5:00 pm
just released, the shocking 911 call from shaniya davis's mom crying over her 5-year-old daughter, the same mom now charged with selling that beautiful little girl as a sex slave. giving her 5-year-old as a prostitute. just hours ago a positive i.d. of the child's body found dumped on the side of a highway. more horrific charges are expected any time now. sarah palin's new book is out. she's everywhere, first oprah, now barbara walters, next a nationwide tour. do you have a different opinion of sarah palin through all this? hln's own joy behar has an opinion. we're sure of that. she'll be talking with me this
5:01 pm
hour and taking your calls. want to hear from you. you know the number, 1-877-tell-hln. e-mail me at cnn.com/primenews or send me a text. it's your chance to be heard. welcome once again, this is "prime news." i i'm mike galanos. so many new developments in the death of 5-year-old shania davis. her body was found along a highway in north carolina, the unthinkable allegations against her own mom, antoinette davis charged with offering up her daughter for sex. now police have released her 911 call from that day that little shaniya went missing. listen to mom here crying, pleading for her little girl. >> i woke up this morning and my daughter was not in the house. i don't know if she walked out -- i don't know what's going on, but she's not here. >> how old is your daughter? >> she's 5. >> 5? >> yes, ma'am. >> what time did you wake up?
5:02 pm
when did you last see her? >> i saw her at 5:30 last night. >> 5:30 last night. is that when you put her to bed? >> yes, ma'am -- no, when she went back to bed. >> that was 5:00 this morning, is that what you're telling me? >> yes, ma'am. >> were there any doors open or anything like that? >> she know how to unlock the front door. >> okay. what is her name? >> shaniya davis. there you have it. just moments ago we heard from shaniya's dad. he had custody of her little girl, raised her. just last month he thought he would let shaniya's mom have a little more time with her daughter. >> i believe every parent would blame themselves. and we all look within ourselves to see what we could have done different. >> is there anything you think you could have done differently? >> possibly. u but i really don't want to get into me. this is about shaniya.
5:03 pm
this isn't about brad or antoinette or mr. mcneill. this is about shaniya. >> we'll take your calls at 1-877-tell-hln. joining me now, clinical psychologist michelle golin, also mike eiglarsh and michelle sagona. we have the positive i.d. anything new on who may have done this to shaniya? >> what police released earlier, mike, they said more charges will follow. so we can only assume that those charges will also add up on the two people they have in custody. i can tell you that just a couple days ago when i spoke with investigators, that they did say that they feel they have the two main key players in shaniya's disappearance behind bars right now. now, that's not saying that they won't move forward if there is someone else connected, possibly connect connected to this and will come forward with the rest.
5:04 pm
as far as the charges, we should learn more about those at a press conference scheduled to take place tomorrow morning at 10:00 a.m. from the police department. >> so far, michelle, are they being pretty tight-lipped about how this heinous crime went down, how mcneill may have taken shaniya, went to the hotel? do we know anything from there? >> investigators do know for sure when shaniya left that hotel just outside -- actually in the town of sanford, north carolina, about 45 minutes away from where she was reported missing, that she was alive. what they're not saying is when they think that she was actually killed and then dumped off onto the side of the road about seven miles away from those surveillance pictures you see on your screen right now. that is from that hotel, that she was last seen with mario mcneill last week. >> so heartbreaking to see that. >> it is. >> let's listen to a little more of the 911 call. this is shaniya's mom talking about who was at home at the time. a point of contention, how many people lived there.
5:05 pm
here is antoinette davis again. >> are there anymore juveniles inside the home? >> my son, but he's here. >> and your door was not unlocked? that's what you're telling me? >> no. it was not unlocked. but i'm telling you she knows how to unlock it. i'm hoping she didn't unlock it and walk out. >> there you go. saying little shaniya walked out while she's facing charges that she gave her little girl up as a sex slave. mike eiglarsh, let's get you in on this. these 911 calls aside -- we now know shaniya is dead -- what charges are we looking at for mom here and mario mcneill, the man accused of kidnapping her? >> for mom they already allege they have sufficient evidence that she did the unimaginable, ooechl, to take your own child and prostitute her out. what they're looking for is evidence to prove the link between the trafficking and the ultimate murder. they've got to have evidence. out can't just say, well, she
5:06 pm
trafficked her out and anything that happened to the child is on her. they actually have to have the evidence that she knew something like this would happen. with him, they're doing the same thing. if he was involved in the actual execution of this child, you're going to expect to see first degree murder charges on her. >> spell that out for us. mark, let's say that whoever did this, it was a planned deal, that mcneill delivered to whoever killed shaniya and that's the person who did it. and mom knew and mcneill knew, does that mean murder charges? >> absolutely. it makes these 911 calls even more troubling. just think of the level of depravity that she had to possess to, number one, put her child in that position allegedly. secondly, to do the 911 call and put herself up for the academy award. it's pathetic if that happened. >> when we come back, we'll talk to clinical psychologist mi michelle gollin, how do you put on the act knowing full well you
5:07 pm
sold your little girl as a sex slave. we'll take your calls, 1-877-tell-hln.
5:08 pm
5:09 pm
i hold a lot of ill feelings right now, differently than my brother. the bond with shaniya and i from teaching her how to tie her shoes and how to color within the lines and to write her name, i feel robbed, and i feel shaniya was robbed. she was very intelligent and she had such a wonderful, kind soul,
5:10 pm
and her spirit brightened every day of everyone she touched. >> shaniya's aunt fighting back the tears and emotions. we also grieve the loss of a beautiful 5-year-old girl. taking your calls on this, 1-877-tell-hln. her own mother is facing charges of selling shaniya for prostitution as a sex slave. we also have a mario mcneil, con viced felon, accused of kidnapping shaniya. let's listen to another 911 call. let's get the one set up about what shaniya was wearing. this is her own mother, antoinette davis, what we believe, at least at this point, faking the 911 call talking about what her little girl was wearing. let's listen to this. >> she's mixed, by racial. >> what was wearing? a blue shirt with designs on the front but her hair is out. >> did she have on any pants -- >> she didn't take no shoes, no pants, no nothing. >> did she have on underwear? >> yes, ma'am. >> do you know what color? >> they're white and got pink--h
5:11 pm
i can't really remember. they're like white with pink designs on them. let's bring in our clinical psychologist michelle gallen. this woman is innocent until proven guilty. but from what we're seeing, selling her daughter as a sex slave. how do you get to that point where you can fake it like this on a 911 call when you know what you've done to your little girl? >> clearly a sociopath. we don't know. there's been questions of drug use and so forth. but this crime is horrific. and i have to say the amount of issues involved in this also that needs to be noted and pedophilia in the sense of the selling of shaniya. i think, mike, as a country, we need to look at the sentencing of pedophiles and what is happening. it's in the news all the time. and we just had a man who was
5:12 pm
sentenced to 20 years. that is not enough. >> no. >> at all. 27 years would have only been the maximum. that's the maximum. >> michelle sagona, is it true that antoinette davis is pregnant with another child? >> there are definitely reports out there, and investigators aren't saying one way or another. but it has come out that she could possibly be pregnant with another child as she sits in a north carolina jail cell at this moment. she is in a special portion of the jail, mike, i do want to mention, where she's only allowed to come out one time a day to take a shower. that said, she's by herself: she's not allowed to be around anyone else at this particular point. she does have another court appearance scheduled at the beginning of december. >> i have to leave it there.
5:13 pm
michelle, michelle and mark, we know you're sticking around for this next story. a georgia high school teacher accused of putting out a hit on a 16-year-old student. police say randolph ford told another student he'd pay to have that student, the victim in all this, killed. he's been arrested for making terroristic threats. we'll hear what the victim's mom has to say about all this. take your calls, 1-877-tell-hln. plus this, sarah palin's new book has been released. and she's been on oprah, had an interview with barbara walters. that is just the beginning. seems everyone has an opinion on it. want to hear yours, 1-877-tell-hln. i'm going to welcome that lady, joy behar. she has an opinion. she has not been a sarah palin fan in the past. we'll see what she has to say in a matter of minutes. that's coming up.
5:14 pm
5:15 pm
5:16 pm
welcome back to "prime news" on hln. how about this story, a substitute teacher accused of putting a hit on a 16-year-old student. police say he went on the school bus to try to hire another student to whack the first student in question here. all right. here we go. here is randolph ford, math teacher at a high school outside atlanta, georgia. the 16-year-old told police mr. ford asked him if he was gay, then he says that mr. ford threatened him. then days later police say the suspect pulled another student off the bus and told him he would pay to have him kill the teen. we'll get both sides on this.
5:17 pm
we'll take your calls if you want in. 1-877-tell-hln is the phone number. joining us now marcia kildabrew, her son had the hit put on him. the family's attorney is also with us, terrance madden. let's get this straight here. so september 29th is the what i'm reading here, the teacher asked your son if he was gay. is that how all this started? how did that go down? >> yes, sir. he actually asked my son to come out of class and to -- he asked him was he gay. >> what brought that on? had they had trouble or was that out of the blue? >> no. actually my son didn't even know who this man was. he was a substitute and he had no other dealings with this man besides being inside the classroom. >> then they had a verbal altercation then or the next day? what happened next? >> it was the next day. they had a verbal altercation and the teacher threatened him then and said he would hit him in his -- in miss mouth.
