our top story tonight is a taxman may be reading her e-mails. the internal revenue service claims it doesn't need a warrant to read your e-mails. we will get to that in just a moment. it prefers, is it legal for the irs read my e-mails between now and 10 anytime? >> that is the problem here. documents say that the irs has written policies telling thousands of agencies.

is wrong. we make about? >> well, i think that those words are just going around the whole issue. they might has well have been reading at home or something. there is a laundry list of critical federal laws that make it clear that this isn't legal action the government says don't worry about it. it is absurd. gerri: exactly. an old law, so old in fact, that it allows the irs access and the government access to e-mails that are under 180 days old. go figure how they came up with that. wanting you to respond to the irs handbook where they outlined their ability to do this. it's said the fourth amendment

does not protect communications held in electronic storage such as e-mail messages stored on a server. internet users do not have a reasonable expectation of privacy in such conditions. i mean, i have a reasonable expectation of privacy. how about you? maxwell, of course. that position is legally absurd. you have the fourth amendment restriction of searches and seizures. the 10th circuit ruling. there are other statutes as well. federal law says that not only do you have an expectation of e-mail, if somebody violates it, they can go to jail for felony. gerri: let me make a comparison. if i go to your mailbox and i take your mail out, i go to jail. why isn't the same true with my e-mail box?

>> i completely agree. now you have a situation where there is no judicial intermediary because they are saying that they don't want to have a one and they are going to step over the constitution and just move forward applying a 30-year-old law completely out of context. it is an unconstitutional approach. gerri: will be challenged in a court of law? >> perhaps. the senator who is the author of the original bill has voiced concern here on capitol hill in washington. they are looking at an amendment to clarify this issue and i think that would also provide some guidance. the one i like big brother to go away. thank you for coming on. so is the irs weighing in?

amendment. we are going to look at this and in fact, today, i fired off a letter to the irs acting for accountability is what is going on. >> will you investigate? this is the irs. at the end of the day, they carry a very big stick. >> well, congress carries a big stick as well. we are going to ask those questions. i will be in contact and expect a proper response. >> we will have a hearing coming up in the upcoming weeks. if i haven't had answers directly, i can assure you that i will be asking these questions during the context of the hearing. >> you are always watching government overreach and you are always following it as closely as you can. are you outraged as well? >> yes, because we have had a federal court ruling, saying

that no, you can't just go and subpoena an e-mail. the irs could go and if they had a probable cause to go to your e-mail. now they can go in and they can read your e-mail. every aspect of your life is relevant to this. what about the dinner you deducted? going throw your e-mails with your buddy, so it's another reason to worry about. gerri: frankly, that is very concerning. >> what they have to use for a subpoena is a far lower

threshold. they can subpoena you without a judge and go out there and they could subpoena and say to turn over these e-mails to us from gerri willis. gerri: that is what i am worried about. the coverage on this, people have been stepping very carefully because you don't want to make the irs now. it is concerning, but yet the overreach is stunning. the rs will be charged at the irs is paying for it. because if you're not coming or going to have to paychecks. >> all this has been placed under the shoulders of the affordable care act. obamacare. the irs is not ready to do this. i don't think the irs ought to

complex and complicated and confusing. and that included the health and human services secretary kathleen sibelius. one of the reasons the estimated costs are spread out across hundreds of pages in obama's newly released budget is requesting an additional $1.5 million just to implement the change -- exchanges, that is. with more with the confusion had, michael cannon, the director of health policy studies at the cato institute. thank you for coming on. why can't we get a straight answer about the cost of this? wire the costs rising? >> blasting the obama administration wants is for anyone to know the cost of this law. the cost is spread out among federal agencies. we pick out individual parts, we find the projections, like you said. like you said, kathleen sibelius has been spending lots of money

to encourage them to implement the law. earlier this year, they said they would be spending $2 billion by the end of the year. but now we learn it will be more than twice that amount to an you say the devil is in the details. look at the insurance exchanges. we were told 4.4 billion and now we are told it will be more than that. but can we trust her for numbers >> that is the cost of driving the states. states don't want to do it. only one third of the state say that they want to run these exchanges because this is going to be a disaster. and they don't want to take responsibility for it. the federal government has to run exchanges in 33 states. they will not be able to get up and running. supporters of this law are heading for the exit. you have jay rockefeller, a

senate democrat saying that it is so complex. gerri: getting to the big kahuna of costs, focused on how much money is coming out of taxpayer pockets. how much will it really cost to extend health care coverage to 27 million people? we have been told everything. we know that the low income folks will get medicaid, low income folks will get subsidized. but there is no reporting in the budget that tells you. $3 billion here, $32 billion there. there is no real accounting of what we will have to pay for this. >> the congressional budget office has been tracking that and what they found is that current states are refusing to implement parts of the law is the medicaid expansion. at the but the cost is actually going to be less. the cbo has said that back in july -- they said that the cost will be $84 billion less than they had originally projected.

