alongside my partner in crime, melissa francis on "markets now" at 1 p.m., and i'm joining imus next week as . charles: the economy only added 8000 jobs last month. not so bad, but this month is worse. welcome, i am charles payne in for neil capito. nearly 12 million people unemployed. an immigration plan would flood the job markets with a million people a year, and critics are saying that it we will all be looking for a bigger jobs must then we are to have.

a lot of people are saying, can we get our own house in order before we open the floodgates, melissa? >> the only type of jobs that are available are for highly skilled workers. so yes, it doesn't make sense to bring in a lot of people. charles: it is interesting that melissa mentioned that because i think of all the people coming and come in come at least from what i have seen so far, science and engineering and math jobs. >> that as i come all these applications for high skilled employees, the economy does need those folks. i would caution you are either

going to have members of congress were staffers who will leak stuff, sometimes it is an ax to grind order something else. i just think it is important. house republicans have said whatever happens in the senate, we are going to do a regular order in the house, which means subcommittee hearings open to the public, the full committee hearing, open to the public before any vote potentially could ever occur in the house. that is why i am not -- it is not something to get to breathless about. charles: i hear what you are thing. we kind of understand that this is sort of along the administration's agenda, something they would like to see. again, i just don't think the country -- that it speaks well to handle that kind of influx. what do you think? >> i think that we have to take it slow with immigration reform.

i was with immigration reform long before it was fashionable. we have to strike the right balance because the idea is to increase productivity through grow the economy we have higher unemployment, and less compensation. charles: we actually have had fewer people. in part because of the economic situation. >> it is discouraging. these are people rather than trying to stop, we should be taxing them. we should have them contribute to what it is they are taking out of the economy, anyway you slice it, we need more skilled workers in this country and we need to train our own unemployed people to learn to be skilled workers in the field of jobs that we have open. charles: that is interesting.

where do we put our efforts? can we say, yes, we want to slow down immigration so we can focus on people that are part of this permanent underclass. we know how many people who have been unemployed for these weeks and it is a crisis. >> we talk about this personal responsibility all the time. i'm going to look at my 2 cents and say there are jobs out there in science and technology and engineering and mathematics. if you're interested in these things and they look like they are, you should go out and get trained in them. if you're someone who is unemployed coming up look at the jobs that are open and how you can retrain yourself to fill those voids. we all know waiting for the government to do something is going to leave you starting in the long run. charles: tim, we do see the trends. let's just say and throw another option out there, 750,000, a

huge influx. particularly if the country is going through this transition. we have a health care law and it's going to be a doozy. we know what her people and it will be very expensive to implement and very complicated. at some point, do you think the political will of washington will put the brakes on immigration and slowdown of the? >> i have a lot of confidence in marco rubio. i am confident that it will be a thorough review and we are going to have a good, long, thorough debate on this. the biggest threat to american workers is the fact that no jobs are being created under the current economic circumstances. >> that is right. >> we are not getting any of the spending under control. obamacare provisions are going to be an additional drain. we have the epa and so many other apparatus, they are chasing away innovation and job creation. >> you're absolutely right.

that is what everyone should be focused on right now. how do we grow the economy, how do we get people back to work. that should be the number one issue. you feel like you're just throwing up hands like we can't do it. charles: one of the big things out there is certainty in making sure that small businesses create that. essentially, productivity is the only way we are going to get out of this mess with the economy. >> immigration issues seem to rub a lot of folks the wrong way. in other words, we have already talked about how important these jobs are, and sadly we do not have enough americans to fill them. you know, can we allow this and will the gop be okay?

