the suspect in the ft. hood shooting can talk, but may never walk. major nidal hasan's lawyer tells us why. plus the president wants more answers on how hasan's links to a radical muslim group were handled. unspeakable acts of sex abuse on children. alleged performed by a 77-year-old father and his four sons. a sixth person how in custody as a search for bodies continues on a farm. then, a man is dying and he needs help. the priest who is guiding him is secretly his father. but now the mother says hey, forget the secret, the son needs money for treatment. all this hour on "morning

express." hoping you're having a very good friday. i'm richard lui. the army psychiatrist charged with murdering 13 people at ft. hood will probably never walk again. major nidal hasan's attorney says his client is paralyzed below the waist. you might remember a police officer shot him multiple times. yesterday president obama ordered a review of the handles of hasan's contact with a radical muslim cleric last year. the fbi says it was dismissed as innocent at the time. defense secretary robert gates warned against rushing to judgment. >> frankly, i deplore the leaks that have taken place, because people who are leaking are leaking what they know, which is one small piece of the puzzle. and what's more, they don't know whether or not what they're leaking might jeopardize a potential criminal investigation at trial. >> now those 13 counts of premeditated murder we mentioned earlier may have hasan eligible
10:02 am
for the death penalty if he is convicted. so the balloon boy's parents are due in court in about 30 minutes. they are expected to plead guilty and admit the whole thing, this thing, was a hoax. last month richard and mayumi heene said they thought their son was inside that balloon. the couple could face jail time now. and one former prosecutor explains why richard heene is facing felony, not misdemeanor, charges. >> they disrupted air traffic at denver international airport. there were national guard helicopters. the entire nation was riveted and terrified that this little boy was going to die. so i think this is really beyond the scope of one of these cases. it's really out of the box and warrants a far more serious punishment. >> richard heene turned himself in to sheriff's deputies yesterday. his wife is charged with a misdemeanor. again we are waiting for them to come to the court live and we will take you there to get those live pictures. we expect them to plead guilty. in about an hour the u.s.
10:03 am
attorney general is expected to announce the alleged 9/11 mastermind will be brought to new york for trial. just a short distance from ground zero. an obama administration official shade khalid shaikh mohammed, you see here, and four other gitmo detainees will be tried in civilian court instead of a military commission. >> i am absolutely convinced that khalid shaikh mohammed will be subject to the most exacting demands of justice. the american people will insist on it. my administration will insist on it. >> five other gitmo detainees are also expected to be transferred to be tried by military commissions. a sixth man was arrested in a disturbing child sex abuse case in missouri. the details still coming out about this horrific situation. a 77-year-old father, you see here, and his four sons, are already in custody, but did not
10:04 am
enter a plea yesterday. according to the court documents obtained by affiliate kshb, the alleged victims are adults, now, and came forward in august. also, the sheriff is continuing searching for possible bodies linked to this case. now you're thinking about buying a home or refinancing your current one, we have some good news for you. mortgage rates fell to rock bottom levels. jen westhoven joins us right now. every little tip affects that mortgage payment that we have each and every month and we have an adjustable. >> it can. it can be $100. $50. but every month that adds up to a lot over 30 years. so, mortgage rates back under 5%. again. so that is some good news in a bad economy. it motivates people. the benchmark 30 year fixed rate mortgage 4.91%. the low was in the spring. it was 4.78%. but we're not too far off that. and when we get under the 5% mark, a lot of people get off their doves, shall we say. they think, hey, i'm going to do
10:05 am
the work, get down there and figure it out. that could make a difference if i refinance. some people decide to move. >> these are historic lows, if we take a look at what some folks were paying 30 years ago. >> these are lows we haven't seen like thins there was a gi bill and people were coming back from the war. >> that's perspective. it appears a missing 5-year-old girl has been spot on hotel surveillance video but the man charged in her kidnapping is not the guy with her on the tape. plus they still don't know where shaniya davis is. she disappeared from her home in fayetteville, north carolina, tuesday. and her dad made a desperate plea for her safety. >> i just ask that they bring her home safe. you know, i miss her and love her very much. if you're listening to daddy, i miss you so much, honey, and i'm waiting for you. i'm not going to give up, and you don't give up either, honey. >> this is the man charged in this case. he's the mother's boyfriend. according to the manager of the
10:06 am
mobile home where shaniya lives. he says he's not guilty. detectives have identified the man we saw earlier on the tape, but they are not sure of a connection between him and shaniya's family. bob, that was a tough, tough spot of the father pleading for his daughter's return. i was asking you earlier, i looked at these numbers behind you and i said is this from one day? and you said, well not quite. >> not quite. >> a day and a half. >> totals? >> this is huge. remember this came ashore as a tropical storm a couple days ago across the gulf. now it's a hostal storm up above cape hatteras. been pumping in rain and wind. langley air force base in virginia, 10.38 inches of rain. and still comes down at times today. so you're not over with it yet. even newport news, about 8.66. surf city in north carolina side, 7.5 inches of rain. all records for the day, obviously and the rain continues. here's your low. you can see the clouds spiraling around this thing.
