the markets this monday morning shrunk. it is dismissed as october surprise one of the. the final debate is tonight. if romney keeps the momentum he is the next president. we have not forgotten the markets. a very small bounce for stocks, gold and oil just ahead. futures, expected to open relatively flat. i say this most mornings. the real movement is later in the day but this morning it is true. a relatively flat opening. as for oil and gold, they were down sharply last week especially gold, a very small amounts at best for the price of gold this morning and also for the price of oil. that is setting the scene as the opening bell finishes and we start trading and the opening trend for the dow is dead flat. we are down four points, but 13-3 is where the dow industrials are right now. get to caterpillar fast. we said that they uped their profit but a weakening outlook elsewhere. what is the stock? nicole: the stock is up 1.5%. this is a global indicator. when they see an outlook that is deeper than expected sales won't be as strong as expected, that is not only on caterpillar's

stock but also the minds of investors. it means -- stuart: mcdonald's is another indicator of the world economy. we are down big on friday. where are we today? nicole: we are trying to get a little bit to the upside, fractionally higher. this is some of the analysts cutting their numbers on mcdonnell's but they too saw the worst sales growth they had seen in nine years and tough economy, stronger dollars, competition. stuart: we were expecting a modest stock, look at the big board now, we're down 22 points. we did not get that modest bounce. back to you shortly. iran agreeing to face to face negotiations of its nuclear program. you might see the president make a big deal about that in the foreign policy debate. iran does say any discussions would have to take place after the election.

not exactly clear. the administration says fox will take place, might be a good idea. no market reaction to that at all. oil did not move on that story. it is at $90 per barrel. gas prices which have nothing to do with iran continues to go down another $0.02 over the weekend. the national average coming in at $3.66 and diesel at $4.11. tonight's debate the final debate before the election and will focus on foreign policy. the big issue will be the attack in libya and the administration's handling of it. here's what president obama said september 12th. >> nowak of terror will shake the resolve of this great nation, alter that character or eclipse the light of the values we stand for. stuart: no acts of terror. that comment came up at the previous debate between the president and mitt romney. >> you said in the rose garden the day after the attack it was

[talking over each other] >> he did call it an act of terror. it did as well take the 2 weeks or so for the whole idea of there being a riot to come out. stuart: he did not refer to an act of terror. he referred generally to acts of terror. joining us is senator john borerosso. did the president is lead? and if you consider that he did mislead, how vigorously should mitt romney mount the attack today?

>> the president did mislead but the president failed even if you look at the run up to the murder, the assassination of these brave americans, the signals were all there, the alarm bells were going, the british pull out of ben gauzy and there had been attacks on our structures. the president should have seen this coming. then you have what happens in the next couple weeks. stuart: does governor romney lose the debate if he attacks the president on this foreign policy issue too vigorously? >> i think the governor will make a spirited defense of his gold in terms of foreign policy and the biggest threat to our national security right now according to the chairman of the joint chiefs of staff is our debt and this president has filed $5 trillion of additional debt on the american people which to me weakens our nation and that is the case to be made

tonight by governor romney. stuart: you think governor romney will say that? can't have a strong presence in the world if you are broke? will make that point? >> i would expect that he would and i expect it will resonate with people, ronald reagan used to say peace through strength and strength involved that -- economic strength. if you are bar wing $0.40 of every dollar you spend from china how view stay strong and independent nation? you can't do it. we need to focus on getting the economy going and the poll you showed which essentially shows a tied race on jobs, the economy and the debt, governor romney is doing well and the president is doing poorly. stuart: what to do you make of the headline in the saturday new york times saying that iran and america had agreed to face-to-face talks after the election on iran? what do you make of that? i read that as an october surprise. i don't think it has worked.

would come up tonight? >> i think it didn't work and the white house has denied it which shows a white house with additional ongoing leaks that had to be leaked out of the % white house. the president wanted to negotiate with iran and said that four years ago when he was running. four years later he said he was going to have a better relationship across the entire middle east as a result of the force of his own personality and his charisma and what we see as a worse situation. iran has four times as much enriched nuclear material now as they did four years ago through the senate, we have forced on to the president's sanctions to be used against iran. he has used them but has given a number of waivers so you have money from china going into iran. i want to make sure iran gets no nuclear-weapons. stuart: always, pleasure. thanks for joining us.