or will they be against our? >> if we can find the right balance, the pathway to citizenship, you will see the gop lead the way. my biggest concern is president obama trying to force this down their throat to try to guilt him into a bad bill that is really going to create more government tendencies. what the gop is looking for is higher wages, lower unemployment and people getting married. strong families create strong economies is the one we are all looking for that. >> 88,000, that is nothing, you look at those who dropped out of the workforce in march and throughout their hands and said forget it, i'm not going to find a job. there are people out there and it's that people are discouraged and walking out to be one the

charles: does it pay to get paid? the president is leaving his budget next week. he is still not going after the nearly 50% of americans who don't pay any federal income tax and the irs is targeting the top

earnings as well. people making a million dollars are 12 times more likely to get audited. liz macdonald says this is only going to get worse. and we have an analyst here as well. >> here is the deal. top officials testified before congress and said that even with health reforms, new taxes coming in, the irs cannot handle it either. and the new taxes are really complicating what is going on behind the irs. and yes, we know that the high income people have always been audited more than the general population. but the concern is that we could wrongfully trigger audits for those targeting ads. so that is not a good thing for the upper bracket. charles: 12 times more likely doesn't seem fair. >> there is nothing fair about it. what is the irs going to audit you for?

you make a small business income, not for the money is and the deductions are. the irs is targeting that and they want the big revenue. charles: okay, we get it, i guess we get it, but where is this taking us? >> i'm not sure. i'm not sure that it's taking us anywhere. i was thinking about this program. like what tax level would you be happy with? well, i assume the answer is 0%, but is it 5%? is a 20%? my viewpoint on this is that people who complain about the high taxes don't really have any numbers in mine that would satisfy them. >> i have always thought that, you know, i always thought the opposite way. 90%, 80% -- i can tell you this much, over half of that money seems like a lot to me.

>> yes, it is. charles: it feels egregious. >> yes, we need to talk about what level is appropriate. the irs is looking like the museum of mass confusion in the tax code makes more liars out of people than golf. something that inspires more fiction writing in the new york review of books. that is what the tax system is doing right now. it is not fine. i have covered the irs for years and i have testified before congress about irs reform. and i would say that both sides say they agree. until we get a tax code that is in place and doesn't wrongfully ensnare them, this whole government spending and the fight about taxes, i don't like what the american people are now

exposed to. >> when i say that is fine, what i mean to say by that is that it's fine that we should criticize a garbled tax code, and i agree with you and everybody agrees with you that if we have a garbled tax code, we should make it a better tax code. that would not change the fact that for a century or so, maybe i've got my history off, we have a progressive tax rate in this country and we intend to keep having one. >> let me stop you on that. we get it, it's an aggressive tax code. what is striking about this conversation is going to a flat tax were we are stuck with progressive taxes. >> i haven't heard anyone saying that they don't agree that the tax should be progressive. but even within a progressive parameter, there is still this notion. and the problem is that once you

it is only six pages. so we know if you tax something law, you discourage it. if you make it eight couple pages short, you encourage it. >> i can tell you that every small business owner is doing well. the great recession kill the competition and their survivors are stronger today, but they are reluctant to hire. they don't understand and they don't know what to do. they will work 12 hours a day,. but they will not hire additional help. >> i don't agree with some of us, some people have never had health insurance before now they need that. i'm not going to go there.

charles: it just seems like -- like it could probably be shorter. saying they could make this thing a lot shorter. if there is some alter your reason, do you think? >> we could all do ourrjobs better, including government bureaucrats. liz says that she doesn't want to go there, but charles, let's just put it on the table. yes, we want to encourage immigrants and we want to encourage a nation of immigrants. that is right based on the evidence you have given us. now, we should do better on this. but why you would compare the two, immigration on one hand and help address on the other hand, i'm not quite sure. unless you are suggesting that immigration is a bad thing and we should make it more difficult

for people to get their green card. >> in both cases if you can make this natural, you can probably shorten up the health care law as well. it is a little bit more convoluted so you can help people out. but i just worry that they make certain made certain things more complicated and we have people saying that when we pay our taxes, we have heard this from a lot of people. >> yes, there is a smothering pillow of hyper regulation. submarines, saying that we didn't get that one, so here's another one, fix it. charles: i think immigration is good. we are in a position where he probably should try to clean up the house little bit better before we invite more people inside. we have to leave it there, guys, i'm sorry.