10:07 am
but you have high pressure to the north. that means the high pressure and the low pressure difference getting the winds right off the ocean again today and it's wreaking havoc right now across laguardia, newark you're looking at about 2 1/2 hour delays because of the gusty winds. the rain is also out there. but most of it is offshore. with just pockets of light showers rolling on through the jersey shore back in towards places like virginia. voesal flood warnings are definitely up and out from sandy hook past cape may into the delmar have peninsula and lower parts of virginia beach. that's ones apektd. the other aspect is the wind. look at some of these wind gusts. oceana, virginia, 75 mile per hour gusts. that's hurricane strength. today winds will be half as fast but you're still looking at beach erosion. let me show you this video coming out from the new jersey shore. this is wildwood, south of the atlantic city area. flooding. we have erosion. we have all this going on across the region. cape may county is under a state of emergency right now. look at the flooding right there. that is coastal flooding at its worst. >> what was this guy doing here?
10:08 am
>> he's not using his head. >> no, he's not. >> you've got to be careful with floodwaters like that. especially you're talking about almost a tidal surge. that's the wind getting pushed up with the ocean. unreal. >> you've got a witch's brew of a situation there. >> it's a mess. jersey shore gets hammered worse by nor'easters than hurricanes at times. >> of course tropical concerns. bob will be back in about five minutes. will sarah palin be going rogue at the dinner table this thanksgiving? stick around and hear oprah ask a tough question about levi johnston, the father of palin's grandchild. and tichkerring on the computer keeps a man out of jail.
10:09 am
10:10 am
if you were sarah palin, would you -- would your almost son-in-law levi johnston be coming to your thanksgiving dinner? here's a sneak peek of her interview with oprah which airs on monday. take a listen. >> so, one final question about levi. will he be invited to thanksgiving dinner?
10:11 am
>> you know, that's a great question. and -- it's lovely to think that he would ever even consider such a thing. because, of course, you want -- he is a part of the family. and you want to bring him into the fold and kind of under your wing. and he needs that, too, oprah. i think he needs to know that he is loved. and he has the most beautiful child. and this can all work out for good. it really can. we don't have to keep going down this road of controversy and drama all the time. we're not really into the drama. we don't really like that. we're more productive. we have other things to concentrate on and do. >> does that mean yes he is coming or no he's not? >> palin was anything but upbeat, though, when talking about her interview with katie couric during the 2008 presidential race. what she admits about that in about 30 minutes. soon, very soon your bank will no longer be allowed to automatically charge you overdraft fees. jen westhoven's been giving a
10:12 am
hallelujah in the back every once in awhile. >> yeah, because you're in the driver's seat now. if you want to keep paying those fees go right ahead. you just opt right in there. but for people like me, and a lot of other people out there who are saying hallelujah on facebook page it means the days are over of you paying a $35 fee, $35 for a $2 mistake. so that may never happen again. it won't start until july 1st. but the fed just announced that as a new rule. so it means, now it's not for things like checks. it means that a bank can't just automatically put you into their overdraft program where they are basically, they are hoping they're going to make some big money when you make a little mistake. so this only works for an overdraft on your debit card when you're at a store, for example. and i've had, you know, a few times, people make mistakes. human error it's called. where you buy something small and obviously you weren't sure about that. or, it could be at an atm. maybe you're in a different city and you can't see your balance because it's not your own bank's
10:13 am
