second-generation cuban-american i was proud of my party's convention starting last night, and i want to contradict something that your guest said. in miami, we are very diverse, hispanic and -- and strong republicans. as you know, the cuban american community is conservative and strong, and we support trump because he no -- we know he will keep us safe, and socialism out of this country like it affected our country. in the party is not that white. diversity, lot of especially in miami, and i thank you for your show, and have a great day. guest: it is interesting. south florida as a rule leans very democratic and the caller is right. dykema -- the cuban community does trend conservative, and i know the older generation that escaped castro in the 1960's, as

they die off their children and grandchildren are trending less conservative. so, the idea that the cuban vote is overwhelmingly republican is increasingly not true, although for sure they do still lean conservative when taken as a whole. host: let us look at the land. where are the battleground states and where is the president doing well? where is the former vice president showing strength? thet: the map comparing 2020 map with the 2016 map is largely the same. we are looking at the three ,ritical rust belt states that surprisingly, swung for donald trump, wisconsin, michigan, and pennsylvania. there are other states that are battleground. arizona is a battleground which trump won. error -- georgia is more of a reach. even texas. the monitor has newsmaker

that still do that. when you watch a lot of them nowadays, it is like watching an episode of "the view" instead of the news and just getting the reported coverage. after watching the convention last night, i have been an independent since i started voting and i vote christian principles and morals rather than for an individual or a party, and i think trump upholds those. although, i do not think he has the most moral person himself. as far as the supreme court goes on the issues important to me on abortion and things like that, i think you will uphold that by appointing people who believe similar to what i do. also, the three things that are important. i am a veteran, i go to work every day, and i am a father to my children. so, those principles, i feel
8:19 am
like the republicans are making sure that that is going to continue to go on for this country. it scares me to think that the liberal ideals that this democratic party is bringing forth with socialism and almost reality ors even a possibility of being a reality. it is very scary. anybody atot see how all that has any brain cells could even consider voting democrat in this upcoming election. our whole country as it was founded is under attack, and people need to open their eyes and see that. like i said, it is scary to me. guest: right. this caller expresses views that are prevalent within the

christian community, and not all evangelical christians are conservative, although most are, and that is a critical element of the trump base. and, the views that this caller express beautifully captured the view that donald trump is there ally even if he himself does not hold up their ideals of moral behavior, whereas the democrats under joe biden, the fear that it becomes on on marxist. has aden himself background as a kind of centrist and wherever the democratic party is, he represents the center. the party has moving roger lead to the left which would make a slightly more left leading joe biden -- leaning joe biden than in the past. what we are seeing last week and this week our efforts to shape the image of both parties and

8:23 am
advertising and sending home messages over and over again. those of us who follow politics get tired of it. but most people do not consume politics the way we in the media do, thus the repetition. host: what are democrats doing this week? guest: they are lying low. you see them pushing back on the trump messages, but they know he has center stage and he sucks all of the oxygen out of the room and he is hard to counter program. they are trying. free democrats you will see some hate watching, democrats who cannot stand donald trump or watch him, but they will watch anyway just to get their blood boiling. i guess it is some kind of psychological phenomenon. of we are seeing a lot negative partisanship in this campaign, meaning that even if people do not love joe biden a lot of people and left leaning democrats do not love joe biden. they dislike donald trump more
8:24 am
than they are wary of joe biden, so they will vote for joe biden anyway, and by allowing donald trump to dominate, this reminds americans who do not like his job performance that they do not want four more years of this. host: mike north carolina, republican. it is your turn. ofler: i did not watch all it, but what i did see i was pleased to see the gentleman from cuba who made an impassioned speech at the hispanic business roundtable that president trump held earlier. i think his first name is maximo. spain, iy fled from think maybe possibly during the spanish civil war in the 1930's, and then they fled to cuba. the family fled cuba when castro came to power.

