were using their personal laptops when they overshot the minneapolis airport by 150 miles last week. a federal official now says the faa is expected to suspend or revoke the pilots' licenses as early as today. we got that in just about ten minutes ago here at "hln." experts disagree on whether they put the passengers' lives in danger. the pilots said they lost track of time. they told the ntsb they were focus odd a new computer program that arranges cruise schedules. they did not monitor the airplane during their talk. >> i don't really know we can say that passenger safety was threatened because our system has a lot of safeguards in it. there's something that is there to keep them from running into another airplane. there's a collision avoidance system aboard all aircraft, there's air traffic controllers separating aircraft. the airplane was flying under control of the auto pilot on course. the passengers' lives wouldn't have been threatened in in circumstance. >> because we have backup system

in place does not excuse their negligence. when you miss an airport by 150 miles and fail to contact act, in my personal opinion you're endangering the lives of passengers. >> delta airlines us spended the pilots. it says the offense violating airline policy. delta sent passengers a $500 travel voucher for the inconvenience in that flight. the health care reform roller coaster is taking another turn. harry reid will club a public option in the senate bill. state kansas city opt out, though. it's not clear if conservative democrats will support this bill. olympia snow who has backed the overhaul plans says his decision was disappointing. >> it's regrettable, because i certainly have worked in good faith all of these months on a bipartisan basis, and as you know have been standing alone at this point as a republican to do so because i believe in good public policy. >> i believe that a public

option can achieve the goal of bringing meaningful reform to our broken system. it will protect consumers keep insurers honest and ensure competition. that's why we intend to include it in the bill that we submitted -- that will be submitted to the senate. >> now even if the senate can get the votes for a public option, it may never be an option for you. in about 15 minutes we'll explain why people with employer-based coverage still would not have a choice. now police say at least a dozen people watched a girl get raped for two and a half hours and did absolutely nothing. they say it happened on saturday outside a homecoming dance in richmond, california. two people have been arrested and a third was being questioned. officers believe at least four males attacked the girl. she's in the hospital in stable condition right now. we just got a new video of iraq's deadliest bombing in more than two years. look at that. this horrific blast happening. two bombs killed at least 160 people and caused heavy damage

in baghdad on sunday. 540 were wounded. security has been tightened at security checkpoints and roads into the capital. officials say 70 people have been arrested. that new video really showing the br and afters very clearly for us. a police officer is accused of pulling a gun on a chain saw wielding haunted house character. they say the actor chased the off duty cop and others into the parking lot to get an extra scream out of that. that's when the officer pointed the gun at the actor. the police report says the officer may have been drinking. >> we were about three to four feet apart. he held him arm out like this with a gun in his hand and the whole time his child was pulling on his arm. >> callers said he seemed to be very intoxicated. in fact, the people inside the house of screams noted that. when he was being processed, two of the officers noted that his speech was slurred, there was a moderate odor of alcohol from his breath. he didn't seem to be taking this

as seriously as he should have been taking it. >> the officer is charged with assault and reckless endanger endangerment endangerment. he'll find out if he's be suspended this morning without pay. there's been no response so far from hem or his attorney. now, we're still waiting for nasa so launch the new aries rocket. you see that thin white tube in the middle, not to be confused with the communication towers next to it. it gives you a sense how big this thing is. it keeps getting postponed. it was supposed to be up in the air an hour ago. it's delayed. the top section is all fake parts that will crash into the ocean after the test. nasa hopes to use the rocket for future missions to the moon and mars as well. that's why we go to bob van dillen right now. weather delay right now bob. before we had a weather dlar and they were waiting for the approval from the chief weather officer. any wind? what do you see in that area? >> it's been a concern too.

