considerable knowledge what happened during the attack on the consulate and apparently the obama administration is concerning their views don't support the so-called official account of events. former justice official of the house intelligence committee victoria y it's a violation of law. she represents one of the state department employees. >> my client is being so compliant with the law. here is the state department was trying to ignore this until you beat up on this. they were obstructing justice. >>dam housley has learned from an unnamed special operator who watched the events that took place in bghazi that the official account may be wrong, perhaps terribly weakening. they say the united states had mitary assets in position to act and respond to save at least

two of the lives that were lost in that attack. we take you a of that up tonight with former c.i.a. operative michael sawyer who led the bin laden unit and thomas mcnerney and congressman robert lotta on the losing war on tracking and the crush the keystone pipeline. someone inside the obama white house is issuing threats and intimidating employees of the state departmental that wishes to share critical information. fox news chief washington correspondent james rosen has our report. >> state department pushed back against charges first aired on fox news alleging that benghazi whistleblowers have faced threats and intimidation.

>> we do have to look at the issue and de-politicize it. american people deserve answers. i'm determined there will be an accountable and open state department. >> the state department would never tolerate sanction retaliation against whistleblowers on any issue. that is an obligation we take very seriously. >> president obama professed to be aware of loaning snding efforts to question survivors of the benghazi attack in which terrorists killed the u.s. ambassador to libya and three other americans. >> i'm not familiar withthis notion that anybody has been blocked from testifying. so with a i'll do is i will find out whatxactly you are referring to. >> on mochb, former justice department official victoria tony sing identified herself as one of the attorney as benghazi whistleblower but they say no

such whistleblowers have come forward. yet republican congressman darrell issa wrote to the state department's number two lawyer back on april 16. attorneys representing department personnel in this matter will require clearance to possess and discuss sensitive information. >> they've had two letters from chairman issa, one on april 16, the other one april 26. we want you to provide a process clearing a lawyer to receive classified information. how can they lie to the press corps. >> that is why we need to give them immunity. the administration has lost his credibility. >> fox news has learned that the house oversight government refm committee will hold a fresh round on benghazi with the first slated to start next week.

here now to talk about the administration and benghazi, the mixed messages and appeaance of a stone wall over more than 7-month period, former c.i.a. operative and head of the bin laden tracking unit and mike iterney. let me begin with you. i will put it this way and i don't in a trivial manner. the noise that is suddenly being made on this date about bwz at least four whistleblowers coming forward at this time? >> it's not surprising, they suppress the truth, they decided

not to rescue four americans that were in trouble when they knew how deep that trouble was. we have had a continuing series of lies. this is clinton saying she didn't know that her ambassador needed more security. the president going off to las vegas to raise money i instead f trying to help those people that were being attacked, it's kind of embulus parade of lies. i think the dam is breaking here because of the special forces fellow. there is no doubt that we could have made an effort even with the people who were on the ground there. >> general, the assets are in place in position, whether the souther europe or whether it be in northern africa, do you have a read as tohe degree to which you have confidence in with a the official account is that there were not assets in position to deploy to rescue these americans, specifically the four who were killed? >> no, i don have confidence,

lou. first of all, let's remember it was 9/11, 11th anniversary of the most horrific taking on the united states. we had assets in the mediterranean. we have a fighter base of f-16s and should have been on airborne alert right off of libya. we gone through actions taken down moammar khadafy. >> we had a c-10 force and spenl operations force in croatia on an exercise. on 9/11, why would you have such a valuable asset in another area on an exercise rather than say at signella or in libya on alert? why were there not more airborne ground alerted forth on that very special day.

>> and southern italy, libya is itself. michael, this group, covert force compromised of as adam housley reported some 40 c.i.a. operatives. is it typical they would be able to be dispatched on that quick a notice to speed in time all the way to benghazi? >> in the case of benghazi, in the case of libya, as the general just said, libya was falling apart. the administration wanted to continue the pletense that democracy was coming. certainly as an intelligence officers you are always respectful of what the president or the political people say, but nonetheless you put forces in place just in case it happens when they are wrong. i'm sure that the military both in terms of special forces and the marines and the agency had

people rdy to help. you have to remember on the friday before they leaked the story to make sure that petraeus had to resign, he said no one at the c.i.a. refused to help tho peopl who were undee attack which directly leads back to the white house as the people who stopped a mission to save them. >> are you intimate go that petraeus' ll, he was hardly the first general to have an affair -- are you suggesting that that affair was tied to take responsibility or make it abundantly clear where the blame lies? >> i think there is no doubt about it based on the information that came out afterwards. the affair had been examined and found to have no national security implications. obama had to get rid of the

secretary of defense because he had been a strong secretary of defense and a c.i.a. director and petraeus also knew from his experience that we're not involved in a law enforcement action against islamists. this is war. he had to get rid of petraeus and had to put somebody in like john brennan to tow the line. >> poop boy aside, do you agree with michael's assessment here? what are your views? >> i think michael said it about right. if general petraeus is brought back, subpoenaed or brought back to testify, he is going to tell the truth. that is very important for the committee to do. it'squally important to get survivors, people who were engaged in the operation to testify which the administration here to for has not happened. many have been shifted so the

media couldn't get them right away. i believe we have other problems with the chairman of the joint chiefs of staff and very strong secretary of defense panetta who's answers under oath were not compelling. once the dam starts to break, there will be lot of people coming forward and disssing their views. >> thank you very much. good to have you with us. >> consumer confidence hit a three-year high. stocks hit a record.

