a michael thanks for joining us we begin in hong kong with a legal setback for pro-democracy protesters the territory's high court has rejected a challenge to an emergency law banning demonstrators from wearing face masks the court refused to grant an injunction against the mass ban but said it would hear lawmakers petition against the measure later this month the ruling came as thousands of protesters braved the rain showing fresh defiance against the decree hong kong chief executive terry lamb imposed the measure on friday she said it was needed to prevent more violence. moments after the high court's decision pro-democracy lawmakers said the facemask ban could set a dangerous precedent. there are extremely important constitutional implications

coming out of this case because if the chief executive can use to emergency powers in this way there is nothing stopping her from using it to do other things such as prolonging the detention time and to contravene the fundamental human rights and freedom of the hong kong people you can suspend elections so i think the high court sees the importance of this case and that is why they have taken the rare move in allowing this case to go forward within the shortest period of time d.w. is mathias a boon and is monitoring developments in hong kong and joins us now with more mathias now that the court has rejected the challenge to the emergency law how are protesters likely to respond. well as you can see protesters are out and about today again and i have never seen so many people wearing face masks as today on demonstrations this is they are clearly not

accepting this law whether the court is now granting the injunction or not that the real case will be in court a little bit later when they will when the democratic lawmakers will challenge again the constitutionality of this law but for the protesters here it's very clear that they are not going to obey a ban on face masks and i do not think that this measure will calm down or this in this not granted injunction will calm down things here on the ground and you know in the early days of these protests hong kong's leader kerry lamb appeared to take a hands off approach to the demonstrators then she took a firmer stance and announced this emergency law which the court has now of course for now appelle what's next is force or protesters are concerned.
10:04 am
their main argument off those who challenge this law in court is that it opens the box of pandora we've heard it and that this emergency provisions that date from the 1920 s. and old colonial law have a lot of undemocratic measures that the government could apply so if the government would be allowed to you do too to put in place this facemask ban they could also put in place other regulations from this emergency law which include media censorship which include could fuse you so there's the argument. that the lawmakers are making here is that all of these measures are unconstitutional and this law predates the constant new jews should be obsolete by the company by the constitution since the constitution is many constitution called basic law has been and acted so mathias put all of this in perspective

a little bit so and so we have a suspended metro system that usually carries millions of people every day a government now at least for the time being empowered by the court and processors who seemed more resolved than ever do you get the sense that conditions are more volatile now that they've been in in weeks. well i think we are seeing a gradual deterioration we have seeing protesters more ready to use violence not only more determined to protest but to use violence that police dropping one limit after the other in their ex's exercise of violence and we see a government that has not been in control ever during this summer the government house as you have sand pulled back a little bit then house after i took on so with more police and none of this has worked so. we are seeing a gradual erosion off the way that hong kong used to be government.