i have been following elections but i really do think that president trump is making serious, not just incremental, but serious inroads into the black community. oneaw herschel walker and of the democratic representatives. we see this young lady, a woman of color from baltimore running for the seat that was vacated by the gentleman that passed away there. thatshe is running an ad is brutal and vicious on -- and so, i think there is a huge exit, thatalled bla has many black people who are fed up with the democrats. they have said we have been voting for you. host: i want to take that point.
8:27 am
what do the polls show? guest: it shows that he largely does not appeal to black voters. he is polling at about 10%. in the election last year he got 8%. this is a huge issue from joe biden, it is not just about what polls say, but who turns out. joe biden absolutely needs black and hispanic voters. he is definitely underperforming along -- among the latino vote. minoritiesgument for that donald trump, through economic means, will give them opportunity. but a lot of minority americans and people of color feel that donald trump is racist and that the country has not progressed under him. and, they need to really double down on the democratic message,
8:28 am
which they feel is more inclusive. it is a fascinating battle as the country becomes less white to see how the two parties tried to appeal to this growing demographic, which is people of color. host: marie. greenville, mississippi, a democratic caller. caller: good morning. i have several things that i wanted to bring about. i watched some of the convention, and i want you to answer this at the end. they talked about the 7 million jobs. i wants me to tell me where are these jobs? people were out of work and 7 million went back, how is those job creation? when donald trump first began the campaign running for president, i actually came into it with an open mind. i have been a democrat all my life, that i really wanted to

think you should invite her because she is only going to come into the oval office and get down on one knee during the time that colin capra nick was protesting the national anthem --: capra nick -- colin ka epernick, and for him to say that about her. in the second thing for him to say, he said about hillary's campaign. he said that during the campaign we hired paid protesters to go everywhere that she went. i think it was in dallas, and he said it was so bad in dallek's -- in dallas that she could not get off the bus because we had paid protesters. host: what is your point of bringing up these two issues? caller: because i want to say, when president obama was campaigning and they brought up something that his pastor, jeremiah said, and they ran this whole thing saying that if jeremiah wright spoke like that
8:31 am
then obama had to have the same ideas and ideology, i am saying that even though trump does not listen to rush limbaugh, that is the mindset. want toour thoughts, i applaud the listener for tuning into rush limbaugh. it is important for voters of all political views to go into an area outside of their comfort zone, if you are a liberal, just do not watch msnbc and cnn, maybe check out fox or rush limbaugh just to hear what they are saying, not because you have to agree. theor the jobs, a lot of recent job creation is simply the jobs that had disappeared coming back. a shift in seeing how the economy operates during the pandemic with a lot of people stuck at home and people getting deliveries so amazon have been hiring. some companies are hiring during

court fight, in case justice kavanaugh's fight. if there is a supreme court fight in 2020, it will bode well for republicans. we noticed last week that democrats barely talked about judges at all during their convention. and, i think the reason is that the party leaders understand that the judicial and fight is a winning fight for republicans, and if i were joe biden or kamala harris, i would not want to be showcasing the types of left-wing judicial activists that the democrats want to put on the supreme court's, and i would not want to be showcasing the fact that the democrats want to take extreme measures, like they want to pack the supreme court and expand the number of seats from nine to 11. that is something -- the number of justices on the supreme court has not changed in over 150 years, since 1869.

