washington and back. in just about 40 hours. and after their exhausting travel, the president and first lady are returning to the white house in turmoil. the president facing more plunging approval ratings. as the president honored mandela, the white house announced the administration has turned to the clinton era for help. former clinton chief of staff john podesta returns to the white house to serve as what the obama administration calls a counselor to the president after a series of scandals, misrepresentations, misstatements, and contradictions over a number of events and issues in the overall failure of the obamare rollout. major issues that now threaten the president's agenda, his legacy, and his party's prospects and next year's elections. white house press secretary jay carney said of the move, the president is looking forward to

his council on many issues, including the implementation of the affordable care act, a climate action plan, and executive actions. and podesta had his work cut out for him. even in celebration of mandela's life, the predent could not steer clear of controversy. on his way to the podium, president obama shook hands with other world leaders, including cuban president raul castro and what the administration says was a spontaneous and counter. nonetheless, some republicans slammed the president for. senator mark arubia said, obama should have used the moment to ask castro about the basic freedo that our -- that are systematically denied. also, the preside taking a brief moment to take a salsa with both the british and they miss -- danish prime ministers. the topic of, the president's job approval has now hit a

record low of 38% with the staggering disapproval. breaking new the house and senate have announced just moments ago they finally reached the elusive budget deal that both parties had sought. the deal is for two years and establishes the amount that congress is legally allowed to spend on discretionary not entitlement items over the next two fiscal cycles including the remainder of this fiscal year and for fiscal 2015. the deal would save approximately 63 billion in sequestration cuts spread equally between defense and nondefense and would require the raising of fees including airline fees and an overall federal employee pension programs and contributions. those changes to include an increase in the annual contributions paid by most federal workers. >> this bill reduces the deficit

by 23 billion it does not raise taxes and it cuts spending and a smarter way. that means and a budget agreement that reduces the deficit without raising taxes and replaces some of the arbitrary across-the-board spending cuts with smarter, promised reforms that pay for this relief. lou: house is expected to take the bill up as early as tomorrow the senate to follow if it passes the lower chamber. also on capitol hill today, reblicans and democrats on the house foreign affairs committee wrote secretary of state on the proposed iranian nuclear deal as the president's top diplomat attempted to persuade congress against enacting new sanctions against the iranian regime. ranking democrat blasted the obama administration for not requiring that iran stopped enriching uranium as part of the six month interim deal. >> i want to make it clear that i have some serious reservations

about the agreement. first and foremost, it seems to me at a minimum that it should have required the iranians to suspend the uranium enrichment as demanded by six separate un security council resolutions. i do not think it is asking too much to say that at least while we are talking he stopped enriching. lou: called the negotiations delicate and confirmed that the road iranian state would only be required to slow their enrichment process. >> iran cannot increase the number of centrifuges in opation, and it will not install or use any nex generation centrifuges to enrich uranium. lou: in the senate finance committee today held a confirmation hearing for the president's choice to head the internal revenue service, john cussed cannon who told senators he would work to restore the

public trust in the wake of the agency's targeting of conservative groups in the scandal that has ensued. in every area of the irs taxpayers need to be confident that they will be treated fairly, no matter what their backgroundr affiliations. the public trusts the irs most important and valuable asset. lou: the committee has not yet scheduled a confirmation vote. but the committee chairman and its top republican said that they support his nomination. 50 million americans in the northeast today dealing with snow, freezing rain, and sleep still from a powerful winter storm that made a mess of both work commute and air travel, heavy snow throughout the morning in washington d.c., baltimore, philadelphia, new york city. because of that the federal government shut down the nation's capital and along the eastern seaboard. public schools also posed d.c., philadelphia, parts of delaware, maryland, west

virginia, kentucky, and bringing with it an average of 3 inches of snow to most spots but in some locations as much as a half foot. airports on the east coast are still scrambling to adjust more than 1300 flights canceled. ports in new york and new jers with delays of over an hour. boston and washington, more than a half-hour. the storm now moving into new england. subfreezing temperatures in many areas remain. fox news senior meteorologist janice d. in live in our weather center with the very latest. good evening. >> good evening. we have to stop meeting like this. we are seeing too many storms bring a lot of weather to the northeast. as you mentioned, hhve a foot of snow in maryland. 3 inches plus in delaware. looks like new jersey. so not a huge storm, but it did disrupt travel. kids had a school day. of course, they shut down parts of washington d.c. it was a quick mover. it is out of here.

