dial in. if you would like to send a text message, you can do that as well. text, pleased a include your first name and the city that you are texting from. you can also follow along and make comments on our facebook page. so we are going to go to calls in just a few seconds. was nominatedett to the >> and your understanding -- >> i understand circuit court
5:30 pm
judges to be absolutely bound by the president of the supreme court. the supreme court has held in a case that that obligation is absolute. that circuit court judges are not permitted for example to anticipate over rulings of the court and jump the gun. obligated tos are follow supreme court precedent. as well, they are bound to follow the precedent of their own circuit according to the circuits doctrine and for example in the seventh circuit, that means that edges follow precedent unless there are extraordinary circumstances that justify its overruling. crocs lastly, as we just discussed, circuit court judges are required to follow all supreme court precedent. if confirmed, would you follow precedent regarding abortion? >> i would, absolutely.
5:31 pm
>> daniel, we wanted to get your reaction to the nomination. >> i guess i am a little bit broken up about justice ginsburg. about abortion, she said she wished it had been done under the protection clause instead of under right to privacy. the right to privacy is applied to the bill of rights, but it is not specifically stated whereas the equal protection under the law, it is for all people men
5:32 pm
and women. and all genders. had a suggestion about abortion, for a fetus with a viable heartbeat, it should have all of the protections under the bill of rights that are normally borne humans should have. at august 21time weeks, if congress would make a law that you cannot have an abortion if the fetus has a viable heartbeat, ron paul said that would prevent about 90% of the abortions. right now, you can have an abortion anything goes kind of. theink the reason trump won election was because he had the catholic church, the pope, who tells the bishops to support people or presidents who are antiabortion and trump definitely -- >> daniel in fort, new jersey.
5:33 pm
is on thealler republican line. you are on the air. >> hello. first of all, i am proud of our president, president trump. i am also very happy that he nominated her, because she seems like a wonderful woman. it isn't about the catholic church and the pope against abortion. got set it is wrong. it's a life and you have to respect. if you don't want a baby, you can give it away for adoption, you can -- you don't have to kill it. i wish her the best and god bless them.
5:34 pm
>> she looks like that type of person. she's a smart and decent girl and that's what this country needs, more decency. it is out of control. i wish her the best and i will be praying for her. >> let's hear next from jane in arizona on our independent line. >> thank you for taking my call and my opinion. i think this is an excellent awesome choice by the president. she has impeccable qualifications. she has been vetted just three years ago, so it shouldn't take very long to do that again. of course, it is a totally different situation that we are dealing with now where everything is so polarized. looking at just the woman with seven children, two adopted from haiti.
5:35 pm
i guess that racist will not be allowed to be one of the terms that the leftists can throw at her, the vitriol because she has two children from haiti. then, [indiscernible] [indiscernible] judging by how many people do abort babies when they find out that they have a defect or something, it shows courage and she walks the walk as far as life. 1 she decided to keep this baby1 and what a beautiful gift from god that child is. to the whole family. showslks the walk and what this country should be all about. i believe and i hope that they don't put her through what they put justice kavanaugh through. we also thought that he had impeccable qualifications and was leading a wonderful life. then, with all of the made up lies, it is terrible what this country is going through. hate is such a strong emotion. it is so sad to see people with such hate inside of them against
5:36 pm
our president and against good people. this person standing up there today is truly unique. >> as someone who is supporting amy coney barrett, you think the political process should wait until after the election or until the next president is elected? >> i think it should go through right now. i don't even think they should have a hearing. x from what i understand, there is no law that says you have to have a hearingc. vettedsaid, she was three years ago and it was bipartisan that she was approved. this time, it's just going to be political. it's just going to drag it out and drag her and her family through the mud and make up things like before with justice kavanaugh. i think it should go right to a vote immediately because this election may need the uneven amount of justices on the court to determine the results.
5:37 pm
in arizona.a caller next is joyce from boca raton, florida. >> i am glad that i called in. i think this is a very exciting day in our history. i knew before she got married to marty. marty's parents were friends with my parents. it was a thrill watching her come along through the years may she rest in peace. this is a fabulous choice. she has children. b that represent not only the white people but everybody. she is a very united person. she will do a pretty good job.