for you. daily presidential tracking poll shows mitt romney 49, president obama 47. no change from yesterday. let's bring in scott rasmussen. this would seem to imply that mitt romney no longer has that surging momentum. would you agree with that? >> yes. numbers today are exactly the same as they were the day of the second presidential debate. the first debate took place governor romney gained some ground, gained four points. second debate to place. president obama had a better night and stopped the bleeding but did not turn the race around and tonight could be a very significant impact. stuart: how about florida? what do numbers show there? >> florida we show governor romney up by 5 points. it is one of three states that moved to romney.

stuart: pennsylvania? a big headline today, not sure which paper it is in. pennsylvania is now in play. what are your numbers? >> latest numbers show the president still up 51% to 46%. romney gaining ground. he was down by a dozen points. still it is a tough state for the republicans would always looks good. never quite pull it off. if mitt romney wins pennsylvania probably means we will have a significant electoral college landslide. stuart: if mitt romney were to win pennsylvania. that is and a love for college landslide. ohio. what is the latest number? >> ohio the closest and biggest of all states, we show president obama up just one point. this race has been close in the buckeye state. if mitt romney were to win florida, virginia, where he is up 3 and ohio is almost certainly he would move into the white house.

if barack obama can hang on to ohio there are other have still a romney victory but they're more challenging. stuart: ohio is still dead center the most important stage as we speak. >> absolutely. stuart: i said earlier if mitt romney can maintain the momentum he has a achieved over the past couple weeks that he would be the next president of the united states. that is if he maintains the upward momentum. do you agree with that? >> yes. he is up by two points in the national popular vote numbers. of that shift another point you can feel comfortable you will win enough swing states and the left for college when we look at it we are projecting president obama with 237 lot durrell votes, mitt romney with 235 and handful of states with 66 electoral votes left that will decide the presidency. stuart: that is close. scott rasmussen. i don't know when you sleep and i presume you do on occasion.

macdonald and nicole petallides are here. let's talk caterpillar. week global output. nicole: it was dragging on the dow. it moved into positive territory. we cannot lose sight of what caterpillar is really saying. they are lowering their numbers for 2012. they are cutting their outlook for the long term forecasts. this is the second time that we have done this. about a month or two ago, we said the same thing. stuart: profits were up 20%. they did see revenue on the rise. nicole: they will not see the growth that they had expected. stuart: thanks a lot. the dow is dead flat. i mean dead flat.

every american who works will probably see a tax increase january 1. that is 163 million of us. a tax cut expiring. a worker making $50,000 a year will have to pay an extra $1000 roughly throughout the year. neither party seems interested in extending this tax cut. >> prior to the tax cut being enacted, everyone thought this is a great idea for more money. did it really helped? it is also being overshadowed by the fiscal cliff and the bush tax rate expiring. >> politicians also feel like they will not get any credit for it if they extend it. the question is whether or not it was actually working. stuart: if you don't get the credit, you don't do it.

economic power, we build up our economy first, which romney is good at, and when we have a strong economy pushed through. stuart: one of our previous guests was saying that governor romney will bring up the economy as the best way to have a strong board policy. you were nodding your head. >> absolutely. if you have a strong economy, you have collateral damage. make that case. we know he already made that fail. stuart: how does the president handle what many people think was his misleading of the american public over the benghazi attack? blaming it on a video for a couple weeks and not acknowledging a terror attack. >> he will blame everybody in sight. it was their job to provide the security.

romney's comeback should not be to focus on timelines and eight and words. what romney should say is, okay, you had a real-time video. why did you not send in anybody to rescue them? that is a sharp edge to take. we have the video now that has been leaked. >> k.t., the president could set you are trying to -- you and your administration politicized the killing of osama bin laden. >> absolutely. all americans think killing in london was a good idea. romney should not take that. they should not have to back them into the corner because he had an inappropriate comment early on about libya. the american people want to know what the heck happened. they sell for americans killed at an american embassy. they have not yet had an explanation. stuart: does america care?

