mayor. stop your puns. we'll try to say something nice. today is the bit of jay carney and composer richard vagner to the lovers of opera and haters of jews across the world. this is "viewpoint." >> john: good evening i'm john fugelsang and this is "viewpoint." thank you so much for joining tonight. when officials under oath at a congressional hearing insist first on their innocence you might expect them to be willing to talk about the issues at hand. so when the house committee on oversight and government reform swore in irs official lois lerner to find out what she knew about that agency's targeting conservative groups, members were not surprised to hear this.

>> i have not done anything wrong. i have not broken any laws. i have not violated any irs rules or regulations, and i have not provided false information to this or any other congressional committee. >> john: good start, but they appeared a little more surprised and in some cases annoyeded to hear what followed. >> after very careful consideration, i've decided to follow my counsel's advice and not testify or answer any of the questions today. >> john: republican congressmen trent gowdy of south caroline that thought the committee could continue to press lerner but the democratic representative elijah crumbings of married set disagreed is. >> you can't tell your side of the story and not be suspected to cross-examination. that's not the way it works. >> unfortunately, this is not a federal court and she does have a right and we have to adhere to that.

>> john: and she wasn't on trial. congressman issa apparently now agrees with congressman gowdy and said he will bring ms. lerner before the committee again. jay carney insisted again president obama wanted to cooperate with crooning in it's oversight function as the investigation moves forward. >> the president believes the activity here, the actions here, were wrong and inappropriate. he wants to get to the bottom of it. he wants people held responsible if they are responsible. >> john: while by lois lerner supervised the irs tax exempt organizations device that targeted these conservative groups she seems to have evaded oversight in the past two two days before lern er addressed an american bar association conference where she allegedly planted and then answered a

question. >> if you could comment briefly on the status of the irs investigation and these political non-for profits i would appreciate that as well. >> well, you can look at our website right now that is seeking information from 501 c 4, 5, 6 of organizations and a big piece of that questionnaire relates to their political activities. that's our beginning. >> john: for more on the congress lois lernr and the investigation of the targeting of the visit groups i'm very pleased to be joined by congressman joe crowley democrat from new york's 14th district: >> thank you. >> john: you called on lois lern er to resign from the irs. would you comment on her response to your question that we just played. and her decision to insore her fifth amendment right against self-incrimination today. >> thank you for letting me hear that. her response, that's what they're doing as of right now.

she clearly was not fort coming with all the information that she was prepared to give out just two days later with a set of questions. and i think there in lies the problem for her. that she was not forthright and forthcoming with congress on a simple question. when asked why she waited so long to come clean on the issue she said no one had ever asked her before. that wasn't true. obviously i had just asked her two days before. john, therein lies her president obama why she invoked the fifth amendment. she had been drilled just two days before and she came clean. >> john: that's why you she refuseed to speak today. >> i think that's why. i don't think it goes back in when she knew what. that's become clear that they were under investigation for quite some time as the i.g.'s

report indicated last week when it became public. >> john: were you angry that this irs mess happened under president obama's watch? >> i'm angry that it happened at all. democrat or republican. let's be clear here, john, the irs was going after both progressive and conservative groups. what they call the project is irrelevant because there were many--a number of progressive groups that were denight denied status quite frankly. whatever its political speech the irs should not be using its tools to go after that speech. this was under mr. schullman's watch, he was a bush appointee not an obama appointee. mr. miller is a civil servant the acting chair of the irs. president obama has not yet replaced him with a permanent political appointee. so it happened during his presidency but i think it's a

stretch to say that it was under his watch. >> john: i'm glad that you brought up the liberal groups from targeted as well. one such group emerge america," did have their tax status denied and that did not happen to a single tea party group. >> not an one. i can understand the outrage that all americans should have because of the ineptness of, and i think an agency gone rogue. this was across the political spectrum and i join my conservative colleagues in their outrage because i think progressive groups were targeted as well, and it's unacceptable. >> john: the white house communication staff has not been doing all that much to help the president. press secretary carney admitted there have been legitimate criticisms of how they handled the irs story. how would you rate their performance so far? >> whenever you're under the gun

