name it really with up arrows with the exception of gold, metals, mining is to materials, that group, those commodities in particular are under significant pressure. that really is at top, top stories we're following. back to you. dennis: thanks very much. the markets are watching washington as to federal reserve presidents testify before congress. peter barnes is in washington d.c. with the latest. >> reporter: so far no comments on monetary policy from richard fisher, president and the federal reserve bank of dallas. that's with the testifying about today at the house financial services committee, and they both believe that dodd-frank financial reform does not end too big to fail and that it would allow the government to do bailouts of the biggest banks.

and they want tougher measures for big banks. >> these banks are treated differently from the other 99 percent. differently from other businesses. and under dodd-frank unfortunately we believe this imbalance of treatment has been unwittingly perpetuate. >> reporter: the former head of the fdic who helped to write dodd-frank was left to defend it saying the agency's ability to take over a big bank and stick shareholders and creditors with losses in this too big to fail, but she acknowledges that regulators still have to finish writing some of the import rules around this and have to make it clear to markets that it will work. cheryl: my next guest said that he is still betting on equities. values. chief research analyst. i want to get your take on what we saw today. weaker gdp number did not affect

says nothing about impacting on the minority, keeping blacks out, keeping hispanics out, you name it, the bottom line is that if you have a policy that statistically will keep people from working at a job and that policy is not job-related or consistent with business necessity then you keep people out. what is wrong with it is that it essentially says there are more minorities, unfortunately, they're involved in committing crimes and have a rule like that, you're basically permitting more people who are not minorities to be able to handle a job, whereas the people who are minorities can also handle the job of a system of the ones that have a criminal background, their the ones that are excluded. if the criteria for the rule or the policy of what the application must look like, in other words, the skills they have is not related to the job, you're essentially just keeping them out from working really for no reason other than the fact that in essence they're being discriminated against in this policy is essentially not something that is done

necessarily intensely, but can have that effect. dennis: the reason they aren't hiring me is because it turns out i was convicted of a crime. the "wall street journal" editorial page, don't you feel like employers ought to have the right not to hire me if i had been convicted of felony? >> employers do have the right not to hire you if you have committed a felony. he is talking as if this is a law, but the key thing he said was statistically what he's talking about is a theory called disparate impact which says that even if you don't intend to discriminate, the federal government can sue you. this is pushing the boundaries of the law, if not illegal. the supreme court will hear a case called mount holly in the coming session that will determine whether or not this theory is legal and not under the fair housing act. but have ramifications throughout government. it is not illegal to do a criminal background check. what you're seeing here is an agency of government that is completely out of control. not only do they want to ban companies from doing criminal background checks, they want to ban them from bank credit checks

they want to make it illegal for you to say you have to come to an office and work. this is just the beginning of an agency that needs much more attention. dennis: marriages said the eeoc is out of control. what do you think? >> absolutely false. first of all, this is ben slauson said to 71. it was a case called race starts. status by the u.s. supreme court. take the example of having a requirement that you have a must have a high-school diploma and ordered to be a janitor. you know or it seems to be that in your area, of blacks the don't have high-school diplomas. when they need high-school diploma? dennis: wait a minute. they have to have a high-school.

have been. >> i thought that the meetings were very productive. what you find is that these, they have to incubate for a while. anywhere between six and nine months before you find out whether the conversation that you had, they go back and crunch numbers. we are just now starting to see, and hopefully the next six weeks or so, we will have some good announcements to make about the california trip back in february. about a seven-nine month period of time that is the shortest period of time generally speaking that you will have on this type of recruitment trips. wonderful people in connecticut. we had a lot of one on ones in

connecticut. the financial services side of things. listen, new york is a hard sell. that is a great pity, as you well know. i think one of the hardest cities to recruit from a number cut is new york city. they sure are making it easier to talk to people. governor malloy. come by. he was very hospitable. i do not suspect that they are ecstatic that i was in their states recruiting. really, i hope when they go back and think about it, it is like a visiting coach that comes into your hometown. they are professional. they are positive. they are not there to run your team down.

it is with a tax policy or a regulatory policy. it would not have happened if i did not have neighbors or competitors out there changing their laws and regulations. i have been to florida within the last six months to regroup businesses. sitting on the stage with rick scott. he gets it. he is a true competitor. we invite each other to our states. he comes here to share. i get it. i accept it. the challenge to me is to make sure we keep taxes a more competitive place than any of those.

what do you think? >> what this shows is we have a far more competitive marketplace then people say. the huge engine of capital. you will have unlimited data plans. sprint has far more spectrum than at&t or verizon. one way to measure the marketplace is to look at all of the advertising out there. it is. dennis: four or five competitive on each. for two years in a row, the staff is at an annual assessment of wireless saying, you know what, we are not sure that is truly a competitive industry.

>> it has been one of the crown jewels of the american economy. it is the leader. it always has been in the world. because it has been so unregulated, there are a lot of folks who want to regulate it even more. there is a concern that at&t and verizon combined have about 80% market share. that will start changing, i think there'd what happens to t-mobile? the ceo of dish rwanda to buy sprint. he wants to be a player in this space. a big question is, will he try to buy t-mobile. what is the problem they are trying to correct? i thought you go into a market when prices are going up unnecessarily. >> innovation is going up. speeds are going up.

consumer experience is only benefiting. it really divides object. dennis: yet, they do all kinds of things that are not necessarily logical. now we get to the spectrum auction coming up. if you end up thinking it is not competitive enough, then maybe you do not let them bid at all. >> there are a lot of groups that are really pushing to exclude at&t and verizon. that is a question that still remains. we will not know for sure until we get the new fec chairman installed. that may be early next year until we know for sure whether or not they will be able to participate. >> these airways belong to the american taxpayer.