5:38 pm
>> i would think judicially that ruth bader ginsburg and amy coney barrett would not agree on a lot of issues. but you still see this is a good choice. >> i see this as a good choice. we have different justices on the supreme court. everyone comes from a different background. they have been raised by parents or grandparents or whomever. that is how we get some of our characteristics. i think it's a very wonderful thing that this woman has birthing ander own has brought other children whose parents couldn't raise them or didn't have parents at a certain point. i think she is a bright woman. she seems like a very bright woman and time will tell. i guess there is a reason why they do gome where
5:39 pm
through the vetting process for a reason. to really have them figure out who she is. more than just a figurehead. >> what is the connection between your parents and this to ginsberg? -- and mr. ginsberg? >> my parents were good friends with marty ginsburg's parents. we were all from new york. we had a commonplace that we club.o that was a country not a fancy place, a wonderful place to play golf and socialize. when marty engaged to ruth, she was so excited. along, walking along, he had a great smile on his face and he said to me i want you to meet my future wife,
5:40 pm
ruth. it was a thrill. just wonderful. >> thank you for sharing that story with us. is a republican from florida. go ahead. >> thank you for taking my call. we are going to need everything
5:41 pm
to keep this country great and do the things we need to do. >> next up is annabelle in new york and independent. >> thank you for taking my call. -- i amanted to say very pleased with trump's decision on nominating amy coney barrett because she is an incredible woman. she loves her family, she loves the constitution and she loves this country. she is not partisan to either side. really feel that she did a beautiful job speaking tonight. the way she honored justice ginsburg was beautiful also. >> next call is albert in south carolina. >> i am a democrat. i think that the nomination was great, but there is a time and a
5:42 pm
season for everything. i was looking at the children and that is great that she is raising children from another country. i'm going to tell you something, i am 70 years old and i fought in vietnam. this racism is out of control and it's bad and it has been like that for a long time. the only thing i couldn't understand was with trump with the covid-19, all these people had died. i was looking at the leaders not having mask on and not six feet apart or whatsoever. that is very disrespectful. to thing, you tell us what do than they are doing it. >> that was albert from south carolina.
5:43 pm
joni is in california. what do you think about the nomination? >> i am so excited. this is something we all should be happy about. is a brilliant standing by all of the people and this is what we need. we needed a judge who is not biased. who stands for righteousness and peace. i am very very pleased to see her be elected for the supreme court. and god blessica all the people and let's give up all this hate and anger and respect america for which it stands. thank you. our next guest is on the
5:44 pm
independent line. >> i am an attorney in central new york. i had a caseo, involving second amendment rights and i had to do legal research going through the law books. decidedhe newer cases since the case written by justice cooley at the affirmed that there was a personal right to bear arms under the second amendment. i came across a case out of the second circuit, -- seventh circuit where someone convicted of mail fraud, a nonviolent crime who did his time and paid his restitution and later sought a hunting weapon, he was told he was going to be denied the right because he was once a felon. there was a dissenting opinion. i wasn't through two paragraphs of that before i said it's brilliant.
5:45 pm
who wrote this? it's amazing. is not aal research fun thing that little -- lawyers do. they don't make movies out of doing legal research, but i was and wrapped by that thing. couldn't believe the depths of the scholarship. amy coney barrett road. -- wrote it. i said how can we get her on the supreme court? the other comments that said what a wonderful wife and mother and person she is, i will concede every bit of that. she is an incredible human being. when we put a supreme court justice on there, what that justice is going to do is going to resonate down to every town and village in this country. every lawyer is going to be affected by what they do. into a lawyers
5:46 pm
office with a problem or you are assigned a case, that's the bulk of my practice, i am a court-appointed attorney. you have to look at the facts and bring about the law. the supreme court justices who were the brilliant writers and justice scalia, her mentor, his opinions were literature. they were that good. when i read the dissenting opinion in the u.s. versus ricky cantor, i said she is writing literature. every lawyer who is going to tell his clients with the law is just had his job made easier by putting her on the supreme court. >> what is the importance to a lawyer or to the law process of a dissenting opinion? nothing means everything but everything means something.
5:47 pm
sometimes, it can be a springboard. yes, precedent is important. but sometimes, it can be a springboard toward the future and a lawyer has to be able to make a plausible argument. you can't say this is the law because that's what i think it should be. a judge can never accept that. but you can cite a dissenting opinion and there have been some dissenting opinions through history that when they arrive, they had a second coming for one of a better term. even a dissenting opinion is very important as to what it means. the dissenting opinion in justice white -- of justice white in the supreme court welch decision which completely
5:48 pm
libel andhe law of slander for a public person literally outlined the common law of defamation and law students are told to read it. not a black-and-white thing. it is a great big glob of gray and constantly changes. something with a decoder ring and say this is what it means. important forry everybody in general. and for lawyers in particular. a dissenting opinion is very useful. >> thank you and thank you for letting us put you on the spot with that answer. we appreciate. norma, a democrat from florida. what is your view of amy coney barrett's nomination?
5:49 pm
>> thank you for letting me speak today. agreementotally in with her nomination due to the fact that the president took it upon himself to nominate her for his own purpose. say.is own read i should this is how he is. everything is done for his behalf in order to justify whatever is best for him. he has already made his belief that voting is going to be thawed -- fraud and he won't give up his seat because it's going to be fraud and this is all in preparation for him to have a way to fight against that he is not going to make it as election.in the 2020 i don't agree with that at all.
