to tell us what it all means. next to elizabeth warren of course, a person i know who knows the most about healthcare reform and worked hard on it for the obama administration, our friend in los angeles, jacki schechner. and here she is with today's current news update. hello, jacki. >> good morning, bill. good morning, everyone. it certainly is a big day. i know we all have a bit of a health reform hangover but now that the dust has settled, the court ruled 5-4 that the individual mandate was unconstitutional under the commerce clause but could be interpreted as a tax. we were surprised when chief justice john roberts turned out to be the surprise swing vote. ultimately what's going to happen now is that we've got the entirety of healthcare reform that's going to continue ahead as planned. there was another provision the court ruled on yesterday that got a little bit less attention. and that's the expansion of medicaid. some of the states were worried

if they chose not to participate in the federal expansion which would then eventually cover some 17 million lower income americans that they would then have their medicaid funding pulled from the federal government. the court ruled that the federal government doesn't have the right to pull the all right existing and could opt out. if states decide to participate in the expansion of medicaid they have to provide by the parameters. it's a goo states to opt in. we know this will have some impact on those lower income americans if they don't. if they choose to opt in the federal government picks up the tab for the first two years and states will only have to pay as much as 10%. otherwise, we continue forward with things like not refusing people with pre-existing conditions, making sure we no longer charge women more than men, making sure that people up to the age of 26 can stay on their parents plans and you no longer get dumped by your insurance company the minute you get sick. there are all sorts of great

states, after all of this wrangling, all of this talk the supreme court, the nation's highest court, said that the affordable care act is constitutional. they upheld the entire law including the individual mandate by a 5-4 vote. it should have been unanimous. too close, but it went the right way, and that majority opinion, most was written by john roberts, himself, the chief justice. some people felt that anthony kennedy would write that opinion because he is the swing vote and roberts might go that way or might not. but it was roberts who led the way. you know the only wrinkle is and what threw people for a loop at first was that the court did say the commerce clause -- in other words, that the individual mandate was constitutional under

the commerce clause. of course, no. we disagree with that. that was the main argument of the administration but their back-up argument, it is constitutional under the taxing power of the congress. said absolutely it is. john roberts, again, writing the majority opinion. you can't deny it. shortly afterwards president obama once the dust had settled went in front of the cameras in the east room of the white house yesterday. i was at the whitehouse yesterday, and he said for the american people, it's a bigwin. >> whatever the politics, today's decision was a victory of for people all over this country who is lives will be more secure because of this law and the supreme court's decision to uphold it. >> and he said all americans, all americans across the board liberal, conservative doesn't matter. we are all better off. >> today, i am as confident as ever that when we look back five years from now or 10 years from now or 20 years from now we will be better off because we had the courage to pass this law

and keep moving forward. >> and that's an important point, to keep moving forward. i think it follows and fits in with the president's theme forward not backward. and the forward is that the president says now to continue to i ammplement and continue to expand healthcare until we really have universal healthcare in this country . >> the highest court in the land has now spoken. we will continue to implement this law. we will work together to improve on it where we can. but what we won't do what the country recant afford to do is refight the political battles of two years ago. >> yeah. we are not going to refight the political battles and we shouldn't, and i don't think the american -- you think people want to go back to where we were finding this whole thing out and listening to eric canon and mitch mcconnell and whiny members of congress?

