10:30 pm
the onset figure out what's the real new deal, but just reimbursing the watch now. the in hong kong was once home to a sprawling media landscape journalist there seemed to be worlds away from the censorship. their peers faced across the border and mainland china. but that's all ended in 2020 with the national security law since then life and hong kong has changed and the free press as all but disappeared today marked a new low invasion crackdown on civil liberties in the territory. in a landmark case, to hong kong journalists of been found guilty of endangering national security and under mining authorities with their pro democracy news outlets. they are the 1st
10:31 pm
journalist to be convicted of sedition, says britain, handed hong kong back over to china in 1997 on nickel for alicia in berlin. and this is the day the nobody told us that you may get arrested for both your dates and you've been to fails. all right, and the thing, today's, the judge have the key to assess a piece or the best deal for teeth, one to prosecute people for reporting on the information that are not in the line with the whole cult. oh, forties, narrative to freedom of his nature is not the app. so to one thoughtful i'm sad. news ever be adding capital daily. overall,
10:32 pm
there's really no press freedom. almost all press freedom left and also on the day a month after venezuela's disputed presidential election, both sides have turned out their supporters to underscore their claim of victory. e leaders are also asking what's next for the country and the opposition a clearly, my doodle cannot be recon nice as a legitimate way, not of this very rancho election. we are very much awarded by the situation of the leaders of the opposition. welcome to the show. it's good to have you with us. tonight's another blow for hong kong is dwindling. civil liberties on thursday at court in the territory convicted, 2 journalists of sedition, the former editors, a stand news, a now defunct pro democracy news website, were found guilty of undermining beijing's authority. this marks the 1st such
10:33 pm
ruling against journalists since the 1997 hand over of the former british colony to mainland china. to employ a cooling, arriving at quote, the full, my editor in chief of stanton views in no doubts about the seriousness of this case . and the light can he budget? both he and another editor, patrick lum, arrested in december 2021. they were charged with conspiracy to publish and reproduce dishes publications which they both denied the on the same day. the offices of stance and use were rated by police with computers and other materials taken away as evidence. the media outlets that began in 2014 was forced to shut down a bit to run to a chinese language website. digit becomes so important during the pro democracy
10:34 pm
protests that began in 2019 pro chest that both china and the home como storage fees. so as a national security threat before. finally stumping them out. press freedom in hong kong has been under threat for some time. the popular newspaper apple daily has also been forced to close the goal, lead time to come through quickly, where it's for my own uh, the media tycoon. jimmy ly is already in jail and is still facing other challenges. now that these stand news editors have been found guilty of sedition, they too can expect prison sentences. the latest example, the beijing is cracked um, on free speech in hong kong. let's take
10:35 pm
a closer look with sony chung. he's a pro democracy activist from hong kong. he now lives in excel in the us. welcome back to the w, sony. now the 2 journalists were found guilty of endangering national security. is that what they did? as i said would be lot. uh because we, um we, what we have seen is that they try to, um, save, got the price uh, the freedom most price. and they just tried to ensure that everyone can have a platform to talk about democracy and try to criticize the casselman a by publishing commenter. res. actually, i also publish a multiple columbia to read, also to stand use and the one called use that as one of the sancho to say that by allowing my plumbing to read to be published is an act of submission. so this is totally unacceptable. awful. maybe it was we thought, where does press freedom stand in hong kong today, especially after this ruling i think this is a fairly dr. brick king who,
10:36 pm
because this is the 1st time after the 1997 handles, the, the hong kong department of justice, the pos appear to have use this british colonial role, which is cost efficient. right? um, to prosecute an arrest notice and now the whole consult has to make the verdict stats on the duty just because the publisher and editor you'd see a leading to publish articles that criticize the government. and i think that actually has so much about the actor to the home, caught them in a has like now a total weight off. i remember to quit the system and this is belong to a face space society. and like what we have seen in hong kong into plus, becky, where can hong congress turn to these days for independent information?