he was the house and senate. now, he doesn't have that same power. frankly i don't think he can push through bad legislation like he used to. that is good sign for the country. sooner or later we're going to get rid of obamacare almost entirely. its terrible program. it's hurting the economy. that is why we have a slow growth and recovery. once that is gone you will see a boom in this economy like never before. >> lou: we'll take a look at a revealing poll in the next segment. it's kaiser came out with a new poll on obamacare. it's amazing. it's confident with what would you said but not confident the nob prize go economist paul grugman and professor neil rguson who is finest

for us. >> i think high debt does, but i don't like to focus on debt. i like to focus on taxes and spending. if you have high debt because you broaden the base but if you have high debt because you are paying people not to work, you have slower growth. when you look at this debt. i want to make sure that neither krugman nor ferguson are trying to talk me or american people to raise taxes to pay that debt down. i have never heard of an economy tax order prosperity. i wish they talk about taxes and spending rather than debt. they go after this debt issue. it matters how you get your debt >> lou: i would rather they spur creation of jobs and be done with it. >> me too. >> lou: it's so dreary.

>> lou: comedian conan o'brien. fox chief correspondented henry runs the thing. we like it a lot. there is some truth in every joke. let's facet last year was a dangerous year for republicans. here a an a analysis of election. his findings confirm just that. romney could not turn out republicans and last year overall voter turnout was 58%. 58%! that is rough from everybody. that was down from 62% in 2008, a lot of extra enthusiasm for the president. and 52% back in 2004 when there wasn't a lot of enthusiasm about anything.

look at that performance. that is disaster. just ask governor romney. consider this, president obama won last year with historically low percentage of white voters. he achieved only 39%. the president, however, had a little extra support in other places. 71% of the happy vote. and 73% of asians voted for president obama. but the black vote was spectacular. he got 93% of the black vote. talk about a consensus, that is a consensus. according to fray the key to victory was in that black voter turnout. even though they make up 12% of the eligible voters in the

country, they turned out 13% of the total votes. black voters turned out at a higher rate than white voters last year. if white and black voters turned out the same rate as they did back in 2004, there was a difference of 4% in the overall turnout, governor romney would have actually won the election. not clear that the democratic party can repeat last year's performance when the nation's first black president isn't on the ballot. one thing is clear. everything the republican party did last year was inadequate. it wasn't enough. a lot of it was just dead wrong. some of those fancy super pacs and big budgets they demonstrated they aren't enough and republican party has a lot of thinking to do. they better find some better

ambassador? >> yeah, the fact is the obama administration red line was a bad idea. the fact he is not going to enforce his own red line is a worse idea. it is a credibility hit to him. it's a credibility hit to the government itself. just because you do one foolish thing means you have to do another foolish thing. >> lou: reconcile something for me. we have had over 70,000 people murdered in the country of mexico. that is on our border. there hasn't been a peep from this administration about the narco violence that has raged through mexico. we suddenly have a group of council of foreign relation subscribers, we have to go to war in syria. can somebody square that.

>> it's time to take a deep breath. what are our objectives in syria by saying, red line and not sure what to do. chemical weapons, send in the marines. we do not belong in the middle of another sill war. problem with the chemical weapons, go in and destroy them. have our allies allies do it. >> lou: thank you. >> the epa working to delay the keystone pipeline. did i say epa -- i meant president obama. we'll be joined by congressman, what happens next is next.

study this thing to debt. big thing we've already seen the state department come out and said, there is insignificant minimal impact here. it has to go forward. we're talking about 830,000 barrels of oil that come into the united states from canada that would cate 20,000 jobs and another 100,000. >> lou: it's been out of hands of the house of representatives because this president and senate are going to drive policy in near almost every instance but with the epa stepping in, it had been the state department's game to approve the administration to approve and move on. people forget, epa is this administration. this is the president speaking. this isn't the epa. >> it's supposed to happen the state department says, this is in the national interests to have this pipeline. president would give the presidential permit to get it

moving. it's sitting in committee and we've heard it over and over, epa saying there is this problem and that problem. we want to make sure again this oil is coming to the united states. canadians are best trading partners, plus we don't want to see that oil going to china or to india going to the west coast of canada. >> lou: there are all sorts of strategic issues, job issues, economic issues here. there is also just good judgment and architecture of values that will set the stage for the country's destiny to at least through this century. we are the world's richest nation in terms of energy reserves. for this kind of decision to be taken by the administration, this will be a pivotal issue in the 2014 elections, don't you think? >> i think so. especially in the midwestern states where the pipeline is going through, you have the senate races that will be hotly

contested. it will be asking those members or those candidates, where do you stand on this pipeline. again, it's just not, people are going to know, this is private line. this is nothing to do with federal taxpayer dollars. this a private line that will bring the oil into this country. that is going to be a big issue for those states. >> lou: very important decision today, important ruling by the partment of environmental protection. state department in pennsylvania ruling that there is no evidence whatsoever to connect natural gas drilling with high levels of methane found in private water supplies in the town of franklin pennsylvania. it clears the way for fracking in pennsylvania. is eight boon nationwide next-door for example in new york? >> i think it's important. individual states are out there

doing the regulations and putting the laws on the books they have to do. when you look at the federal government or epa thing they will have a one size fits all. what they do in pennsylvaa is different than ohio or north and south dakota. it's different. when the states are out there, they are the ones that have to answer to their constituents so i think it's very important ruling. >> lou: this is war between the obama administration and environmental protection agency and industry, particularly the petroleum industry, chemical industry across this country. who is going to win? >> i think the american people will win. when i say the american people. it's the jobs that are created. over three million jobs most likely in oil and gas production in this country. you are absolutely right. when you are talking about where we've come. 25, 30 years ago people were saying, this country has no energy. has no supplies, here we are