the low level clouds were a concern earlier in morning and it was upper level winds. that won't change much over the nex several hours. a ship landed in the landing zone area. that wasn't supposed to be there. that was an hour ago. we'll see if it gets off. let me show you what's happening. we have heavy rain west of the region. that is a warm front lifting into the panhandle of florida. now we see supercells develop around that warm front and that is why we have a tornado watch for this entire area. look at these two right here. that is a supercell that's going to rotate in. there's one right behind it. you can see it right there. these will have twisting motion. a brief tornado is a possibility. so far no warnings just a severe thunderstorm warning when you get towards the beach and as for frequent lightning and heavy downpours. look at the rain into atlanta. if you're trying to travel in and out of the major city here big problems. we'll see delays because of the heavy, steady rain. rain to philadelphia and

that states could opt out. even if his version of the bill became law, it would not change coverage for most of you. here's the details. people with employer-based coverage are actually blocked from switching to the public option as it is defined now. oregon democrat ron widen says many pushing for this public option don't realize it. >> when i was having my meetings, people would stand up at rallies and say public option or bust. then i would say folks i really appreciate your activism. are you aware the way the public option bills are written more than 90% wouldn't even get to chose them. people were practically falling out of the breechersleachers. >> >>. a burglary suspect in california left police a clue on how to track him down. his cell phone. investigators found it outside a

out, meaning $8000 at first and then down to 6,000 and then 4,000. you get the drift. that would be less expensive those lawmakers say than a competing plan. that would extend the full credit. it will make it available for more home biersuyers as well. as of right now the clock runs out on november 30th so we'll be watching. they may attach it to the extension of jobless benefits. we'll keep our eye on that, too. a lot of people waiting to see if they'll get a few weeks more of benefits. time for our tech check. a couple of new smart phones to tell you about, and they're coming out in time for the holidays. this is the new blackberry storm 2. it goes on sale tomorrow if you sub subscribe to verizon. so many times that's the case. only one network. the reviews say it did correct the problems of the blackberry storm 1, so that one apparently

launch for its new aries 1-x rocket. it will happen in about 20 minutes or so. it's way in the background. it's about 327 feet tall. this thing is huge. at 10:54 eastern is when we see it reach to the sky. eventually nasa hopes to use that technology to launch missions to the moon and mars as well. there she is. we're waiting for that launch. those are some of the stories this tuesday. first off right now, a story about 52 children that have been rescued from alleged prostitution rings. the fbi says nearly 700 people were arrested over the past three days in a nationwide effort. it started in 2003 to end sex trafficking of children in the united states. >> the money involved in prostituting children is much higher than just regular prostitution, so they get them -- the desire by the johns

if you will, is for younger and younger girls. so, i mean we see them as young as 11 years old. >> well the fbi says almost 900 children have been saved from sex trafficking since this initiative started and there's more than 500 convictions. negotiations are under way after complaints of racism at a chicago nightclub. student leaders at washington university in st. louis say they've been talking with lawyers for the club. complaints were filed with state and federal officials after six african-american students were turned away from the bar supposedly because their pants were too baggy. >> no one should have to encounter that particularly students just going to have a good time. >> the students believe the decision had nothing to do with baggy pants, especially, they say, after a white student wore the same jeans and was admitted to the nightclub. the faa is investigating the close call at los angeles international airport.

a witness told the "los angeles times" two planes came within 15 feet of each other on sunday. an faa spokesman says it was 100 feet. a commuter jet just landed and did not stop where it was supposed to. it came close to a runway where another plane was taking off. now to a story we're talking about at least one south carolina lawmaker that could bring up impeaching the governor during a special session about employment benefits today. lawmakers adjourned in june just before governor mark sanford secretly went to argentina to be with his mistress. one south carolina republican says impeachment would have been explored sooner if lawmakers had been in session when sanford returned. leevi johnston in the news again. he may be very close to baring it all. media reports say his manager is pretty sure johnston's photo shoot with "playgirl" will include full frontal nudity. he hired a trainer so he would look a little more buff. he's the father of former alaska

the morning specifically around philadelphia and lifting through new jersey and new york city. you get the heavy rain around nyc off the jersey shore too. a developing store. right now an area of olympic in southern nevada. that tightens up and throwing a lot of snow at you starting in the next couple of hours. the rain is changing over to snow for areas around salt lake city. the warning is posted out there for the better half of colorado. 8 to 14 inches of snow, even a possibility in denver metro itself as the winds begin to come up slow and condense out into snow. the warnings are in red and the white-shaded areas and blue-shaded areas under advisories. the snow is out there. the other big story is the wind. high wind warnings areas shaded in red gusting to 60 70 miles per hour near vegas and even the bay area. that's something we're concerned with today through tonight into early parts of tomorrow. >> plenty to watch. you know that aries rocket we've been trying to get off the