10:37 pm
um, 1st of all, uh luckily we still have um, a, a stomach stand off we, excess of people may shouldn't be as well. i'm like, meaning china, we don't have to wait, fly will a cyber 5 will, but still hold those. um they rely on the multiples weston result, the media sources you know, to, to seek, uh, authentic information. so meanwhile, i will also say that i'll be advocate for like on international media to, to set up the regional faculty in hong kong to ensure that people on the ground can have to have the ssl for information. and this kind of like authentic information can be disseminated to the people on the crown, and show that the public can to this information generated by the document cannot be tolerated on the ground of your. of course, for us to look at the situation from a far but what can you tell us about how, how come there's a whole has changed since the national security law. a lot of the
10:38 pm
lights are being impacted up to the mattress lation of the nation's pacific. you little so media freedom definitely is being repressed us to be due to the shut down of stanley use and apple bailey, which later on will be out there will be another product coming up regarding to me like an apple davy. right. and you, i mean, full thoughts, a lot more people like 80 lives, right. they can no longer talk freely on the street. they have to sell the sensor. so it just look just about the media themselves, but get the you can patch at the layman 80 like because um, you know, call in the previous e as in that case. um, we can really talk about a part of case we can't criticize the essential kasselman if we want. but now this won't be the case. this kind of my step census trip is quite permanent right now. so this is a fairly, of course, i me concerning situation and the fat of pain on the ground is the principle of one
10:39 pm
country to systems dead. i, i'm straight out. so that's the case right now because i mean, before the handle, the i mean before discussing and try to handle the home call back to mainland china and lots of things being published by the chinese sleep. i've been shopping back then like political freedom, freedom of press. many people would anticipate that hong kong could be main opponent most and could become a city that is still, i mean start with this and compared to the mean, i 60 you in china. so when hong call people could no longer enjoy this kind of political freedom and even like economic freedom, cultural freedom. and this kind of stuff happen. or we can do care that the one country to system is absolutely being on the mind in the you know, a placebo or way. so we can no longer say that one country to system is alive and,
10:40 pm
and will boss. how much whole do you have for the future of hong com or i think we still, we may helpful even though the situation is favorite start and we can see that it's very depressing right now because many political prisoners right now using hong kong and the lumber scrolling, but then i think people on the broad basis to find a way to, to decide and also at the same time they want to keep the momentum up and also to bhaskar overseas in many continents. they also try to, i'll continue to hold on story. i try to keep that online. i think this is fairly get punched in and in the meantime, we also see that the international community has spoken up united nation the united states. many you live in countries have white, fully recognized that all of that, i mean the chinese human right. got built in home home and you know the paces. so
10:41 pm
when more and more international and high. so i'll try to joint this are showing the cost of a full sizing for freedom. and i still with me also because i think the will is now witnessing what happened. you don't call. and i hope that there will be more question up to, to come to every 1st uh, also retiring and tight as hong kong pro democracy campaigners sunny tongue. thank you so much for your time. all the best to you. thank you. so what this will work tonight, freedom of speech is great. so telegram is a relatively free online platform but i also realized that some things need to be controlled in the the questions are swirling in the tech world following the announcement of a formal investigation to whether possible juror of the head of the popular messaging ab telegram failed to curb illegal activities on the platform,
10:42 pm
which has nearly a 1000000000 users. today, the european commission announced it was also looking into whether a telegram was in compliance with the use new digital services laws. direct who was detained in paris. this week is suspected by french authorities of complicity and allowing the list of transactions, images of child sexual abuse and drug trafficking on telegram. and the case has sparked a heated debate about the limits of digital freedom of speech. french lawyers say it's unprecedented for an individual to be held criminally liable for what users do on a tech platform. that telegram complies in every respect with european digital regulation disorders. and as moderator does the same standards as other social networks, you don't speak or go to as well. so show they thought that no, it's normally absurd to think that the head of a social network could be involved in criminal activity that don't concern him
