express." hoping you're having a very good friday. i'm richard lui. the army psychiatrist charged with murdering 13 people at ft. hood will probably never walk again. major nidal hasan's attorney says his client is paralyzed below the waist. you might remember a police officer shot him multiple times. yesterday president obama ordered a review of the handles of hasan's contact with a radical muslim cleric last year. the fbi says it was dismissed as innocent at the time. defense secretary robert gates warned against rushing to judgment. >> frankly, i deplore the leaks that have taken place, because people who are leaking are leaking what they know, which is one small piece of the puzzle. and what's more, they don't know whether or not what they're leaking might jeopardize a potential criminal investigation at trial. >> now those 13 counts of premeditated murder we mentioned earlier may have hasan eligible

for the death penalty if he is convicted. so the balloon boy's parents are due in court in about 30 minutes. they are expected to plead guilty and admit the whole thing, this thing, was a hoax. last month richard and mayumi heene said they thought their son was inside that balloon. the couple could face jail time now. and one former prosecutor explains why richard heene is facing felony, not misdemeanor, charges. >> they disrupted air traffic at denver international airport. there were national guard helicopters. the entire nation was riveted and terrified that this little boy was going to die. so i think this is really beyond the scope of one of these cases. it's really out of the box and warrants a far more serious punishment. >> richard heene turned himself in to sheriff's deputies yesterday. his wife is charged with a misdemeanor. again we are waiting for them to come to the court live and we will take you there to get those live pictures. we expect them to plead guilty. in about an hour the u.s.

attorney general is expected to announce the alleged 9/11 mastermind will be brought to new york for trial. just a short distance from ground zero. an obama administration official shade khalid shaikh mohammed, you see here, and four other gitmo detainees will be tried in civilian court instead of a military commission. >> i am absolutely convinced that khalid shaikh mohammed will be subject to the most exacting demands of justice. the american people will insist on it. my administration will insist on it. >> five other gitmo detainees are also expected to be transferred to be tried by military commissions. a sixth man was arrested in a disturbing child sex abuse case in missouri. the details still coming out about this horrific situation. a 77-year-old father, you see here, and his four sons, are already in custody, but did not

mobile home where shaniya lives. he says he's not guilty. detectives have identified the man we saw earlier on the tape, but they are not sure of a connection between him and shaniya's family. bob, that was a tough, tough spot of the father pleading for his daughter's return. i was asking you earlier, i looked at these numbers behind you and i said is this from one day? and you said, well not quite. >> not quite. >> a day and a half. >> totals? >> this is huge. remember this came ashore as a tropical storm a couple days ago across the gulf. now it's a hostal storm up above cape hatteras. been pumping in rain and wind. langley air force base in virginia, 10.38 inches of rain. and still comes down at times today. so you're not over with it yet. even newport news, about 8.66. surf city in north carolina side, 7.5 inches of rain. all records for the day, obviously and the rain continues. here's your low. you can see the clouds spiraling around this thing.

but you have high pressure to the north. that means the high pressure and the low pressure difference getting the winds right off the ocean again today and it's wreaking havoc right now across laguardia, newark you're looking at about 2 1/2 hour delays because of the gusty winds. the rain is also out there. but most of it is offshore. with just pockets of light showers rolling on through the jersey shore back in towards places like virginia. voesal flood warnings are definitely up and out from sandy hook past cape may into the delmar have peninsula and lower parts of virginia beach. that's ones apektd. the other aspect is the wind. look at some of these wind gusts. oceana, virginia, 75 mile per hour gusts. that's hurricane strength. today winds will be half as fast but you're still looking at beach erosion. let me show you this video coming out from the new jersey shore. this is wildwood, south of the atlantic city area. flooding. we have erosion. we have all this going on across the region. cape may county is under a state of emergency right now. look at the flooding right there. that is coastal flooding at its worst. >> what was this guy doing here?