to move to get a new job and they're stuck because they can't sell their home. home prices home for the fourth month in a row according to the s&p shiller index. they're just ticking up and compared to last year that's true down by 11% but they're going in the right direction. that's a good sign. the recession may be over? yeah. that's what i had. there's a report due thurt thurs. the gdp is expected to show that the economy grew in the summer months. i really did say grew. that's good news in a bad economy. i'm hedging all this because we have viewers writing in saying you have to be kidding me. these are some theoretical numbers. i know it's not necessarily ha you see, but the the gross domestic product will likely confirm that the recession ended, and that we're moving into dproetgrowth in june or july. this is one of the biggest gauges of economy we've got. it measures everything we make like cars and every service performed like haircuts. it may be improving.

cups. a man convicted of making threats against president obama will not go to prison. he was sentenced yesterday and will spend two months in a halfway house. he was convicted of posting online threats during the presidential campaign. now, in court he apologized and said he was drunk and his threats shouldn't be taken seriously. a little girl had a kidney transplant and had to fight off infections and now cancer, but emily is getting unexpected help. she attended kindergarten for a day and a half where she made quite an impression on one classmate named peter. now he's selling produce and baked goods out of his little red wagon to help emily. >> because i love her. >> what do you love about her? >> that she's nice and i really like her. >> he's got the little smile on. we call him the sweetie pety around the house. it was touching to see this

hln. she's also the author of this incredible new book "i want." also joining us is hyla, an entertainment journalist with fivedollarprep.com. here we are tonight steve phillips and the young woman that he had sex, brooke hundley, both out of work for having a consensual relationship that ended really, really badly to put it mildly. but jane, is that reason enough for steve to be fired in your mind? >> i don't think he's fired for having sex. i think he's out of there because he exhibited unprofessional conduct and very questionable judgment. he's 46 years old having sex with a 22-year-old. a woman less than half his age. he's also married with children and he is a de facto boss because even if he's not her direct supervisor by just the virtue of the fact that he's on television, he has power and authority to wield over subordinates in the office. on top of that he has a track record of doing this kind of thing when he was the mets' general manager, he was sued for sexual harassment admitted to

having an affair with an employee and later settled out of court. this could be the tip of the iceberg. we don't know if work e-mails were used, work locations, work computers. we don't know the half of it, i'm sure. >> for espn it seemed that it came down to image, as far as they're concerned. listen to what espn explained to us today about why steve phillips was fired. this is what they said, very concisely. his ability to be an effective representative for espn has been significant and irreparably damaged. hyla, what do you think? should he have been fired? >> absolutely. you can't compare him to david letterman. david letterman is one of the biggest brands in hollywood of all time. and you have to think about the bottom line. how does steve departing from espn affect espn? they don't care. he's not in the same league as david letterman. letterman leaving cbs would be a major shake up and it would

also affect the network financially. >> and "showbiz tonight" did learn late today that brooke hundley is no longer working for espn. we don't know if she was fired or if she, in fact quit. what do you think, jane, should she have been fired, as steve was? >> i don't think she was fired for having sex, i think she was fired for being an alleged loony tunes chock-full of nuts who terrorized steve phillips' wife and children, if she did half the things that are being reported that she was alleged to have done, she's exhibiting way beyond unprofessional conduct. these are potential criminal charges, except for the fact that the family said we don't want to press charges. they want this to go away. >> well, the steve phillips sex scandal broke just two weeks after letterman's shocking admission that he was having sex with several employees. let's take a look at both cases and break it down a little bit. dave, of course, hosts the "late show" on cbs and he runs worldwide pants. that is the company that produces the show. steve is a high-profile baseball

analyst. he admits to having this affair with a 22-year-old employee. again, he is not her boss he gets the boot as well. now, hyla you said you can't really compare the two but looking at the similarities, how do you explain phillips' getting fired and dave not so much? >> phillips is just nowhere near the same league as letterman. i think when you look and you're a network and you're trying to decide what's best for our network, cbs decided okay it's best for our network to keep letterman on because of his brand and what he brings to the table. phillips doesn't bring that type of power that letterman does. so i think it's an easy decision for espn. they don't need the headache they don't need the drama. they had to deal with erin andrews a couple weeks ago, now there's another sex scandal involved. just cut all the ends and let's start fresh. >> jane, how do you see the difference between why he got fired and why david letterman does not? >> first of all, david letterman does not have a history of being sued for sexual harassment and

