remind the viewers about the purpose of your organization. also could you tell viewers how you are funded? voluntaryough donations from the american people. we are a nonprofit educational foundation that tries to bring more transparency, accountability, and the rule of law to our nation's public life. host: one of the issues of transparency that your organization spends a lot of time with is looking into the russian investigation and the backdrop of it. what wasople again essentially your take on what was done in that investigation. guest: my take is the obama administration and hillary clinton campaign were nervous about the legal issues surrounding hillary clinton's emails and other misconduct of 2016bama administration in

as it related to hillary clinton's emails and the targeting of president trump. they doubled down on it, manufactured false allegations against president trump to excuse unprecedented spy operations and later criminal investigations into trump and his team. host: what substantially came out of that? we saw the mueller report eventually, but what conclusive evidence have we found? guest: recently we have information our intelligence community had intelligence that the russians, evidently listening to hillary clinton and company, new that clinton was making it up or was trying to diffuse the russia collusion allegations that were fanciful to distract people from her email obligations. that was briefed to president

to thend was referred fbi for investigation, but not much was done. host: as far as the release of information, one of the things that people were looking for was the durham report. what was that and what was released from it? guest: durham has not released anything. there have been some disclosures from the office of intelligence and other agencies. someial watch received documents about what was going on. durham has had one prosecution/plea deal and not much else. host: the washington post reported last week that there are still no criminal charges or public report on this. why do you think that is! you would have to ask the justice department. it is a disappointment. durham was appointed in april 2019.

there is no excuse for the lack of action. i am not seeing evidence he has done a serious investigation. compare and contrast to mueller. what a significant d.c. criminal investigation looks like. es.nesses, grand juri none of that is president -- is present in the durham operation. host: in most recent days, the president sent out in a tweet as far as the authorization of a declassification. talk about that tweet, what resulted, and what you expect. guest: he said he was ordering the declassification of everything related to the russia gate probe and hillary clinton's and mel's -- emails. the justice department has not released anything to us. they told us the tweet has no meaning legally.

i don't know whether that is right or true. my question is, why is the justice and state department continuing to cover up documents? this is not required by law. it is usually discretionary, despite the president's wishes to the contrary. host: who is behind the cover up? are you pointing to people appointed by the president? ultimately someone like christopher wray is responsible, attorney general barr. they know these documents are out there but they don't have much interest in having them released. timing, sor as the far from the russia investigation, why do you think that matters today? guest: because, as i collect it, is still going on. you still have leaks targeting president trump.

what took place during the russia investigation is a crime in my view. the more information we have, the more accountability there will be. it is not sufficient to get a criminal investigation going, but if we don't know what they did, there is going to be zero public pressure on the justice department to hold them accountable. one of the reason durham has been able to skate without having to do anything is because only now are we learning key aspects about the corruption behind russiagate. host: such as how? and barack brandon obama knew that the russia gate smears were just that and that they were concocted by the clinton campaign to target trump. we have known that generally and in the last few months we have information going back to the beginning that flynn was

biden and burisma. one official called it the gift that keeps giving and talked about the russians trolling biden over burisma. it was a big deal in the state department. we saw that confirmed during impeachment. we are seeing it confirmed with documents. now we are having the blanks filled in as to what moneys were being sloshed around. host: from the statement you called for the removal of the investigator because he was slow walking the process. guest: those are after-the-fact rationalizations. how many prosecutors does the vice president get involved in firing? host: the new york post story, is there a direct line from the computer itself, the person who founded, to rudy giuliani? are there questions as to the

validity of the evidence? guest: the new york post tried to figure out the chain of custody and i would hope the justice department and fbi are doing something about it. i am concerned they are covering it up to undermine the allegations. it seems a straightforward issue to figure out whether the emails are legit or not. we have information that hunter biden's lawyer was seeking a return of the material and i have not seen anything from the biden campaign to suggest the emails are not accurate. there is a "washington post this week where biden is reported to tell someone how he needed to make money for the family. we have politico being told by the biden campaign there is no official scheduled meeting between biden and this burisma official, but we can't rule out it did not happen. this is piling up and i suspect

it will get worse. host: the washington times has a story taking a look at this issue. the first sentence says hunter biden left the laptop computer at a delaware repair shop, whose owner gave the material to the fbi and president trump's attorney, rudy giuliani. according to the washington times, the shop owner told that to a senate committee. guest: when you confirm that to a government body, you are putting yourself in legal risk if you are lying. let's get it out. i want to hear what joe biden has to say about these emails. did he get any money from his brother and his son? where was that money coming from? we want the details about where hunter biden was getting money. the scandal is significant. i am also concerned about why

the justice department and fbi has been sitting on this material for a year. what have they been doing? attorney general barr earlier this year said, i don't see any evidence about obama's or biden's involvement in crimes. they are not going to be pursued. did he know about the laptop? if not, why not? host: what's the likelihood that any other information is going to come out so close to election day? documentsmay just get in the ordinary course because of the freedom of information act lawsuits. separately we may get some documents about dr. fauci and his top deputy and their communications about china, the who, and coronavirus as soon as next week. we never know what's going to be in the mail the next day. our first call comes from

of the other issues judicial watchdogs, mail-in voting and watching over that. talk about the work you are doing there and relate it to the caller to a vs question. is the rolesncern are not clean enough to mail blindly into them, where you have valid and valid applications being mailed to people who have not asked for them. i think this is going to be 100 million valid applications mailed to people who have not asked for them. typically ballots are mailed in most states to people who have asked for them and in some states you have a vote by mail generally. we have had a massive increase operations in a way that increases the risk for voter fraud.

i think the call is referencing numbers during the 2020 primary where you had over 550,000 vote by mail ballots thrown out because of challenges and other problems. that number was above the 319,000 number for the 2016 general election. the concern is you have potentially millions of people disenfranchised because they relied on mail-in ballots. if you vote by mail, it has been generally understood your vote is more likely to be challenged, intercepted, lost, or thrown out. my view is you should be voting in person. host: your colleague and judicial watch took a look at inconsistencies that have risen in specific areas. if those are true, do you think it is enough to sway an

election? guest: the problem is we don't know. that's why you want a system that reassures people votes are going to be counted accurately, that only eligible voters are voting. we announced a study last week that showed in 29 states there are 1.9 million extra names on the roles. you have got more people on the roles than are living there and eligible to vote. it can mean dirty elections. is they are going to be counting ballots well after election day, not so much because they got a lot of ballots on election day, but some states are counting ballots that arrive after election day. in california, they will be counting ballots for 17 days after the election. that's absurd. even early voting opportunities

for voters, i understand why it may be more convenient to vote weeks before election day, but to me it is at odds with the best way to run an election. wereat the biden emails some trump thing on the other side may sway people to vote against him and they can't change their vote. once you make your vote and something comes up, it is too late. sen. harris: there is -- host: there is a lot of legal teams going to be involved. does judicial watch insert itself? guest: we are monitoring what's going on. we sued in california to try to prevent a lawless mail-in ballot plan. we ended the suit after they promised they would not be mailing to dead people and people who moved away.

we have three active lawsuits to clean up the roles in north carolina, colorado, and pennsylvania. even our warnings to states have a positive impact. in allegheny county, pennsylvania, when we warned them they had dirty names, they immediately removed 39,000 names. host: is the concern over widespread mail-in voting, absentee voting, or both? guest: these days it is a distinction without a difference because you have so many ballots going to people who have not asked for them. in the district of columbia, they just mailed to the voter registration lists. that is happening in california and nevada as well. when you have inactive names on the list, they won't necessarily get a ballot, but those names can be used to request ballots