hallelujah in the back every once in awhile. >> yeah, because you're in the driver's seat now. if you want to keep paying those fees go right ahead. you just opt right in there. but for people like me, and a lot of other people out there who are saying hallelujah on facebook page it means the days are over of you paying a $35 fee, $35 for a $2 mistake. so that may never happen again. it won't start until july 1st. but the fed just announced that as a new rule. so it means, now it's not for things like checks. it means that a bank can't just automatically put you into their overdraft program where they are basically, they are hoping they're going to make some big money when you make a little mistake. so this only works for an overdraft on your debit card when you're at a store, for example. and i've had, you know, a few times, people make mistakes. human error it's called. where you buy something small and obviously you weren't sure about that. or, it could be at an atm. maybe you're in a different city and you can't see your balance because it's not your own bank's

atm. this will not apply to check. a lot of people are willing to pay overdraft fees when it comes to checks. it might be a little embarrassing in the store, they say oh, your card's been declined but you can use some other method of payment. >> starts in july? >> starts in july. you might have to take some action. you have to opt in. but sometimes they have these things where you opt in by not saying anything. so just be careful about that. >> i'm going to opt in, then. i'm going to get ready for july. >> now here's somebody writing on our facebook page. thank you, federal reserve, for looking out for us. banks are the biggest undercover robbers. you know, christine romans said that americans spend more on bank overdraft fees in a year than they do on vegetables. >> wow. >> all of us. >> business reporter from sister net work cnn. >> right. >> and just a quick one, iphone, verizon, fortune magazine's got two sources coming out from the manufacturing chain that say, yeah, maybe by this summer. that they're already building a phone that's verizon compatible. >> so, our own jen westhoven may hop on that bandwagon soon.

they're in court right now. the parents of the balloon boy are in colorado court. remember they claimed they were afraid their son was stuck in a runaway balloon last month. now, you can see the gentleman with the greasy hair, shall i describe, the shiny hair. that is richard heene we believe. mayumi heene i don't see in the picture. we assume that she might be right beside him. of course she's a little bit shorter. they're saying that this whole balloon thing was a hoax. richard heene expected to plead guilty to attempting to influence a public servant. that is a felony. his wife is expected to plead guilty to a misdemeanor. they both could face a couple of weeks in jail for this. and there is that famous silver balloon, again, and the video that was taken by the very family. and again, the suspects on the left hadn't side. a mother has exposed her secret, and by the way we're going to stick with that story for you, what's happening in the court and we'll come back. telling you now about a mother

that has exposed her secret affair with a priest because of their dying son. 22-year-old nathan halbach has terminal brain cancer. when he was a baby, his mother agreed to keep his father's identity private in exchange for child support from the priest's order. now, she went public, in this case, claiming the church would not help with her son's sky-high medical bills and the cost of an eventual funeral. since then the church said it will help. in september the priest apologized for breaking his vows, saying he's regretted this for a long time. you got to eat your words here mr. football coach. evidently, three of your players were arrested, and this after you claimed something before that happened. >> yeah. >> said something. >> it was kind of funny, richard. on wednesday, tennessee coach had just bragged about his program, having no off-the-field issues. well then on thursday, three of his recruits, including a couple prized ones, were arrested for

attempted armed robbery. freshman richardson, jackson and mike edwards. police say two of them approached a parked car. when they drove off police say they pulled the car over and found an air pellet gun in the car with these men in it. an attorney, though, says that they are innocent, or one of the men is innocent. the school is investigating. and the windy city is fuming today. the chicago bears taking on san francisco. little thursday night football. this was not ready for prime time. the bears traded everything but the kitchen sink for their quarterback jay cutler in the off-season. last night he threw a career high five interceptions. the bears had a chance very late. the end of the game, 7, 6, 5, 4, last play of the game, cutler intercepted. bears lose 10-6. >> you're saying a kitchen sink would have done better? >> his game is definitely down the game. james is saying i'm not worthy. the king announced out of respect for michael jordan he will stop wearing number 23 and switch to number 6 next year.

