restrictions why in a nutshell. well i would say in this case it's the court doing its job within the democratic system acting as a check and balance in regard to other branches of government in this case the executive which is responsible for laws and rules so this is not the 1st time we have seen a german court overturning corona rules that it viewed as too restrictive and disproportionate for example the highest court in germany in april overruled a blanket ban on church services or a local court in the state of north rhine-westphalia in the summer sent back to regulators a lock down extension on the meat packing industry saying again it was too broad so what courts are essentially doing is weighing the purpose the goals of

a measure of legitimate goals against the costs of that measure and in this particular case in berlin the court pointed out that it is not proven that restaurants and bars are one of the major vectors of spreading corona and that in fact there's another rule in place in regard to restaurants and bars that would serve the same purpose as the one that was overturned here namely bars and restaurants here are not allowed to serve alcohol after 11 pm and the court at least in this case viewed that as sufficient to ensure that people wouldn't relax their inhibitions and get too close to each other if the restaurant stayed open a little longer. i wonder whether you see a tendency or at threat there runs through these rulings. i absolutely do and it would be the attempt to balance justified the public goals of trying to ensure public health and safety against the constitution's protections of

hall debate he stayed an extra 30 minutes or so to answer more voters questions but michael i will say that again we saw how these 2 men are very different wavelengths and as one observer here put it i think correctly had they been on the same stage we very likely would have experienced something similar to the 1st presidential clash which benefited nobody near the net neither the candidates nor the viewers should be i have to ask you i mean do these public appearances or or debates even matter in this election given the large number of early votes already cast and the relatively small number of undecided voters. michael it's hard to imagine that anybody was really swayed by what they saw and just remember visually you had this very odd spectacle if you can call it that of the split screen dueling town hall debate format and the reason for that this constant visual reminder was that president trump as you mentioned had contracted covert 19 and refused to take part in a virtual debate so we got another reminder of how contentious this election season has been and beyond that they didn't answer some questions that might be important