we have some snow down wind where we could see a foot, but otherwise the system is long gone. in its wake very cold temperatures. or read about icy roads. look at these. twenties, teens, even single digits as you get toward new england which will continue. overnight tonight, tomorrow night and thursday night. not going anywhere fast, these cold temperatures. especially across the northern planes where we are dealing with wind chill warnings. temperatures below is zero, feeling like-35 to-50 in the area shaded in pure. so really dangerous. people are urged to stay indoors look at minneapolis. daytime high, 21 wednesday with subfreezing temperatures in the overnight, and this will continue for the next week or so. and then we're going to be talking about another storm, and this one could put the last one to shame. this could be our nor'easter.

lou: senate docrats taking advantage of majority leader harry reid decision last month to invoke the so-called nuclear option which elimites filibusters' on presidential nominees. the senate confirming patricia mellon as a federal appellate court justice for the d.c. circuit. they voted to break a filibuster of congress when mel watts headed the federal housing finance agency, overseeing fannie mae and freddie mac. full speed ahead. the supreme court reportedly indicating that they could revive a federal rule requiring e pollution fromouth and power plants dress to states and the mid-atlantic and northeastern regions. several justices suggested during a 90 minute argument today that they do believe the environment to protection agency did not exceed its authority when they issued the across state air pollution rule in 2011. end new reports that the obama

to take effect. eighteen new taxes including the medicare device tax that is crushing businesses. it is no surprise. the money has to come from somewhere. they're going to take obviously from the lesser expensive drugs. on sorry, the more expensive drugs and try to, you know, save money so that they campaign for the entire plan. it is broken. everybody knows that it is broken except the administration. that is why they brought in podesta. as you referenced earlier in your show, the average american is not going to be sitting around the dinner table during the holiday saying so, my gosh. he is here. think in this. no one knows a mix of the washington insiders. he is there to push a very liberal progressive agenda to expand the president's executive powers to try to address and deal with a lot of things that congress is now allowing the do. lou: and as you well know, he is a highly effective person and operator. but he is being -- as jay carney

said, being brought into employment the affordable care act. i thought it was an extraordinary choicef words because if it is going to rest on his shoulders, as good as he is, he is probably going to be in deep trouble. >> well, you will have a lot of work to do. the fact in the president and his administration and evebody who is trying to a minister the obamacare plan is basically changing long without the ability of congress to interject be part of the process, i would not be shocked if they're is a constitutional challenge as to the fact that they are making and changing laws without the proper authority t do so. number two, everybody knows that it is a mess. even their own some democratic senators, as you know, senator baucus said it is a train wreck. it is. the website, the cancellations. each and every day there is something new which is why you have senators and congressmen who voted for this who rammed it

through the need to go back to their home states immediately until people why they voted for it, why they did not vote for the grandfathering of all these amendmts that would have given the protections that the american people deserve and why they're losing their prescription drug care now. lou: let's take a look at the president's most recent disapproval rating which is an astonishing 57%. his approval rating has dropped to 38% in the newest poll. also showing 41 percent would vote for a republican. 38 percent for a democrat for the house. the first time that democrats have, as the underdogs on the generic ballot. this is the panic in the concern and the anxiety that we saw in the senate early which is now in thh house. this administration making these moves. is it a sign of desperation?