would probably no longer allow u.s. military aircraft to refuel. earlier a u.s. air force base in alaska mr. obama told troops he would carefully weigh sending more forces to afghanistan. >> i will never hesitate to use force to protect the american people or our vital interests. but i also -- i also make you this promise. i will not risk your lives unless it is necessary to america's vital interests. >> mr. obama's trip will take him from japan to singapore, china and south korea over eight days. the man accused of kidnapping an 11-year-old girl and holding her captive for 18 years has apologized. phillip garrido wrote to a california tv station saying he wanted to apologize to every human being for what has taken place. garrido and his wife are accused of holding jaycee dugard in a compound behind their california home. they pleaded not guilty. and new this morning, the top lawyer at the white house has resigned in the first shake-up on the president's

senior staff. democratic sources tell cnn that greg craig has or was pushed out because of a dispute over closing the prison at guantanamo bay, cuba. craig was the driving force behind the president's controversial promise to close gitmo by january of next year. the white house now says it cannot make the deadline because it does not know where to put 200 terrorism suspects held there. now to an ohio mom that's accused of taking her kids shoplifting. police say surveillance tape shows the woman and her two children stealing clothes. but when security guard confronts them, a fight breaks out. police say two more adults got out of the getaway vehicle to join the melee. the adults were arrested. the 8-year-old boy and 10-year-old girl are in protective custody but had to see all of that. bob van dillen joins us right now. friday and we're hoping that you got some good news for us. but i don't think everybody's going to have good weather. >> no. the northeast right now, i

showed you all the delays. newark, laguardia, philadelphia, all about two hours to 2 1/2 hours at this point. what about the rest of the country? a couple of areas of low pressure. both of them are in canada but they're dropping cold fronts back in towards the plains. drives in towards denver area, as well. the snow out there for around denver. we have the rain for you, getting into northern minnesota. and it's heavy at times right now. not quite in towards mip. should fall apart before it reaches you. but that line stretches back over to the west and gets into higher elevations and it condenses out as snow. we're going to see snow, heavy at times, mainly downi-70 between utah and colorado. it's going to be heavy at times today. 6 to 12 inches of snow overnight tonight. the blue shaded counties are winter weather advisoradvisorie. here's that grand junction radar. it's really been filling up over the last couple of hours. everything you see here is falling as snow. so it's heavy at times. western colorado, highest elevations are going to get that in utah, too.

anthony sowell, the man who owns the house where eleven bodies were found pleaded not guilty to charges that led to the investigation at his home. these charges are connected to an alleged attack on women, and police investigating that discovered the bodies. the video that you're seeing is from earlier this month. police have expanded their search now of his house to a nearby property.

and what i have in my mind, only i know about. and i have a yellow pad, although i have a great memory, i have a yellow pad, i write certain things down, but nobody sees that other than me. now, during the course of saying hello to people, i'll jokingly say, who should win? and the girls will blurt out names, et cetera, et cetera, but that's all fun. the girls love meeting me, i loved meeting them. and i don't know what carrie's talking about. >> so she just misinterpreted the situation? >> well, sadly, because, you know, i have a good heart and i'm nice to people. and the pageants have become so successful, not because i'm a bad person. and i'm really nice to people. in fact, i'll go a step further. the ones that i know can't win, i'm nicer to them. >> right. i actually go out of my way. i don't say i feel sorry for, but i actually go out of my way to be nicer to the girls that i know can't win. >> make them feel comfortable. well, you are a very, very friendly guy. and i want to ask you about this

five alleged september 11th plotters heading to u.s. soil to be tried in a civilian court. within the past hour attorney general eric holder announced the justice department will seek the death penalty against mastermind khalid sheikh mohammed. they were waterboarded and that will likely pose legal problems for prosecutors. the president spoke about his decision to close guantanamo bay today during his visit to tokyo. >> i'm absolutely convinced that khalid sheikh mohammed will be subject to the most exacting demands of justice. the american people insist on it

