been an advocate for its principles, no paid prioritization, we helped to craft those rules that we hope would become law. sen. franken: didn't you go to court against -- went to court: we -- that neutrality has historically been defined by this body and the senate and historically at the sec as no blocking, no paid prioritization. the fcc took a broader approach and put wireless and broadband services under a title ii regulation, the 1939-based regulation for services that are transitioning fast. sen. franken: you in court before they did that. you and to court -- mr. stephenson: no we did not.

the rules imposed, we did not. sen. franken: ok. mr. stephenson: we supported them and we helped craft them. sen. franken: i stand corrected, i guess. that is not the first time. [laughter] sen. franken: thank you. i just wanted to -- i guess i am done. i would like to see the fcc, by the way, have their section here. would you? >> yes. again, i think there is a legitimate role, the question evolved inssets and a transaction, the fcc must workout. mr. kimmelman: compared to previous transactions, it would be beneficial to the process. sen. franken: mr. stevenson and

mr. --, you have not committed a deal for review by the fcc? mr. stephenson: we are working through the process right now. the trigger is whether we assume licenses from time warner. access to over 100 licenses. we are going through them to decide which one we need to actually transfer. until we get to that review, we cannot say if there will be an application or not. i would suggest that the doj, as was pointed out, looks at the fcc on these matters or expertise. and no doubt that the doj will continue to work with the fcc with the review and will also keep the fcc posted on the process and whether we do a former filing or not. sen. franken: there is a different level you have to meet and the fcc, their merger review requires that any proposed deal

actually benefits consumers, so i would think that the message you are sending to us and the current and potentially at&t consumer is, if you cannot assert that this deal will benefit the american public, it is not a great message. esther komen, do you think they should review this deal? mr. kimmelman: if it is within their jurisdiction, i believe that they should. if it will have benefit to the overall policy announcement. sen. franken: thank you. >> i want to thank all of you for participating in and answering our questions and providing testimony. we have received a statement that will be admitted. it will remain open for a week for additional questions and submissions. this hearing will be adjourned.

with a friday midnight deadline approaching, congress is set to take up a continuing resolution, extending honey. , why isnanovich congress facing another government shutdown? and senatehouse cannot seem to get those appropriations bills done in a timely way. they got one done for the fiscal year started on october 1, which is the first time in years they got one done before the start of the fiscal year. the others will remain on hold because they had been mostly written, they say, but in the end the transition team of the incoming president wanted them not to proceed with the on the business they wanted to put together. and leave some things open until next year when the new administration can have more of a say in the spending

priorities. host: talk about some of the key details in the bill and some of the writers. do the bills how departments? capy: they already have the number, which is one point zero $7 trillion -- $1.07 trillion, part of the deal that john boehner made with the white house to ensure that there would not be a government shutdown, that they would have a couple of years of certainty in terms of what the discretionary spending level would be. so they are using it as a guide. that is what they used for the passed inhat the september and this is a continuation of that. this plan calls for the government to be funded by

stopgaps for the first seven months of the fiscal year and it is causing concerns with appropriators that prepare these and put them on autopilot, and they do not believe the department of defense should be operating under cr's especially when they have so many operations going on overseas. host: talk about plants, michigan. this will provide funding for their water system. how much is actually included in the bill and why is it in the cr? nancy: there are two things going on. this is supposed to be carrying $170 million and appropriations to help flint, michigan deal with the water crisis. and if there is another bill going through congress this week. reauthorization, and to the water bill has the authorization for the flint funding. it leaders want to see both