fdr tried to pack the supreme court during his presidency and failed. even justice ruth bader ginsburg, the lioness of the left came out and poured cold water on the scheme. move,as an unprecedented but she understood that it was so extreme that she poured water on this plan to pack the supreme court. so, the judicial fight is a good issue. it is his biggest accomplishment as president. he has transformed the federal judiciary and solidified the conservative majority with his appointment of justice gorgeous -- gorsuch and his appointment of justice kavanaugh. judgesalso appointed 53 to the critically important federal courts of appeals. this is one quarter of the federal judiciary.
8:41 am
he has flipped three circuits. there are 11 regional circuits in this country where they divide up the appeals around the thetry, and he has, on second, third, and 11th circuits, president trump has flipped the circuits. he started there were more democrat appointed judges and republican appointed judges, and now there are more republican judges. ,, onenth circuit president trump took office there were 11 more democrat appointed judges than republicans. that is down to just three, and when president trump wins reelection he could flip the ninth circuit, something that no one thought was possible before president trump. with mikere talking davis about campaign 2020 and the courts. republicans, 202-748-8001.
8:42 am
democrats, 202-748-8000. independents, 202-748-8002. we will go to clinton and florida. republican.lorida, how are you? caller: i am doing well. one of the reasons i voted for trump was because of the courts. i wanted to ask you a question. how much of the problem is the media? is you arei say that able to call trump a racist on national tv and they will not ask you why. before he ran for president he was not a racist and you cannot be given an example, but everybody accepts it. how does the media narrative play into the effect of making his job harder? always going to be a liberal so-called mainstream media. fortunately we have other ways to get around that leap --
8:43 am
liberal media bias. you can talk directly to americans through c-span there is radio and the internet. we are always going to have that difference advantage -- disadvantage dealing with the media, but we have to learn how to work around it. peoplesay with these calling president trump racist, i find that interesting. if you go to the article iii project's website, we have a feature that shows president and minority judicial nominees, who are rated or qualifiedfied by the american bar association and the liberal bar association. go look at how the democrats vote. they say that they want more women and minority judicial nominees from republican presidents, and yet they vote near lockstep against them. and it is documented on the website.
8:44 am
host: what will your group be doing in the general election? what role you play and how will you participate? guest: we will continue to publicly advocate for president trump's judicial nominees and their records. we have several very good judges who have been appointed for the federal bench including those 53. we will promote the judges like judge kenneth lee on the ninth circuit who just led a panel striking down california's unconstitutional ban on high-capacity magazine clips. there are judges like judge jost -- justin walker who is a federal judge in kentucky who. he came out during the coronavirus pandemic and slapped down the louisville kentucky mayor, fletcher, who had a policy where you could not have -- you could not have drive up church service or services you
8:45 am
could not go to a drive up theater and listen to a church service yet he permitted drive-up liquor sales. judge justin walker stepped up and said the state and local leaders have a lot of power during a crisis, but you cannot act arbitrarily and discriminate, especially against christians or other believers. these are the types of issues that we will highlight for your election -- for the election. we cannot election year, but we can exercise our first amendment rights and we will do it to the fullest extent possible. mississippi, independent. caller: good morning, i would like to remind everyone that trump tower used to put a c in the upper right-hand corner of -- of it -- the apple applications for colored apartment filings. does he believe that a public
8:46 am
individual has to win reelection free and stay out of jail along with most of his family and half his cabinet? and while everyone is watching melania, be sure to google porno movie and check that out. thank you, goodbye. guest: i will pass on that one. caller: carl. republican. host: hello. caller: yes, i just wanted to ask him if he thinks that trump is putting an emphasis on confirming more judges and getting more supreme court justices, because i think that has faded from the talk. i think president trump has been a victim of his own success. he has appointed two supreme court justices and 53 federal circuit court judges.
8:47 am
of allumber two out presidents, out of all 45, for the pace of his appointments to the federal batch. the only reason is he is -- he is number two and president carter is beating him because congress added 152 new judgeships during the carter presidency. president trump has filled every single federal circuit court vacancy because these federal circuit courts are where more than 99% of all federal appeals stop. the supreme court largely has discretionary review, meaning they get to decide what cases they hear, and the supreme court only hears about 100 cases or less a year. federal courts of appeals are critically important, and president trump has filled every one of those vacancies, and not only has he filled them, he has filled them with rocksolid conservatives like he promised. president trump promised in 2016
8:48 am
that he would appoint justices in the mold of justice scalia, textual list -- textualist constitutionalist. you can look at article iii project and there is a feature on our website called judiciarytracker.com and it shows president trump's transformation of the federal judiciary. a republican of missouri said this about another potential pick by the supreme court. "i will vote only for the supreme court nominees that have explicitly acknowledged that roe v. wade was wrongly decided by explicitly acknowledged i mean on the record and before they were nominated. do you agree that there should be a litmus test? guest: i have the greatest respect for him, we clerked together on the 10th circuit, and i have known them for a long
8:49 am
time and i think he is very smart and is the future of the party, and i understand where he is coming from and that when judges disappoint there is some frustration, and i understand his desire that have judges that understand that there are critical, and their limited role is to interpret the law and not to create the law. they are not legislators, that is not our system of government. , theongress writes the law executive branch enforces the law and the judicial branch interprets the law. i do not think we should have a litmus test and there are several reasons. the first is that we do not -- i did not think it is ethical for judges to go into a back room with a senator and promise that senator how they are going to vote on future cases in exchange for the senator's conservator -- confirmation vote. if you are a litigant in federal