prosecutors agreed to a sentence of probation with a possibility of up to 90 days in jail for richard, up to 60 days in jail for his wife. millions of people across the country were captivated by the couple's claims that their son had floated away in this balloon. the boy was at home the whole time. you might wonder what is next for the hennes? will they go to jail? what about the kids? >> sharon liko joins us on the phone from colorado. thank you for being with us. >> thank you. >> so they entered guilty pleas today. how long before they're sentenced? >> oh, probably about six weeks. they have to do a presentence investigation so they'll go and meet with the probation department and talk about what they did and they'll look at their background and then probation makes a recommendation to the judge, assuming there's no surprises, then they'll probably get jail. but actually henne might get the jail on the condition of

probation which probably wouldn't be a bad thing except they ought to add the price of the jail time to his tab along with the $2 million that he cost colorado in his little excursion. >> it's funny you bring that up because i have to think a lot of people are thinking these people should pay. there was an awful lot of manpower that was asserted to try to get this balloon back to the ground safely thinking that there was a little boy in it. what about restitution? >> well, that should be a condition, it always is. how you pay back $2 million, i don't know. but it would be nice if this guy likes to be rich and famous and he's going to go out and sell his book, that the state has the first rights on the book and that the state gets paid back and what's left over is his. >> let's look at this again. we've got a class 3 misdemeanor for her and a felony count for him. really, what is the probability of jail time if the prosecutor is only pushing for probation? >> it's -- there's a possibility because of what he did.

i mean it's so outrageous that with both of these offenses, jail is a possibility. jail for her, prison for him. so it's something that's definitely plausible. they go to jail a certain amount of time and then they do their probation. so they pay their debt in a couple of manners. but i think that kind of a sentence actually is good. it lets people know that maybe, just maybe they don't want to go to jail. maybe they like it on the outside better than on the inside. >> who wouldn't. okay, sharon liko, thank you for your expertise in this matter. we appreciate it. a missing 5-year-old girl was spotted with a man just an hour after she disappeared tuesday, so let's get you updated here because police in fayetteville, north carolina, say shaniya davis was seen with this man in a hotel about 40 miles away from her home. police used surveillance video from the hotel, here it is, to confirm her idea. the man seen with her they were

arkansas. the leader of tony alamo christian ministries has been in federal custody since he was caught on a raid on his compound last year. the remnants of tropical storm ida are still a problem. heavy rain is along the mid-atlantic here. look at what some of the streets look like up and down the east coast. schools are closed. more than 100,000 people lost power in virginia and north carolina and five deaths are blamed on the storms. here's what one reporter saw in virginia. >> reporter: hey, guys, i'm out here at bush and olney. and you can see where the water is well over my waist. >> coastal flood warnings are posted from new jersey southward to the outer banks of north carolina. flood advisories are also up along the potomac in washington, d.c. and up the delaware river to philadelphia. well, levi johnston's manager says his much-hyped play girl shoot was, quote, fantastic, though he wouldn't go into any details. the manager said the shoot did

center towers fell. nearly 3,000 people were killed in the attacks. the actual transfer of the prisoners to new york may not happen for several weeks. formal charges haven't been filed against most of them. so an attorney that practices in the area of international law and defense and has previously worked with the guantanamo detainees, so he joins us to talk about the tricky issues ahead in the september 11th suspect trials. jeffrey, thank you for being with us. let's talk about this. no charges have been filed yet. what does that mean for this trial? >> well, the charges will be filed. what you'll have are indictments for first degree murder, for terrorist charges and really this is a transparent effort as opposed to a military tribunal. there were open trials before in 1993 for the sheikh trial, the world trade center bombing, and those were successful for the government and they're trying it again. >> one question that i have that

really stands out to me is if this is a civilian trial, how do you find a jury? >> right. if i'm a defense counsel, the first thing i will ask for is a change in venue because you'll say how can you get a fair trial in new york a couple of miles away from the world trade center. however, it's happened before. it's difficult to get a change in venue. and obviously jurors will have heard about what happened, but they have to be impartial and fair. >> yeah, but can you get a fair jury anywhere in the united states at this point really? >> realistically that's how the system works and you're going to have to try the case in the united states. it's unclear whether you can get that fair trial, but it's happened before. they will try to get an impartial jury and a judge will make sure that the jury will be impartial. >> you know, there are reports that the alleged mastermind, khalid sheikh mohammed confessed but it might have been coerced because a justice department report states that he was waterboarded almost 200 times at one point. what problem might that pose?