it's a huge find education and shows the guys have guts background, a good set of balls because he took this issue on and he won on it. it's a huge victory for obama. it's a huge loss for the republicans, for mitt romney who have staked everything on this, and romney who said the other day repeating that if the supreme court overturns it, it means that the first three and a half years of the obama presidency had been wasted. okay. well, the reverse then is true, for the supreme court to uphold it means that the first three and a half years of the obama presidency have been well spent and spent on something that's importantly for the american people and helps the american people. so romney is out there. and plus he is doubly -- double lose her on here because it's his damn program that may president obama adopted from massachusetts and made it nationwide. most important, it's a huge victory for the american people. don't forget all of those millions of american families who couldn't afford health insurance before, now they can,

could not get health insurance because they have a pre-existing condition. skids stay okay their parents' healthcare programs until they are at least 26 years old. it's going to get better and better and better are all in place, and so the american people are the ones who really benefit from this. you know what it means? november the 6th, november the 6th, boy, republicans are saying, we are still going to repeal it. mitt romney says i will repeal it on day 1. so the clear choice is november the 6th. it's yes or no. it's yes for universal healthcare or no, against it and start all over again. and the supreme court is going to put that choice now before the american people, and republicans are going to run on this. i say let them run on it. 866-55-press. my column is up on the website at billpressshow.com. ol john roberts saving the court and his ass by writing that majority opinion a historic

candidate, the outstanding senate candidate elizabeth warren joining us just a little bit later. we will get back into healthcare but first find out all -- everything else that's going on in the news today. today's currents news update from our friend, jacki schechner out in los angeles. good morning, jacki. >> good morning, bill. good morning, everyone. there is some other news. president obama's going to head to colorado today to see the wildfire damage firsthand and to thank responders for all of their hard work. yesterday, president obama signed a colorado disaster declaration, which makes federal funding available for emergency preventative measures and crisis counsel ling. in colorado springs, officials have evacuated tens of thousands of people. at least one person has died and the waldo canyon fire has destroyed an estimated 346 homes. the ap reports there are signs of hope as cooler conditions are helping to slow the flames and the fire is now about 15% contained. there is also a second fire called "the hyde park fire."

it's about 70% contained but not before wiping out a total of 257 homes so far. back here in d.c., congressional leaders are hoping for quick action on big legislative package that takes care of looming issues fast approaching end end-of-month deadline. there is a transportation part of the bill which keeps aid flowing to the states for highway and transit construction and uses federal loan guaranties for private investment and infrastructure. the bill is going to save 1.8 million jobs and create another million. as for stopping the federal interest rates from doubling it looks like we have resolution on that. there are changes in pension laws that will pay the tab to keep rates at 3.4%. and just want to let you know that people are actually funneled raising off of the healthcare decision yesterday. the obama campaign sent out e-mails asking for money. they have -- the romney says it raised $3.2 million between the

romney and every other republican, justice uphold healthcare law by 5-4 majority. roberts writing the majority and a huge victory for president obama. indeed. by the way, i notice eric holder is nowhere in the headlines at all. hum. wonder why. yeah. dumb thing for the republicans to do. but what a great, great turn on the supreme court, an historic decision for several reasons. first of all, because this is the biggest expansion of healthcare since medicaid and since social security or since medicare and medicaid, i meant to say. and secondly, because everybody -- you heard the prognosticators and the pundits. everybody, the washington echo chamber is saying that the supreme court was either going to invalidate the entire affordable care act or at least the individual mandate. they all got it wrong.

and historic because john roberts, the justice who has always, always sided with clarence thomas and antonin scalia and samuel alito, this time, he went with the progressives on the court and said no. the congress has the authority to do this. and the affordable care act does stand as within the purview of congress as constitutional. it was a great moment yesterday, certainly for president obama, a personal vindication for president obama as he pointed out yesterday this was not necessarily the politically popular thing to do. there were people inside the white house starting with his chief of staff, rom emanuel who urged him not to do this. yet the president was committed to it and he made the decision. he we want forward, and yesterday, he proves that he did the right thing. the president saying yesterday, big victory for all americans.

mess that whole battle was in the united states congress over the healthcare reform act. the last thing the american people want is to relive and replay that whole battle. i mean that's just insane. you want to see the great, great difference between members of congress and their different reaction on the news yesterday from the supreme court this photo, if we can show it with nancy pelosi and john boehner, it's an actual photo, not photo photoshopped standing side-by-side on the floor yesterday when it becomes clear that the news is the affordable care act has been upheld. look at the big smile on nancy pelosi's face. look at john boehner. >> look at that sour pus. >> looks like he sucked on a pickle. >> so mad. >> it looks like he is about to cry. >> well, he probably was.

