new rules companies will only be allowed to collect data relevant to their services so weather app for example won't be allowed to access your address book or photographs. the new regulations also afford individuals the right to launch a complaint with the supervisory authority in their own country instead of potentially having to challenge a foreign company abroad those violating data protection rules will face harsher fines instead of the maximum three hundred thousand euros in germany companies will face up to twenty million euros in penalties or four percent of annual turnover whichever is bigger for facebook that'd be one point three billion euros. the new regulation requires companies and website operators to pay closer attention to what they do with their users information and remaining legal anomalies are likely to be settled in the courts in the coming years. consumer watchdogs have

welcomed the new rules and say they give individuals more control over their personal information. time for our tech editor our until the collecting of private data is mostly going on behind the scenes we all know that. what will change now though because. i mean this collection of dollars going to continue will of click on a button. but then i guess again we want what's going well on the consumer side some things are going to change i mean most people actually just kind of click through the terms of services i mean i think for the i tunes tunes or service if you read actually try to read it out it'll take thirty six hours to read through the whole thing people have actually done that in the past just to see now for the consumer those terms of services are supposed to get a little bit easier easier to understand the information presented there is supposed to be presented in a clearer fashion so that is one change that is going to come into effect another change for the consumer is that they will actually be able to petition companies

and asked them to provide the data that they're collecting on it to them so that they can verify that they are holding in line with the current european data protection laws and also if they need be they'll be allowed to actually request that companies delete that information or give it to them so that they can move it on to different companies so at least for the consumer things will be changed and they will have tools that they can actually use to take it to the companies and say are you using my data the way you should be but who is overlooking this because there's no single body overseeing or enforcing these rules it's that patchwork of of twenty eight regional and national bodies doing that well that's exactly right and that's i'm sure that part of the criticism that people have levied against this new set of laws one example is that the germany's data protection minister basically said that he's going to lose a lot of power through this because right now in the previous laws he could actually go to facebook which is example that he used and say ok you're not using consumer data the way you should we would like to fine you or force you compel you

to be to bring your practices in line with what we require now he's not going to be able to do. that instead because facebook's european operations are based in ireland he will only be able to partition the irish government to then start a proper process some type of legal measures against facebook so at least within the context of individual countries they'll be giving up a little bit of their sovereignty which could be problematic in the long term because you're talking about the big corporations of the moment what about the small guys what about small business well that is really kind of an interesting point because right now this legislation was obviously written with companies like facebook like google like apple in mind but we've seen a lot of trepidation among small medium and enterprises i was talking to one photography here in berlin recently who gets paid to go out in the street and take photos in advance at parties and things like that and she said all of her business partners canceled her contract for the next six months because they aren't certain that they will be able to take those kind of photos given the new legislation i

also talked to a series of realty agents and even people as small as singer songwriters who said that the not even certain that they'll be able to keep up their e-mail mailing lists because they're not certain if they are conform with the new regulation and while some of that may be a little bit exaggerated it does kind of speak to the uncertainty that some of these new data protection laws set of kind of injected into the market and we're going to have to leave it there i guess a lot of lawyers telling me as well today that people are overreacting but it's better to play it safe exactly thank you very much for coming in. and i string business with you don't see you again very soon clearly don't move to a. problem. the move. the i'm
