in new york city two weeks ago with amnesia, we've been telling you about this now identified. her name casey elise peterson from washington state. her father says this is not the first time she disappeared and lost her memory. it is not clear how she got all the way from washington state to new york city. teammates, family and friends are paying tribute to the university of connecticut football player stabbed to death eight days ago now.

the funeral for 20-year-old cornerback jasper howard is being held in his hometown of miami today. the entire team flew to florida to be there. a viewing for howard, that was held yesterday, he was fatally stabbed during a fight outside a campus dance last sunday knop one has been charged in his death. a few hours from now the public will get a kplans to pay respect s to respects to thompson. yesterday her neighborhood held a festival that doubled as a fund-raiser for somer's grieving family. went missing last week walking home from school and her body found later in a landfill in georgia. here's our jacksonville affiliate wjxt. >> reporter: from the bouncy houses smiles. face painting singers and performers onstage even puppies. driving by the orange park town hall this might look like a big

12:05 pm
>> again our jacksonville afit yi. the community raised more than $18,000 for somer's family. at the stroke of midnight tomorrow night, michael jackson's "this is it" sgin as two-week run just two weeks in theaters around the world. a documentary created from footage shot as jackson was preparing for his summer concert series in london. the clips showed the king of pop rehearsing very intricate dance moves. that's really all he could do. he couldn't do simple stuff. just the fancy stuff. his voice is strong. he appears to be in good health, but the film in the motivation behind its release is controversial. so let's bring in tom o'neal of "intouch weekly" to talk about the controversy. tom, who in the family is upset? be honest. they haven't seen the entire thing. almost nobody has. >> right. as a matter of fact, those of us in the media won't get to see it until a few hours before it
12:06 pm
opens tomorrow night. they're keeping this under wraps. there are quotes in it british press la toya and joe jackson suspect body doubles were used in this. however, the family is solidly behind this project. they're going to be at the debuts at the nokia theater in los angeles on wednesday and i believe even joe may be participating in some of thesish but the fans richelle, they saying this is not it and set up a website called "this is not it" dotcom. claiming the big mystery, could she have done these concerts? the people behind it showing robust healthy vigorous michael. well, was that really the case? >> the question is, though would fans -- if the fans say that, some family members say, he couldn't have pulled this off, would they want to see michael at his worst? wouldn't they be upset then as well if they 3u9 forth a movie where michael wasn't the best? i'm not advocating body doubles.
12:07 pm
we don't know if that's true. wouldn't they want a film where they show michael at his best? wouldn't they be upset if that wasn't the case? >> good point. the flip side also important, there's a group of fans that would tag along behind michael wherever he went in the final years. the fans who set up this site and claim that michael was in such bad health four days before his death, that they bepged him not to do this concert. they claim on their website that the things we don't see, for example, are scenes of kenny ortega, the director and choreographer of this cutting up michael's food feeding him helping him up the stairs. that's how frail he was. >> allegation. no proof. >> right. >> speaking of ortega, a clip of sound of him talking about la toya jackson. let's play that now. >> i don't agree with it but at the same time i respect that la toya's concerns. michael was a perfectionist. the important thing here is she hasn't seen the film yet and i hope that when she does she'll come to realize that what this is is a great celebration of a
12:08 pm
master of his craft and that it is a privileged peak at that, the creative process of a genius. and that we really do come to understand the reasons behind the way michael wanted to do this project. white was so important towhy it was so important to go out after a ten-year absence. >> and we played that in the middle. he's talking about la toya's also saying that she doesn't think michael would be pleased with think, because michael was such a perfectionist. he wouldn't want people to see the process. what's your take on that? >> right. we'll never really know because we'll never get behind the scenes of this to find out how much is real how much is fabricated and allegation they relied heavily on studio recorded music. we see michael's lips moving but is he really singing? in fairness to the producers, they didn't know that this was going to be so important. they were just shooting random footage for archival purposes mean by hind-the-scenes document prip suddenly when it was needed
12:09 pm
as actual evidence of this concert and what we missed then it became really important. even if a lot of these allegation are true and body doubles were there? i could see as a director needing that creatively for transition. i could see using some recorded music needed for creative purposes again but is it honest? >> last question before we let you go. because everyone wants to know. money, money money. who stands to make the most money from this? >> well, the money comes down this way. $400 million is the projected take of this. sony paid $60 million to aeg the concert organizers for the footage. as soon as sewingy makes bake their $60 million, the profits on the other side get splid 90% to the jackson estate and 10% to aeg. >> be clear, the jackson estate does not mean all of the jacksons. it means the mother and the children. et cetera, et cetera. no la toya joe and every other jackson you can name? >> that's right. >> staying clear.
12:10 pm

1:59 pm
>> the fans are saying, this is not it. and they have set up a website saying this is not it.com, claiming that, you know, the big mystery left from michael's death was could he have done these concerts. and the people who are behind the concerts are the producers of this and thinker showing us a robust healthy, vigorous michael. well, was that really the case? >> well some published reports question whether a body double was used in place of jackson. so in response to that a representative of sony which co produced the movie is telling tmz.com, this is a quote this is pure garbage, every frame is unquestionably michael. no response now from sony to that. how about this? we have learned mark mcgwire is headed back to the big leagues. this time, he is said to be headed to be the hitting coach for the st. louis cardinals. he's going to be replacing hal mcrae who is out of a job.
2:00 pm
in 1998, mcguire set a new record for home runs. you certainly remember this everybody was paying attention, he had 70 for the season, retired three years after that, with 583 homers under his belt. but, of course he's also remembered for refrusing to answer questions during that congressional hearing about whether he used steroids. we're going to have to see how this plays out for cardinals fans. and there's a lot of cardinals fans. an unbelievable survival story. a car crashed right into a couple's bedroom, landed on top of them while they were in bed. hear what they're saying about the accident that could easily have cost them their lives.