10:43 pm
either directly or indirectly. ammonia do you like to have a girlfriend? is the director of cyber security at the electronic frontier foundation, which focuses on digital rights and she joins us now from san francisco. it's good to have you on the show 1st, so i'd like to get your reaction under of being charged as well. right now. the biggest problem is that there's a lot that we don't know about these charges against or off. we know that this has to do with the telegram that it has to do with the allegedly, a criminal things happening on telegram. but the problem is that there are sort of 2 classes of traffic that happened on telegrams. one part of telegram is sort of like an open social network that's, you know, sort of your channels and your group traps and you're on an encrypted one on one messages. and all of that is, is visible to telegram. but there is also a mode of telegram use where you can have one on one messages with secret tax
10:44 pm
enabled, which is i end to end encrypted what, you know, questionable encryption. i and supposedly telegram cannot see the contents of those communications. so for the stuff that telegram can see, expecting it to do have, you know, some sort of moderation of that content is not unreasonable. but if the government expects a telegram to moderate content to that, it can't see. or to stop making end to end encryption available because they cannot see that content. then that's a real attack on, on strong encryption and on privacy and security all over the world, that would be very concerned. mm hm. you say there's a lot, we don't know about these charges and let's look at europe as a person. is he a free speech warrior or an unfortunate sick business man, willing to profit from hiring the worst parts of the internet? i mean, i don't think those are the only 2 options. um i think that the telegram has
10:45 pm
a reputation as being sort of a, a free wheeling space because it is very light the model rated. uh some of that may be because they're off cares about greek speech. and some of that might be because they're off has about 30 employees instead of the, you know, sort of vast numbers of people with, with different levels of competence in different languages and understanding of culture and of laws that you would need in order to do an affective moderation of, of a platform with like a 1000000000 users. but they say that they're moderation is up to industry standards. would you say that's not correct, then i would say that there, i would be very curious to know what industry standards they're referring to. all right, all right, so how exactly did telegram turn into a haven for all sorts of criminal activity as well?
10:46 pm
uh, in 2 different ways. uh the 1st is that because telegram is very lightly moderated, people can get away with discussing what were engaging in criminal activities on telegram channels and telegrams, group chat. and often this leaves people with the impression that their communications are, are protected and that they're private and that they're secure. and really they're not just the platform isn't doing anything about it. i am the 2nd is the door off, has made a lot of a lot of statements casting aspersions on the actual here is sort of safe and private and the engine crypted chat apps that exists, such as such as the signal best leaving people with the impression that their, their communications are much more private and secure than they actually are. he has also about not to cooperate with law enforcement to think he didn't know whom
10:47 pm
he was inviting in. this is not the 1st time the draft has a has tangled with a government that has the right needs to, you know, take criminal action or even to, to ban telegram in the country. unless you cooperate it, he has gone up against the german government and the brazilian government. and in both times he's managed to sort of score him his way out of it, especially by promise of greater cooperation. so i think that leaving people with the impression that his uh service is not cooperating with the, with any government requests is probably very misleading. right. how much are other tech bosses panicking right now? it's all clear. oh, you know, we don't all have lunch. as we don't hang out, but the certainly this, this might be cause for concern for say you almost and ex, uh uh, i think there was a court in brazil that is currently
10:48 pm
a threatening to ban. i x in brazil unless i x appoints a local representative who is held responsible for content moderation and responses to law enforcement requests from the brazilian government girlfriend of the electronic frontier foundation. great speaking to thank you so much to venezuela malware. a month after the disputed election, both sides have taken to the streets of the capital, caracas, in front of a crowd of supporters. nicholas monroe claim victory again calling his opponents cowards. the monroe is also called an opposition leaders to be arrested, forcing them into hiding well, hundreds of dissenters have accordingly already been detained. but the opposition leader, money equity. now my child did emerge to hold her own account or protest encouraging
10:49 pm
