the latest arrest include a 21-year-old man and two teens. five people are now in custody in the saturday attack in the high crime area of richmond, which is in the northern bay area. investigators say the victim was drinking with others in a school court yard when she was attacked. as many as ten people assaulted her for 2 1/2 hours in the dimly lit area. a school board member said the school should have been more diligent in its security. >> i haven't been told that yet. this just happened over the weekend. i have to look into that and find out. i can't speak to what the motives and rationales but i believe from what i'm hearing that people felt the dance was going well. people were having fun. that everybody who was there was in the building and that they had closed the doors and so the situation was contained and this girl had left so they didn't know that she had returned or came back. should we have anticipated it? yes. i believe you have to anticipate any potential problem.

and that's something that should have been discussed. >> a 19-year-old former student was arrested trying to flee the scene as many as two dozen people saw the rape, watched the rape, and never notified police. the 21-year-old man accused of killing uconn football player jasper howard in connecticut is set to be arraigned today on murder and conspiracy charges. john william lomax iii is held on $2 million bail. four men have been arrested. none is a student at the university of connecticut. howard was stabbed to death october 18th during a fight outside a dance on campus. the entire uconn football team flew south to miami for the funeral. investigators are hoping a time line might jog somebody's memory and lead them to morgan harrington. at a news conference today virginia state police said harrington was spotted outside a university of virginia arena between 8:30 and 9:00 local time on the evening of october 17th. she left the arena during a

metallica concert and she was denied re-entry. harrington was last seen around 9:30 p.m. local time on a bridge. she walked across two parking areas to get there. last night her parents appeared on nancy grace. >> what do you know about her telling her friends inside that she might get a ride home? >> i know she did tell them she could get a ride home is what we believe. i don't know what that means. i can't think that morgan would leave with someone she did not know. >> exactly. exactly. >> kids think everyone is their friend. >> they do, ms. harrington. they are so trusting. >> a $150,000 reward is being offered in the case. breaking news in another matter. shocking new video allegedly showing the balloon boy's father trying to shove a cigar into the

mouth of his infant son posing with a beer bottle. the family comes out swinging in a new battle against the sheriff. nancy has the latest tonight at 8:00 and 10:00 eastern here on hln. after several delays for low hanging clouds, nasa succeeded in launching the first ares experimental rocket. it took off from kennedy space center this morning. it's a tall one. nasa hopes the ares will replace the shuttle fleet and help with future missions to the international space station. the ares is also part of nasa's scheme to return to the moon and eventually mars. four months after michael jackson's death, his fans are getting to see the spectacle that never made it to the stage in london. the behind the scenes film "this is it" opened at midnight to long lines like this one in a detroit suburb. how you doing? >> good to see you.

what a pro mere it was. unlike anything i have ever seen. it took place last night downtown los angeles and it really was symbolic of an awards show. you had not just the red carpet but the fans in the middle wearing their jeweled gloves in honor of the late, great michael jackson. also, just a listers that showed up. everyone from will smith to jennifer lopez, paris hilton. it seemed as if they couldn't move fast enough to dash inside to get a front row seat to this exclusive event. the world premiere of "this is it." it really captivated the audience. my producer and i had a chance to take in the action along with the thousands of fans and family members, people in the industry who were there. and people clapped. they applauded. they cried. they chuckled at different scenes where michael was really, really shown in a different light. a light unlike any one has ever

was what it was. a production of michael jackson's last piece of work. his rehearsals. it wasn't perfect. there were parts of the documentary where he made mistakes. called himself out. there are also parts of the documentary where you saw michael jackson really in his truest and purest form and if the numbers are any indication it sold out in advance in many theaters but it will be interesting to see just how well it plays out. there are estimates it could sell as much as $200 million. it's really not on track, the level of the harry potters, and "batman" movies that we've seen but it's early in the game. >> not many behind you there. >> not yet. >> it's 10:00 in the morning. >> it's very early. we're still about an hour away from the first screening. not yet. >> okay. a worker canned over a button. why he's talking to a lawyer about this.