lands right on top of them. the fire chief says they could easily have been crushed if this car had slipped during the 42 minutes it took to free them. okay, during the 42 minutes there was hot engine oil and gasoline spilling on them. but in spite of that, they ended up with just minor burns and a few cuts and some bruises. they spoke about their ordeal on nbc's "today" show. >> i pretty much woke up with it on top of me but before that i remember the shaking of the house and the noise and then just a weight. it was just like -- just came right down on top of us, and i actually thought it was an earthquake and the roof fell on us. and i don't know how long it took but i definitely went into panic mode after that and started screaming for help. >> we were in between both tires, and like the radiator -- like, part of the grill was smashed in the back the head board so i couldn't see her at all. we were on the outsides of that. >> i still can't believe that we're alive. just watching all that, it's a

2:05 pm
pay packages of the next 75 most highest -- highly compensated employees. the decision, what you could see for those employees likely come in december maybe early next year. and the reason for this is it's not unheard of on wall straight for star traders to be in line for pay packages when it you total it up to be tens of millions of dollars. sometimes it eclipsed that of senior management in the first group of compensation cuts that we saw come out last week richelle. >> all right. my next question is addressing the concern that a lot of people have when you talk about the slippery slope. what about companies that did not get t.a.r.p. money poppy? are they -- >> yeah. >> is their pay going to be tampered with at all? >> i think that's a great question, because a lot of folks say, well, it's unamerican for the government to step in here, and, you know implement change at a company where they vice president gotten any taxpayer funded bail out. we have seen changes, when you look at morgan stanley that paid back its t.a.r.p. money, they
2:06 pm
instituted clawbacks, the right to take back money if employees actions, a trade results in a loss a few years down the road at the firm. some critics say that's not going to solve the problem. the only thing that is giving shareholders say over the compensation of the people that sit at the top of the firms through the compensation committee. that's part of the board. they decide on executive pay. nell minnow is the chair of the corporate library, pushing for this reform for decades. we talked to her today, and here's what she had to say on that topic. >> right now the consumers of ceo pay the shareholders have almost no ability to send any signal back. you can't replace the directors who do it wrong, you can't say no to these outrageous awards. it's unthinkable, unfathomable to me that directors continue to serve, directors who have approved compensation awards that have created perverse incentives continue to serve.
2:07 pm
>> all right. you can see more her interview on cnn money. but to get to that point congress may pass a bill, letting shareholders have more on the say of executive pay. the issue here it wouldn't be binding. so some have been pushing to have more say of who sits on the boards. but it's not easy and really, you have to have deep pockets to do this. right now, to propose an alternative slate of directors shareholders must pay millions of dollars forward, have their own proxy statements distributed at the annual board meeting. so in the absence of this the oh only real way to sort of out a sitting executive is to create public pressure. that's really what we saw richelle, when we saw ken lewis stripped of his chairman title at bank of america. so it's difficult to evoke change of the a lot of folks want the system changed. that's what the woman you heard from, nell minnow mentioned. you can see it on cnn money. >> thank you poppy. someone is challenging

oprah is attacked. one of the trainers of "the biggest loser" has some harsh words for her. don't miss tonight's -- brooke anderson is in hollywood. this usually doesn't end well for those trying to take on oprah. >> yeah, not many people criticize oprah especially this harshly, richelle, and we know that oprah is always very open about her weight her fitness regimen, approaches and diets that have worked or haven't worked over the years. she has legion legions of fans. but don't discount jillian michaels among them. she lashed out at oprah to "health" magazine.
2:11 pm
okay. i know jillian doesn't have a very gentle approach. sometimes it's very off-putting for some. but if you watch "the biggest loser," rich he willrichelle you know that jillian gets results. i don't think this was a cheap shot, as some were saying i think they just really wanted to get the facts out there. >> okay. what have been people been saying on facebook? i know you put this up there to test the waters. what are people saying about it? >> you know it really sparked a heated debate on our facebook page. listen to what nikki says. quote, i don't think jillian michael's has any say in anyone's weight unless they are training with her. she needs to mind her own business. arnold b. says oprah is very misinformed about weight loss. the bottom line is who brings results when it comes to losing weight? jillian or oprah?
2:12 pm
jillian wins convincingly, case closed. and listen to what diana says. sounds like jillian is looking for a bit of air time. diana brings up an interesting point, because jillian richelle, is reportedly going to get her very own show from nbced called "losing it with jillian michael's." she will travel around the country, spend time with families helping them not only with their fitness and weight loss but also with finances, career goals how mom and dad's relationship is faring that sort of thing. it's set to debut next year. some people say she is lashing out at oprah for publicity. >> she probably believes what she says but it doesn't hurt to get into it with oprah, because it makes people talk. >> very good point. and we're going to have more on this coming up tonight on "showbiz tonight." plus richelle, married espn sports caster steve phillips is fired after a headline-making sex scandal. should he have been let go? was he treated unfairly?

determineded to get you, no matter what? >> yeah through your phone. a lot of people don't think about this but a smart phone is a mini computerment and you don't think twice about getting your computer protected with software getting your phone protected, not so much. and so of course, the criminals know that and they have come along to target your smart phones more and more these days. they generally go avids in this case with the individuals instead of these massive cyber attacks we hear about on your computers. they're hacking into phones to grab your personal information. one was rather ingenuous, really. they were able to take blue tooth headsets so they could talk to other head sets within 20 feet of each other. many people don't think of their phones as being open to risk. and only 23% of smart phone users actually enable security software. you can find out some other tips how to do that and to keep yourself protected so that people aren't getting into your business. you can go to cnn.com/tech.