8:50 am
court and you are going into think that you are getting a fair hearing, and you know how the judge will rule in your case based upon his exchange with the senate in the background. i do not think that is senator intention at all, but i do not think it is the right approach. i think the best way that we are going to pick judges is how president trump has been picking judges. it is not the perfect system, but there is no system better than that, and that is looking at their judicial philosophy. it is not their commitment to how they will rule on cases that how they will go about deciding the cases. with what does the text actually say and then what the text mean the public at the time that it was enacted so that people will have fair notice and they can order their affairs based on what the public understanding of the law is.
8:51 am
host: st. petersburg, florida. an independent. caller: good morning, i find it confusing when trump supporters say democrats are communists when our president trump states he has love leaders between him putin isong-un --, and his best friend. he calls them all the time without any oversight or discussion about what they have commented on, and my biggest thing is that the russian bounty on our soldiers as never been discussed by our president. he stated that he did not ask where aret that and, they coming from? he supports and loves communist leaders. it is bizarre, and, quite frankly, i think they need to take a look at that.
8:52 am
because of these two reasons and the russian bounty on our soldiers i have decided to commit to biden and i would not look at it any other way. thank you, and have a great day. guest: i am here to talk about judges, i am not here to talk about foreign policy. i am just here to say that foreign policy is a complicated and i seriously doubt that president trump's friend with dutch friends with the dictator from north korea. i think there is some shots going on there. host: douglas, oregon. a republican. caller: good morning, i have not spoken since the iowa primaries in 2016. listening to the democrat debates during the primaries this year, i heard kamala harris say that she supported mandatory gun buyback. i am a second amendment kind of guy. my fear is that if hyden were
8:53 am
elected and -- biden were elected and schumer gains control of the senate and keeps his promise to get rid of the filibuster we would have a one-party state. could they been packed the court like fdr tried to do and take away our second amendment rights. the supreme court, that is all that stands between us and the second amendment. the last time that there was a major decision it was only 5-4 in favor of a person's right to defend themselves. guest: i absolutely agree and i wrote a fox news.com opinion piece. democrats have promised to nuke the legislative filibuster if and myn the senate credits will almost certainly win the senate in that scenario. they will new the legislative filibuster which means they will lower the vote threshold from 60
8:54 am
to 51 votes and they have promised to pack the supreme court mean -- meaning that they will add two or three supreme court seats and they are looking to pack the lower courts and they are talking about adding new states, puerto rico as one of the states and the sea, and maybe others. four or moreave new democrat senators that come along with that and they will be able to lock in their gains, and your second amendment rights will be very much curtailed. many other rights will be curtailed. i think this is the most important election. i said this in my opinion piece. i think this is the most important election of our time, and it is not hyperbole. go look at their platforms and what their supporters are saying. host: some conservatives have expressed anger over recent decisions by the chief justice
8:55 am
john roberts. to share their disappointment? guest: so, sure. there are times where you are disappointed with how the judge rules, that i think, and again i talked about this in my opinion piece. i think that conservatives need to step back and look at the bigger picture. aat this is very much conservative majority on the some ofcourt despite the tactical decisions made by the chief justice. i think his biggest concern is protecting what he thinks -- what he thinks he is doing is protecting the court's public legitimacy. so there are times when it is frustrating to conservatives, but if you view -- if you step back and look at the picture, this is very much a conservative court. just look at the supreme court
8:56 am
did in espinoza, where the supreme court with a 5-4 conservative majority said that the poor, largely minority parents should have the same educational opportunities as wealthy, democrats politicians to send their kids to schools of their choice and have educational opportunity. it is a hugely consequential decision, and chief justice roberts was rocksolid on that case. host: omaha, nebraska. democratic caller. caller: hello. i had two points. one of them is i was wondering how many of the judicial nominees, the ones that have been put on the courts are nonwhite. i am curious about this because i know president trump was
8:57 am
called in front of a court that had a judge of a mexican consent. was yousecond point keep bringing up this point about democrats packing the courts. and from everything i can see, that is exactly what the trump administration is doing and bragging about it. how do you reconcile that? iest: to your first point would encourage you to go to article iii project's website which shows the women and minority judiciary appointments for president trump and republican presidents going back to clarence thomas. it shows that democrats claimed that they want more diversity on the bench but they vote in your lockstep against these women and minority judicial nominees for republican presidents.
8:58 am
i think democrats need to reconcile that. as to your second point about court packing, there is a difference between filling existing vacancies and doing it efficiently like president trump and sanity -- senate majority leader mcconnell and my former boss, chairman chuck grassley and lindsey graham. this congress have done a good job of prioritizing judicial nomination, something the democrats do not do as well. that is not packing the court that is being good at your job. what democrats want to do is do something that has not been done in almost 150 years which is add new seats to the supreme court and change the number from nine to 11 or more which has not been done since 1869, right after the civil war. fdr tried it and it failed. again, justice ruth bader ginsburg came out and maybe
8:59 am
unprecedented move of saying that democrats should not do this. is the founders and president of article iii project and the website is article3project.org. we will take a break. when we come back we will talk with tony perkins about campaign 2020 and evangelical voters. after that, more of your calls and comments about last night's republican convention and the week ahead as well. here is more from the president's son at last night's republican national convention. [video clip] >> this time the other party is attacking the very principles on which this nation was founded. freedom of thought, freedom of speech, freedom of >> this time the other party is attacking the very principles on which our nation is founded.

