drivers, don't hold it against them. some doctors blame it on genetics. this just in -- a good sign that the recession may be ending. a new government report shows that the economy grew in the most recent quarter, even more than expected. jennifer westhoven is joining us. jen, does this mean that the recession is over? >> technically, that's what this is pointing to. the gross domestic product rose 3.5% on an annual basis over the summer. think it's hard for a lot of us to swallow, when you look around and see what you're seeing. but look, it's the first time we've seen a plus sign that the economy grew in a year. and the real question is is it real growth? because we all know, right uncle sam pumping billions of dollars into the economy. a lot of growth cash for clunkers, the first-time housing credit. how much of it has staying power. but we do seem to be slowly coming out of the worst recession in 70 years.
8:56 am
and the big question you're probably asking is -- great you see it on a piece of paper. when am i going to see it in the jobs market? we're watching. natasha? >> jen thanks for the update. well the bodies of at least 18 americans killed in afghanistan are back in the u.s. and president obama was there to see their flag-draped coffins arrive home this morning. the deaths came in the deadliest month for u.s. forces since 2001. and a time when the president is trying to decide whether or not to send more u.s. forces into harm's way. the 15 soldiers and three dea agents who arrived home this morning were killed monday and tuesday in afghanistan and killed in a helicopter crash and roadside bombings. five people have been arrested in the gang rape of a 15-year-old california girl. three are juveniles and police say they're looking for as many as five more suspects. and ten or more people who watched the rape did nothing. one of the teachers said the blame is shared across the entire community.
8:57 am
>> something horrible and atrocious happened on our campus. and yes blame lies with the school officials with the teachers. with the district. with the police. with the students who were afraid to speak up and walked by. but it's important to realize that our community recognizes this is a problem. and we are taking active steps to fix it. >> the victim is a sophomore who was found semi conscious and in critical condition. she was released from the hospital yesterday after four days there. police say all the suspects will be charged as adults and could face life in prison if convicted. after months of debate house democrats are rolling out a new health care reform plan and they're expected to do it in about an hour. the plan will include a government-run insurance plan the so-called public option. but doctors would be able to
8:58 am
negotiate reimbursement rates with the government. democrats say it would create competition and choice and hopefully appeal to moderates. the house is expected to begin debate on the bill next week. the company that makes louisville slugger baseball bats was found liable for the death of a young man killed by a baseball. rafer wiegel has more. we're getting more responses on the story, you can understand why. it was a very emotional day for the family of this young man, brandonen patch killed by a line drive in 2003. a montana jury awarded patch's family $850,000, from the company who makes louisville slugger bats, for not adequately warning about those bat's dangers. they say because balls hit by aluminium, brandon didn't have time to react. and it appears to be an indictment of the entire sport of baseball. brandon patch's mom had this to
8:59 am
say. >> we came into this not knowing, you know, we were just hoping to prevail is all. for brandon. this is for brandon. and for the other kids on the field. >> so here's the deal -- there's no doubt that a baseball hit by an awlum until bat travels faster. the question is, is the company or should the company be liable for that? that's what we're asking you. did the family deserve to be compensated like this? or should baseball be played at your own risk? go to cnn.com/robin. click on the facebook link to leave a response. hundreds of schools are closed due to swine flu as a school officials in kentucky say the schools may be an incubator for the virus. the education department reports at least 350 schools were closed last week. affecting 126,000 students in 19 states. many school officials say they are afraid that the h1n1 flu virus could spread even faster

if their schools stayed open. we've got some wild weather we're dealing with today. some of you dealing with snow others rain. bob, what's in store? >>le with be more snow for the rockies and more heavy rain through the lower part of the mississippi salley stretching through the great lakes overnight tonight. look at the spans of the storm system. one low is the surface low there responsible for the heavy rain now central kansas through oklahoma, down to texas too. but here's your upper-level support. i put it right around southern parts of colorado and northern new mexico as that slides over towards the east you're going to see the energy continue to move through and the back side of that of course is all snow now from denver in towards wyoming and now stretching in towards nebraska and south dakota. how about the heaviest rain falling near kansas city stretching down through oklahoma city. one severe thunderstorm watch. and that's the area shaded in yellow. it includes areas to the east of oklahoma city now. as you zoom in towards the radar, the biggest squall line is to the east.

one warning is for bristow winds to about 60 miles per hour in the thunderstorm complex. and out ahead of it that's why there's a warned area. fort worth is dry notice the showers are moving through and it will slow you at airport. already an hour delay now. snow up the slopes of the rockies. let's show you video from denver just yesterday. already they've seen about ten inches or more around the airport. grand total, clous close to 40 in some sections of colorado. cheyenne and a closure of i-80 between there and laramie. >> bob how are your driving skills? >> so far, so good. the bad drivers you see on the road? they may not be able to help it. it could be in their genes. a researcher finds that people with a certain gene variant performed worse on a driving test than people without it. he said about 30% of americans have that variant. so that's a lot of bad drivers we're talking about.

right? they never went down that far. interesting to watch and we note that the game will change. a lot more people will qualify for free money. the senate has come up with a deal that would be good news in a bad economy. you wouldn't just get this if you were buying your first home. if you've lived in a home for five years and you want to move, you could get a $6500 credit. and first-time buyers keep the $8,000 credit and it would run through april. right now, the tax credit runs out at the end of november, unless they pass something new. some businesses apparently recession-proof. well this texas taquaria may be one example. we serve up their recipe for success. >> reporter: this couple

high school dance. police arrested five people and are looking toor five more. they say as many as ten people watched the whole thing without calling 911. correspondent richard lewis is joining us. richard, it's hard to understand that all of these people could be standing around, not doing anything. >> it's one of the most shocking details of the case so far. but one psychologist said it's a common phenomenon you've heard of this before, it's called group think. >> everybody was looking to the other saying, i guess we're doing this no one is saying anything. and had one person stood up. had one person jumped in or said, this isn't okay it would have shifted the dynamic of that group very quickly. >> now here's a reason as to why they may not have jumped in. potential bystanders may not have called 911 because they were scared of retaliation. that's part of the reason police are now offering a $20,000 reward for information about the attackers. they're hoping that will be
9:13 am
enough incentive to get people to come forward on this. >> okay. so richard if the witnesses don't come forward is there this any way they could be charged with a crime here? >> this is interesting. there is a law that makes it illegal not to report a crime against a child. but richmond police say it does not apply in this case. >> we have not been able to arrest and prosecute any people that just watched. i think that's one of the most disturbing aspects of this case. but in california, and actually it's a national law that the victim of the crime has to be 14 or under. and in this case, our victim is 15. >> the detective says they have figured out who instigated the rape and they have used that information to try to get some of the people who committed lesser crimes to give up information, natasha, about the so-called ringleaders in this. >> hopefully people will start talking, richard thank you. >> yes absolutely. the world series is considered an american classic. and it got under way with some very high-profile peeps.
9:14 am
here's rafer with the latest. >> you don't have more high-profile people than that. and there was nothing more american than the world series one of our country's greatest tradition, there's former yankee yogi berra, with the first lady and the second lady, with an iraqi war veteran. derek jeter gets to put it on his mantle. cliff lee wowsed crowd. he was the story in the game he struck out ten yankees pitched the whole game to win game one for philly in the most intimidating place to play yankee stadium. if you can't get to work out west because of the bay bridge, you can do what the houston rockets did. they couldn't get to their game in oakland from their hotel in san francisco. they thought about taking public transportation. cops advised against it. so they took a ferry. believed to be an nba first, they were there on time and they