supporters to continue fighting when she called the stolen election. the us in the european union and several latin american countries say the results are fraudulent and that opposition leader and window gonzales is the real winner. you know, we use authors like i've been following all of this in caracas, independence island capital oscar. one months after the election, what's the situation in the country as well? it has been a very about 4 months here. and then as well as starting with the results given by the electro council. and the protests that ensued that is triggered by the government to alicia series of arrests and persecution. like my mother, we have seen in the past. many young people are behind bars, the families unable to see or speak with them. and in the midst of those people are still responding to many of the child to take to the students peacefully to protest what the place is, the century. the opposition has bound to king fighting. how are they keeping up the
10:50 pm
pressure as well? the fact that the opposition leaders are still and let us wait another, please have him left. despite the brutal persecution is a testament to the pressure and conviction, they have. the democratic international community has also stepped up to defend the opposition. and that translates into pressure where the opposition 6 now are support you pressure the regions and sitting down and negotiate. but above all, to recognize that the most obvious we will get one the elections despite all the obstacles put forth by the regions. and they have the towns and then the one side of it has been summoned to testify by the country, general prosecutor. what's that all about? well, this is the 3rd citation that the receipts after this and the rest could be issued against him. but the child. busy said today that his,
10:51 pm
his home could be seized in the, in the account in the next hours. so there's an ongoing persecution of the opposition. people that are surrounded by the we've seen it also with the rest of this past week with her close. um uh, allies, uh and uh, we saw yesterday after her house as one of her closest hours was also between. and it is in custody or the last numbers reaching. the inter american commission on human rights is accusing the venezuelan receive of a sewing to her as a tool to silence it. citizens, you mentioned the arrest one more. can you tell us about the uptake and human rights violations in the aftermath of the election? as well as the letters of the surgeon, is, is charging them with terrorism, treason, and other crimes. many of them are young people and at least a 100 detain. these are minors, the government clients,
10:52 pm
they were trained in sheila and the less to commit violent cause. but we're seeing that many of these people were arrested as their homes after a period on social media video supporting the opposition. there are also at least 10 journalist arrested as well. also many more have been targeted for the actual witnesses. the day of the elections and others are just active, political and political parties that support the opposition. now human rights items here has claimed that this has been the most massive tools of arbitrary unless it's been a long history. and now before, before, there are, there were ongoing international investigations on crimes against humanity and as well. and what we're seeing now is that the files just keeps on growing it. this is being watched with concern not only inside the country, but of course also by the international community. and there has been pressure on the resume that you just today said it would not recognize maderos legitimacy. does
10:53 pm
that affect him at all? so well, this depends on which country says what thing for rhetoric is always useful. having international enemies to blame for the drug government shortcomings. but being isolated in the regions is also uncomfortable for nicholas level. and we seeing that that's when colombia and brazil are crucial in their positions because most people have to big hours that are now given him the cold shoulder in the midst of increasing reynolds. while in migration, due to the lack of sweet odds and opportunities expected from 6 more years of my growing office. this week, monroe re shuffled his cabinet. what kind of term does that for shadow, the new composition of his cabinet. what we saw the same faces in different positions, but one of the most important ones is, deals dog have a job as the minister of and of peace and justice because he's one
10:54 pm
of the most radical of pieces in the chessboard of personalities and this region. so we might see an increase and repression and persecution against the opposition leaders. and we may see freedoms being of not having a guarantees for them. they might even as little as about to leave the country from under a one another term. and i want to know from you briefly has the exit is started yet and how we're neighboring countries bracing? yes we are. we are registering an increase in migration and some mayers and governors in borderline columbia haven't asked or the government to increase a problem policies to receive this uh, increase and expected more drugs are coming into the country specially columbia, which is the one that receives most that has one set this for
