are searching for the body of shaniya davis along a central north carolina highway. the police say they've received reliable information she may have been dumped there. police have charged shaniya's 25-year-old mother with human trafficking and felony child abuse. new pictures a moment ago. the mother antoinette davis is due in court in two hours. shaniya lived with her father until last month. he was hesitant to let her stay with her mother but felt she deserved an opportunity to be a part of shaniya's life. >> of course i had some reserves. however she been trying. i know she been working for at least six months, and she had been trying to get her life back on track, and she said she had just recently got her own place. so i was wanting to give hear chance. she asked if she could be a mother, and i felt she was sincere in asking, and figured i'd give her a chance. >> police have also filed kidnapping charges against

this is really a spare parts mission. there's only six flights left in the space shuttle program. this is last one this year. five next year. then that's the end of the shuttle program. between now and then, they've got to bring up all kinds of big spare parts and they're going to stack them literally on pallets, attached to outside of the international space station. so they're going to have three space walks on this mission, part of what they'll be doing during space walks, getting all of the pallets out there and all of that heavy equipment stored because they're there won't be a vehicle big enough to bring up large pieces after the shuttle is retired the end of next year. when they come back, though, there will be seven astronauts on board. nicole stot, up there 2 1/2 months returning on this mission. six up, seven coming down, christie. if all goes well here, it's cloudy here, little overcast, but it's low clouds and everything is green from that

we are following sad news out of north carolina where police have found the body of missing 5-year-old shaniya davis. she disappeared last week. according to media reports and the associated press, her body was found near a north carolina road south of sanford. we are expecting a news conference this afternoon. we will bring that to you live when it happens. but here what happens we know. police have charged shaniya's 25-year-old mother with human trafficking and felony child abuse. antoinette davis is due in court this afternoon. police have filed kidnapping charges against 29-year-old mario mcneill, captured on camera last tuesday carrying shaniya into a hotel room 30 miles from her home. cops say he admitted to taking the girl. there he is. but his attorney says he will plead not guilty to the charge. again, awaiting a press conference and we'll bring that to you live when it happens. what makes former child stars turn to addiction?

looks like we're opening up our wallets more, and that is good news in a bad economy. it may be a key sign that the economy is recovering. retail sales actually rose more than expected in october. the government reported a 1.4% rise, thanks in part to strong demand for cars. nearly half a percent more than analysts are expecting, and it's quite a turn around, because retail sales have fallen more than 2% the month before.

to come to us from north carolina, but this is what we know so far. it appears they're still waiting on confirmation for someone to take a look at this child's body. a family member. but we believe that the body of 5-year-old sha mia davis has been found off a road, in lee county, north carolina. she has been missing since last week when her mother said she put her down to sleep and an hour later she was gone. there is a body that has been found off of a search, information police got, and they did find a body who they believe to be shaniya , and her mother s facing charges of human trafficking and felony child abuse. we don't know what other charges may come as a result of this discovery today. but we'll keep you posted on this. a legal battle is heating up between the pentagon about

25-year-old mother with human trafficking and felony child abuse. antonette davis is due in court at any moment now. shaniya had been living with her father until last month, and he said he was hesitant to let her stay with her mother, but he thought she deserved ab opportunity to be part of shaniya's life. >> of course, she had been trying, and i know that she had been working for at least six months, and she had been trying to get her life back on track, and she said she had just recently got her own place. so i was wanting to give her a chance. she asked if she could be a mother, and i felt that she was sincere in asking. and i figured, give her a chance. >> police in north carolina have also filed kidnapping charges in this case against 29-year-old mario mcneill captured last tuesday on surveillance video carrying her into a hotel room 30 miles from her home. police say he admitted to taking

her, but his attorney says he will plead not guilty to the charge. so all of the breaking news tonight. watch nancy grace for the late-breaking developments on sha mia's death. and we expect another news conference in the next couple hours. a new arrest in the case of a missouri family accused of horrible sex crimes against children. 7 76-year-old darryl moehler is charged with two counts of forcible rape against two girls, 5 and 9. he says he has no idea about the allegations. his bail has been set at $40,000. moeller's brother and four sons in missouri are charged with crimes, including bestiality and forcing an 11-year-old relative to have an abortion. moehler says he has grown apart from his relatives and has nothing to do with them. a body was found in the chicago river this morning, and investigators believe it is that of michael scott, the president of chicago's board of education. an autopsy is being performed right now. the president of the cook county