5:18 pm
>> okay. so we have this question asked. we have threats after that. did you go to the school at this point? >> actually, once the threat came through to have him killed, i called the school exactly that day and i didn't get anything from the school. and so at that point i called the superintendent. >> so you didn't go to the school after the altercation? >> i didn't. my son asked the vice principal repeatedly to call me, call me. he said call my mom, call my mom, call my mom. no one would call me. he didn't get suspended or anything or nothing happened with him after the verbal altercation with the teacher. they put him on the bus and went back in the class with the man. >> why didn't you go to the school at that point when your son had this altercation with the teacher? >> actually, i called the school. i didn't go up to the school. i actually called the school. nothing was done at that point. >> okay. terrance, let me get you in on this? are you working with the school on this?
5:19 pm
where does it stand, your relations with the school? >> first of all i want to initially reiterate two things. on the first day, on or about september 29th when my client was asked was he gay, that was so inappropriate, so out of the way and that doesn't belong anywhere in an algebra class which is the class they were in. on the next day when the verbal altercation ends, she was a little bit kind. i think it was closer to that i will hit you in your fing mouth is what the teacher told him. my client did go to the principal's office and report this to the vis principal. we want to reiterate that. he's coming up with -- i've seen reports he's coming up with all kind of things and excuses. however, he did not go to the authorities, being the principal or vice principal and report this incident while my client did. nothing was done about it. >> we have it to the point where this teacher allegedly goes on the bus and he's asking another
5:20 pm
student to basically take care of, marcia, of your son. that's the way we understand it? >> yes, sir. >> what's the other student say? let me ask that? is another student kroob rating this, the person this teacher allegedly went to? >> yes. >> yes. >> let me stay with you, marcia, what happens now with the school? you unveil this. what has happened? what do they say at this point? >> actually the school doesn't contact me unless i contact them. the school at this point hasn't offered me even an apology. they haven't offered my son an apology or anything at this point. the school hasn't done anything really. >> okay. >> we want to reiterate that had on september 30th something been done, appropriate action been taken, we never would have gotten on or about october 9th when he pulls a student off the bus. my client is saying that what he did was ask the student did he want to make a hit for money.
5:21 pm
when the student asked who, this teacher wrote my client's name on a piece of paper and held it up, not only where the student that he solicited saw it, but also other students who were on the bus saw it and made it clear to my client that the teacher was talking about him. >> he's saying this was a joke? is that part of his excuse at this point? he's on paid leave, that is correct, at this point? >> that's correct. he's on paid leave. this has been since october -- approximately october 9th. the question you asked before, you know, they're proposing it as a joke. what kind of joke? first of all, you have to go back to september the 29th when he's asked this inappropriate question. then it escalates to where he has a verbal threat to hit him in his f'ing mouth. >> we appreciate it. we'll hear from the school side when we come back. stay with us. y8

welcome back to "prime news" on hln. advice for women, skip the mammogram until you're 50. is that right? i'm sure there are a lot of women out there confused after this. government task force issuing a new recommendation says mammograms in your 40s could do more harm than good. is this sending a dangerous message to women who may have their lives saved by early detection? we'll take your calls on that, 1-877-tell-hln. sarah palin on a media blitz. she's everywhere, promoting her new book "going rogue." yesterday saw her on "oprah." today a bigger view with barbara walters. sarah palin defending her record and getting feisty.
5:31 pm
here she is on good morning america talking about the personal attacks that have hit her and her family. >> no candidate was picked on and made fun of as much as you were. >> oh there's so much bull crap out there about my family, my record, my state. it hurts when i hear the negativity about the state of alaska and, of course, my family. so a lot of bull. >> a lot of bull, bull crap, sarah palin laying it out there. let's bring in my colleague joy behar of the joy behar show tonight at 9:00 eastern on hln. are you seeing a different side of sarah palin at all? are you softening to her in any way through all this in these interviews? >> you know, i love a bitter woman. she's a bitter woman. >> you're seeing bitterness, huh? >> she says it's not a vindictive book, but i don't think she's read the book. >> how much have you seen of it? you've seen the interviews? >> i've seen the two barbara
5:32 pm
walters interviews, of course, this morning from "good morning america," and i saw a lot of oprah's interview, not the whole thing, because i was busy, coming to do my show. but i've seen a lot of it. i think she's just the same as she's always been. although her sentences were slightly more coherent this time. >> how about your colleague, barbara walters, i was watching her on "good morning america," dubbed her a smart girl, confident, appealing and some coming to her defense even "the view" today, saying whether you like her or not, she has views and you can agree or disagree. what about that? >> they were coming to her defense on "the view" today because of the "newsweek" cover they said was very sexist. i think that the main thing with the "newsweek" cover, the american flag. she posed for that picture forerunner's world, and i don't think she appreciated the fact that the flag was thrown around in some would say this disrespectful manner. she posed for it.
5:33 pm
that was her call. now it's coming up again. i think that's really what's ticking her off more than anything. >> you mentioned it. this is sarah palin reacting to the "newsweek" cover taurk together your friend and colleague barbara walters. let's listen. >> have you seen the cover of "newsweek," a picture of you in shorts from a photograph that was taken for "runner's world" magazine. how do you feel about them showing you like that on a cover? >> i think it is so cheesy. had i known then that a picture of me in shorts would end up on the cover of "newsweek," i wouldn't have allowed "runner's world" to profile me. "knewsweek" should be more policy oriented, more substance osh yented than showing some gal in shorts on the cover. >> let's pick up on that. i think you were -- you correct me if i'm wrong, in watching what i saw on "the view" with
5:34 pm
your colleagues, you were the only one saying this wasn't wrong. it sounded like whoopie was saying this was wrong, elizabeth hasselbeck as well, she's not being treated fairly, this was a cherry-picked shot from "runner's world." >> why is it cheesy on runner's world but not news week. she supposed for a cheesy picture. it's going to pop up again. was tlnt drawing or a pick tif of obama looking very -- they oild his body and made him look very sexy or something. >> there it is, we got it. >> washingtonian. but that's not quite news week. >> washingtonian souns more news weeky than "newswreak." seems to me that's a legitimate periodical, the "washingtonian." >> there was that shot there. let's get a call in.
5:35 pm
beverly is with us. your comment or question for joy? >> caller: i have a comment. i love sarah palin. i was a democrat all my life. this is the first time i voted. it was because of her. i think a lot of people are jealous of her. i think instead of them harping on her, let's get on levi and have him shut his mouth. >> anti levi, pro sarah there. >> he has been shooting his mouth off. he said some very scathing things about her in "vanity fair." we don't know who is making up what. this is a soap opera now. this is not a presidential candidate anymore. she's a reality show character and a soap opera actress. >> what would she v to say or do for you to say maybe she has a political future? >> she'd have to give some kind of opinion on policy. i haven't heard her say anything about it. she talks about obama digitering. first of all, she stole the word
5:36 pm
from cheney, not that he create ed the word "digitering." maybe there's no concept to giving thought to something. when you're thinking of something they call it digitering. i would like to hear what she has to say about our policy in afghanistan, about the health care issues. i haven't heard her really give us any of her insights into what we should do with the country. >> joy, good talking to you. joy behar on monday through friday here on hln, 9:00 eastern. pleasure talking to you. >> okay, mike. thanks. we'll continue our conversation, take more of your phone calls on sarah palin, what your thoughts are. has she i'mmpressed you or not? you know the number, 1-877-tell-hln. sglvrnlths sglfrnlths

we're continuing our conversation, sarah palin on a media tour promoting a new book, "going rogue." we saw her with oprah win free, also a big interview with barbara walters. 1-877-tell-hln is the number. joining me kelly goth, political blogger and contributor to the huffington post. sharon gentleman koeb bass, strategist for the hill. kelly, i'll start with you. how is sarah palin doing in these interviews?
5:40 pm
holding her own or doing well with oprah and barbara walters so well? >> i think she's coming across as very genuine. it's clear when she's talking about topics she's comfortable with, her family and faith, she's coming across very well. there's no one that has ever doubted she's not a great retail politician, that there's something to work with in terms of her skills with appealing to people and relating to people. >> sherry, what's the goal for sarah palin? what does she need to accomplish in these interviews besides the book? just to begin to remake herself in some ways? >> regardless of whether she wants to run for president at some point in the future or not, what she's doing now is just the right thing, letting the country know her on her terms, be able to correct a few misconceptions. this is something that she quite frankly was unable to do when she was placed on the ticket and things were moving so quickly and people were controlling her. the next step is to go out and raise money and build her
5:41 pm
network of republican base around the country, in her own organization. that would prepare her to run in 2012. then and only then should she get into the subsive issue stuff. barack obama waited and waited and waited, everybody wanted him to get into it. he didn't. it would give people more reasons to throw arrows at her now. when she does come out very strong and intelligent, a lot of people will have egg on their faces. they weren't paying attention to sarah palin before she was on the national ticket. >> let's get a call in janice in illinois. go ahead. >> caller: i watched joy and i watched oprah. sarah is a joke. she wants her 15 minutes of fame. she's uninformed, inexperienced. she could do nothing for us. she is not a woman of substance about the issues. i agree with joy all the way. >> janice, what have you seen in these interviews where she's coming off as uninformed. she's not talking policy.