here. mercedes says the university is right. okay, mercedes? >> hello, charles. charles: that has captivated the nation's attention. you think the university is right in this case? >> it all depends on the timing. the evidence shows that murdoch did not conduct himself in the right way. after he had these issues with rice, he went to the athletic director and said, wait a minute, has anybody noticed what he has been doing with these players? the university has done nothing wrong, there is no retaliation, he was terminated because he had issues with rice. so far that we know, he said i

would like to go see my son's basketball camp and he said no, you can't go and murdoch went when he came back, that's when he was terminated. so as long as the facts are such, there is no issue with the university. by the way, there might be a lot of credibility to the timeline that i suggested. and that is because if murdoch claims that all of these abuses are taking place, why did he not come in 2010 when he started with rutgers? he should have started then. but he didn't come forward until he was terminated. that's a problem for him is beyond yes, certainly. will it feels a little disingenuous come in the timing of it. >> there is evidence that suggest he did tell the university, he did have a problem with it. he did talk to pernetti and he was ignored.

he looked at it and these jobs that he had, these jobs are difficult to get. it is a very small community. i'm sure he was trying to protect the students and look out for his own best interest because he can't just go get another job. they are very prized jobs. he followed protocol and then they said we are not renewing your contract. there was never any issues about him not doing what you're supposed to do. he blew the whistle, and now he is out of a job. charles: okay, you mentioned he is looking out for his own interest, as well as the players. which one came first? where do you think that somewhere along the line the players came for his own job security? >> i think they came before. because he did go to the university they didn't look at it right away, then he is let go and the video is made viral. that is not right.

there are others who have resigned and there is nothing that suggests that he was egregious in this. he may not have blew the whistle as loudly as he should have in the beginning, but he recognized was wrong and he tried to address that. then he realized that they are saying, shut up and get out and he is saying, are you kidding me, i'm trying to protect the students and my job is important to you. charles: mercedes, do you buy that? >> no, i do not. it sounds so much like what was done with sandusky. when you go below before a jury, the jury is going to take him would be looking for? and it took you two years to open your mouth and these kids are being abused the way that you claim that they were? we won't buy it. bottom the bottom line is money in this case beyond obviously, to your point, a lot of digging,

the board has had its attention attracted by people in financial communities. my guess is we will get it probably no later than the second quarter announcement. charles: i guess it is interesting that larry would say that because a lot of people on wall street, the company needs to ask what $140 billion as a red flag. >> well, maybe it is just one of the things that happens when you were too successful the company. i would argue that they have not gone anywhere. this is a stock ran up to $700 per share now is down to 400 everyone is freaking out. major have never run up to 700 in the first place. frankly, any new telephone that comes out will only be incrementally better than last. the new blackberry, a cool fall. guess what, it's not selling all that well. when you compare an apple iphone to another phone, it is kind of like comparing a motorcycle to a harley-davidson. they're all motorcycles and all were pretty much the same, but

just sort of unique about wrestling, wwe, than the rest of the sports? not dissing the rest of the sports. >> i don't even have to do that. i can put wwe in a class by itself because it takes the very best of sports, the excitement of a buzzer beater at the final four, walked off home run, hail mary in the fourth quarter of the super bowl. we take that element of sports and makes it with the drama of your favorite tv show, the pomp and circumstance of an enormous rock concert and put it together that is what is globally accepted about wwe when people buy a ticket or when people watch us on pay-per-view this sunday. it ditch release to the best in sports and entertainment under one roof. that's why they're celebrating their 29th anniversary of russell mania. charles: the thing i marvel at with all the things i talk about. you guys are not just big, you know, big guys, but you're

athletic, nimble. it is like, is there a special type of training? really, home on wednesday night. i promoted this show, went downstairs to the basement, did you bench braces just in case you get out of line. i'm staff. you guys fly around the ring. is the real deal with respect to the type of athleticism. >> being a superstar is hard work, and there's a fundamental set of skills that everyone must learn, but to make it to our major leagues, not only do you have to be athletically gifted, but you have to be able to conduct yourself in a professional environment. we ask to be on an operating level of the greatest pinnacle of superstars. so being a wwe superstar is hard work. as a lot involved.