>> of course it is. you get what you vote for. every single democratic senator voted before i got there to ram this thing through. and then they made sure that they did not take up one amendment that would have protected the american people through the grandfathering process to allow them to keep the plan. they had many opportunities to fix this and says t do nothing. now theye filing see why a bills, obviously covering a backside saying, they g home. i'm really doing it. i did not release understand it. i'm going to fix it. they're just doing it for show. the american people finally king up and holding senators and congressmen accountable for ramming something through against the american public policy that is hurtful to the medical industry, doctors, hospitals, nurses to run our great country. lou: to put questions. we are already at a time. this new budget deal. mary ann ryan hadulled off. the leaders are supporting.

your reaction to what is the first bipartisan budget action that i have seen in years. >> well, it's about time. as you know the senator said that it does not address the big things, and clearly it does not. saving 23 billion, while that is important we are running a $17 trillion national debt and a trillion dollar deficits. we need to do more. they need to address theebig things. they're just taking the cancer that they can go home for the winter holiday break. the good news is it does create some certainty and stability so people can plan, businesses and individuals can plan. we do get back to the regular water. that is a good thing. we really have to start getting into obviously medicare, medicaid, social security. lou: let's cut to one of the other big things. your view on what you think of draft movements, particularly for the united states senate in new hampshire. you are one of those people being drafted. your thoughts. >> listen. there are three good candid it's

running. plenty of people being considered. it is an honor. a drop in the mill to the young man who is doing that. and not sure what i'm going to do, but think that the senators voted for that bill have to go back to their home states and tell people why they voted for this and explain why it is a good thing for not only new hampshire but every other state. at that point if they're is a good reason the navy will figure it out of the more. right now on focusing and obviously the holidays, taking care of my family and contributing is i'm doing here now. lou: those sound like extraordinary priorities as well. very positive indeed. thank you for being with us. i personally think the draft movement is a terrific idea. some sort of sense of what the people want early on. thanks. up next, a historic vote and major ramifications for banks, how they do business. wall street veteran michael holland on the so-called volker rule. i don't think it is so-called. do you?

complain about income inequality , but what about tax and equality. a new report by the congressional budget office shows that top 40 percent of households paid 106% of the net income taxes in 2010. that is because americans in the bottom 40 percent actally paid negative income taxes, receding refundable tax credits, of course. those americans in the bottom 40% received on average $18,950 in government transfers, contributing to a negative income tax re in 2010, as i said. what i love about these reports when you look at stories like this, 2010, and this day a age it is a reality, the fanciest communication devices in the world, we could only bring it up to 2010. there it is. general motors naming its first female ceo in company history today.

in a group of regulatory agencies today approved the long awaited volker rule which bars banks from betting on the market with their own money and brings in a lot of new regulations and work -- joining me to talk about the potential impact on wall street and his view on the markets on our economy, michael holland, president of the holland balanced fund. >> great to be year. lou: one of the funniest lines today. you watch the computer read all of the seine. he approves. i love that. it's like george washington saying he liked his picture on thdollar bill. does he like it? >> no. no. i think the intent that he wanted to my he should approve of thentent, but the actual mechanism they're using or mechanisms or lack of mechanisms , but before the late 1990's we had a system that had worked for 70 years and was

simply that the banks could not use the customer's money that was insured by taxpayers to gamble. lou: a better idea. >> yes, he did. he got it through congress. instituted.n its wisdom, now to get out of the nest that 2008 brought us we are ending up with -- i think the solution is worse the problem because we're now having a situation where the regulators will be much more involved deciding who is doing what to whom and what is right and wrong. lou: what aut those people saying it was the investment banks who screwed it up really putting out those products in going into the sub prime market and just creating toxic assets of every imaginable shape and form. the commercial banks were doing just fine. your reaction? >> are true. untruth. eryone -- there are so many places to point a finger. we don't have enough fingers between the tool list. if you start with people in washington, the people who created all of this, housing, or

people on both sides of the aisle are culpable and the banks were simply conduits. a lot of people made money, and it was not just wall seet. lou: a lot of, you know -- i don't know whether you own bank stocks. i certainly do. a lot of investors do around the country obviously. but the idea that banks need oversight regulation to my don't think anybody would argue. what would you put in instead? we have a full year before it goes into effect. >> simple as the solion would be to go back to politicians, you can't do that. go back to the late 1990's and simply say that commercial banks and commercial banking, investment banks will the investment-banking. lou: the return. >> so, what a great idea. it works for 70 years. this looks like a real mess to try to implement. lou: i could not agree more. the second is a footnote to the