5:42 pm
she's just talking her own life. >> caller: i know. even when she has an opportunity to talk about policy, she doesn't do it. it's like general, it's not even specific. i'm sorry. she has nothing to contribute to us or the world. >> janet, not a fan there. let me throw out this point. i don't think it's the time for her to talk policy. when she's a candidate again or heading that way, then let's hear policy. at this point -- >> exactly. >> the goal is, just set the record straight. >> i think any politician would probably give their right arm to have the level of name recognition and the base of support that sarah palin has right now. so that's -- i think any liberal that underestimates her or misunderestimates her. i think she didn't necessarily change critical opinion in the oprah interview. one of the biggest criticisms of her is exactly what the caller
5:43 pm
said, voters think she's uninformed. that's going to be a problem in terms of the long term. i will agree with something sheri said, one of the lns barack obama had an advantage is he had been running so much longer. sarah palin had three months to convince people she was up to speed. i think that's what put her at a disadvantage and lingered and hurt her brand in that regard. >> keli i agree that at some point she hats to come with the policy and substance and all that. i'm saying i don't know if now she has to do that. maybe this is step one, step two is that. i'll get your thought on that. >> i think it would be ill advised for her to go out and give policy speeches another this point in time. she's doing this at exactly right the pace. yes, she has her critics out there. some are republicans, some are democrats, some are independents. i think a lot of those people will have egg on their face when she comes out hard core policy. this woman is very deep in policy as governor of alaska prior to being named on the ticket. anybody who pays attention to that will know and will know
5:44 pm
what's coming next. >> real quick. if we could get the "newsweek" cover back. i think it's unfair that they would take the shot from "runner's world." how do wow solve a problem like sarah? isn't that a cheap shot, to swipe this shot? >> i'm going to say something that i said a lot about the hillary clinton supporters, i don't think necessarily the color is sexist. i think it's stupid. there is a difference. i would say this. the thing about her and her supporters, you can't have it both ways. i think she's an attractive woman who has benefited from that. rush limbaugh would agree with that statement because he calls her a babe. i don't think you can have it both ways saying why are people objectifying me when that has benefited her. i think it's a stupid cover, not necessarily a sexist one. >> sheri. >> sarah palin's politics are to
5:45 pm
the right of my own. as a woman i want to see her succeed or fail on her own. it bothers me that they're focusing so much on her looks. she did not pose for "newsweek" for this cover. we've seen past presidents that didn't look so nice in their running shorts. it's out there and i don't know if complaining about it does any good. let's get it out of the way so we can get into the subsive matters as we get closer to 2012. >> good, spirited conversation as always. appreciate it. hope to talk to you soon. coming up. this one has the attention of a lot of people out there, government task force issuing a new recommendation on mammograms, saying women should skip the procedure until age 50? currently women are told to have a yearly mammogram beginning at age 40. is this sending a dangerous message out there? isn't early detection a good thing? we'll take your calls, 1-877-tell-hln.
5:46 pm
5:47 pm
5:48 pm
welcome back to "prime news" on hln. this got our attention. new findings, new cancer advice that goes against everything we've been told. here is the new advice, no mammograms until age 50. government task force says women in their 40s should skip that routine mammogram. why? because it could cause more harm than good. this is from a panel of 16 health experts. not one of them is an oncologist. does this send a confusing message to women? maybe they'll skip the mammogram when they need it? we'll take your calls, 1-877-tell-hln. joining me to talk about this, rechb nay sca reg renee skyla with the susan g. komen cancer. and dr. douglas owens who led a
5:49 pm
2007 study with similar findings, basically agreeing with this new call here. renee, let me start with you. are you concerned that some women may hear government study and skip the mammogram when maybe they need it? >> let me just preface this by saying i'm not a doctor. i'm just an advocate, i'm someone who travels the country and speaks to a lot of women about breast cancer. when i heard this last night, mike, i could not sleep. i was so disturbed by this because it feels like we're taking a giant step backwards. i think that there's already a lot of confusion and a lot of noise out there about this. and i feel like this just adds to it. yes, i'm very concerned. >> you would think better safe than sorry, i think that has been the -- kind of the adage here. let's start the mammograms, get the early detection. you said you speak to women and talk to women about this. how do you think they're going to take this new sns. >> listen, i talk to women around the country who say they found their own cancer through
5:50 pm
breast self exam. the things that were troubling to me about this guideline are they're telling doctors don't teach your patients breast self exam because it doesn't do any good. i talk to womengood. i talk to women who tell me every day i found my own cancer. or women in their 40s who were diagnosed found their cancer in a mammogram. only 15% of cases are women in their 40s, but one person's life we save that makes it worth it. >> doctor douglas owens, similar findings, do you agree flat out, doctor, for women who aren't in high-risk category to wait until they are 50? >> the first thing is to understand what the task force is recommending. women in their 40s make individually based decisions about whether they want to start mammography screening.
5:51 pm
we had thorough analyses of benefits of mammography, and there are benefits and thorough analyses of mammography and there are potential harms. how do you balance benefits and harms, our view was not all women would make the same decision. it would balance the harms the same way. >> they said the harms, according to this task force they said the harms were increased anxiety and unnecessary surgeries. look, i'm a big girl. we can deal with anxiety. i don't want to deal with a breast cancer that is stage two or three that could have been checked and taken care of had i been screened a couple of years ago. we will get dr. owens in and dr. weiss. what are insurance companies going to do with this? that is a concern.

joy behar has an opinion on this. i'm going to be talking to her this hour. we take your phone calls, call in, 1-877-tell-hln. e-mail me cnn.com/primenews or send me a text hlntv. it is your chance to be heard. this is hour number two of "prime news." i'm mike galanos. new developments in the death of shaniya davis. police confirm her body found along a highway. antoinette davis charged with offering her daughter up for sex. the 911 call from the mother. >> i woke up this morning and my daughter was not in the house. i don't know if she walked out. i don't know what's going on but she's not here. >> how old is your daughter? >> she's 5.
6:02 pm
>> 5? >> yes, ma'am. >> what time did you wake up? when did you last see her? >> i saw her at 5:30 last night. >> is that when you put her to bed? >> that is when she went back to bed. >> that was 5:00 this morning? >> yes, ma'am. >> were there any doors open? >> she knows how to unlock the front door. >> okay. what is her name? >> shaniya davis. >> that mom is accused of selling shaniya for sex. the little girl ended up dead. joining me to talk about this, mark iglarsh, michelle sigona, investigative journalist. mark, i want to start with you. what does a judge and jury do
6:03 pm
with what could be a bogus 911 call and feigned tears. >> i'm looking for something that outs here. i don't hear anything that she knew her child had been gone. the defense says this is not fake. this is real. that is what they use to show this is a grieving mother who has no idea where her daughter went. >> that is what the defense. prosecution is going to come with evidence that says that is garbage. >> how sick. what kind of woman could make a call to 911? the same type of woman, the evil in her heart that would sell her child into prostitution. >> it is unthinkable. hannah in ohio. your thoughts here? >> caller: yes. my question is they show footage of her going into the hotel. but what about the footage of her leaving the hotel if they
6:04 pm
are so sure she was alive. >> great question. what do we know, michelle, about this same surveillance camera picked up or we believe would have picked up shaniya taken out of the hotel room. >> that is a very good question, hannah. a lot of times investigators will hold back portions of surveillance tape, portions of photos hoping people will come forward so they can confirm information we have. only release a few snapshots of the child in mario mcneil's arms to be able to verify that, yes, this is shaniya, yes, this is mario mcneil. we are able to charge him and move forward. he is not convicted. he is charged with first degree kidnapping. what investigators know i can only assume from the video footage they saw on these surveillances her leaving
6:05 pm
probably alive. that is why investigators were able to tell everyone today we know when she left that hotel in north carolina that shaniya was alive. though they may hold those photos back for a reason, for the courtroom. >> it is so heartbreaking to see this little girl, the last photos in the surveillance shots, a sleepy eyed little 5-year-old clinging to the mario mcneil character. let's talk about him, mark. let's clarify for everybody, if he is the person who gave shaniya up to whoever bought her as a sex slave, that is kind of what we are looking at, is he an accomplice to murder? >> potentially. it hinges on what specific evidence they have. morally is one thing. i'm sure some of your viewers say hang them both. legally the burden is on the
6:06 pm
prosecution to show beyond a reasonable doubt there was sufficient evidence he played a role in the child's death. >> playing a role in getting shaniya to whoever did this to her. >> absolutely. if he knew that would lead to her demise. the mom gave me the child to hold temporarily and i gave her over to someone else, hey, i didn't know the child would be harmed. >> let's take a quick break. when we come back we will go to michelle and what we know about what went down. we will take your calls at 1-877-tell-hln.
6:07 pm
6:08 pm
6:09 pm
>> are there anymore juveniles inside the home? >> my son but he is here. >> your door was not unlocked? >> it was not unlocked. i'm hopes she didn't unlock it and walk out. >> that was antoinette davis, shaniya davis' mom. the 5-year-old was found dead, found on the side of the highway. we'll take your calls 1-877-tell-hln. let's bring back michelle sigona, our criminal defense attorney mike iglarsh. the 911 calls is a revelation, especially we know that mom is accused of selling shaniya for sex. mcneil charged with kidnapping. what else do we know? as far as a timeline as far as what happened to shaniya? >> what is interesting is now this 911 call came out, that
6:10 pm
trailer they lived in is very small. it is only 12 by 40. they had according to the manager of the sleepy hollow park, antoinette, her son, shaniya, her sisterened a boyfriend and her sister's son as well. if anyone were to get up in the middle of the night or anything for that matter, you would hear them. you would pass by someone. you would definitely see something. the fact that she calls in and allegedly hears nothing and all of a sudden her daughter is gone doesn't really add up. if you remember, barbara davenport put up four surveillance cameras throughout the sleepy hollow community. what barbara told me when she checked that surveillance she saw people come out of that trailer and look around as if they were looking for a child who had went missing. so these are very interesting developments. >> the timeline is not adding
6:11 pm
up. she put her down at 5:30 in the morning and is surveillance video at the hotel she is there at 6:00. it is an impossible drive to get there. >> with those facts and what michelle just added the 911 call takes on a whole different meaning. you have the other corroborating evidence the prosecutors and investigators will bring in. compare that to what she is alleging and the whole thing is exposed. lynn is with us in iowa. comment or question? >> caller: yes. i'm not understanding why she called 911. if this was what she was going to do, prostitute her daughter, maybe she got scared because the guy didn't bring her back when he was supposed to. >> i'm guessing this is part of the ruse to take the attention to her in selling her daughter as a sex slave.