constantly by the opposing party, you know, man hits dog it's president obama's fault. woman steps on ant, blame the president. that's what is happening here. it's gotten out of control. i do think that my republican colleagues, the credibility is being tested here. i do think they're start to go way over the top. this is not a watergate incident and they're turning this into watergate and it isn't. >> it's true. when rand paul shows you you're going over board that's a sign. while congressional oversight is important and the white house as is working with congress there have been some attempts to politicize this. is there any way to have this investigation and separate it from partisan politics? is this thing going to getting allier asgetuglier as it develops? >> ms. lerner was dismissed both the chair and ranking member of the oversight committee and now the chair mr. issa, i think is

seizing the moment, as we say on hard delivery of the fifth amendment to use this opportunity to drag her back to the committee and further try to get information out of her. i think what she's really trying to do is basically save her job. i think she knows that she was at best ms. leading or not for the right, not forthcoming with information to congress. i think when you juxtapose that with the statement two days later that she may have cross-examined in that way you have to admit on that day she lied. that's where she's trying--i think that may be where this is leading. >> john: under the republican white house liberal groups have been targeted by the irs i want to believe that the republicans would be fighting it as hard as you're fighting now i commend you for it. i have to ask what are your thoughts on your former colleague and fellow new yorker anthony weiner's attempts to

fifth. what does her refusal to say a word mean in the obama white house? >> not much. look they'll try to bring her back. they'll give her immunity if they think there are any serious crimes she's involved in. i question if there are, i don't know if she has that much to say that would have that big of an impact on the house. >> does anyone think she's involved in any crimes? >> john: i don't. it's hard to see where they are. it may be not being forthcoming with congress in previous appearances. >> cenk: that's horrible. i can't wait for oliver north to weigh in on that on fox news. haveis there question of how they've handled themselves. >> clearly. you know how i feel on the white house communication. they are not very good. what they allow to dribble out

every day. it takes a turn here, takes a turn there. and the white house has nothing to do with this. at least i'll be extremely surprised if it turns out that they do. there is a big story happening we're learning now exactly what took place here. nobody is paying attention. >> john: what is the big story we're learning. >> we're seeing more and more good reporting of what happened in cincinnati. and despite the efforts of some to move away from cincinnati, this is the center of the center it is not uncommon for different divisions of the irs to be housed in different places. in this case it was cincinnati. we're seeing what happened there. poor communication, constant change of leadership, and people were not directed. >> john: under staffed. >> under staffed. >> john: in a flood of highly political groups claiming to be not political. >> people have many reasons to be unhappy that their internal

revenue service is not functioning with a high level of expertise. but that's what the story is. >> john: according to "the new york times," reporters began receiving word from tea party groups that they were being scrutinized by the irs last year. that story didn't go anywhere during the election year which makes the tea party say it was a conspiracy. are the republicans now trying to make up for lost time with 2014 around the corner? they're not going to get a scalp out of this. why the fervor out of this? >> this is less about republican and more about individuals trying to get their picture in the paper. this is really the case. if you look at the kind of impact this has on a congressional election in 2014 the only real impact could be in primary races where tea party candidates are taking on established republican candidates otherwise there aren't that many districts any more where you have close races. >> john: isn't that the real story, the real political story that you have mainstream

established republicans trying to suck up to the tea party. >> exactly. those who are not darrell issa try to get as much press they can suck up, which is what he is all about. yes, it's about mainstream republicans kissing up to the tea party by expressing their profound disgust. >> cenk: as long as nothing is getting done in washington, d.c. you have the democrats trying to drive a wedge between the republicans and the tea party and the g.o.p. trying to suck up to the tea party so they don't have a wedge. >> that's another great myth of this whole thing. >> john: congressman paul gossar told a bush appointee he should be ashamed if the irs leaked the tax information from harry reid. another learn said the irs story demonstrates the culture of intimidation fostered by the white house. so it's clear the tea party is so intimidated by president

gif. but it was pointed out "g" is for graphic, so it should be gif. and i'll say choosey mothers choose jiff. last week minnesota became the 12th state to legalize same-sex marriage. following delaware and rhode island's lead earlier this month. corporations in this country have done this too with the vast majority adopts anti-discrimination policies to protect their lgbt workers with one notable expect, exxonmobil corp. the lgbt rights group freedom to work is hoping to change that today the group filed what is called a grouped breaking discrimination complaint against exxon contending it violated illinois human rights act when it response to an employeement test. exxon treated a stronger and well-qualified applicant who was