atm. this will not apply to check. a lot of people are willing to pay overdraft fees when it comes to checks. it might be a little embarrassing in the store, they say oh, your card's been declined but you can use some other method of payment. >> starts in july? >> starts in july. you might have to take some action. you have to opt in. but sometimes they have these things where you opt in by not saying anything. so just be careful about that. >> i'm going to opt in, then. i'm going to get ready for july. >> now here's somebody writing on our facebook page. thank you, federal reserve, for looking out for us. banks are the biggest undercover robbers. you know, christine romans said that americans spend more on bank overdraft fees in a year than they do on vegetables. >> wow. >> all of us. >> business reporter from sister net work cnn. >> right. >> and just a quick one, iphone, verizon, fortune magazine's got two sources coming out from the manufacturing chain that say, yeah, maybe by this summer. that they're already building a phone that's verizon compatible. >> so, our own jen westhoven may hop on that bandwagon soon.
10:14 am
>> there's a lot of people who, verizon is one of the biggest cell phone networks in the country. >> choice is what it is. let's talk about a bank robbing mom. a minivan driving soccer mom has been charged with a string of bank robberies in southern california. jen westhoven, get the minivan, let's go. >> put the money in the minivan. >> agents arrested a 37-year-old mother of five after connecting her red minivan to the crimes. this is surveillance video of roxanne penick. local media report that the family was having some money problems. the fbi said she hit at least four banks. good imitation but tough times for her, obvious. a priest's affair with a woman was a closely guarded secret until the son they had together learned he only had weeks to live.
10:15 am
10:16 am
10:17 am
they're in court right now. the parents of the balloon boy are in colorado court. remember they claimed they were afraid their son was stuck in a runaway balloon last month. now, you can see the gentleman with the greasy hair, shall i describe, the shiny hair. that is richard heene we believe. mayumi heene i don't see in the picture. we assume that she might be right beside him. of course she's a little bit shorter. they're saying that this whole balloon thing was a hoax. richard heene expected to plead guilty to attempting to influence a public servant. that is a felony. his wife is expected to plead guilty to a misdemeanor. they both could face a couple of weeks in jail for this. and there is that famous silver balloon, again, and the video that was taken by the very family. and again, the suspects on the left hadn't side. a mother has exposed her secret, and by the way we're going to stick with that story for you, what's happening in the court and we'll come back. telling you now about a mother
10:18 am
that has exposed her secret affair with a priest because of their dying son. 22-year-old nathan halbach has terminal brain cancer. when he was a baby, his mother agreed to keep his father's identity private in exchange for child support from the priest's order. now, she went public, in this case, claiming the church would not help with her son's sky-high medical bills and the cost of an eventual funeral. since then the church said it will help. in september the priest apologized for breaking his vows, saying he's regretted this for a long time. you got to eat your words here mr. football coach. evidently, three of your players were arrested, and this after you claimed something before that happened. >> yeah. >> said something. >> it was kind of funny, richard. on wednesday, tennessee coach had just bragged about his program, having no off-the-field issues. well then on thursday, three of his recruits, including a couple prized ones, were arrested for
10:19 am
attempted armed robbery. freshman richardson, jackson and mike edwards. police say two of them approached a parked car. when they drove off police say they pulled the car over and found an air pellet gun in the car with these men in it. an attorney, though, says that they are innocent, or one of the men is innocent. the school is investigating. and the windy city is fuming today. the chicago bears taking on san francisco. little thursday night football. this was not ready for prime time. the bears traded everything but the kitchen sink for their quarterback jay cutler in the off-season. last night he threw a career high five interceptions. the bears had a chance very late. the end of the game, 7, 6, 5, 4, last play of the game, cutler intercepted. bears lose 10-6. >> you're saying a kitchen sink would have done better? >> his game is definitely down the game. james is saying i'm not worthy. the king announced out of respect for michael jordan he will stop wearing number 23 and switch to number 6 next year.
