lou: leave it to justice anthony scalia. very few people do that. chris was entertaining, as were we all. for example, said the justice, if you carried around a really horrible weapon, just to scare people like a head after something, that was, i believe, a misdemeanor. >> the interesting thing is that this notion -- there is a law in north carolina that is similar to that. saying that you can cause terror by carrying a handgun in the open. but the concept is in that state, there is an open carry law. so you can go to jail for doing something that is legal. that is the problem with gun control in this country.

>> can you go to jail in north carolina or is it a tort and civil law? >> i will look most respectfully at this. it is not a personal injury claim. it would actually be something that we could be arrested with, you know. lou: i can imagine there thousands upon thousands of personal injury attorneys salivating. >> i think what the justice was saying is that there can be restrictions in terms of guns in this country. there are certain things that have not come before the court that these organizations are trying to bring before the court. that has been the weapon against firearms. i represented the portion of the gun industry by claims of wrongful death and class-action claims. lou: it was very successful. in fact, creating a firewall

around industry that a lot of people thought would never be possible. >> the law is wrong. lou: is the justice wrong here in suggesting -- the clear intimation by justice scalia is that there is the second amendment and it is simply creates an intensive legal minds, limitations on those rides at the state-level. >> i think he has made it clear that he believes the due process clause of the 14th amendment to incorporate the second amendment. i think what he is also saying is that he is a true constitutionalist. but it should be based on the standards at the time of the founders and of the drafters of the constitution. that is the standard by which it will be judged. lou: he raised strict interpretation, if you will, textualists, originalist. and if we can get more nuanced or more focused -- i'm not sure

lou: let's talk about the choctaw. i am in trouble with my wife before we even begin with the choctaw. we are going to talk about two very different governors. first we have maryland. governed by a liberal democrat, martin o'malley, and virginia, governed by bob mcdonald. this is a metaphor for what is going on in the national choice

that will be made in november. both of these have been rising stars within their parties and serve as chairman of their party's national governors association. pretty impressive. maryland and virginia are also two states surrounding washington dc into which taxpayer dollars/all the time in huge amounts and with great regularity. let's take a look at what is happening to the states, the economies in the political environment. since taking office in 2007, governor o'malley has enacted 19 tax hikes. just trying to help the two parties understand where they are with the economy and politics. nineteen major tax hikes, a millionaire's tax, sales tax from a vehicle tax, a tobacco

and alcohol sales tax. maryland and governor o'malley. they are behind it. as a result, the tax group, antitax group called change maryland, is comprised of 30,000 former wealthy residents of maryland. they fled the state and its high taxes. they are out of there. that is estimated to have cost maryland more than $1.5 billion. $1.5 billion. that is part of a larger trend. maryland has 100,000 residents. 100,000 residents in the past decade. let's contrast that with

virginia. virginia has lower corporate tax rates than maryland. virginia actually gaining more than 100,000 residents. 107,000 residents over the past decade. meanwhile, virginia just posted its third straight but coetzer plus. -- third surplus. virgin is 5.7% unemployment rate is the lowest in the entire region. much lower than maryland. which, by the way, is much better than the country. it has seen unemployment rise from 6.5% -- 6.5% at the beginning of the year, and that has now risen to nearly 7%.

6.9%. in the course of six months, you are talking about basically four tenths of a percentage point. 7%, basically. despite all those taxes, maryland is carrying a deficit of about a half billion dollars. a deficit, despite all of this, of a half billion dollars. are you kidding? there are more differences, of course. unlike maryland, virginia is a right to work state. meaning that employees have a right to keep a job without joining any union. it is no wonder that the ceo magazine named virginia as the seventh best state in the union in which to do business.

while maryland, we are getting a lot of numbers under maryland. i assume the governor is used to that. maryland is 40th to do business in. it makes you wonder what the last 10 are. a separate study by the american legislative exchange council ranked virginia third in the nation for economic prospects. they were rated third. compared to maryland's 21st. the politics of it all, the virginia governor is talked about as a vice presidential contender. maryland's governor dropping hints about a potential run for rd. yes, he does have a record. we will take that up in the "chalk talk." what was he thinking? congressman todd akin, a fundamental misunderstanding ofn on life support. inside the mind of a defined