over the weekend, the fbi used equipment like ground penetrating radar at that house in cleveland where the remains of 11 women were found. they used also orange paint to mark several spots, and that could indicate more digging this weekend at anthony sowell's house and also next door. now the search has expanded four houses down. a woman says a niece found something behind a boarded up house. >> they found bottles this long, and come running up to the house with their bare hands, look what we found. >> well, police haven't said whether they found any human bones behind that house. sowe sowell's attorney hasn't comment commented about the murder

charges he is facing. he tried to rape a woman and she got away, and that's what led police to the bodies. a flock of birds hit a plane right after takeoff. it hit them about 4,000 feet above kansas city saturday. >> heard this rumble, bang, boom boom, and then kind of like a flash. and then you saw smoke. and then, you know, we started decreasing in altitude. >> an airport spokesperson says the birds hit both engines, but only one lost power. the plane did land safely. and you'll remember, it was a bird strike that forced a usairways plan to land in the hudson river in january. >> a guy in texas who wrecked his $1.7 million car says a bird distracted him. a lot of birds causing so many problems. he ended up crashing the vehicle in a salt marsh. then again, this thing is kind of hard to drive.

house. anthony sowell pleaded not guilty on friday for charges of allegedly trying to rape another woman who got away. that investigation led police to the bodies. a new arrest in the case of a missouri family accused of horrific sex crimes against children. 72-year-old mohler was brought into a courtroom on saturday and charged with two counts of forcible rape between kids ages 5 and 9. his bail is set at $40,000. his brother and four sons have been arrested in missouri. mohler says he's grown apparent from his relatives and has nothing to do with them. general motors reported a loss of 1.2 billion from july 10th, the day it came out of

bankruptcy to september 30th. this is a bit of good news, however, because gm will start repaying government loans early, anticipating it will pay back $1 billion next month. since the end of 2008 we as fax payers have forked over $50 billion to help gm. it looks as though we're opening our wallets a little bit more. not just good news in a bad economy. it could certainly be a sign that the economy is recovering. retail sales rose more than expected in october. the government reports a 1.4% rise. nearly half a percent more than analysts had expected. homeowners in financial trouble can save their homes and their credit. acting fast is the key. hln money expert clark howard tells us how. >> i get a lot of questions from

a breaking story this afternoon from fayetteville, north carolina. the news no one wanted to hear in the search for a 5-year-old girl who has been missing for nearly a week. investigators believe they have nound little girl, shaniya

davis' body. police were searching for her all morning after getting a tipped she was dumped along a central north carolina highway. investigators have charged shaniya's 25-year-old mother with human trafficking and felon child abuse. antoinette davis had a court hearing this afternoon. shaniya lived with her father until last month. he says he was hesitant to let her stay with her mother but felt she deserved an opportunity to be a part of shaniya's life. >> of course i had reserves. however, she had been trying. i know that she had been working for at least six months. she had been trying to get ore life back on track. she just recently got her own place. i was wanting to give her a chance. i felt she was sincere when asking to give her a chance. >> police in north carolina have filed kidnapping charges in the case against this man.

action. >> reporter: and she did. she start ad nonprofit called may we rest in peace. she's raised thousands of dollars to bury these people. i thought, oh my god. we have to help restore some dignity to these families. >> for six families there is now dignity in death. their fathers, sisters, mothers and brothers laid to rest because of the kindness of strangers, making a difference in a town that could not on its own. the county had run out of funds to bury the unclaimed. >> my father buried, not cremated. so this is really something that's going to help me sleep at night, knowing that he received what he had actually asked for. >> wow. that makes me a little emotional right now. it's a good feeling. >> it's going to be something that we can always look back and think that somebody was there to help us when we needed it or,