6:12 pm
mark? >> we've seen it in high-profile cases. people call into 911 and get the tears rolling and need a cover. social services, people are going to start to look or she is innocent. those are the two options. >> michelle, that is what police are at this point they are believing as mark is saying those tears are worked up and it is part of a cover? >> this is definitely a possibility. again, antoinette and mario mcneil are innocent until proven guilty. they have charges stacking up against them. police did mention today that more charges are expected to be filed tomorrow. we should learn a little bit more. when the autopsy comes back. that is being conducted right now. we can really in a few days tell the manner in which shaniya died and possibly how long she had been in that location? >> are there past abuse
6:13 pm
allegations against shaniya or the brother? >> dss will not confirm anything involving children. dss has responded to complaints with antoinette and her children. her other son is in foster care. as soon as all this took place that is where he was taken. >> we have to leave it there. coming up, a georgia high school teacher accused of putting out a hit on a 16-year-old student. randolph ford said he told another student he would pay him to have the other student killed. we will have that, from the school, the alleged victim talking. >> sarah palin's new book "going rogue" is out and she is out. what do you think? how is sarah palin doing?
6:14 pm
6:15 pm
6:16 pm
welcome back to "prime news" on hln. a substitute teacher is accused of putting a hit on a 16-year-old student. cops say he went on the school bus to hire another student to whack the first student in question. randolph ford, math teacher, a high school out of georgia. mr. ford asked him if he was gay. and mr. ford threatened him. and he pulled another student off the bus and said he would
6:17 pm
pay to have him kill the teen. we will take your calls, 1-877-tell-hln is the number. marcia killebrew. let's get this straight. september 29th the teacher asked your son if he was gay? is that how this started? >> yes, sir. he asked my son to come out of class and to -- he asked him was he gay. >> what brought that on? had they had trouble or was it out of the blue? >> no. my son didn't know who this man was. he was a substitute. he had no other dealings with this man besides being inside the classroom. >> they had a verbal altercation then or the next day? >> the next day they had a verbal altercation and the teacher threatened him then and he said he would hit him in his mouth.
6:18 pm
>> okay. so we have this question asked. we have threats. did you go to the school at this point? >> actually, once the threat came through to have him killed i called the school exactly that day and i didn't get anything from the school until at that point i called the superintendent. >> so you didn't go to the school after the altercation? >> i didn't. my son asked the vice principal to call me. he said call my mom. call my mom. call my mom. no one would call me. he didn't get suspended or anything and nothing happened after the verbal altercation with the teacher. they put him on the bus and he went back in the class with the man. >> why didn't you go to the school at this point when the son had this altercation at this point? >> actually, i called the school. i didn't go up to the school. i called the school but nothing was done at that point. >> terence, let me get you in on this. are you working with the school
6:19 pm
on this? >> first of all, i want to initially reiterate two things. one, on the first day, on or about september 29th when my client was asked was he gay, that was so inappropriate so out of the way and that doesn't belong anywhere in an algebra class. the next day on the verbal altercation, she was a little bit kind. it was closer i will hit you in your f 'ing mouth. my client did go to the principal's office and reported this to the vice principal. we want to reiterate this. he is coming up with all kind of things and excuses. however, he did not go to the authorities being the principal or the vice president principal and report this incident while my client did and nothing was done about it. >> we have it to the point where the teacher allegedly goes on
6:20 pm
the bus and he is asking another student to basically take care of marcia, your son? >> yes, sir. >> what did the other student say? is another student corroborating this? the other student the teacher allegedly went to? >> yes. >> yes. >> marcia, let me stay with you. what happened with the school? what do they say at this point? >> actually, the school doesn't contact me unless i contact them. the school at this point hasn't offered me even an apology. they haven't offered my son an apology or anything at this point. the school hasn't done anything, really. >> again, we want to reiterate it, on september 30th had appropriate action been taken we never would have gotten to on or about october 9th when he pulls a student off the bus. my client is saying that what he did was ask this student did he want to make a hit for money
6:21 pm
when the student asked who, this teacher wrote my client's name on a piece of paper and held it up, not only where the student he solicited it saw it, but other students on the bus saw it and made it clear to my client the teacher was talking about him. >> he is saying this was a joke? that is his excuse at this point. he is on paid leave, is that correct? >> yes. that is correct. he is on paid leave since approximately october 9th. the question you asked before, they are proposing it as a joke. what kind of joke. >> no. >> first of all, you have to go back to september 29th when he is asked this inappropriate question. then it escalates where he had a verbal threat to hit him in his f'ing mouth and asking a student how is my client going to take it. >> thank you. we will hear from the school when we come back. @@@@@@i

welcome back to "prime news" on hln. new cancered a sfris women. skip the mammogram until you are 50? i'm sure a lot of women are confus confused. government task force saying mammograms in your 40s could do more harm than good. is this sending a dangerous message to women who may have their lives saved by early detection. we will take your calls 1-877-tell-hln. sarah palin everywhere. yesterday on "oprah." today big interview with barbara walters. we have snippets of that. here she is on "good morning
6:31 pm
america" talking about the personal attacks that have hit her and her family. >> no candidate was picked on and made fun of as much as you were. >> oh, there's so much bull crap about my family, about my record about my state. it really hurts when i hear the negativity about the state of alaska and, of course, my family. so a lot of bull. >> there you go. bull. bull crap. sarah palin laying it out there. let me bring in my colleague joy behar. we will take your calls as well. 1-877-tell-hln. all right, joy, are you seeing a different side of sarah palin at all? are you softening to her in any way in all this? >> i love a bitter woman. she's a bitter woman. >> you're seeing bitterness. >> she says it is not a vindictive book but i don't think she has read the book. >> how much have you seen of it? >> i've seen the two barbara
6:32 pm
walters interviews from "good morning america" and a lot of oprah's interview. not the whole thing because i was busy. i've seen a lot of it. i think she's the same as she's always been. but her sentences were slightly more coherent. >> barbara walters dubbed sarah palin a smart girl, confident, appealing. some were coming to her defense on "the view" today saying whether you like her or not she has some views. what do you think of that? >> they were coming to her defense because of the "ne ""newsweek" cover was sexist. the main thing was the american flag. she posed for that picture for "runner's world." i don't think she appreciated the flag was thrown around in somewhat disrespectful manner. she posed for it.
6:33 pm
that was her call and now it is coming up again. that is what is ticking her off more than anything. >> this is sarah palin reacting to the "newsweek" cover. this is talking to your friend and colleague, barbara walters, let's listen. >> have you seen the cover of "newsweek." it is a picture of you in shorts from a photograph that was taken for "runner's world" magazine. how do you feel about them showing you on a cover like that? >> it think it is so cheesy. had i known a picture of me in shorts would end up on the cover of "newsweek." i would not have let "runner's world" profile me. it is wee bit degrading. "newsweek" should be more policy oriented more substance oriented than showing some gal in shorts on the cover. >> let's pick up on that. i think -- you correct me if i'm wrong, watching what i saw from
6:34 pm
"the view" you were the only one who said this wasn't wrong. whoopi was saying this was wrong, obviously, elisabeth has hasslebeck as well. >> why is it cheesy on "runner's world" not ""newsweek"? she posed for a cheesy picture. it is going to pop up again. wasn't there a drawing of obama looking very -- they oiled his body and made him look sexy. >> the "washingtonian" is not "newsweek." >> "washingtonian" sounds more ne newsweeky than "newsweek." >> not quite "newsweek." there was that shot there. let's get a call in.
6:35 pm
beverly is with us. your comment or question. >> caller: i have a comment. i love sarah palin. i was a democrat all my life. this is the first time i voted and it is because of her. i think a lot of people are jealous of her. i say instead of hopping on her, let's get on levee and tell him to shut up. >> he has been shooting his mouth off. he said scathing things about her in "vanity fair." we don't know who is making up what. this is a soap opera. this is not a presidential candidate. she is a reality show character and soap opera actress. >> what would she have to say or do so you could say, huh, maybe she does have a political future? >> she would have to give an opinion on policy. she talks about obama diterring, first of all, she stole that
6:36 pm
word from cheney. but maybe there is no concept of giving thought to something. when you are thinking of something they call it ditherring. i would like to hear her insights in health care, or afghanistan. i have not heard her insights on the country. >> the clock has ticked off. she is on hln account eastern. >> joy, it has been a pleasure talking to you. >> okay, mike, thanks. we will take more of your phone calls. has she impressed you or not with these interviews with oprah, barbara walters?