10:20 am
he said so after the cavs win over the heat with m.j. there courtside. james thinks, in fact, that nobody said wear number 23 in spite of the fact that he can dunk like that. 6 was his number in the olympics. another bizarre guinness world record. sorry, just had to let that sink in. britain's manjit singh set a record for pulling a double decker bus by his fair for almost 70 feet, and man, i don't know what conditioner that guy uses, but he's definitely in line for some endorsements. look at the guy. >> i know. i thought he had something bad to eat, actually. it was just like ooh! >> and with that. >> we better let you go. take the reins here. that was a hilarious story. thank you, sir. by the way, thank you, facebook. a man arrested for armed robbery is out of jail because of an unusual alibi here. he was updating his facebook status when the robbery happened in brooklyn.
10:21 am
rodney bradford was actually 13 miles away on a computer at his dad's apartment. bradford was picked out of his lineup but his lawyers used witnesses and the facebook time stamp to prove his innocence. bob, you were saying unfortunately for folks that are at the airport right now, they're stuck listening with -- to folks like us for the next 2 1/2 hours or so. >> i gave you the line, you blew it. >> next time, write it down for me. >> you're absolutely right. let me show you flight explorer. we have a lot of action going on across newark or laguardia. if you don't like listening to guys like me you're going to have to do it for an extra 2 1/2 hours. the rain come nothing new jersey. newark you have laguardia, jfk down below it. we have 2 1/2 hour delays currently at laguardia. newark, 2 1/2 hour delays. right now in philadelphia, 80 minute delay. boston, seattle, same thing. looking at this all day long, richard. more in just a bit. >> they're worried about listening to guys like me, not you.
10:22 am

in just 30 minutes the u.s. attorney general's is expected to announce that five 9/11 suspects will be brought to new york for trial, just a short distance from ground zero. an obama administration official says the alleged mastermind, khalid shaikh mohammed and four others will be tried in civilian court. police say new video of the missing girl shows her with a man at a hotel shortly after she disappeared from her home. police have identified him and charged another man in this case. they will not say how the two men are connected and they still don't know where 5-year-old shaniya davis is. those are some of the stories we're watching for you. right now we take you to some live pictures coming out of the

courtroom where the parents of balloon boy are in court in colorado. their hearing is about to get under way. you might remember in this story, they claimed they were afraid their son was stuck in a runaway balloon last month. i think if you look at the picture on the left-hand said you can see mayumi heene in the center. all the way to the background directly to her right is her husband richard heene. also leaning forward. this is a line shot so a lot of the heads are just in a hoe. on the right-hand side is video of the silver balloon itself which they are now saying is a whole hoax. richard heene is expected to plead guilty to attempting to influence a public servant. that is a felony. his wife is expected to plead guilty to a misdemeanor. they both could face a couple of weeks in jail for this. it hasn't started as of yet. but of course we're going to keep our eyes on that hearing right here on hln. president obama is in japan this morning to talk, among other things, about rebuilding afghanistan. prime minister yukio hatoyama said japan would agree to provide civil assistance but
10:32 am
would probably no longer allow u.s. military aircraft to refuel. earlier a u.s. air force base in alaska mr. obama told troops he would carefully weigh sending more forces to afghanistan. >> i will never hesitate to use force to protect the american people or our vital interests. but i also -- i also make you this promise. i will not risk your lives unless it is necessary to america's vital interests. >> mr. obama's trip will take him from japan to singapore, china and south korea over eight days. the man accused of kidnapping an 11-year-old girl and holding her captive for 18 years has apologized. phillip garrido wrote to a california tv station saying he wanted to apologize to every human being for what has taken place. garrido and his wife are accused of holding jaycee dugard in a compound behind their california home. they pleaded not guilty. and new this morning, the top lawyer at the white house has resigned in the first shake-up on the president's
10:33 am
senior staff. democratic sources tell cnn that greg craig has or was pushed out because of a dispute over closing the prison at guantanamo bay, cuba. craig was the driving force behind the president's controversial promise to close gitmo by january of next year. the white house now says it cannot make the deadline because it does not know where to put 200 terrorism suspects held there. now to an ohio mom that's accused of taking her kids shoplifting. police say surveillance tape shows the woman and her two children stealing clothes. but when security guard confronts them, a fight breaks out. police say two more adults got out of the getaway vehicle to join the melee. the adults were arrested. the 8-year-old boy and 10-year-old girl are in protective custody but had to see all of that. bob van dillen joins us right now. friday and we're hoping that you got some good news for us. but i don't think everybody's going to have good weather. >> no. the northeast right now, i