freedom of thought, freedom of speech, freedom of religion. the rule of law. thomas jefferson famously said i have sworn upon the altar of god, eternal hostility against every form of tyranny. our founders believed there was nothing more important than protecting our god-given right to think for ourselves. now the left, they are trying to cancel all those founders. they don't understand this important principle, to improve in the future we must learn from our past -- not erase it. we will not tear down monuments and forget the people who build our great nation. we will learn from our past so we don't repeat any mistakes. we will work tirelessly to improve the lives of all americans. leftiden and the radical are now coming for our freedom of speech. they want to bully us into submission. if they get their way they will

no longer be the silent majority. it will be the silenced majority. this has to stop. freedom of expression needs to a liberal value. at least before the radical left took over. now the republican party the home of free speech. the place where anyone from any background could speak their mind. may the best ideas win. people of faith are under attack. you are not allowed to go to church, but mass chaos in the streets gets a pass. this election is shaping up to be church, work, and school versus rioting, looting, and vandalism. in the words of biden and the democrats, peaceful protest thing. anarchists have been flooding our streets and democrat mayors are ordering the police to standdown. america, inesses across many of them minority owned are being torched by mobs.
9:02 am
the democrat mayors pretend it's not happening. they called it a summer of love. that brings me to another important principle. every american must be free to live without fear of violence in your country, in your communities, and in your homes. createdand women are equal and must be treated equally under the law -- that's what we must put an end to racism. -- we must ensure any police officer who abuses their powers, you know they agree with that, too. we cannot lose sight of the fact that our police are american heroes. you can't focus on building a better future for your children without the peace of mind.