6:39 pm
welcome back to "prime news" on hln. sarah palin on a media tour promoting her new book "going rogue." we saw her with oprah winfrey. big interview with barbara walters. we are taking your calls, 1-877-tell-hln. joining me to talk about this, kelly goth, contributor to huffingtonpost. kelly, how is sarah palin doing in these interviews? is she holding her own or doing well?
6:40 pm
>> look, she is coming across as very genuine. when she is talking about topics she is comfortable with, her family, her faith, she comes across well. the only time she comes across not so well is big global issues she is not competent. no one has doubted she had skills to relate to people. >> what is the goal for sarah palin? what does she need to accomplish in these interviews besides the book to begin to remake herself? >> regardless of whether she wants to run for president at some point in the future or not. what she is doing is the right thing. she is letting the country know her on her terms, correct misconceptions. this is what she was unable to do when she was placed on the ticket and other people were controlling her. the next step would be to raise money and build her network republican base around the
6:41 pm
country in her own organization. that would prepare her to run in 2012. then and only then should she get into the substantive stuff. barack obama waited and waited and waited. when she does come out and i fully expect she will, very strong and intelligent a lot of people will have egg on their faces. they are not paying attention to the sarah palin before she was on the national ticket. >> let's get a call in real quick. >> caller: hi, mike. listen, i watched joy and i watched oprah and sarah is a joke, man. she wants her 15 minutes of fame. she is uninformed. she is inexperienced. she could do nothing for us. she is not a woman of substance about the issues. i agree with joy all the way. >> what have you seen in these interviews where she is coming off uninformed. she is not talking policy. she is talking about her own
6:42 pm
life. >> caller: i know. when she has an opportunity to talk about policy, she doesn't do it. it is general. it is not specific. i'm sorry. she has nothing to contribute to us or the world. >> janet not a fan. let me throw out this point. i don't think it is time for her to talk policy. when she is a candidate again or heading that way let's hear policy. >> exactly. >> at this point set the record straight. kelly, i'll let you have first shot at that. >> any politician would probably give their right arm to have the level of name recognition and base of support that sarah palin has right now. so i think any liberal that underestimates her or misunderestimates her as former president bush would say, does so it their own peril. she didn't necessarily change critical opinion in the oprah interview. one of the biggest interviews is what that caller said. voters think she is uninformed.
6:43 pm
that is going to be a problem in terms of the long term. i will agree with what sherry said. one of the reasons is barack obama had an advantage is he was running so much longer. she had three months and that put her at a disadvantage. >> kelly, i will agree with you to a point, at some point she has to come with the policy and substance. >> she has time. >> sherry, i'll get your thought on that. >> i think it would be ill-advised to give policy speeches. yes, she has her critics out there. we've heard them all. some are republicans. some are democrats. some are independents. a lot of those people will have egg on their face when she comes out in policy. she was deep into policy as governor of alaska. anybody who pays attention to that will know what is coming next.
6:44 pm
>> robin, if we can get the "newsweek" cover. i think it is unfair that "newsweek" would take is this shot from "runner's world." isn't that a cheap shot to swipe this shot or what do you think? >> let me say this. i'm going to say something i said a lot about the hillary clinton supporters complaints about sexism, i don't necessarily think the cover is sexist. i think it is stupid. there is a difference. i would say this, the thing is you can't have it both ways. sarah palin is an attractive woman and she has benefited. i think rush limbaugh would agree because he calls her a babe. i don't know if you can have it both ways when people are object fiing me when that has benefited her. it is stupid not sexist. >> i just want to say sarah palin's politics are to the right of my own. as a woman i want her to succeed
6:45 pm
or fail on her own. it bothers me they are focusing on her looks. she did not pose for "newsweek." you saw the barack obama pictures of him looking very nice with his shirt off. we see that quite often. we see past presidents who didn't look so nice. it is out there. let's get it out of the way so we can get into the substantive matters closer to 2012. >> good spirited conversation. coming up, this one has the attention of a lot of people. government task force issuing a new recommendation on mammograms saying women should skip the procedure until age 50. currently women are told have a yearly mammogram beginning at age 40. isn't early detection a good thing?
6:46 pm
6:47 pm
6:48 pm
welcome back to "prime news" on hln. this got our attention. new findings, new cancer advice that goes against what we have been told. no mammograms until age 50? a government task force says women in their 40s should skip the routine mammogram. why? because it could cause more harm than good. 16 health experts, not one of them is an oncologist. does this send a confusing message to women? maybe they'll skip the mammogram when they need it. rene skyler. ambassador for the susan g. komen foundation. dr. marissa weiss.
6:49 pm
dr. doug owens who found similar findings in a 2007 study. rene, are you concerned some women may hear government study and skip the mammogram when maybe they need it? >> let me preface this by saying i'm not a doctor. i'm an advocate. i travel the country and speak to a lot of women about breast cancer. when i heard this last night, mike, i could not sleep. i was so disturbed by this because it feels like we are taking a giant step backwards. there is already a lot of confusion and noise and i feel this just adds to it. so, yes, i am very concerned. >> you would think better safe than sorry. that has been the addage here. start the mammograms, get the early detection. you said you speak to women and talk to women about this. how do you think they are going to take this news? >> listen, i talk to women around the country who say they found their own cancer through
6:50 pm
breast self-exam. the things troubling to me about this guideline is they are telling doctors don't teach your patients breast self-exam because it doesn't do any good yet iself-because it doesn't do any good and yet i talk to women every day who say i found my own cancer during a self-breast exam or women in their 40s who were diagnosed their cancer was found on a mammogram. yes the majority of cases don't thon women in their 40s. only 15% of cases are women in their 40s. but still, it's just one person's life we save, to me that makes it worth it. >> yeah, exactly. let's bring in dr. douglas owens. again led the american college of physicians. 2007 report, similar findings. do you agree, flat-out, that, doctor, that for women who aren't in a high-risk category to wait until they are 50, do you think that's the way to go? she mike, first thing to understand is what the task force is recommending and their recommendation is that women in their 40s make individually based decisions about whether or not they want to start mammography screening. we studied this at american
6:51 pm
college physicians and we have more thorough anal seefrts benefits of mammography and there are clearly benefits, and unfortunately there's -- we also had thorough analyses of the harm's of mammography and there are potential harms. and so the question is how do you balance the benefits in the harms and our view was that not all women, if they were presented with this information would make the same decision or would balance those harms the same way. >> dr. owens, we have -- >> they say the harms, accordings to the task force were increased anxiety and unnecessary surgeries and i guess i am just trying to say listen i'm a big girl like so many of the women who i talk to. we can deal with anxiety. i don't want to deal with a breast cancer that's a stage 2 or 3 that could had been checked and taken care of had i been screened a couple of years ago. >> we'll get dr. owens in on there and dr. weisz and i will talk about what are insurance companies going to do with this?

tonight, incomprehensible horror. a 5-year-old girl allegedly sold as a prostitute. killed and dumped on the side of the road. stun, churning new developmentless in the case of shaniya davis. her body's just been identified by police. but somehow this case gets even more hellish. cops say this little angel was sold as a sex slave by her own mother. now that mother, tonight behind bars, is reportedly pregnant again. we'll have her tearful 911 call that cops say is completely fake. little shaniya last seen being carried into a hotel room by a grown man. god only knows what happened next. and toxic tales in an addict
7:01 pm
nation. cops say a 1-year-old child was left home alone. so her mom could smoke crack and get boozed up. this little girl was found wandering the streets. she was found by strangers. but her mom didn't claim her for 24 long hours. and get this, this woman just got a job working for family and social services? i can't make this stuff up. plus, the nightmare escalates in the missouri house of horrors. fast-breaking developments in. a new victim's stepped forward claiming these men locked her in the basement repeatedly raped her and buried her newborn child alive. and that's just the beginning. three of the victims now claim they were forced to kidnap and murder a complete stranger. of all of the toxic families ever uncovered, is this the worst? "issues" starts now. tonight, a father's worst fear's confirmed. the body a small child has been positively identified as that of

his precious 5-year-old daughter, shaniya davis. devastated dad, bradley lockhart, choked bacters just hours ago. >> i'm very appalled and disgusted to that fact that anybody can bring themselves to that. however with the faith of the lord that we could cleanse ourselves and ask for forgiveness and forgive those who've done this disgusting act. >> amid this devastating news, outrage, grief and disbelief has swept the north carolina community and the nation. police are accusing this little girl's mom of the unthinkable. shaniya's mom, antoinette davis is accused of selling, that's right, selling her 5-year-old daughter into sexual slavery. police alleged she allowed shaniya to be carried off to a hotel room by her sister's ex-boyfriend, mario mcneill, the trusting little girl, holding onto the man with no idea of what horror likely awaited her. so trusting. cops say shaniya and her alleged

kidnapper were at that hotel for an hour. look at that little girl. police believe the child was alive when they left. huh, i can't take looking at that child. meantime, another layer of jaw-dropping claims. cnn affiliate wral reports that the dead child's mom, as she sits behind bars tonight, is pregnant again. the reported father of her unborn child, are you sitting down? the very man she allegedly tried to frame in the abduction of her daughter. as for shaniya's disappearance, listen to this mom in her chilling 911 call, police now say, which you're about to hear, all an act. >> 911, what's your emergency?
