"cashin' in." wayne rogers, jauohn and tracy burns. as the white house scrambles to resell obama care to the public, democrats are pulling out all the stops. >> we have certain inalienable rights of life, liberty and the pursuit of happiness. one might argue that education and health care fall into those provisions of life, liberty and the pursuit o happiness. although health care was not listed per se in the constitution, it should be a constitutional right. >> life, check. liberty, check, psuit of happiness, check, in the constitution. john, i don't see obama care anywhere in this document. >> it's not, eric. unfortunately the representative and many democrats are ignorant as to just what a right is. a right is a right to action, to pursue your life, liberty and

happiness. it's not a right to a freebie or a gooder service from someone else. just a notion of a right to health care means that other people are enslaved to provide you with that health care. the result is thedestruction of all rights. that's why the founders understood it to be individual rights. it's your life, your liberty and your happiness. that's why health care, education, a haircut or a free meal is not a right. >> we called the representative and i guess she was unavailable. we couldn't get her on. we tried to get her on the show, she couldn't join us. but in her place we have julie who will defend obama care to the end, right? >> well, don't confuse me with sheila jackson-lee. but i will say this. to jonathan's point, we do have mandatory education. you have to send your kids to school. i think education is very important but your health is everything. >> so education is right. health care is a right. >> i thnk health care is absolutely a right. >> what about a big house >> liste come on, if you don't have your health, the health is

obviously thomas jefferson and madison and the people who were responsible for the constitution with roll over in their graves if they heard this. these are people who are talking on the floor of the house of representatives and the senate in the united states who have never read their federalist papers. they have never read the background of the constitution. they know nothing about the enlightenmentnd the philosophy of adam smith and hutchinson and the people who founded those things, because all of these people were living under the divine right of kings. they were afraid of a central government that mandated certain things and called certain things entitlemts and rights. we have no entitlements and rights. we have individual liberty. that's what it's all about. jonathan is absolutely right. and if these people could read, which they don't, they would understd that. it's as simple as that. >> go ahead, tracy, go ahead. >> there's a very fine line here. look, i don't think obama care is the answer, but i do think that we owe the american people of our fine country something if they are ill.

if you click it, should you be taxed for it? the senate passing a bill paving the way for states to collect sales tax on online purchases. they say brick and mortar stores collect sales tax so why shouldn't online retailers also. jonathan, just another tax. is this fair? >> it's not only unfair, eric, but it's destructive to the

economy. i mean freedom creates wealth and force, which taxes are, destroys it. thiis simply the government taking more of your money. it's more regulatory costs and expenses for retailers. it makes trade harder, it makes trade more expensive. how does that help anyone except the big spending government. we've only had a sales tax in this country basically since 1930. rather than adding new taxes, why not take them away from the bricks and mortar stores and let the economy thrive and fly. >> i struggle with this one because i do not agree with adding one single additional tax to this economy. >> what about the kids? >> if i'm barnes & noble, brick and mortar, it annoys me that you can go onto the website and get a break. so where is the equality there? look, i worry about this, though, because you get the states collecting sales tax from other states, what ee are they going to start collecting. you're opening a whole can of worms with this. >> what about it, wayne? jonathan says eliminate the sales tax for brick and mortar.

what do you say? >> well, that's fine for jonathan to s that, but why not eliminate the income tax and have a national sales tax. that would be a better idea. so when you're doing -- when you're explaiing it, it's much more complicated than this. this has to be a level playing field. you cannot have tax on one and not tax the oth. >> there's 9600 different tax jurisdictions in america, 565 indian reservations, almost 10,000 -- over 10,000 different jurisdictions that small businesses probably would fold having to deal with all that bureaucracy. >> well, small businesses are not on the internet, right? they're small mom and pop stores. >> huh? small businesses are not on the internet? >> the road that you drove to get to the studio today, who's paying for that? how are you going to fund basic components of government? roads. the reason i'm staying on this and the reason i made that point is because if you exclude certain people from the sales tax but you include other people

in it, the only option is to put those other people who are paying it out of business or eliminate the sales tax as jonathan said altogether. in which case i don't know how states will function and provide even basic services like roads. >> hold on, tracy. here's the way it would work out. the big internet retailers, they're actually okay with it. it's the small ones that aren't. they are the ones that have to deal with it. >> rightfully so. first there's a million dollar cutoff. a million or less you don't have to worry about this. does that prevent an incentive to grow over a million dollars? we're preventing people from growing. so there's that same notion we see all over again. i do think there's something really wrong with the fact that if i order it, no tax. i go to the store, tax. >> wayne, what about it, aren't we call -- i buy a lot of stuff online. i'm just going to end up paying more for it and the consumers will end up eating this cost anyway. >> that's true, eric. but you can't have a double scale here. you've got to have -- what's