trump's job performance. a six percent drop from 78% in april. what do you make of that. guest: i think we have been through one of the most multi was times as americans. we have issues, the coronavirus -- that we had the economic downturn from the response to that. then we had the rioting in the by the that was prompted .irst peaceful protest these are issues that have to be addressed. been an impacts during that time. the what is happening in last two weeks, what happened last week, what happen beginning yesterday and will carry through this week is the voters as we move closer to the election realize this is an election of contrast. an election of choices. i think they look at the accomplishments of this administration, which are vast

9:08 am
i agree with probably 98% of the policy this administration has put forward. at the end of the day, that is what impacts my ability as a father, impacts my ability as an organizational leader. these are the things that matter at the end of the day. when all is said and done it is the policies we pursue. challenge the accomplishments of this administration when we look at it that way. host: the president's personal behavior, are you saying you should not look at that? i'm not quite sure what you mean by moral behavior. morals, what you represent and talk about, faith and family. the sea always represent the same morals and values that you have? if you want to go back

prior to the president stepping in the oval office, there are certainly things i would agree with -- victim at leet disagree with. this is why was not an early supporter. when it came down to hillary clinton and donald trump and we look at the policies, the promises, we had to make a choice. grateful that i along many, many millions of evangelicals made the choice to support donald trump. he has done nothing to persuade us otherwise. heon't support everything says or how he says it. i do agree with the policies of his administration with the people he has placed in positions of leadership. host: we will go to austin texas, carolyn joins us there on the republican line. good morning. , you asked him about

9:12 am
we had what we had donald trump and hillary clinton and looked at the platforms, that is again what we are looking at in this election cycle. has worked to defend religious freedom. we see this on display and he was criticized for bringing this up that in the committees of the democratic convention, under god was taken out of the pledge. you could say that is an aberration but not necessarily. even jerry nadler wanted to take away so help me god from the of. there is a clear distinction between the parties. the democratic party platform does not reference god as of now. the republican party embraces religious freedom and god upon which this nation was founded, the principles of scripture that our previous caller mention. we do need to be guided by those elements.

tony, i don't think there is room in the political arena for a lobbyist with a religious arm. appropriatek it is only because not everybody believes like i do. when you involve the church and the state, you are basically this involving, disemboweling that don't believe in god. you don't believe in a god that is different than yours. theink that is why democrats don't preach. they too believe that church and state should be separated. onanted to get your opinion what you think about trump's lies about democrats and religion. guest: do you believe that those that don't believe in god should have the ability to engage in the political process and shape policy? caller: absolutely.
9:19 am
guest: but not people who believe in god? caller: when you say something about being religious inside of politics you are leaving out a certain amount of people. say you don'tyou believe in god and engage in that process, we have many atheist institutions that advocate for that process as well. should they not be involved? caller: they should be involved. you are specifically disemboweling people that don't believe in god. i'm sorry, not everybody is with faith. that is whatk makes america unique. everyone has the ability to come to the table and be a part of shaping the future of our country. faith, cause one has orthodox christian faith is that -- does not mean they should check their faith at the door. not be restricted

that has been his policy domestically and in foreign policy. it is another clear contrast. we apologize for america or we champion the cause of american ideals. we had a perfect nation? no. never have been, never will be. we could get better. i go back to those contrast. last week was criticize america. this week is to celebrate. celebration of what is good about america. people continue to come to this country, there's a reason for that. they come here illegally, they come here legally, all different fashions and forms. america still the world's last best hope. there is one thing joe biden and isala harris would solve, it the immigration, the illegal immigration aspect. if they are successful in the policies they are putting forth i'm not sure people will want to come to america.