lgbt or was perceived by exxon to be lgbt in a far worse manner than exxon treated a weaker applicant who was not lgbt. joining me now is tico almeida founder and president of freedom to work, the group that filed the discrimination complaint against exxon today. thank you for being here. >> it's great to be here, thanks. >> john: tell us why this is so ground breaking. >> this goes back to how you should never pick on someone who is smaller than you. we decided to go after a big player. they're the biggest anti-gay company in the country and probably the world. they're a holdout among corporate america and hold out among the fortune 500 in maintaining anti-gay policies. we decided to test exxonmobil. they have been claiming for a long time that they don't

discriminate. they said they didn't want to adopt a policies policy because they said it wasn't needed. we decided to test them and september in resumes, and we found discrimination against openly gay applicants to exxon. exxon prefers there were a few examples of this where exxon preferred the weaker race may over the stronger lgbt resumé. >> john: these were not actually real people applying. they were resumés that your group created and submitted. >> we teamed up with the equal rights center, a civil rights think tank that has been studying and conducting testing like this for decades for the african-american movement, disability, latino groups, they've been testing employment for decades. this is the first time that we as gay people have taken a

strategic move out of our preed decemberer of other movements. when they had success i always thought we should copy that success. that he had what we've done in this case. >> john: the question about the timing. it is a plan to expose it one week before their shareholders are set to meet in dallas. >> we had a statute of statute of limitations that was about to expire. we were going to have to file this week any ways, but it is i think important that the shareholders when they take up that vote next wednesday have this information in front of them. because last year, unfortunately, they voted down the shareholder resolution that was brought forward. this voted it down 20-80 wrongheaded vote. at that meeting there was a push from exxon corporate leaders saying we don't need this because we don't discriminate. now we have evidence that they do discriminate, and i hope that the shareholders are going to take that into account and tell exxon settle this case and i will tell you i'm willing to

settle this case. freedom to work is willing to settle this case right away. we'll settle it tomorrow if they will adopt a clear anti-discrimination policy that protects gay americans and transgender against discrimination. if they agree to that, that's simple, it's cost effective and helps them recruit and retain the pest talent when you're welcoming all employees. >> john: you're right. >> if they'll do that we'll settle this case tomorrow. it's unfortunately going to be that they're stubborn like they've always been. i think they're going to drag this out for a long time. >> john: or we could tax them. now i have a question tico, mobil used to have a benefit for same sex employees. what happened to that. >> and they had a policy in discriminating against hiring, firing and conditions of employment. >> john: and they dropped it.

>> when the merger happened, exxon was so anti-gay that they insisted that mobil delete the equality policies that mobil had for years. in the history of corporate america this has got to be the first time and i hope the only time ever, where a coupe company has gone backwards on civil rights. mobil rolled back the clock and they moved from the 1990s to the 19 50's when everyone else in corporate america was moving forward and treat every with respect if you want to be a profitable and moral company. >> john: but they made a lot of minton their marriage didn't they. is the tone deafness on equality coming from the top tico? i'm sure its just a coins against that the ceo is also the vice president of the boy scouts of america board. >> i think there is reason for optimism on the boy scouts. they're going to vote tomorrow

in dallas like exxonmobil is going to vote in dallas next week. and they say that the boys scouts are going to do the right thing and not discriminate and allow all those who serve in the scouts to do so. i hope that exxon will follow the boy scouts lead. exxon is beg left behind. another big player, another constitutional power other than exxon that is dragging their feet on guy rights is the obama white house. they're still refusing to sign the executive orders that president obama promised in writing four years ago that he would sign. i'm not blaming the president. i think the staff has bungled this entirely. it's thyme that they--it's time that they fix it. they should stop dragging they are feet on the pathway to equality and get the president to sign the executive order that he promised that he would sign.

whether or not immigration seems to be the one area right now where american elected officials are making progress. the bill passed it's first big test yesterday getting approved in the senate judiciary committee but it wasn't a win for everyone. you see senator patrick leahy was forced to give up an amendment that would have allowed same sex partners of u.s. citizens to get green cards9 cards. leahy poke of his heavy heart over the concession on civil rights but acknowledged the same sex provision was never going to make it if it led to the demise of an immigration deal. he hopes that to take it up again. joining me is viviana hurtado.

