following the vote in the house yesterday, congressman santos went to the capitol steps and held an ad hoc, chaotic gaggle with reporters to defend himself. [video clip] >> everybody is innocent until proven guilty. you cannot behave as judge and jury in this procedure. i think leadership for allowing this procedure. there were seven democrats who agreed and voted present on this procedure. i understand the policy is complicated but the reality is there is a procedure. you cannot be judge, jury and executioner. i have a constitutional right to defend myself and i will do that i look forward to doing that and i look forward to seeing the process play out and if the exit -- ethics committee finds cause to remove me, that's it. it's not about silencing 100 40,000 people who voted for me. host: the scene intensified when

bowman criticizing republicans for not voting to expel congressman santos. they deferred the expulsion to the ethics committee. to some marjorie taylor greene there, the republican congresswoman defending the party. we want to get your reaction to what happened on the house floor yesterday. house republicans blocked a vote to expel congressman george santos. begin dialing in now. joining us this morning to give us more details about how this came about yesterday is lindsay mcpherson, senior congressional reporter. how did this resolution get to the house floor? guest: robert garcia, a democrat from california, had introduced his resolution back in february. expulsion resolution and other legislation is a metal of

privilege in the house which means any member can go to the floor and call up the question of privilege to force a vote and that's what he did on tuesday and that requires leadership to act on it within two legislative days. they have options to avoid an up or down vote and they deployed one of those options which was to move to refer the resolution to the ethics committee. that is what leadership did to avoid the upper down vote and republicans ended up voting with their leadership. host: why did republicans choose that movie? we have heard from some of his republican colleagues saying he should not be in congress. why not vote for the expulsion? guest: the main rationale is that expulsion is a pretty rare step that has not previously been used without either an ethics referral or

recommendation for expulsion or without a member having already been convicted of a crime. george santos has yet to be convicted. in the interest of due process, they thought they should send it to the committee and get the recommendation from ethics before they take that step. host: as you heard in his congressman santos noted, seven democrats voted present, why ? guest: they thought it was important to remain neutral. i haven't had a chance to speak with the democrats in my guess is that they also wanted to act in due process and send it to the committee. the committee has jurisdiction and they were already investigating this. they opened an investigative subcommittee to look into the allegations against george santos on february 28 so they had the authority to pursue that

and had the authority to pursue expulsion but some people felt it was too soon to bring the matter to the floor. host: who leads the committee and where is their investigation right now? guest: the investigative subcommittee is led by david joyce and susan wild. they cannot speak about their work so we really don't know how much they have accomplished in the past two months. from talking to other people, they did put things on pause a bit while the doj case played out against george santos. speaker kevin mccarthy says to move ahead with their investigation and now that the doj investigative part of their case is closed, they filed 13 charges against george santos. they can proceed with their own investigation in ethics.

that is a sense of what will probably happen but when i spoke to david joyce who leads the investigation subcommittee, he couldn't even tell me whether they have the authority to do that. typically it's the justice department and the ethics committee holds off until all the procedures are done including court cases. it's not 100% clear but all indications from lawmakers is that ethics will go ahead and pursue their investigation. host: will democrats drop this now? guest: that's to be determined. my guess is that they might wait a little to see if ethics has anything but i don't think they will necessarily sit around and let this go on all year. some democrats i think they believe this was kind of a smokescreen and republicans say they will do with this quickly but they will let the committee

system of justice in the house. you have congresspeople who started the coup on president trump. with the russia collusion. people were dismissing the fact of the reality of the situation. then you have nancy pelosi doing anti-trading. when you give into ethics in congress, you have to first start at the beginning. you have to be honest and you have to be fair with both parties, not just one. when you start with santos, you cannot start with him. host: got it, stephen in michigan, he says he should not be in congress. his resume is fictional so how can he serve his constituents if he cannot be true to himself?

body to what it should be. we all filed this resolution three months ago even before this last group of charges. with power comes great responsibility and the represented from new york is filling no interest in a public good and we should not refer this matter to the ethics committee. it's already there. every republican should stand up and join us and defend this body and expel george santos. host: congressman garcia with his motion to expel. they voted along party lines but the house representatives yesterday referred the resolution to the ethics committee which is already investigating george santos. representative dean phillips, democratic congressman from minnesota tweeted out that i served on the house ethics for four years, it's not resource or

structure to perform the expeditious accountability congress need. instead of investing in ethics, the gop made changes in january to reduce its efficacy. he also writes -- it's not a surprise that the majority wishes to refer george santos to a committee that is already investigating him in all likelihood, will be unable to make the recommendation that almost every member of congress knows is necessary and appropriate. let's listen to the speaker of the house, kevin mccarthy earlier this week defending his move to refer this expulsion to the ethics committee. as we look to these issues, we had report command from durham. what does that say about adam schiff? he liked to the american public? should he be expelled from congress as well? taking congress in america down through the path he did and lying to us? i think these accusations are very serious and i have a concern about george santos. i firmly believe in the foundation of this country and you have to have a process. i will ask that the ethics look at this and don't do a short time -- a long time basis. i think we can look at this quickly and come to a conclusion on what george santos did and did not do through x six just through f just through ethics. i think that's when you bring it back to congress. i would like to refer this to ethics.