story, i was just so raw from my chemotherapy experience, so raw from watching ferrara fawcett die. it's an epidemic. and so -- i should not have -- i wrote a letter of apology to his family. i should not have said it. >> larry: how'd it get out? >> a reporter who didn't identify himself as a recorder. >> marvette, what do you think? was it unfair that suzanne had to apologize for something she said at a cocktail party and not on the record? >> well, anything you say is on the record so i don't think it was unfair for her to have to apologize. but i think suzanne is clearly passionate about alternative medicine. she personally experienced it and clearly was moved by the loss of patrick and felt that what she was saying and what she was sharing would be helpful not harmful. >> yeah, i think it was terrible that she was misled by this reporter, thought she was having a private conversation, expressing her opinions, but in the end, i think best to apologize. she also revealed on larry king"larry king

live" that she wrote a personal letter of apology to patrick swayze's family. but suzanne still sticks to her guns about her highly controversial theorys about cancer treatment. so, kim i'm thinking that suzanne maybe getting slammed here because some people think, well, i just have to say it, that she's kind of out there. >> yeah that could be part of it. look, i think she's being slammed because she is not a doctor and she is really talking about a lot of these theorys that are controversial that may have worked for her and that's great if she talks about whatworked for her and what helped her but obviously she's not a medical expert. so people are certainly going to criticize her. again, i don't know whether these are right or wrong but she had to expect that. she is not naive to this industry. she's been in this business for a long time. she knows that if she goes out there and says something at a cocktail party or on "larry king," people are going to slam her for it. >> people are going to pay attention. she certainly feels strongly about her opinions. she does have a right to speak her mind. kim serafin, marvette britto thanks ladies.

easy to see why heene would turn his life and that of his family into a nonstop audition for more turns in the big tent of the reality media circus. jane velez-mitchell, do we have this wrong? does frank mitchell have this right? can we fault heene for trying to work the system to his favor? >> frank mitchell is completely wrong. this guy put people's lives at risk. they were deploying choppers and they were discussing sending a rescuer from the chopper on to the top of the balloon to cut it up to try to rescue this kid. what if somebody had died in the process? not to mention that he's forcing his children to lie, allegedly, according to his wife. and the child is so traumatized, every time he's confronted a tbt lie, the poor child throws up. to me this is tantamount to child abuse. and why are we saying just because, what, the guy was on a roelt reality show, that makes it okay? there are people doing prison

time for stealing a tv set. this is far more potentially dangerous and destructive than stealing a tv set. this guy should be prosecuted to the max. >> well, believe it or not there was a moment in the history of this whole story when we actually thought it was true and it was for real and maybe there was a kid in this thing. and now, of course, we've learned that heene's wife did fess up to the cops that the whole thing from the very beginning was a great big balloon hoax. court documents reveal mayumi heene instructed their three children to lie to authorities as well as the media regarding this hoax. and lie they did almost. we all remember when their son who was supposedly in that balloon, told cnn's own wolf blitzer the whole thing was just for a show. watch how painful it was for heene to kind of squirm his way out of this one. take a look. >> you want to ask him now? i don't know if he can hear me what he meant by what he said, we did this for the show? you want to ask falcon?

>> falcon they want to know they want to know why you were in the attic? okay, for so long? and why you -- say it again? >> now, watching it again, of course, it looks like he didn't want to ask that question. he was clearly very uncomfortable there. hyla, a lot of people at that moment when we all thought this was for real actually felt sorry for this guy. do you now just a little bit, maybe? >> i don't know if sorry's the right word. i think he got in way over his head and i think hollywood creates this climate. the more outrageous you can be the better chance you can get a reality show. again, the buck stops with richard heene. he's the one that makes the decision, he's the father. it all falls on him. but if there's executives saying hey do something outrageous and maybe we can get you on a television show it doesn't surprise me. i mean he's playing with the