a man sacked by home depot in florida is ready to sue the company over a button. it read one nation under god indevisible. no one said anything until he began bringing a bible to work reading it in the break room. last week he said he was fired when he wouldn't take off the button. >> i think that was the pretense that they used to fire him was by the way, your button isn't home depot issued and so therefore we'll fire you because it was, you know, it's not as easy to say we don't like the fact that you have a bible with you. >> the attorney calls this religious discrimination. home depot says the noncompany button policy is a way to take no sides. the majority of you support the fired employee. let's hear both takes. randy e-mailed us this.

secretary of state visits pakistan. a car bomb exploded in peshawar. 90 people were killed. clinton is in islamabad 100 miles away reassuring the pakistani government the u.s. stands with it in the fight against violent extremism and militants are on the losing side of history. the northwest airlines pilots that overshot the minneapolis airport last week had their licenses pulled. in harsh letter the faa said the pilots endangered the public while they were on "a personal

huckabee is. a former writer for david letterman said she quit his show because she continued it to be a hostile working environment. she accuses high level employees of having sexual relationships with female staffers and says women benefited professionally from those relationships. she said she's not taking legal action but she wants to call attention to the complete lack of women's writers on late-night talk shows. pennsylvania police say a woman posted an ad on craigslist. undercover cops said they met the woman in the bar where she offered to take care of them. she was charged with soliciting prostitution. the officers misunderstood what she was saying according to her attorney saying she's innocent and she's a die-hard phillies fansen fan and is looking for tickets.

new developments in the brutal attack on a 15-year-old california girl. police in that area say they arrested three more people in the gang rape and beating of a 15-year-old girl outside her own homecoming dance. there are five people in custody. our affiliate has more on the shocking reaction among some of the students. >> reporter: this has really outraged the community here. let me tell you what's going on at the school campus. we were there yesterday and, you know, while students are outraged, the talk among some of these students saying that some people are actually blaming the victim saying that she was drunk and that she shouldn't have done

that. some people are saying that people used to make fun of her for other various reasons. other students are hearing that and saying, how would you blame her? it's this back and forth. school district officials are really upset that students are reacting like this. actually tonight there is going to be a community meeting at richmond high school. they're inviting parents to come and students to come to discuss safety. they feel that a school assembly is also needed to address the fact that there were so many witnesses, maybe up to 12 people who stood there and did nothing about it. that's very bothersome to the administrators here at richmond high school. so that may give you a sense of people are laying blame some on the victim some saying of course not. of course it's not her fault. how could you say that? so i think for the majority of people they are saying this is definitely a heinous crime. they are encouraged that police have been making arrests and

if sarah palin intends to run for the white house in 2012 she may want to reconsider. the latest poll numbers aren't looking all that promising. paul steinhouser is along to explain how she my want to look closely at these numbers. >> remember last year when then alaska governor was the running mate for john mccain? a big question mark was she qualified to be president in case something happened to mccain. there's still a question mark. brand new cnn opinion research corporation national poll less than 3 in 10 say palin is qualified to be president. 71% say she's not qualified, chuck. that's some troubling numbers even among republicans there seems to be split on that question. check this out. some positive figures for her. not all is negative. about two-thirds think she's not a typical politician. that's probably a good thing nowadays. equal amount say she's a good role model for women. 55% say she cares about people and is honest and trustworthy.

it's redefining what they think of as urban squaller. these are apartment buildings with rooms separated by pieces of wood and chicken wire and many people live in a very small space. we profile one man living with 18 others in a 625 square foot area. and nicer ones are the ones made out of chicken wire because the ones that make the small wood enclosures become so hot where temperatures reach more than 93 degrees, which is just impossible. these citizens in hong kong, these destitute citizens, have been living in small spaces like these for quite some time. this is nothing new. with the economy that we're seeing now and its collapsed in hong kong we're seeing more and more people moving into these communal spaces like this, chuck. they are going for 100 u.s.

loans to the small businesses? >> sure. it is a great question, brooke, because we talked about the small business administration and how those loans have increased when you look at the broader pictures, that is not the case. it is unclear whether the bank are lending more. what we do know going through treasury reports from april through august, the lending at the 22 bank in this country that got the most t.a.r.p. money it is down $8 billion. that is a 3% decline. doesn't sound like a big decline but it is frustrating if you are trying to get a loan. as for mike tracy, he is trying to get a loan through the small business administration, another one to open up a second bar here in new york city and actually the head of the small business administration says now in a recession is a rather good time to try and start a business out of necessity breeds innovation as they say. it is interesting, the lending picture is still tough. there are a lot of resources we wanted to show folks if they are looking to open a business.