7:04 pm
>> whatever! we'ring about to look at all of
7:05 pm
the inconsistencies in that statement in a moment. antoinette davis, charged with human trafficking and providing her 5-year-old daughter for sexual serveittude and prostitution. tonight's big issue, is there a child sex crisis in this country? i believe there is. call me, 1-877-jvm-says. straight out to my absolutely fantastic expert panel. susan filan, defense attorney and former prosecutor. glad to have you here tonight. also delighted to have judge greg mathis, host of "the judge mathis show." and as well as jeff riccio from tar heel canine training inc. the company that discovered this poor child's body. well done, sir. >> thank you. >> michelle sigona, investigative reporter and founder of michelle sigona.com. we start with you. what is the very latest? >> the very latest right now, jane, is that, obviously just a few hours ago shaniya's body was positively identified from investigators. there is an autopsy that's being performed on that body right now
7:06 pm
which will tell investigators a lot about -- if she was sexually assaulted. how long the body was outside exposed to the elements. and a little bit more about how shaniya's died so that's what we're waiting for. we'll learn more tomorrow about that tomorrow morning at 10:00 a.m. in a press conference and investigators also came out today season said they do expect more charges to be filed. now whether those charges will come down against antoinette and also mario mcneill, who's being held for first-degree kidnapping right now, it is hard to tell. but that is something that we're waiting to hear about for tomorrow. as far as antoinette and mario, they're bogbeating held in a special portion of the jail right now where they're only allowed to come out once a day and that is only for a shower and then they're brought back in. >> well, if these allegations are true, they need to reserve a special place in hell for people who do something like this. but they're only accused. they're not convicted yet. >> that's right. >> here's what i have to ask you before we go, michelle sigona, the child was reportedly found wearing only a t-shirt.

obviously that would be a sign that would point toward sexual assault since she was last seen in the photograph dressed up and they're saying that they have caught the two main players. is that what you're hearing from police? >> that is what i heard from police. almost three days ago. they said that they feel athis particular moment that they do have the two key players in this investigation. but that's not saying, jane, as you and i both know, that more people could eventually be arrested or more charges could be filed against them. >> well, here's what i don't understand. susan filan, you're the former prosecutor. you've done so many of these cases. play dktsive for a moment. supposedly the mother allegedly sellless the child into sexual servitude to the ex-boyfriend of her sister, who has had access to the house in the past presumably. beak the ex-boyfriend. but yet he decides to take her to a hotel for an hour. does this indicate to you, because the first thing i thought of is, is he delivering her to somebody else? is he a middleman in a
7:08 pm
transaction? >> well, it's possible. i mean it sounds to me like there's absolute desperation for money. and it's a scheme beyond the normal sell, you know $5, rent a kid for an hour. go into my bedroom and use her. it sounds like it's a little bit more elaborate than that which is quite horrifying and that goes to your theory, jane, that there's a sexual epidemic in this country. somebody a little bit more elaborate. something more complicated and the thing about pedophilia and using a child for your gratification, and actually going to a hotel room, it could be involving video, it could be involving other people, something that gets uploaded onto the internet. something that you can actually make more money than your own personal gratification. perhaps videoing the act and then selling it, you know, for commerce, interstate commerce. so may be even federal charges coming. >> that is absolutely fascinating. and god only knows what went on in that hotel room. but we do know that this child was alive when she left. so she was killed somewhere
7:09 pm
else. and the question is, who killed her? because there are no murder charges forthcoming at this time, nor are there rape charges at this moment. but, again, you heard, there will be a news conference tomorrow. we could learn a lot more. probably will. if antoinette davis was bs'ing the 911 operator, she might had b.s.'ed her way into a corn. listen very careful 3 what she says. >> caller: you said none of the doors were opened? judge mathis, she seems to be saying that shaniya unlock the the door to let herself out and yet in another breath she tells the 911 operator that the door was not locked when she woke up. it does not compute does it?
7:10 pm
>> absolutely not. her statements certainly are conflictive. and that's perhaps one of the reasons the police thought to arrest her. you know what's so disturbing about this and i know that they haven't charged her with any form of murder but quite frankly i believe that some form of murder charges might be forthcoming against her because -- but for her actions, her and mcneill, but for the actions the child would still be alive. i know that we haven't found a direct link to their murder but certainly, but for the kidnapping, but for the trade in human trafficking, this child would still be alive. and that's one of the primary issues i think they should take into consideration when determining whether to charge him with some form of murder. >> susan filan, briefly, do you think she's going to end up, the mom, being charged with murder? >> yeah, i do. and along judge mathis' reasoning. i think she's somehow going to be charged as an accomplice or co-conspirator because she's responsible for her role in the sexual trafficking and then she's also responsible for the
7:11 pm
ultimate consequences forseeable or not for her actions. so in other words, if you start a robbery and ends up in somebody's death you're responsible for that person's death whether you intended that as part of the robbery or not. in for a penny, in for a pound. >> absolutely. all right, more hellish details on the gruesome death of the special angel, as her dad described her. we're also taking your calls on this. 1-877-jvm-says. what do you think, what are your theories? 1-877-586-7297. plus, cops say a mom left her 1-year-old daughter all alone so that she could go smoke crack? but that's just the start of the story. just wait till you hear where this woman works. ul fall off of your chair. but first shaniya was last seen being carried by a man into a heatem room. god only knows what happened after that. look at this trusting child. clutching onto this man. apparently just feeling comfortable there. not knowing what would happen. this is a 5-year-old girl. shaniya's aunt spoke just moments ago. listen to this.
7:12 pm
>> i hold a lot of ill feelings right now differently and my brother. the bond with shaniya and i from teaching her how to tie her shoes and how to color within the lines and to write her name, i feel robbed. and i feel shaniya was robbed. she was very intelligent. and she had such a wonderful, kind soul and her spirit and smile brightened every day of everyone she touched.
7:13 pm
7:14 pm
7:15 pm
7:16 pm
you tell us what's going on. november the 10th of 2009 with first-degree kidnapping unlawfully you kidnapped shaniya davis a person under the age of 16. >> tonight more questions and answers mario mcneill, the ex-boyfriend of shaniya's mother's sister is charged with kidnapping little shaniya from her mother's home. the girl's lifeless body discovered yesterday. now look at this mugshot. is it me or does it looks like he has a little smirk on his face? no one so far has been charged with murder. a lot of unanswered questions but they will hold the news conference tomorrow and i bet they're going to have a lot more to say, possibly new charges. lori, pennsylvania, your question or thought, ma'am? >> caller: yeah, for the man who is charged with kidnapping, i was just wondering, why is he not being charged with the murder he was the one being seen carrying her? and another thing too people were saying how comfortable she
7:17 pm
looked in her arms and i know there are shows where they've done -- they've looked at how kids are used for sex trafficking and if it's a way of life for them, that's all they know and they go with that and i'm just -- >> ma'am, you have raised very good points. now let's do a little backstory here. this child was given to the mother by the father in early october because the mom begged for a second chance to be a mother, which blows my mind right there. why would you beg for a second chance to be the mother, and then have something like this allegedly happen. but, susan filan, why have they not charged this man with anything beyond kidnapping at this point? >> evidence, evidence, evidence. they have to wait and see what the forensics are, what the autopsy reveals. and when you charge somebody, you've got to have both probable cause and ultimately proof beyond a reasonable of doubt. you want to win in a court of law. prove your case brick by brick
7:18 pm
by brick. so it's just premature right now but it doesn't mean that they don't ultimately enough and not going to but you don't want to be precipitous, rash, you don't want to blow it. it's just not time. >> yeah, and given the theory that there is always the possibility that he was delivering this child, if the accusation of child trafficking is true, to somebody else. and perhaps that person is somehow involved. but we don't -- >> it could be a co-conspirator or an acomps. >> i we're plagged to have with us is jeff riccio who was with the canine unit who discovered little shaniya's body. north carolina highway about seven miles from the hotel where this child was last seen allegedly with mario mcneill who is now charged with kidnapping. now police say it wasn't a tip, per se that led them to shaniya's body. the information came from a reliable source. so my question to you, jeff, first of all, excellent work. >> thank you. >> hats off to you. >> thank you. >> amazing job. where the body was found, how
7:19 pm
close to that was where you were sent originally? in other words, go here and then you find the body. where was the difference? >> well, we were originally a few miles away and we had cleared a whole different area and then we decided to come back and check in with the command post and when we had pulled into the parking lot, somebody had said that they had heard that the victim had been left by some deer carcasses and we had known on walker road where there are deer carcasses druchled from driving through this earlier and that's when we went to that area kind of on our own and located the body. >> what -- it must be very depressing to be hunting for a child's body to begin with. >> oh it's horrible. >> yeah you had your dogs. describe what it was like to get that word that, oh, here she is, here she is. i can't even imagine. >> it was like a mixture of relief and sadness. i mean there's -- there's no real way to describe it. you're relieved that it's over and that you know, the family
7:20 pm
can grieve but at the same time, you just can't believe that somebody could even do this to a child. it was horrible. horrible. >> michelle sigona, give us some background here, in terms of who this tip came from. we were told it's not some kind of anonymous tip called in. a reliable source. what in the heck does that mean? >> jane it could had been information from shaniya's mother antoinette, or mario mcneill himself, because if you remember over the weekend, they pulled in antoinette and they were questioning her on and off and those charges against her came out later saturday evening. and then also searchers went out to that area on sunday and monday. so it could have possibly been from her. or it could had been some other information that they uncovered throughout this particular investigation. >> yeah, and supposedly he admitted kidnapping her, according to the cops, and then he pleaded or is planning to plead not guilty. fascinating. fantastic panel, stay right there. we have more, plus, one nightmare to another. six men accused of sexually
7:21 pm
assaulting young members of their own family. couldnounce facing murder charges? we'll have the gruesome details including claims the liddle kids were in this family and forced to kill with knives. but first a poor little angel allegedly sold into prostitution and dumped on the side of the road. last night nancy grace talked to shaniya's big sister.