conversation. now to the headlines. what have we got here to wrap up the year? what are you seeing the prospect in the near term? >> we are still okay. we talked about the federal reserve being the main wind at the back of these markets. the fed has set out in 2008 as the only adult to as we describe it in washington with any common sense to say things are bad, congress is going to do nothing. the administration will do nothing. we can do something. ththey have done something. it worked well in the early years. quantitative easing is about to go away. lou: in dember tapir. >> december, january, february, it does not really matter. the markets are beginning to get very immured in the beginning to say, it does not really matter. they're beginning to believe the fed words because the fed live in washington, no one believes them. they have actually said what they're going do, set up to do it, have been successful.

they say they will continue. lou: i love all of the interpretation, the business media and the nonsense that goes into extrapolate what every fed bank president in the country. the end of the day just listen to what the chairman says and we will be all right. >> it is just the way to do it. do what he has been doing. lou: your view, this market in 2014. >> i think the fed has our backs. they will continue to have our backs of thing slowdown. we will do things in the future we have not done in the past emetic continue to say the only thing they can do is get financial asset prices up. it is not really difficult, not very complex. lou: it is so complex that i need to hear what you think. comes up. and why on earth are we helping the iranians to give up when we need to be driving them to their knees. sanctions, we started to work. nctions are really taking a toll. giving is nothing in response. the bottom line is the iranians as well as every other dictatorship and band of thugs around the world have figured out that preside obama is a weakling. john kerry is an opportunist, and the personal egos and arrogance trump the security of not only of israel, but of the united states. this is folly. folly. lou: the idea that $7 billion in sanctions would be lifted. the secretary said today at the sanctions in place would overwhelm that number. one should not worry once had about it. your reaction?

>> my reaction is once the sanctions regime starts grumbling it is like a mine collapse. only takes one timber to go, and then it all goes. the reading in the international , often unscrupulous international business community centered on the persian gulf is that the sanctions will go away. you are already seeing a rush of international businessman kamal oil companies trying to get in on the deal that they think is coming. it will be hard to reverse. it just sends me. let me put it in another perspective. we have a president who is far more eager to shake the hand of role castro then to shake the hand of israel's prime minister. that tells you a great deal. i just feel that obama is now so desperate for a legacy. john kerry is so desperate for -- to go down in history as a

great secretary of state, they are going to do incredible damage to not only israeli security, that of our allies and clients in the gulf, but to american security. as i said fox for years, president obama has already accepted that the iranians will get nuclear weapons. it is really about containment. lou: what about china. the president said he was going to give it. he did. china now has an aircraft carrier moving to the south china seas. three of their naval vessels, and this president him well, where we headed and what should the united states response be to back. >> well, we certainly should be standing firmly with our allies, japan, south korea, and other clients in the region, the philippines. and we are saying the right things. the obama administration is saying the right stuff. the problem is that the

♪ lou: a new challenge emerging in republican efforts to win control the senate. to do so they need to score six seats. ticker look. there are some inherent advantages. twenty-one democratic senate seats are up for reelection compared to adjust 14. that is about a 50% advantage for the republicans. of tho republican sees 12 are being defende by incumbents. two others are wide open. this is where it gets tricky. seven of the 12 incumbents are now facing potentially tough tea party challenges, including the top two ranking republicans and a last-minute move last night to party favorite congressman steve stockman said he would be challenging senate minority leader mitch mcconnell - excuse me, whip john gordon. what prompted that rebellion,

this is -- this looks like a real battleground shaping up for the republican party. leon -- >> bottom line the teaarty as a fervent group of activists to vote in primaries, and even if o, four, six, seven incumbents that you have are all leaving and probably leading comfortably , they're all worried because of the nature of turnout in republican primaries. lou: does this displayed you? >> the swaddling is got to be great for the democrats. l the republicans. no one is really out there as a primary front runner. even the "chalk talk" here with all of those faces up there, all these men that really are not -- it's great for the democrats. lou: let me throw something out