you know, help my father when he needed it. >> poppy harlow joins us from new york. those six families have closure. what about the rest of detroit's unclaimed dead? >> reporter: that's a great question. this is still a problem in the city. there are 52 of those unclaimed bodies still in the morgue. we'll see if the number goes up. some good news, though, along with this foundation is that the county, christi, now has their 2010 budget. they've got thousands of dollars to bury some of these bodies. i think to sum it up, as one of the people at that memorial service that you see right here said to me, he's a lifelong detroit resident. he says, you know what, they, meaning all of society, knows us, detroit, for our abandoned houses. we're not going to let them remember us for our abandoned people. it speaks volumes that one person can make a humge difference if they put your initiative into action. see the full story on

president of china will meet again tomorrow. three, two, one, zero and liftoff of space shuttle "atlantis." >> and that never gets old. space shuttle "atlantis" blasted off this afternoon from kennedy space center. it's loaded with big spare parts for the international space station. nasa wants to stockpile as much equipment there as possible before the shuttle fleet is retired next year. this is an 11-day flight. it'll keep the astronauts in orbit through thanksgiving and include three space walks. this is nasa's last shuttle flight of the year. following this story for you. a brush fire just south of los angeles. specifically, in san juan cap stran know. live pictures for you here. about 60 fire fighters, 10 fire engines and 2 choppers are involved in this. about ten acres have burned so far. no structures are threatened right now. take a look at this mud slide in seattle.

he pleaded not guilty on friday to charges for allegedly trying to rape another woman who got away. that's the investigation that led police to all those bodies. michael jackson's personal doctor conrad murray was in court in las vegas this afternoon accused of owing more than $14,000 to a woman and her son. murray reached a deal that keeps him out of jail. his lawyer paid half the money on his behalf today. the child's mother agreed not to force him to pay the $14,000 in back payments. murray will now pay the woman about $1,000 a month. murray says he couldn't pay earlier because he had to close his medical practice after jackson's death. the contents of farrah fawcett's will have been leaked. and the actress left almost everything to her 24-year-old son, redmond, and nothing to long-time love, ryan o'neill. according to a copy obtained by radaronline.com the actress who passed away from cancer in june left $1.5 million to redmond.

the s&p 500 rose almost 1.5%. also helping the gains a fresh report on retail sales. commerce department says sales jumped 1.4 from the month before. if you strip out car and truck sales, the number was up just slightly, indicating that consumers are still very cautious. retailers are hoping for big gains this month. many of them can make as much as half of their annual profits during the holiday shopping season. richelle, they're hoping people get out there and spend, spend, spend. >> that's exactly what they're hoping for. some people may be doing that spending with gift cards. the federal reserve is taking a swipe at gift card fees. it's proposing new rules to protect gift card users from unexpected costs to at least a year and extending gift card expirations to at least five year. the action is based on a law congress passed in may. these new rules will go into effect next august. before then the fed has opened feed back to the public and industry groups saying new rules

we're just moments away from a news conference from police in fayetteville, north carolina. they searched and searched and searched for 5-year-old shaniya davis. she'd been missing for nearly a week. they announced this afternoon

they believe they found shaniya's body. >> the body was located of a small child a little while ago off of walker road. about 100 feet off of the road. at this time, a positive identification will be made by family. and as soon as we have that positive identification, we'll have more information. >> cops searched all morning because they'd got a tip she had been dumped along a highway in scentral north carolina. investigators have charged shaniya's 25-year-old mother with human trafficking and felony child abuse. antoinette davis had a court appearance today. shaniya had been living with her father until just last month. he says he was hesitant to let her stay with her mother but he also felt she deserved an opportunity to be part of shaniya's life. >> of course, you know, i had some reserves. however, you know, she had been

trying. i know that she had been working for at least six months. and she had been trying to get her life back on track. and she said she had just recently got her own place. so i was wanting to give her a chance. she had asked if she could be a mother. i felt that she was sincere in asking. and i figured to give her a chance. >> police in north carolina also filed kidnapping charges in this case against 29-year-old mario mcneill. he was captured on surveillance camera. there's shaniya. last tuesday carrying her into a hotel room 30 miles from her home. police say he admitted to taking her. but his attorney says he will plead not guilty to the charge. all the breaking news on this case tonight. watch "nancy brace" for late breaking developments on shaniya's death. that's 8:00 and 10:00 p.m. eastern right here on hln. again, we're also waiting for a news conference. this just in to hln. court papers show the woman charged in the 2002 abduction of elizabeth smart will plead