>> the defense counsel will move to exclude the evidence of the waterboarding. presumably the government has other evidence that they can introduce in case that evidence is suppressed, but that will be a big battle at trial and that may in fact imply what judge -- what the exjudge holder, attorney general holder was saying about some portions of the case being sealed and others not, others open. >> so how transparent do you think this trial could be? and what might they face? >> well, it will be very transparent, what these five people will face is the death penalty. if convicted, they will be held in a supermax prison in the united states and then face the death penalty. >> okay. thank you so much for giving us your perspective and your expertise in this area. we really appreciate you walking us through it. so let me pose the question to you now that you've heard this back and forth. do you think trying the suspects in civilian court in new york is

part of this entire case, three of these men were lay ministers in the community of christ church. how is that for a toxic secret? how does this happen? this church not only needs a full-blown investigation, but they need to do some soul searching to uncover how someone inside their community could allegedly do something so evil right under their nose. i'm jane velez-mitchell and that's my issue. . >> and tonight on issues, celebrity addiction scandals. a special look at some of the most notorious cases of stars with addiction. that's tonight at 7:00 p.m. eastern right here on hln. the man accused of kidnapping an 11-year-old girl and holding her captive for 18 years has apologized from his jailhouse cell. philip garrido wrote to a california tv station saying he wanted to apologize to, quote, every human being for what's taken place, unquote. garrido and his wife are accused of holding jaycee dugard in a compound behind their california home. they have pleaded not guilty.

police also say garrido fathered dugard's two daughters. an ohio mom is accused of taking her kids shoplifting. police say surveillance tape shows the woman and her two children stealing clothes. take a look yourself here. when a security guard confronts them, though, a fight breaks out. police say two more adults got out of the getaway vehicle to join the melee. the adults were arrested. the 8-year-old boy and 10-year-old girl are now in protective custody. a student's hair cut got him suspended from school. take a look at this. dustin reeder said he was sent immediately to the principal's office when he showed up with a cincinnati bengals helmet design in his hair. the eighth grader was given an in-school suspension, meaning he'll be kept in isolation until his hair grows out so he can do his school work. administrators say they have given reeder warnings about his hair in the past but the boy says he's done nothing wrong. >> it's just a haircut. it ain't drug-related, it ain't got no guns, i ain't got no cuss

words and stuff like that, so why are they worried about it? >> readers parents say it's unfair and they're proud of him. new leaks about the possibility of the iphone coming to the verizon network. right now it only operates on the at&t network. well, the leaks are from sources in the supply chain, apparently. that's new. the latest one, fortune magazine reports millions of verizon users could get an iphone next summer based on reports that apple is building a phone that could work on the verizon network. at&t's exclusive right to carry that iphone reportedly runs out soon. oh, our money expert, clark howard, the one and only, did you know that he serves in the georgia national guard or state guard, i should say? this weekend, you're going to see him serving our troops in operation clark smart. he's teaming up with our morning express's robin meade to help soldiers and you, of course, save more, spend less and avoid getting ripped off.

money, this up to 5 grand and if you're married you can do five and five. you don't have to do five. that's just the ceiling. you put money into this and listen to this, you never get taxed on that money. everything you earn on it tax free. when you spend it, you spend it tax free. you can take money you have in savings, whatever it is, put it into a roth account and the tax free advantage over time is gigantic. now, when are you allowed to spend the money? when would you guess i'll let you spend the money? >> that was my next question. >> how old are you now? >> 33. >> so you would put this money into a roth and you got to leave it in there for 26 years but then everything that you have is your money to spend dollar for dollar government is out of your life on taxing it.