then the opinion and then there is this paragraph that says can't be upheld under the commerce clause and somebody probably read that and dashed off and said, let's go. >> this is it. this is it. they should have known better. so we know what the decision is upholding under the taxing authority of congress the individual mandate. what does this mean? it's a bfd as biden would say. >> it sure is. it's a huge deal. look. the republicans are going to find strategies to attack it. i am sure we will talk about that. but the bottom line here is that this law, which has been under a huge cloud that entire cloud hasn't lifted, but a lot of that cloud has lifted and now obama, democrats, liberals, healthcare advocates, can all say this is constitutional. it's the law of the land. even john roberts said so. so it now has teeth and authority that it didn't have

before. >> so where do republicans go from here? right? john boehner saying yesterday, if the supreme court didn't repeal it, we'll repeal it. mitch mcconnell says the american people want us to start from scratch. right? mitt romney says, i will repeal it on day one of my presidency. you know talking points memo this morning, if i bring it up again, after healthcare ruling g.o.p. hits rewind as democrats look to the future. >> that's basically all they've got. right? >> that's what they've got. i think they are going to try to force some kind of replay of the summer of 2009. >> that's what we need. >> that's exactly what we need. but i think that's what they are going to try to do. you know, they have already started on the tax increase thing. you know, i don't blame them for doing that. if i were them, i would come out of this saying that, too. this is now a tax increase and it breaks its pledge not to raise taxes on middle income people. but the democrats have to answer

that, bill, pretty forcefully because they are already out there saying, this is an increase on everybody. but, no. 85% of people have insurance. so this doesn't affect them one way or the other. most of the people will actually buy it. so it will be a tax increase but only for -- it's estimated to be about 2% of the population. >> those people who can afford healthcare and say i am not going to buy it, they have to pay a penalty. now, you are right. >> that's the republican tack and i think democrats have started to respond to that. think progress did this morning. you probably have. i haven't seen it. >> yeah. i did. >> but there is a problem with that for mitt romney. and i notice he did not use the tax argument yesterday because he can't. >> he can't. >> because this is exactly what he did, the very same provision in massachusetts. >> right. >> so if it's the largest tax cut in the history of this country, that would make him the author of the largest tax cut in the history -- >> tax increase. >> yeah.

i mean i was visualizing yesterday afternoon the moment in one of the debates this fall where rockmney tries to trot out that line and obama says, governor, if this is a tax increase, what you did en masse was a tax increase of exactly the same kind. i don't think romney. >> checkmate. >> romney can't use that line. >> what romney did say and i point this out in my column which is billpressshow.com. romney, on tuesday, said that if the supreme court invalidates the affordable care act, that means that the first three and a half years of the obama administration have been wasted. >> right. >> right? now, to be fair: isn't the reverse true? >> this is what i wrote in the piece that you read from briefly. this was basically my main idea in that piece. and that, you know admittedly would have been a really really powerful attack, i think, to independents and swing voters voters in the middle for romney

talking about the arizona and montana decision. she was in the court yesterday when the healthcare decision was announced and she is back here this morning with us. dolly from slate magazine. hi. good morning. >> good morning. >> when john roberts started speaking yesterday, you thought, oh, my god. right? >> we were going crazy, the whole press corps was trying to look at faces. sotoamayor. what's going on? the chief started reading which wasn't a surprise. i think we suspected he had the obvious. >> opinion. >> one way or the other. for the first 10 minutes or so, he was just blasting the individual mandate, you know all of the bullet points that we have heard activity inactivity, forcing people into commerce. it lookseds -- it looked like the plane was going down, down, down but at the last second, he said that was a tax. he was that one vote that saved the entire act because the other four dissenterred would have