10:34 am
showed you all the delays. newark, laguardia, philadelphia, all about two hours to 2 1/2 hours at this point. what about the rest of the country? a couple of areas of low pressure. both of them are in canada but they're dropping cold fronts back in towards the plains. drives in towards denver area, as well. the snow out there for around denver. we have the rain for you, getting into northern minnesota. and it's heavy at times right now. not quite in towards mip. should fall apart before it reaches you. but that line stretches back over to the west and gets into higher elevations and it condenses out as snow. we're going to see snow, heavy at times, mainly downi-70 between utah and colorado. it's going to be heavy at times today. 6 to 12 inches of snow overnight tonight. the blue shaded counties are winter weather advisoradvisorie. here's that grand junction radar. it's really been filling up over the last couple of hours. everything you see here is falling as snow. so it's heavy at times. western colorado, highest elevations are going to get that in utah, too.
10:35 am
pacific northwest, it's all rain for the valleys. it's all snow for the higher elevations. the cascades, in towards the olympics. watch for a lot of snow to pile up here over the next couple of hours. three to six inches above 4,000 to 5,000 feet. maybe even a little bit lower than that. more details in a bit. that is your forecast. richard, have a good weekend. >> you, too, man. a teenageary show of support for his favorite football team is causing a bit of a buzz. his school gave him an ultimatum about his bengals haircut. you might be surprised what his folks think. plus bernie madoff's personal possessions are hitting the auction block. and this isn't anything like your neighborhood yard sale.
10:36 am
10:37 am
right now live to the courtroom. we believe the hearing has just begun for the heenes. these are the parents of the
10:38 am
balloon boy. you remember that story that we were following for you. very intensely, this silver balloon, and they're going to admit, we expect, both the father and the mother, richard and mayumi, that they are guilty. so we're going to be listening in to that. stay with us here on hln all afternoon as we find out exactly what they will be saying here for you. an eighth grader got himself suspended for showing his team spirit. quite a haircut. >> yeah, kudos to his barber, richard. >> very well skilled. >> unfortunately for justin reader, he says he was went right to the principal's office for showing up with a bengals helmet design on his head. he was told shave it or get a suspension. now, he's standing by his team but administrators say they have given dustin warnings about his hair before. dustin says he's done nothing wrong. >> it's just a haircut. it ain't drugly related. it ain't got no guns. it ain't got no cuss words. and stuff like that. so why are they worried about
10:39 am
it? >> now, dustin's parents say the school is being unfair, and they are proud of him. but, richard, he is in an in-school suspension. so it's not like he's staying home. he's still there learning. he just has to be away from the other kids. >> straight, blunt talk from dustin. >> thanks rafer. the head of an ethics program at harvard university is defending the decision to invite eliot spitzer to lecture there. the former new york governor resigned after court documents showed he was client nine for a high-priced call girl. the harvard professor said spitzer was, quote, the most important living prosecutor on a wide range of corruption. he was really feared on wall street, richard. >> he was. >> you talk about the time, very surprising he was known for that hard hand, if you will. >> he was one of the few people who would, you know, who would say anything at times when washington was like, hey, back off. back off. anyway. >> so let's head to an auction, why don't we, you and i. bernie madoff's items. i don't know if we can afford
10:40 am
any of them, though. >> i think you probably can. >> cannot. >> no, i think stomp of them aren't going to go for too much. but the point is, it really is all for a good cause. >> pay back all those folks. >> that's right. it's all going to go for the victims. here's what you could afford, the boogie board. >> okay, there you go. >> boogie boards from their beach homes. i think i saw estimates they would be about $80. some of this stuff, we're talking about jewels, these are some earrings that likely belonged to ruth madoff, his wife. designer handbags. fur coats. post-it notes. that's one of the things. here you're looking at this is a mets team jacket that was emblazoned, obviously, with the madoff name. i don't think anybody would be wearing that to the stadium lately. you'd get a drink poured over your head. >> yeah. >> still could be a collector's item. and you know, it really does go to a good cause. that's one of his rolexes. is that the plural of rolex? >> rolexi? >> that's a really interesting story. this is called the prisoner's watch, i believe.