world of entertainment, it's something he got a taste of with "wife swap," i don't think he fully understood the power of what he did. in that regard i do kind of feel sorry for him. >> i do understand, in this column that frank rich was saying, he perhaps was a product of our culture. that doesn't make it right and what he did okay. and the "showbiz tonight" facebook blowing up over this today, blowing up like a balloon. not a single person feeling sorry for heene. let's look at alyssa k. who writes, no one should be defending him. he is exploiting his kids to get his reality show. it makes me sick. jennifer s. writes this, the truth is this idiot probably will get a reality show and people will watch it. jane, they're on your side there. and i think jennifer has a point. people may not be forgiving heene but a lot of people they may not admit it, but they would probably watch a reality show if he did one, don't you think? >> oh i hope he doesn't get a reality show. i think he made the crucial mistake of sort of giving it away for free. he did the reality show.

it's already aired, it aired on cable chances across the country as we covered it. he didn't get paid for it and i don't think anybody's going to be interested in watching him do something else because i don't think he'll ever top that. >> brooke anderson let me bring you back in here. are you watching this reality show? i will not watch it unless it's a homework assignment. >> me too. i feel the same way. this guy makes me want to throw up like his poor child was doing when he was forced to lie during those media interviews. what his parents did was deplorable teaching them essentially, to lie and deceive. it makes me so upset because parents should not use their children. let's move on to another big story breaking today. jon and kate gosselin in court today to account for all that money that they both took from a joint account without the other's permission. but kate a no show. what does jon do he complains about kate in a little impromptu press conference on the court steps. he was saying he was a little shocked because, you know i

shocking to me on a daily basis. soy is terrible for you if you have thyroid issues. so we asked in the "showbiz tonight" question of the day, oprah winfrey do you trust her weight loss advice? the results just came in today. a whopping 84% said no, they don't trust her weight loss advice. only 16% say they do. kim, are you shocked by those results? >> you know, i am really shocked. because the fact is oprah is not a political operative, yet a lot of people trusted her opinion on obama on the election. she's not a book critic, but yet people -- if she endorses a book, that book goes to number one, goes on all the best seller lists. if she puts a product on her favorite things list that product goes out of stock even though she's not a brand strategist. so you look at oprah she's struggled with her weight but i think people really do trust her. i'm very surprised with these results. >> they look at her advice hike it's the gospel. marvette, is this bad news for

oprah? >> i don't think it's bad news at all. last time i checked, oprah's never officially endorsed any product. oprah's speaking about what works for her. everyone's dna is different. so you have to adopt remedyies and therapies and treatments that you think are best for your body. if it doesn't work for you, fine, but oprah's only sharing her experiences and i think for her to say what oprah should or shouldn't be doing or what she should or shouldn't be sharing her viewers have a will and choice to choose and that's what they do. >> that's true. and i don't think this will make a dent in her viewership. today the "showbiz tonight" facebook page still exploding with comments about oprah. samantha d. wrote on our facebook wall, maybe oprah should can it for once and listen to what someone else has to say. after all jillian won her own personal battle with her weight and oprah's been trapped in a losing battle for years. do you agree that oprah should

stop giving a little weight loss advice until she gets her own weight under control? >> no because i think people identify with oprah. probably more people who try to lose weight have the same situation who oprah has rather than what oprah has. i think jillian should go on oprah's show, a big ratings hit they can talk about things they'll get another expert in. this is why people love her show. they identify to her, relate to her, and they struggle themselves. >> that's true. they can identify with that. i do think this is a tricky one. oprah needs to make sure she approaches it very carefully. i do want to move now to the brand-new report about jennifer aniston getting her very own talk show on oprah's upcoming cable network she's launching. the "showbiz tonight" truth squad been working all day on this. and late this afternoon a rep for jen called the report, quote, completely false. marvette, no disrespect but i personally have doubts whether jen could pull off hosting a talk show. what do you think? >> i think that jen is a movie star and she should stick to