5:50 pm
as far as amy coney barrett, i don't agree with her saying she doesn't like the abortion-rights because everyone has the right to their own abortion if they're going to have one or not. that is between them and god and she is neither. our next guest, what do you think about this nomination? >> first and foremost, my condolences to the ginsberg family. that needs to be said. what i think about the nomination, i think that judge merrick -- judge amy coney barrett deserves a fair chance and i am undecided as to the november 3 elections. democrats to not
5:51 pm
attack her based on her religious beliefs. i think everyone has the right to that. i was undecided in 2016 and i voted for 20 -- president trump for two reasons. for one, i thought if he had the upper -- opportunity to nominate a supreme court justice, that that would be a good thing for the country in the long run. the final thing was that with all due respect, i thought that he would make a better president than secretary clinton. i am not in favor of career and an outsider that would put working families like
5:52 pm
mine first. i wish her the best in her family and i hope for the sake of decency that what happened to judge kavanaugh does not happen to her and her family. thank you for taking my call. dan who hear next from is a republican from alaska. good evening to you. please make your comments. >> thank you for taking my call. i would like to say that being in alaska, we are out of the mainstream of what we call the real world. i believe that amy coney barrett is an excellent choice. i think we need more conservatism in our world right now. there is too much craziness going on. that is pretty much it. yourat do you think about alaska senator lisa murkowski saying that she would not want the vote to happen for the election?
5:53 pm
what i have to say about ms. murkowski probably shouldn't reset on television. i am not in favor. candace is a democrat in missouri. it's your turn to comment in on the nomination. >> thank you. i am from middle america, so i think in terms of my little family group. i have a bunch of sons and seeing her with the multiple judge, itnd being a seems to me like being a judge of children extends in there. they have a whole lot of decisions going on just like the rest of america. we have a whole lot of ideas on what should be done.
5:54 pm
judging inink of terms of which one gets what. you get the ipad versus you get a book or whatever. it seems like she looks like she would be a really great judge just based off of her family and her professional life and seeing the different things she has done. her speech was really good. account thatinto the president is controversial and he is the one that nominated her. i just take into account what she herself has given us and what she has done for the circuit court and whatnot in her professional and family life. she seems like she would be really good. i am sure the senators are going to go through and that her properly and we will see what
5:55 pm
happens. i'm hoping it's good. as a democrat, are there that wouldoncern have you view the supreme court in a certain way? >> it is a lot more conservative , it seems more conservative and less of our rights are being afforded, it's more of trying to get us to think certain way or do a certain thing. we are all a huge melting pot that we have different ideas and thoughts and we don't want to be controlled. heard. our views to be we want our thoughts to be heard. we want our rights to be afforded us.
5:56 pm
i hope she allows us to still have our rights. to go through the law, letter by letter, word by word and that it doesn't take away from us more than we have already had taken away from us. that was candace in missouri. from thes a caller tennessee independent line. my name is unusual, but that's ok. i am very much a constitutionalist independent. i firmly believe in the constitution of the united states and what it says and the bill of rights. i support those two documents with all my heart all my life and i even defended it in vietnam. that gives you an idea about how old i am. at any rate, i have to say that
5:57 pm
this president has been accused through thehings media and liberal america and it's really not true. donald trump was elected. he was a businessman. he fought and struggled hard in new york city to develop what he had to develop and create what he created. his style that we see today is nothing different than what he did in the 30's through 50's. he has exaggerated what president projects himself to be. he is vulgar at times and not very polite especially when people attack him. that's the way businessmen operate when you are defensive and you try to protect yourself and your business. , the white house
5:58 pm
has donated their time, energy, and money. we have several of his family working in and around the white house. jared and donald junior and the whole family, the girls did they all have dedicated their life to a nation that they have grown to appreciate because this nation has given them -- >> we are going to leave it there and we are going to hear from paul, a republican in california. >> how are you doing. that's not my fault you guys hung up on me. as far as this supreme court judge, i am really grateful and humble that our president is our president. president thatst came -- couldn't even give his real name? you're president of the united states.
5:59 pm
,s far as the supreme court's the judges that are on there already, they are supposed to elections.during the i don't want to talk anything away.out ruth passing thatreme court judge hayek, -- that high up to talk about trump is very disturbing. it's very common sense that you have to use, you have to have a lot of degree. it's not common sense. -- >> paul, thank you for calling it. the last call is from matthew, a democrat from indiana. what do you think about this nomination? think it is a bad
6:00 pm
would, withd trump it on the cnn for also, iwants, and wanted to know why joe biden about -- host: we are going to leave it there. you are getting a little bit off
6:01 pm