10:41 am
it's just ironic that it turned out he's a prisoner. but the prisoner watches were made for prisoners of war. they were made with steel and not gold so that the camp guys wouldn't take it away from them. the guards. >> interesting. >> little back story there. all the money, he has 17 rolexes. all the money will go to madoff's victims. auction organizers say they hope it will raise about half a million dollars. >> we're talking about billions of dollars he bilked from people? >> billions. billions. it's just a little bit they can get back. thanksgiving, what are you doing, are you cooking? >> i can't cook worth nothing. >> come on. >> i'm going to go crash somebody's house. >> you should know. i don't cook everything. i don't cook everything. but i do cook thanksgiving. i love it. so this is a story for everybody out there if you're going to cook or you got to pay for it. you want to pay attention. it will cost a little bit less this year. for ten people, about $43 according to the american farm bureau. they went out to grocery stores across america. turkey, a little bit cheaper this year. the big reason is because milk is cheaper. but, pumpkin pie, a little more expensive.
10:42 am
if you make it from a can, and from a frozen pie crust. so just don't and you won't have to pay more. >> i'm working thanksgiving, and they always give us a great meal right here at hln. >> oh, really? >> they do. you get to ease nice, get nice and fat for when you're on air. works out really well. >> come over to my house when you're done. >> all right, thanks a lot, jen. we have another clip for you from sarah palin's interview with oprah. palin talks about everything from the presidential campaign to her relationship with levi johnston. she also got surprisingly candid about her interview with katie couric. that famous interview during the 2008 race. remember a lot of people thought it really hurt her image. and here is what she said. >> let's talk about the interview with katie couric. >> ha, ha, must we? >> yes. >> okay, okay. >> you talk about it in the book. so i assume everything is fair game. you do say that it wasn't your best interview. >> but, here again -- >> do you think that was a
quote
10:43 am
seminole, defining moment for you, that interview? >> i did not. neither did the campaign. that is why segment two and three and four and maybe five were scheduled. the campaign said, right on, good, you're showing your independence, this is what america gets to see. and i'm thinking, if you thought that was a good interview. i don't know what a bad interview was. because i knew it wasn't a good interview. >> the entire interview with oprah airs on monday. that's the day before palin's memoir "going rogue" hits the stories. >> i absolutely agree. >> okay, you know, at the top of the hour, the u.s. attorney general is expected to announce that the alleged mastermind of the 9/11 attacks is to be tried in new york, just a short distance from ground zero. that is our afternoon "your views" question and we talk about "your views" questions with richelle carey. she's going to analyze that for us. >> i am. something i think a lot of people are going to want to weigh in on, richard.
10:44 am
here's the topic, as you said, khalid shaikh mohammed and four other gitmo detainees will be tried in civilian court here in the u.s., instead of a military commission. president obama, he's in japan right now, made this comment about the upcoming trial. >> i am absolutely convinced that khalid shaikh mohammed will be subject to the most exacting demands of justice. the american people will insist on it. my administration will insist on it. >> also, five other gitmo detainees are expected to be transferred to be tried by military commissions. here's the question. do you agree with trying the suspects in new york in civilian court? do you think it's the right thing to do? maybe you'd prefer that they face military justice back at guantanamo bay. even though that's the goal is to close down guantanamo bay for