that is a terrible way to phrase a question. what do they care more about? >> what do americans care about is they want a president who can fix the economy. there is a foreign policy part. a president who can keep them safe and keep them out of war. at that point, they can go and live their own lives. give a bye to all the criticism that he will not keep us safe. stuart: governor romney comes out and take if elected president i will never bow to a foreign dictator as this president did to the king of saudia arabia. >> that would be a great place to start. you do not think this will be a dull and boring debate? stuart: no. but some other people may be watching baseball.

teammates say that he did in fact orchestrate a sophisticated campaign to evade detection and did all these performance enhancing techniques, let's say it is true. you would have to have someone who has such a high level of personality disorder, a narcissistic band if that is true that he literally is not moved by the criticism of others. not the way that you or i might be. always thinking how do i went against these odds. what kind of armor do i need in order to battle. what is the next thing i need to do in order to optimize this for me having no concern for other people. that gives a man terrible freedom to do some very unusual things. stuart: could it have nothing to do with this psychological profile and everything to do with lowliest?

stuart: i want to look at this on the market now, apple shares, contrary to a lot of tech stocks this morning, they are going much higher. what's going on nicole? nicole: we are seeing apple doing well ahead of the ipad mini. that's something we're continuing to follow. as i talked to one of the traders here on wall street, mark newton, he actually was talking about the trend for apple and maybe you see a jump here. but he thinks it is going to 575 in the next couple of weeks. the trend remains to the down side. that the stock is not oversold yet and actually has more

momentum to the down side than to the upside. here's a look at it right now at 621, but he's saying it can continue to sell off because tech overall has been selling off. bucking the trend today. stuart: microsoft really took a drop today, threatening to drop below $28 a share as we speak, but we won't get into that, now will we? nicole: i guess not for the moment. we know that you own that and you could have bought apple and didn't and bought microsoft and you still have high hopes. long-term deals? joining us now is the sports agent himself, eugene lee. >> hi stuart. stuart: do you think this really will upset the whole idea of long-term contracts? >> i don't think so. i think you will see with elite level athletes, players like kobe bryant, tom brady, michael jordan, they are driven by championships. that's what was so disheartening about the whole a-rod -- stuart: yankees could actually owe him some bonuses if he hits certain milestones. that was a terrible business deal. you don't think that will inhibit others from making 3 similar long-term deals? >> i think you will see teems be wary -- teams be wary about signing players on the north side of 30 realize as they progress in their careers as they get older the productivity is going to decline. but at the same time when you have teams that are large market teams that can afford to pay the luxury tax, they will play to their strengths. they will try to outspend, sign elite level talent, beat the the

small market teams. stuart: so it is worth it to the yankees. i believe this was a steinbrenner deal from way back. >> it was. in 2011 they paid almost 14 million dollars. stuart: it's worth it for a team, a marquee team to get marquee name star players? it's worth it, no matter what they have to pay, even if they don't perform, you're saying it's still worth it? >> i think winning -- it comes down to winning. teams want to sign -- stuart: rodriguez didn't win. >> i know, that was so disheartening the fact he was indifferent. sandra: you may have vested interest in these guys making a lot of money. i'm going to challenge you and say maybe the general public should be excited this happened because arguably these big bucks have changed the game of baseball and other professional sports. maybe this is a sign that teams will look for heart and not just go after the big buck players. >> i think you will see a correlation, the way it's always been, elite level talent demands elite level dollars.

with an a-rod, that was the part that was so disheartening for everybody involved. usually players of his caliber, are dedicated, they are only focused on one thing, and that's winning championships. and for him to send the baseball up in the stands during the middle of the game where he was benched for poor performance, it is unheard of. liz: now he's saying he wants to make things right. he says he wants to come back and make things right. he does not want to be traded. even the general manager of the yankees is saying wait a second, he's never going to be mvp caliber ever again. what do you make of that? >> i agree. my prediction in this off season even with the no trade clause and even with the 114, 118 million left on his contract, i think you are going to see a-rod wearing a different uniform next year. stuart: what is that about sending a baseball up into the stands, what's that? >> apparently, allegedly using the legal term, during the middle of the game in he was benched he had a bat boy take a ball up to a woman in the stands to get her phone number. sandra: during the play-off game. stuart: what do you make of that ladies? liz: i would be so turned off by