>> hi. >> john: so that was an emotional hearing but what do you think of senator leahy throwing out of the same sex act that would allow same-sex couples looking for green cards. >> politics is not scandal of how a bill becomes law. it's dirty and there was strategy involved in negotiations. and i think it came down down to mathematics. there was talk in the white house was not pushing much on this. do you sacrifice 40,000 couples or 11 million people who are here illegally and stand to be on a pathway to citizenship in addition to the score of others who would benefit from the sees at a provisions for high school and low-skill workers.

certainly senator leahy had a heavy heart and so did others from the democratic contingentcy but it's not surprising. the strategy is let's get it to the senate floor john, and then punt it to the house. it definitely would have made the house. >> john: i think you're exactly right. i'm sure the democrats are terrified of the lgbt population defecting to the republican party. you've been watching the very slow progress of immigration lengthslegislation for years. can you talk to us about the what the big concession versus been up until now and what this bill looks like as it slowly grinds its way to the house. >> the news out from yesterday which was the lgbt provision just wasn't even brought to vote. but you know, democrats caved that's what a lot of critics are saying. the advocatecy communities for lgbt denouncing that decision. but you have to remember as well that the pathway for citizenship

for these estimated 11 million plus people who are here undocumented, that was a very big concession on behalf of republicans who were some of the very conservatives were saying absolutely not, under no circumstances. they were able to peg it to border security. some conservative wing said we haven't even really defined that beefed up board security. so i just kind of get the impression that even though there is a lot of elation on certainly for those of us who have been following this for a long time, we saw at the end of yesterday's hearing there were advocates that were emotional cheering there are a lot of people who are unhappy from all sides. it's an i am perfect imperfect bill the way most legislation tends to be. >> john: we know the punditsed pundits are watching this closely and wondering how it will affect

the 2014 elections. >> the latino community is watching in different media. the role of spanish language media is hugely important. it's informing people like the univision and others, they are very strong and traditional media as well as social media and their task is to inform but also combat a lot of misinformation. i was on spanish language last week in philadelphia, and i had a question asked of me, people actually thinking that the law has passed, and there are some unscrupulous types who are saying give me $5,000 because the law has passed, and i will expedite your papers. that's obviously wrong if we're just talking about the fact that it just got voted out of the senate judiciary committee. the latino community is watching watching certainly spanish

media being really strong and online. latinos love their mobile devices and they overindex on the use of mobile twitter and facebook. in fact, right now there is a big movement over the next couple of days called hashtag imarch. there are all kinds of people really interesting political to not say immigration bedfellows a lot of latino community is involved and they're following it. this is a really savvy way to use social media to reach new audiences, new groups of voters, like the latino community as well as the youth vote. >> john: and it's working and both political parties are watching queenly. viviana hurtado. thank you for being on "viewpoint." we hope we can get you back. >> i think i can do something to accommodate that request.

negotiate deals of big payoffs to get them to take them back or you got to release them here. that's not going to go over so well. >> john: you can't release them here because they're called terrorists even though half of the poor schomoos. >> the political problem that the president has when you release these people. clearly some of these folks are not terrorists. but one is or two are and then you're left with this notion that even though congress said you should not release them, the president does-- does-- >> john: in fairness, basil president obama released 500 and it was a tiny amount of people who were found later in the battlefield. >> 98.5%. >> john: i think it was smaller than that. >> i'm going to give you the number. i think it's 9.7. >> we have no idea how this is going to get solved.

weiner pulls out santorum running. by the way liberals who can't admit this was fun are like conservatives who can't admit that andrew breitbart was evil. in fairness, the guy did good stuff. he created the bipartisan middle class caucus. he got an a-rating on middle class issues. did he advocate for the national healthcare act which would have extended medicare to every. we would have had all the socialist healthcare that all our capitalists enjoy. and he went after the u.n. diplomats who owed our city $18 million for unpaid parking tickets. he did some shading campaigning when he ran in new york, but there are sins and evil.