guilty tomorrow as part of a plea deal. these papers were filed in salt lake city. they don't specify the terms of the agreement or which charge or charges wanda barzee is going to plead to. she and her estranged husband brian david mitchell were indicted on federal kidnapping charges in 2008. this is video of elizabeth smart from 2003 where she was taken from her salt lake city home at knife point and was found knife mon -- nine months later. a brush fire just about three miles east of san juan near the cleveland national forest. there's about 70 firefighters on this scene, 10 fire engines, a couple of choppers involved as well. ten acres have burned so far. no structures are threatened right now. let's hope it stays that way. federal officials toured a western illinois prison today that may be used to house guantanamo bay detainees. officials from the departments of justice, defense and holdland security, they all checked this facility out.

some republican lawmakers say the idea to move guantanamo detainees there is too risky. but some people who live there, some of the ones we've talked to, they say this would be a good idea because it would give the local economy a boost. actually, right now we're going to go to -- we're going to go to north carolina now for the press conference on shaniya davis? >> are we ready? >> okay. now we're ready. >> are we ready? testing. okay. hi, again, everybody. this is just another briefing regarding the body that was discovered this afternoon out off of walker road. there is no new information at this time regarding the positive information of that body. we are currently waiting for the fbi to come out to the scene to help exhume the body for evidence and other information. again, we do not have a positive identification on that body as of yet. we can only say that we did discover one off of walker road.

she was pretty clear on that. is still actually at the scene where they found this body in lee county. about 100 feet off of a road. someone disposed of a child's body on the side of a road. and they say they've called in the fbi to take a look at the scene before they move the body. then they will have a positive id. but all signs do point to this being shaniya davis because they actually began the search here because they say a tip came in that shaniya had been dump there had. she's been missing for a week now. the decision to try five of the september 11 septembers in a civilian court in new york has created a heated debate in washington. the argument is pretty much along party lines. democrats are backing up the president's decision. they say the trial will show the world how effective and fair the u.s. judicial system is. others say it will give people like khalid shaikh mohammed, the alleged master mind behind 9/11. >> basically we're dealing here with people who've committed acts of war against us.

they shouldn't be tried in our criminal justice system. they should be tried in our military justice system. and it's absolutely inexcusable we're not using the military justice system to try these people. that's why we have such a system. >> if somebody murders americans and they murder americans in america, they ought to be prosecuted in america and hopefully convicted in america. >> republicans also say that a civilian trial will give the alleged terrorists the public platform they want. there has been a new arrest in the case of that missouri family accused of horrible sex crimes against children. 72-year-old darrel mohler was brought into a courtroom. he says he has no idea about the allegations. his bail has been set at $40,000. his brother and four sons back in missouri are charged with horrific, unthinkable crimes including bestiality and forcing an 11-year-old relative to have

an abortion. mohler says he's grown apart from his relatives and has nothing to do with them. the legal battle is heating up at the pentagon -- rather between the pentagon and aclu. the issue is photos that appear to show americans abusing foreign detainees. so should they be released? michael jackson's personal doctor, conrad murray, was in a court in las vegas this afternoon accused of owing more than $14,000 to a woman and her son. murray reached a deal. this deal will keep him out of jail. his lawyer actually paid half the money on his behalf today. the child's mother agreed to not

force him to pay the $14,000 in back payments. murray will now pay the woman $1,000 a month. hurry says he couldn't pay earlier because he had to close his medical practice after michael jackson's death. the contents of farrah fawcetts will have been leaked. the actress left almost everything to her 24-year-old son redmond and nothing to long-time love ryan o'neal. according to to a copy obtained by radaronline.com the ak dress left $4.5 million to redmond. other beneficiaries include her nephew, father and a former boyfriend. the will was dated august of 2007. defense secretary robert gates has blocked the release of any new photos that appear to show americans abusing foreign detainees. the obama administration told the supreme court gates is using his new powers provided by a law signed last month. the aclu sued to have them released. the lower court supported that. in particular there is about 44 pictures this is about.