7:22 pm
7:23 pm
7:24 pm
she was just learning how to ride her scooter. she ran into the bmw with it. so i have the aftermath of that. >> that was shaniya's dad holding onto whatever sheds of happy memories he right now. what must be going through his mind as he ponders through the decision that he made to allow shaniya's mom to have a second chance at raising the little girl, letting her go there in october and look what happened. and by the way, the child was not enrolled in kindergarten. she was in kindergarten when she was with the dad and then when she went to the mom, reportedly, forgot to enroll her in
7:25 pm
kindergarten. bob, ontario, your question or thought, sir? >> caller: yes, jane, for you and your panel, obviously there is video of mr. mcneill taking shaniya into the hotel room. you'd think there is some video, somebody exiting the hotel room. >> well, michelle sigona. we're saying allegedly because you know i can't certainly identify this blurry image the cops say that's him. what do you know about the exit of the hotel. >> well what i can tell you, last wednesday night someone from the hotel contacted investigators to say, hey, we think shaniya may have been here yesterday. investigators got out there. they had a little bit of problem cracking the surveillance code but once they were in, they were able to pull out their surveillance and able to show those pictures and some of that video to shaniya's father, bradley. and bradley told me just a couple of nights ago. he said, i was the one who was able to identify that, yes, that was my daughter. as far as mario mcneill's concerned, investigators did their own investigating around to figure out who he was. now having said all of that, they were able to put out some of those photos to the media to
7:26 pm
be able to get the word out and to continue to show her picture and that she was alive. as far as the rest of the surveillance, they're keeping that close to the vest as far as after she left that hotel, and we do know from cops that she was alive at that point. >> last night on "issues" the manager of the mobile home park where shaniya's mother and mother's sister lived told me about a drug raid that had gone down at their previous home. listen to this. >> caller: what was seized was a lot of evidence of manufacturing drugs for sale. little bagies, razor blades, that time thing. >> and what kind of drug would that point to? did you get any indication in -- >> caller: based on the facts that they were using razor blades i would surm ice crack cocaine. >> okay. now police say they've been, quote, major departmental social services issues. is pregnant and now has a
7:27 pm
7-year-old son. what happens to these children now that mom is behind bars, one unborn child, one 7-year-old and facing serious charge? >> yes, certainly they'll be removed from the parent even if she's bailed out. however, we would hope that she would go to a family relative. if not she'll be placed in a foster care home and among strangers and would that be unfortunate. you know, jane, as we've seen in so many cases, drugs appear to be related here again and i think it's either crystal meth or crack cocaine. and that's probably the motivation for submitting the young girl to prostitution. >> and michelle, final thought on the unborn child that this mother is carrying. only a few seconds. >> she'll allow -- she'll be allowed to carry the child to term in prison but then the child, again, as the judge said, will be given to another relative or put into foster care. won't be allowed to raise the child in prison. >> oh my gosh. ugh, that is just the depressing, coup de grace on this very, very sad story. and judge, you are absolutely
7:28 pm
right. drugs at the heart of it. thank you so much, fantastic guests. drugs is also at the heart of this case.
7:29 pm
7:30 pm
toxic tales in an addict nation. cops say a 1-year-old child was left home alone so her mom could smoke crack. this little girl was found wandering the streets and you will not believe where her mom works. plus, the nightmare escalades in the missouri house of horrors. fast breaking developments in the sexual abuse case involving at least six alleged predators from the very same family. new allegations that children were forced to kidnap and murder a complete stranger. and that's not the worst of it. a mother has allegedly admitted she was out drinking and smoking crack when her baby daughter, just wandered away, even worse, cops say she didn't
7:31 pm
realize her little girl was missing for 24 hours. police say tuesday house left her baby at home and went to a party. late that night her little girl was found wandering alone on a desolate street corner. she was wearing a pink shirt and heart and playing with an ashtray. look at her. she's just a baby. what an adorable little baby. you can tell even with her face blurred. cops went door-to-door searching for her family. when they put these photos on tv and aunt finally realized, hey, that's my niece. mom didn't even know her baby daughter was in protective custody until cops knocked on her door next day. . but she reportedly told cops that somebody was watching the child. now, they were apparently smoking a cigarette outside when i left is what she said. listen to mom. >> reporter: why did you leave your baby home alone. >> i didn't leave my baby home alone. >> reporter: who was she with. >> and that's the big question, this precious little girl will
7:32 pm
likely be spending her first birthday party in foster care. but that might be the safest place for her. this is not the first time this mom has been investigated. she's already lost custody of her other child. and an unbelievable twist. are you sitting down, people? she work for the indiana family and social services agency. what the heck is wrong with this system of ours? straight out to my fantastic expert panel. and also joining me tonight legal analyst for the insider darren kavinoky, we call him the voice of reason. and addiction specialist dr. reef kareem. dr. reef, we need you tonight. >> yeah. >> sergeant paul thompson from the indianapolis police department. thank you for joining us. i know that you are quite busy, sir. the mom said she went out to party, smoked crack and came home again and left again and didn't check on where her child was. please explain this twisted timetable, if you can. >> well, apparently the child was dropped off by a friend of
7:33 pm
the family and according to that individual, mom was home when he left. now, mom stated that there was someone there when she left and however she went out, partied until about 10:30. came back home. didn't find anybody around so she thought okay to party around more. that lasted into the next day which was sunday. she came home. she went to bed. she didn't get up until monday when she was awakened by the officers notifying her that her child was in our custody. >> and she admitted, you're saying, smoking crack! she was interviewed by the detective and freely stated that she was out drinking and smoking crack cocaine that evening. >> wow. okay, we got to just recap and review once again. detectives say mom got home at around:thornton tirt at momand saw nobody there was and so she goes back out to party more, not really knowing what's up with her daughter. listen to this. >> when she left the house, the person she was having take care of, her child was outside of the house smoking a cigarette. she left. and when she left, she went out
7:34 pm
and was at some friends drinking alcohol and smoking crack. and she said she came back eventually to the house about 10:30 that night and when she came back, the child and the baby-sitter, they were both gone. so she decided to go back out. >> okay, dr. reef kareem, you're the addiction specialist. the operative phrase here, smoking crack. it basically makes everything else irrelevant. when you are smoking crack you should not be in charge of a child or any human being, or any living creature. you are a zombie. >> yeah, this story highlights that same old theme that we hear about all of the time -- the desire for consumption of drugs. when you're an addict or craving, trumps any basic human core needs. >> let me ask you this, dr. reef, though, what about crack? because i'm a recovering alcoholic. okay craving for alcohol but those are those who say crack takes the take in terms of really knocking you out very quickly to the point where within instance you don't care
7:35 pm
about whether the world blows up or not. >> yeah if you wanted to create a drug that could cause major, major addictive potential in a lot of people you would create a drug that's cheap, like crack, that could get in your system really quickly when you smoke it, like crack, that was short acting, like crack, and that can cause all crazy of disturbances in your brain, like crack bn so agreed, crack is definitely a dangerous drug and it's so cheap and it's so widespread that it's easy to get addicted to it and to have a lot of problems. >> or in the words of whitney houston, crack is whack. and that's how she put it. >> crack whack. >> the woman's uncle who said the little girl often stays at his home chalks it all up to a big misunderstanding. listen to this. >> i think she could have had a little bit more responsibility making sure that the baby was still in the other person's care. >> darren kavinoky, an attorney and also an interventionist of sort. is this man an enabler, a denier
7:36 pm
in if she's doing crack she can't take care of her baby. what's the explanation that this is a misunderstanding? >> yeah, well no good one. certainly he's trying to cover for her and perhaps lay the grournd work for a legal defense but sadly this is just one more example of a story that we've seen play out over and over again. and that is the ability to pro-create and have children is no guarantee wheeatsoever that people know what to do with them afterwards and clearly this person's decisionmaking was so poor, so flawed, drug-induced and once that inherently compulsive drug gets ahold of somebody, all rational, reasonable decisionmaking goes out window. so hopefully there's going to be something that addresses it very flawed belief system. >> right. >> that woman's operating under. >> darren, not just a flawed belief system it's a flawed system. that's my big issue tonight. we've got a broken system here,
7:37 pm
people. how is this woman allowed to be working at family and social services when she's being investigated by child protective services? >> well, but, jane -- >> she should had been on their radar. you know? >> but being on the radar, we don't live in a society where people are forcibly sterilized and certainly she's had problem in the past. >> i'm not tabling about that and never say or suggest anything like that. there are no correlation between what a child might achieve and the parent who gave birth to her. and that would be, i think, a very, very -- really, awful, awful suggestion. what i'm saying is, why -- when she's had problems in the past -- sergeant paul thompson, we understand this woman has had problems in the past. vis-a-vis the social services. >> well, actually about 11 years ago and it involved her first child is my understanding. he was just 1-year-old when an incident was investigated where she abandoned the child. took a friend's car and was arrested a few days later.