struck the whole thing down. he said, it's a tax, and i am going to let it stand and we are moving on. and every single reporter in the room got whiplash. we were all in neck braces this morning because it happened so fast. >> you got whiplash. some people got egg on their face, cnn and foch news didn't wait for the "but." they went out and reported it the other way. >> that's right. >> in the beginning. i want to talk about the implications of it, but first and i wrote a column on our website at billpressshow.com. what is your take on what is roberts up to? and why do we suddenly have this, both on monday in the arizona case and here particularly yesterday, a john roberts that looks a little more open-minded, shall we say, a little more flexible than we thought? >> i don't know he looks open minded. he is pretty clear he hates the mandate and even clearer he doesn't much care for the law. but what he is the chief justice, and for the rest of

history, this will be known as the roberts court. >> right. >> i think he breaks from the conservatives when it comes to preserving the integrity of the court. had with had a 5-4 decision to strike down not just the mandate but the entire law, which is what would have happened, we would have had for the first time in a very long time, bill all of the appointees who are appointed by republicans voting conservative, all of the appointees appointed by democrats voting liberal. and we would have had an election issue. we would have had a thermo nuclear election issue. obama would have run against the court. >> roberts had to know that. >> he knew that. the opinion polls have showed the court's popularity tanking, at the lowest. i think he made the decision to throw himself on the grenade,. he will be there a long time. he can say i can do what i need to do in small incremental steps without kicking sand in the eyes of the president and destroying

the integrity and reputation of the court. >> it was for the legitimacy of the court? >> absolutely. if you read the opinion, also a victory for the idea of being modest and humble judicial restraint, saying we are going to preserve as much of the law as we can. those are all promises he made at confirmation. a lot of us doesn't believe him. but it was a victory for the proposition that we let the elected branches hash this out. >> and a victory for president obama. >> well, clearly that is the case. and you can tell by, you know, all of the tweeters who are breaking up with chief justice roberts this morning. >> yeah. they have thrown him under the bus big-time. >> they are very upset. this is a big point in terms of you know putting the supreme court but the roberts court on healthcare law. >> so what does it mean now going forward? mitch mcconnell says this means the american people want us to start all over again. >> well, i mean i guess they are going to try to repeal the thing

in a symbolic move. >> makes it harder for them to repeal any one provision? doesn't it. >> also, you know, the one thing the administration had always had on its side was as parts of this bill that are popular come online, as people start to say i have my 26-year-old on my insurance plan. hey, pre-existing conditions no longer bar me from coverage. as those things come online, what we are going to see is the people hated the mandate. mandate is off of the table. no mandate. everybody hasn't hates it. it's gone. but the parts that are popular as they come online are going to be very, very hard to run against. >> yeah. the president, himself, and others said, no, don't call this a tax because it's not a tax. right? now, it's not that unusual in the sense of across the country, how many states have put in local level, state level, federal level, they will put in a fee. it's not a tax. it's a fee or a filing charge or whatever. they come up with theseeuphemisms.

the supreme court said it is a tax. rush limbaugh even said, the biggesthit in the tax of the world. >> a world. >> a man who is known for exaggerating to make a point. but do you think that's enough to turn this around and defeat it? >> sort of what they decided, i think, the argument they have got left. >> right. michelle bachmann was saying exactly that on the steps of the court 40 seconds after we adjourned. this is a tax and he has raced taxes. >> that's going to be the party line. the question is: how much that sticks. you know youes the president raised taxes. it's a bit of the thumb in the eye that the chief justice said you may be should have called it a tax in the first place, mr. president. but i think that people have decided how they feel about this healthcare bill one way or another. i don't see a lot of independents getting enraged over thisishment i think people are pol arrestized about everything else and so it seems to me folks are going to want to

