corruption in what would be an unprecedented move the european commission could invoke article seven of the e.u.'s treaty to punish warsaw for breaking its rules. let's go right to our brussels correspondent teri schultz she is standing by for us hi terry good to see you how things got this bad between warsaw and brussels well it's taken a while the european commission has been warning morris for some two years that these moves to take more control of the judiciary were simply not in line with e.u. law and not e.u. values e.u. principles and they've issued recommendations to the polish government to reverse course to change what it was doing poland has steamed right ahead and now basically the commission feels it has no choice but to take out the biggest stick in his arse it's in in in its arsenal which is article seven it says if it does not do so then what does what do the use values mean so basically what we're going to see today is the commission saying we have given warsaw as many chances as much time as we can

and this is what we're left with the nuclear option kerry let's get a better idea of what exactly it takes to trigger article seven catherine martens put together a report let's take a look. europe has mechanisms to deal with cases of delinquency and that means more than just idle threats and reprimands. should an e.u. country go against the principles of democracy then europe has no choice but to nail its colors to the mast. article several cumbered triggered by the european commission only in the case of a persistent and serious breach of the rule. it's the most radical form of sanctions within the european union and has not been applied so far. every you country must uphold basic values including freedom human dignity and the

off of voting rights and already the hungary and government has promised warsaw it won't let that happen so the first steps we may well see move ahead that would take only twenty two countries to agree to open this monitoring period over the polish government but when it comes down to actually implementing sanctions it's very unlikely that article seven can be seen through to its to its final implementation terry what is poland saying about all this well poland has has shown remarkable resilience against the commission in going ahead in ignoring all the recommendations the commission has given it to reverse course to to tone down the tension the polish government says this is a matter of sovereignty and that the e.u. should just stay out of its judicial procedures basically poland says that these are reforms that is weeding out corruption that in fact is getting rid of some communist era era people and procedures but the council of europe has has come back at poland without and saying you're acting like a soviet government so the language has gotten very ugly as we come down to this