7:38 pm
the friend called because she was in custody of this child for the police to come and pick up the child because she could not care for him. as a result of an investigation and a situation that's actually handled outside of a prosecution, she agreed to turn the child over to another person who, to my understanding, still has the boy who's 12 years old today at that time. >> susan filean, just briefly we have to do something. if a mother does this once, unless she undergoes a total spiritual transformation and does years of therapy and recovery work, she's going to do the same thing again. she should be on the radar of the child protective services after that point. she should be drug tested. >> yeah, but she's got to be prosecuted. she's got to be punished. i think she's got to be incarcerated. let the addiction specialists handle her adpingz let the therapists handle her problems. but let the system prosecute her, punish her and incarcerated. this child have a future at a future, at at childhood. let her get into a family that's
7:39 pm
appropriate. let's just punish the mom. i don't want to reform her. i don't want to therapize her. i want to encars rise her. >> i want to prevent this from happening again and again and again and again and that's what i'm talking about. it's like, if we don't create some kinds of systems to do more than crime and punishment, we're just going to be locking up a whole lot of people which we do in america, lock up more than any other country in the world and we're not solving these problems. thank you, fantastic panel. moving on janet jackson breaks her silence. speaking for first time since her brother's death. it's not good news for michael's doctor. we will have her explosive comments. plus, these are the most horrifying allegations of the day. some too graphic for television. six men accused of raping children from their own family. now one man is accused of forcing these same children to stab a stranger to death? what the hell is going on? is it me or are things completely out of control which

and let's meet today's winner. who overcame an addiction to shopping. way to go, girl. she said she hid six credit
7:44 pm
cards from her husband. racked up $30,000 in secret debt. boy, he must have loved that. she finally came clean with her hubby and started to go to therapy and learned that shopping was how she self-medicated her depression and anxiety. but she looks good there. she's working at it every day. she's been clean since last january. way to go, meredith for sharing your courageous story you'll be getting an autographed copy of my new book "iwant." a trip here to new york to visit on the set of "issues." we'll not be going shopping, by the way my dear. it is my story of recovering. and it could help you. well, six members charged with unthinkable crimes. all from the same family. allegedly raping young relatives for years. could they have also committed murder? but first, tonight's "top of the block." janet jackson, that's right, she's speak out.
7:45 pm
in her very first interview since her brother michael's death, janet points the finger right at michael's personal doctor. she says dr. conrad murray gave michael the drugs that killed him. here she is on abc's "good morning america." >> he was the one who was administering. i think he is responsible. >> what you would like to see thon him? do you think he should be practicing based on -- >> no, i don't. not at all. so this could happen to someone else? another family? huh-uh. >> now dr. murray admitted to giving michael proppo fall. often news surgery. it's a knockout drug and the sedative lazo pan. and also new the man accused of molesting his son is dead. officials say it was suicide. you may remember way back, evan
7:46 pm
chandler claimed the king of pop molested his son who was just 13 at the time. this was the original case that sparked all of michael jackson's troubles and now the dad who really engineered those accusations, dead. interesting. hm. that is tonight's "top of the block." turning now to a child sex case that's taken an incredibly ominous turn. did a family of accused child predators also commit murder? six men in the moehler family. six men are accused raping young relatives. now one suspect's three daughters say they helped their dad kidnap and stab a man to death with knives back in 1988. evidence dug up at the mohler farm in missouri could back up their story. why would a family of accused child rapist suddenly force those children to commit murder? i can't make any sense out of this. did somebody threaten to expose their evil secrets perhaps? here's what police had to say
7:47 pm
about the initial charges against the mohlers. >> well, these are class q "a" forcible rape. of a child less than 12 years old and we believe that there are other victims out there. and we believe that people in the public can give us more information on each and every one of these suspects. >> and now i hope you are sitting down, another woman has come forward and claims she too was raped by the mohler men when she was child. got her pregnant twice. the accusers say the mohlers buried the first child that she had in the basement and then poured cement over it. how many bodies might be on this family's property? oh my gosh. this is really -- it defies words. it leaves you dumb-struck. but we have to talk about it. i'd like to welcome back my fantastic panel. also joining me clinical psychologist brenda wade. thank you for being here,
7:48 pm
brenda. wow. >> absolutely, jane. >> ohp. and eric burke, reporter for wdaf. eric, i'm actually afraid on ask you what is the very latest? >> well, right now off. mohlers are still in custody. there were were rumors this afternoon -- earlier this evening i think that one of them may have had the means to get out of jail. all bonds set excessively high at least $35,000 up to $150,000 cash-only bond but so far that had has not taken place. right now the town is just trying to stop from reeling from all of the news that continues to come out each and every minute in the last week or so. >> well, listen, i just want to recap and review very briefly. tell me if i've got anything wrong there, eric. the allegations of child rape overall include, sexual performance, mock weddings between children and adults, beastality, i.e., sex with a dog. raping a child repeatedly and then burying alive the child that she gave birth to. raped with foreign objects and murder, specifically, one of
7:49 pm
them accused by the kids of taking them to a mall and kidnapping a man and then force the children to kill him with knives and burying him. am i leaving anything out, eric? >> with the exception of not being not charged of those at of yet. now three victims that have come forward that total 29 sex-related charges, as far as any kidnapping or murder charges, those have not been filed yet. and one of mohlers in court today said he's being accused of murder by the local media and various modia outlets covering this story and no charges filed as of yet. spent a couple of days out there last week. gathering up potential evidence. those search warrants came back returned last night. that's when a story of a possible kidnapping and thens murder involving three of those mohler children. those three women who eventually, now 20 years later have, come towaforward, said th happened. but no charges filed as of late this afternoon. >> mohler jr. is accused
7:50 pm
enlisting his own young daughters. and kidnapping and murdering in 1988. the three women say in a car with their dad when he followed a man home from this shopping center man home from this shopping center in independence, missouri. he allegedly told the kids go get this man and say that i'm having a heart attack. it allegedly work. the man allegedly leaned into the car, and mohler put him in a headlock and "subdued him very quickly." these girls say they all went back to the farm and mohler allegedly instructed the girls to take part in stabbing the man to death. his daughters say they were then forced to dig a grave and bury this man on the property. brenda wade, take it away. i'm speechless. >> you know, jane, i'm speechless too because this is one of those cases where if you ever doubt that children can be coerced by a parent and made to do evil because of the parent or, conversely, do good because parents ask them to do good, but in this case we have this
7:51 pm
hierarchical system. the only word for it -- i don't have a clinical term for it. >> sick? >> i only have a spiritual term. and that is evil. >> yeah. >> this is really evil. and the way that these children were treated, i only hope that these women are getting help. >> we'll be back in a moment with more. you won't believe it. more.
7:52 pm
7:53 pm
7:54 pm
knowing what i know of him and just the character he has, it's completely, completely out of his character. you know, so i'm, you know, just -- i'm completely dumfounded. i mean, this has all been so surreal. my greatest concern is not my father's innocence. that's already been established. it's that the shock of all this will be too much for him and it will lead to his demise before we can clear his name. >> and that was suspect darryl mohler's son. he insists his dad is innocent. and eric burke, reporter, apparently dozens of family members showed up at court to say hey, this has all been fabricated. what do you know? >> well there, were a couple dozen that were here today.

what we've realized, or what we've come to learn over the last few days in trying to track down some of these family members, a lot of them are distant relatives. one of the gentlemen we talked to today was burl mohler sr.'s first wife's brother. so his former brother-in-law. his first wife passing away -- >> so how do they know? >> -- in the early 1990s. well, they aw came to court today to try to figure out what's going on. they are pledging their support right now for the family. one of the family members saying very adamantly that he hasn't seen any evidence to the contrary as of yet. >> michael, pen, your question or thought, sir. >> caller: well, jane, thank you for doing all the work you're doing. but this is absolutely ridiculous. it's the moef dst devastating t i've ever heard. and like the lady said before, there really is a bunch of evil going on and we really need to do something to protect our children. this is an epidemic. >> it is. and i mean, the stats are staggering. look it up. google it. the justice department says this stuff is a lot more common than you'd think, even though it

seems incomprehensible. now, a woman says as a child she was locked up for years in a crawl space at mohler's farm. she says the suspects repeatedly raped her and she got pregnant twice. she says after she gave birth to the first child the suspects put the baby in a box and "burrell mohler sr. and burrell mohler jr. buried the infant in the basement." now, susan filan, the men allegedly poured cement over the dirt floor. the woman told investigators exactly where to look. using radar equipment they detected something in the ground consistent with a box. it was buried about a foot down. but why not just dig it up and s see? wouldn't there be bones there? even if it's an infant, there should be bones there if it was poured over with cement. >> that's right. and that's what's going to distinguish this case from the other cases where you've got recovered memory. sometimes overzealous therapists trigger recovered memories from trauma people. this is going to have corroboration. you're going to find the deceased man. you're going to find these two

infants. you're going to find corroboration. you're going to find so many other people that are going to come forward that are part of this previous abuse that these guys aren't going to be able to exonerate themselves by saying hey, we're decent guys, we have good moral character, we've got family members who are going to stick up for us. there's going to be evidence here, jane, and that's going to bury them. >> yeah. well, brenda wade, how is this -- if it's true. we don't know for sure it's true at this point. how could this happen in a family? what kind of sick family dynamic would create this? >> well, you know, jane, we just saw that there are dozens of people from the family in court saying it couldn't be true, we don't believe it. we call that denial. the family is in denial. nobody was noticing the signs of trauma in these young children. these children had to have been withdrawn, depressed, having school problems, or acting out or had genital trauma that nobody questioned. nobody took them to a doctor and said something's going on with these kids. >> i've got to say, we've got to leave it right there.