high school and took this freshman into custody as a person of interest. now they're calling him a suspect who faces charges of robbery, false imprisonment rape and other sex crimes. police are appalled by the nature of this crime. >> i remember thinking that if something out of a hollywood movie, it's so extremely vicious, and absolutely unnecessary. >> reporter: the 15-year-old vick tip a student at richmond high, left her on campus homecoming dance around 9:30 saturday night and walk with someone she knew where she may have had alcohol, when she was robbed, gang rape and beaten severely for over two hours. police say it was witnessed by up to a dozen people and may have been caught on video. >> their behavior was either about thi apathy not call. to sit there observe it and some cases get involved and commit crimes. >> reporter: a new school surveillance system going in by january might have caught the crime earlier. >> absolutely, because it's tied

into local law enforcement. it would have -- clearly had a more visual view of was going on and people would have been alerted and knowing that this was here. >> reporter: the school district spokesman took a more cavalier assumption. >> when parents bring their kids to school, to the dance, they arrange for a safe ride back. if kids wish to leave the dance in the middle ftd dangs, we assume they have a safe ride back. there is a limit to what question do. >> reporter: police say the victim is suffering from non-life threatening physical injuries but substantial emotional injuries. manuel ortega arrested shortly after the incident is facing charges of rape robbery and false imprisonment in this case and police are looking for five other people but say that number would grow as the investigation unfolds. >> richmond high held classes yesterday, but counselors were there to help the kids and talk to them about this attack thanks to ktvu for that report.

the ares i rocket is supposed to carry americans back to the moon right now. nasa can't get it off the launch pad. today's planned liftoff scrubbed. john zarrella joins us from johnson space center to tell us what the problem is. i'm not sure you technically know what the problem is because you'd be working for nasa if you did, but give us an overview of what's going on. >> reporter: well, you know, richelle if it was a technical problem, you're right. since it was just a weather problem, i can probably handle that much. bottom line was they had a four-hour launch window from 8:00 a.m. eastern to noon eastern to get the ares x 1 off the ground. it started with clouds moving out of the area. concerned on the test flight. didn't want to launch in cloud cover. they wanted clear skies so they didn't risk causing any kind of static electricity to build up on that vehicle. then the wind as you can see, picked up. that caused a problem. on top of that, they had a cargo

ship that ventured into the off-limits recovery area out there in the atlantic ocean behind me. so that forced them to delay when they thought they had a pretty good chance to make it through a hole in the clouds. so one thing after another, bottom line not going anywhere today with the ares x 1, supposed to be the replacement vehicle for the space shuttle. this was going to be the first unmanned test of the vehicle and now they'll have to wait until tomorrow but you know better safe than sorry. right, richelle? >> absolutely. a lot is riding on this. just the animation we're looking at is pretty cool. >> yeah. you know, there's no question about it. there's a lot riding on it. here's a mockup of what this vehicle is. so everybody the viewers all know, this top part of the vehicle, the ares i-x out there is all dummy segments. there are big, huge steel cylinders, plates, inside, so that they mimic the waits of the actual upper stage of the

rocket. up here is what would be the orion capsule where the astronauts would sit. unlike the space shuttle, sitting up in this vehicle, they're actually like the old days of the apollo program, on the top of the rocket. down here, this is all a solid rocket booster and this is the real part out there today. the solid rocket booster that will produce 3 million pounds of thrust at liftoff. so generating a tremendous amount of power as it takes off. it will actually only be about a two-minute flight. the sections will separate. this part continues on, fly back off into the ocean. this part will be on pair chuteschute s parachutes recoverable and reusable just like the shuttle the rocket boost sisters. a lot riding on the success of this first test flight of the ares i rocket that should take humans back to the moon and maybe one day on to mars. richelle? >> looking forward to it finally

a baltimore police officer is accused of pulling a gun on a haunted house character who had a chain saw. police say the actor chased the off-duty cop and others into a parking lot to get an extra scream out of them, and that's when the officer pointed his gun at the actor. the police report says, yeah. alcohol may have been involved. >> we were about three to four feet apart, and he held his -- his -- his arm out like this with a gun in his hand and the whole time his child was pulling on his arm. >> callers said he seem to vb intoxicated. in fact the people inside the house of screams noted that when he was again being processed, two of the officers noted that his speech was slurred. there was a moderate odor of alcohol coming from his breath. he didn't seem to be taking this quite as seriously as he should have. >> clearly it's serious. charged with assault and reckless endangerment.