"this is it" the behind the scenes movie about michael jackson preparing for his concert tour that never was is in theaters. a.j. hammer is in new york. i know you will talk about the controversy of the film on the show tonight. part of that being it doesn't show the full picture of his life. you saw the movie, what did you think? >> i thought it was great. i thought it was entertaining. it was fascinating not just because it is against the backdrop of his tragic death. we got to get a sense of michael jackson as nan control brilliant artist. it was a real reminder to us of his talent. people need to see this if perhaps they were waning because of the the drama in recipient years. you saw the brilliance. it was raw rehearsal footage, you heard quite a bit of singing. right there behind the scenes you got to see it as we are

looking at footage of this show being put together. there was no question. we watched them working out the kinks and bugs. no question this would have been a spectacular concert had it taken to the stage. they showed the making of and utilization of the visual effects that would have been part of the show. >> look at him, moving and grooving, age 50. let me ask you this, some people say this is an amazing tribute, others say it is coming too soon. this is nothing but exploitation. did you get that sense? >> not from watching the movie as far as exploitation is concerned. if they wanted to be exploy tative they could. they shot -- they had the cameras rolling when the whole crew told michael jackson died. they didn't show that. this was not about michael's death. i think anything that comes out now since michael has died will be technically exploiexploitive.

the fans want to see this. anybody who was scheduled to see this concert deserves to see it. i don't understand how people can argue it is too soon. >> a.j. you mention his death. you can't not talk about this. does it show michael with failing health or someone with a painkiller addiction? >> no, it doesn't. we expected that. i'm sure there's lot ofs of footage that may show him looking not as well but we don't know that for sure. you are forgetting you are watching a 50-year-old who is dealing with all he was dealing with. could he have done 50 shows? it certainly looks like he was able to. did they have a responsibility to show him that way as somebody who was sick and dealing with his addiction? i don't think they did. this was not a film about his final days even though it happened before his final days. it was a film about getting ready for the "this is it" concert. we have plenty to talk about tonight.

21-year-old man accused of killing university of connecticut football player jasper howard was arraigned on murder and conspiracy charges. prosecutors say they have several witnesses who can identify john william lomax iii as the man who fatally stabbed howard. four men have been arrested for their alleged roles in the murder. hakim muhammed is charged with conspiracy to commit assault. not one of the four suspects is a student at the university of connecticut. howard was stabbed to death during a fight outside of a dance on exam pus. the entire uconn football team

a 21-year-old man accused of killing football football player jasper howard has been charged. a total of four men have been arrested for their alleged role in the murder. hakim muhammad was also formerly charged today, charged with conspiracy to commit assault. none of the four suspects is a student at university of connecticut. howard was stabbed to death october 18th during a fight outside of his dance on campus. the entire uconn football team attended his funeral monday in

miami. cops have arrested three more people in the gang rape and beating of a 15-year-old girl in california outside her homecoming dance. this is surveillance tape showing the latest suspects to be arrested. two teenagers and a 21-year-old man, five people are now custody in saturday's attack in the high-crime area of richmond. investigators say the victim was drinking with others in a school courtyard when she was attacked. they say as many as ten people assaulted this girl for 2 1/2 hours. this is in a dimly lit area. a school board member says the school should had been more diligent in its security. >> i'm not going to shoulder it just on the school. but as the administration and as the duly elected officials, i'm going to share in the special. and say that we probably could have done better. >> a 19-year-old former student was arrested trying to run away from the scene. as many as two dozen people saw

look at that, that is a huge mess in clearly some scary moments while all that was happening. this is a restaurant near dallas. this pickup truck just crashed into the place. this happened during lunch hour. officials say an elderly couple's truck ran off of the road, hit another vehicle, ran through the patio and ended up right in the middle of that restaurant. this is in kaufman, near dallas. four people, including three restaurant workers and the pickup driver had to be taken to the hospital. none of the customers were hurt. firefighters don't know why the driver lost control. but witnesses say he may have had a heart problem.