move on. this is settled and i don't know if mitt romney wants to run his campaign on doing away with the law that not only did he implement in massachusetts, but that is the most successful state healthcare reform we have seen. >> and i also don't know whether he wants to make the argument against this calling it a tax when in fact, it's exactly the same provision that they had in massachusetts. all right. so, here it is. i just had a hernia. i am not supposed to lift anything this heavy. but here is the supreme court. this is a decision. right? >> yes. >> how many pages? >> i think 80 something for the chiefs and dissents. >> 65 in dissents and some 60, 61 or something for the chiefs as well. right? is there ever a time when -- you must admit, a decision this thing. right? all of these pages, all of these

different permutations and caveats, don't you think reporters maybe ought to take 10 minutes to review it or something and understand what it means before they run out and tweet? you know what i mean? >> well, i am dpromsed. i am going to defend the reporters. it's certainly a mistake to try to get a scoop on a supreme court decision because you've got four seconds advantage on the other networks. but i will say, this is the court's fault. the court has the ability to make this available to reporters. >> ahead of time. >> in a lock-up. that's what the can aidian supreme court does. let us read it. >> a lock-up. you are in there. you can read it but you cannot report or tweet on anything. >> they take your blackberry at the door in canada. you have time to read it and digest it and then you don't do stupid things like saying gore won in bush v gore. the nature of scoops is we want our scoops.

the ink is no longer dry on the supreme court decision yesterday than when senator scott brown put out a statement saying well obamacare may be constitutional but he said it is wrong for jobs and the economy. what's your take? >> well they push that same button. don't they? every time. >> every time. >> the way i see this is for every family who worries that one serious health problem could turn them upside down financially, this decision is good news. it ensures that millions of children, seniors, people all across the spectrum are going to continue to benefit from healthcare reform, and i was very glad to see it. >> the senator has said that he would be a vote for repealing the affordable care act. and he also of course as i understand it, has a daughter who is on his own healthcare

plan because she is under the age of 26. so, benefitting from the plan but ready to repeal it? >> yeah. you know, but that's how it's been all along. remember, scott brown originally ran on blocking healthcare reform. he features it prominently on his website. and yet, completely ignores all of the benefits of the affordable care act. you know, we talk a lot nationally about the coverage issue. here in massachusetts, we already have full coverage. but the affordable care act brings us so much more. it permits young people to stay on their parents' insurance policies until they are 26, the feature you just talked about. it also means for people who have cancer or other very expensive -- needing other expensive treatments people with chronicle illnesses don't have lifetime caps. it also means that seniors are

going to have better coverage for their prescription drugs, and those benefits are starting right now. what scott brown and mitt romney and the republicans are going to have to do is go back to the american people and say, hey, you know those things that are really working out that make healthcare fairer and more affordable, the things we have pushed the insurance companies to do, the things we are now doing on medicare for seniors? we want to take all of that away from you. and, you know, i just got to say: that's a debate i am ready to have. we can have that fight. let's go. >> i think we are going to have that fight in massachusetts. and around the country. >> uh-huh. >> mitch mcconnell saying the american people want us to start all over again. not. >> you know, that's the part too. >> that's the one that really hit me as soon as i saw scott brown's statement and then mitt romney's. and then i thought, do you really think the american people want us to tear this up now that

>> i have to tell you. i saw that. of course, talk about for j.p. morgan perfect timing. it's like they stepped outside in the middle of a hurricane and whispered, oh it wasn't $2,000,000,000. it was $9,000,000,000 and ran back inside. but this is a reminder, both of the kind of risk j.p. morgan has been taking on. but, also, stop and think. they were just in front of congress a week ago. right? >> yeah. >> in front of the house of representatives. i think everybody there was operating on the assumption it was a 2 billion, $3 billion loss. is it the case that j.p. morgan can't figure out how big the loss it is? this has been going on for weeks and weeks and weeks now. or is it the case that they had an idea how big it was and just didn't want to talk about it? either way, it raises the same kind of issues about the risks they are taking on and the lack of oversight.