a baseball with a phone number on it. sandra: if i were a true yankees fan and i was sitting right behind home plate where these gals were, i'd probably take that baseball and throw it back at him and say get your head in the game. liz: -- right between the eyes. stuart: it is an interesting prospect isn't it you pay these players an arm and a leg, and it's really changed the nature of baseball. i think it really has. sandra: absolutely. stuart: the high paid are not performing, are they? >> i don't think you're seeing it across the board. i think, you know, you have the pujols who didn't have a good year this year and you have a-rod. you are going to have teams that predicate their success on players that perform. they will believe that these guys will be interested in one thing alone, that's winning a championship. stuart: you are a sports agent you want these mega salaries because you get your percentage, don't you? >> not necessarily. sandra: look what has happened to the yankees fans. they don't show up on their own

democracy in order to buy more time. at the beginning talk about committee, then about inspectors now about direct talks but at the same time they are continuing to build a nuclear reactor. it is very similar to what happened in north korea. they spoke with everybody, but were busy building the bomb. we need to be clear with them and tell them enough is enough. we will not allow you to acquire nuclear capabilities, either the u.s. or israel will stop you from doing so. stuart: tonight in the foreign policy debate, president obama is very likely to say look sanctions are working. iran's economy is near to collapse. we should pursue diplomacy, not warfare. my opponent, governor romney, will take us to war. he will likely say something like that. and what do you say? >> i think that we have to look at the four years of president obama and ask him what are the results? what happened in iran in the last four years?

they've acquired nuclear capability, much more than before. they are ignoring the u.n. the obama administration is sponsoring the u.n. heavily, and i think it is about time that the u.s. would take a role. i don't mean that you would engage in another war but to take a role and tell iran enough is enough we will not allow it to happen. today ahmadinejad is laughing at the u.s. and laughing at israel and continuing to build the bombs. i think somebody will have to show some leadership. it will come either from washington or from here from jerusalem. stuart: when you say somebody will have to show leadership, do you mean military leadership? >> i mean that we will have to do whatever is necessary to stop iran. iran is not only a threat to us in israel, threat to the american people. listen to ahmadinejad, he said it very clearly, first i will go after the saturday people, but then i go after the sunday

people, people in the u.s. you cannot ignore iran. the capability is a threat to the region and to the u.s. as well. >> would you say that president obama is the favored candidate in israel? or do israeli people, not that they vote in american elections, but would they favor romney instead? >> well, i have one candidate that i endorse. that's prime minister benjamin netanyahu. we also have elections here in israel. but very specifically that president obama made a lot of mistakes in the middle east. when he came in june 09 to cairo and try to appease the muslim world, he made a mistake. when he put pressure on israel, he made a mistake. he made a lot of mistakes regarding his middle east policy. and i think today we see the results. we see what's happening in the middle east what's happening in libya, in egypt, in syria. you cannot appease the radical muslims. stuart: danny danon we always appreciate you being with us.

thanks for joining us. thank you very much sir. >> thank you very much, my pleasure. stuart: one last check with nicole. i see peabody energy is up and quite sharply so. do we have a reason for it? nicole: we sure do. they came out with numbers and earnings, basically outlook and revenue. the revenue is key here. topped more than what analysts had expected, seeing that rise there. you know, a lot of folks obviously have moved switching from -- over to natural gas as prices have been lower, but we talk about the environment going forward, and we are hearing that they are -- it remains a challenge, but they see markets stabilizing and gas to coal switching happening, europeans, that's good news for them actually. european coal fuel generation. and last but not least increase china infrastructure spending as well. all of that will help this type of company. stuart: i just wonder if peabody is politicized. is it in part because governor romney is coming on strong and would favor all forms of energy production in a romney administration? nicole: you bring up a great

gold. >> buy stocks, by housing, so gold. stuart: why would you so gold? >> our currency would improve. there would be less of a need to own an alternative to the dollar. >> i agree. gold is basically -- who else will sell it to you at what price? it is not thorough dividends. >> if romney gets in, you want to own medals that are more tied to the economy. copper. stuart: let's turn it all around again. let's suppose obama gets a second term. >> nervous about certain stocks. certainly dividend stocks will get crushed as the fiscal cliff occurs. you have to watch out for that.