states are refusing to implement the medicaid expansion. gerri: medicated an additional $30 billion to cover people who are not covered now. then a tax credit that would go to middle income folks is estimated to be worth $32 billion. i just don't seem to find much honesty in talking about the real cost. that is what is so frustrating. it's one thing to suggest a program to help americans that you are eager to put into place. it's another thing to tell the american people what they are going to have to pay to get that kind of service. what do you think of that double standard? >> the worst part is not just 30 something billion dollars that the subsidies will cost him the first year. we look over the first limitations, they say it's $1.2 trillion of impact on the budget. but the obama administration

offered authorization from congress to spend the money in those own exchanges. they are really trying to spend $600 billion that congress never authorized. that is the most important story here. they're being sued by the state of oklahoma and probably by other people because illegal subsidies will trigger legal taxes. gerri: some people maintain that obamacare is sort of falling apart. but it will be irrelevant and it's not really going to come to fruition mainly because of the states refusing. and also because it's just not working.

particularly charitable deduction, mortgage interest deduction. which i have seen letters from the irs on the. >> the government is getting really tight about desperately want to reduce as much as possible. what you say about that? are people going out to be to be particularly careful this year with their terrible donations? >> the irs tracks with the deductions are based on the amount of income that you have. they have a reasonable number of what people do for a personal expense and charitable deductions and things like that. you are at the very least going to open yourself to an audit. gerri: they are looking at how much you should be giving in terms of charity. you say aggressive business deductions. how much is a progressive? >> the small businesses -- you

have to have the necessary expenses. there have than people taking excessive travel expenses, finding its way to the business ring. meals and entertainment. it is a truly related to the business. gym memberships. country club memberships, funny things in a more personal in nature. gerri: so you can't include the country club memberships? [laughter] >> no. >> dominick, i want to give you a couple of specific examples of things. if you have a small business, particularly one that tends to operate on cash. a small bar or restaurant or hair salon. more likely to look at you than they are ibm, is that right? >> every single business uses a business code to tell the irs what kind of business you do. the irs tracks this. if you own a hair salon and

you're taking a trip to hawaii for a seminar, you open yourself up for someone saying, is that normal, is that customary, is that appropriate. you must look at the expenses for your business. they have to be appropriate. gerri: you have to ask a tax professional or is there a way to know? >> states come in and target industries and they know what kind of cost is associated with that industry. if you will are showing this in the pizza via business, you are showing $100,000 in income. >> they have actually done it, gerri. gerri: i wonder if the models are right.

are they really that accurate? >> it doesn't matter if they are accurate, what matters is giving them enough to investigate. gerri: they have your e-mail as well. which is crazy. dominic, this is like one of those, you know, red flag in front of a bull, you have your home office. the utility bill, heating and air conditioning, what else? >> daycare. >> this is really a legitimate age where you are working in companies actually want to work out of your house. it is a legitimate deduction. but the problem is when people decide they need to be piggish about it. if you are using more than one room for an office, you should take only 10% of the electric bill and etc.

way through 2013 and there are many changes thanks to the american taxpayer relief act. be prepared for those changes, including a higher income tax rate. money-saving moves you can make. some advice was given earlier on fox business. >> they have made sense in the past. but now the taxes have fully come into play. you must look at the implications of the portfolio because he could have such a loss on the return of the investment based on the tax implications. the loss that you could take, the overall income tax rates. it is a much more complicated and the structure to maximize your return. gerri: he also pointed out that state taxes are a hidden burden when it comes to tax season. some say that the course is worse than others. brace yourselves, my friends. number five is rhode island.

criminals way of making money. what do folks do? >> you have to protect yourself and your own personal information better. you can do that in a variety of ways. you can register for alerts and things like that. but do not respond to e-mails that appear to be from the irs. because the agency doesn't communicate with taxpayers by e-mail. don't ever respond or click on an e-mail like that. don't give your social security and number to some cool cause it. beyond that is good stuff, you're totally right. if someone sends you an e-mail saying they are the irs, they are a crock. i thank you. gerri: still to come, will cost more, a caribbean cruise or a stay at a motel motel six? and getting your resume to fit on one page.
