♪ ♪ logo. ♪ >> the nsa, get out of the way. tonight, the pressure is on. people are saying enough is enough. ♪ ♪. he won welcome, everyone. i am liz macdonald. a panel appointed by president barack obama obama recommended strict limits to the nsa spying program and this comes after a u.s. judge ruled the program unconstitutional. it looks like leary's legal battle could be paying off.

>> and grabbing the on the show. liz: you have been under fire. you have sued opec, you have sued your own mother. the critics have been out in force thing that he hopes that one out of 10 will have. what you think your critics? >> none of those are frivolous. i was protecting my grandmother and my stepdad had taken a do not resuscitate stands. they want to destroy the messenger because we have repeated this about benghazi and obamacare and now about the nsa as well. and you saw this with the

democrat party, the democratic national committee, jeffrey toobin is known to be an advocate. the on beyond the critics are coming out and saying, larry is totally wrong. the constitution is not a suicide pact. we need to protect americans. you don't protect americans i haven't fielded every time you pick up the phone or use social media that they are being watched. and people like me who are critical and more than critical, have been calling for civil disobedience and peaceful way. to try to eliminate the carrying out of we had at the other two branches of government. and it's clear what the nsa is doing. the american people can't live in a soviet style chinese state. that is exactly why the judge

ruled and this is a federal judge who came up through the system. he is a hero and he stood there for the american people. and we want to monitor what goes on the judge needs to take control here >> beyond larry, here's the thing. the real weakness could be the contractors that the government hires to work on the nsa programs. what do you make of that? but the private sector contractors are the weak links link that we should be worried about? >> the one week week is them, of course. but not just with regard to the nsa, but leading up to 9/11, those that were doing security. they let the 17 hijackers go right straight through. there needs to be controlled here. and we need to have supervision

and a few judge would stick his neck out like that. and that's wwat we need. we need court supervision. liz: be found at judicial watch. was the judicial watch audited on of the irs in the '90s? >> yes, it was not by accident. a week later, i got a letter auditing this come asking for my political affiliation. and we were cleared, obviously. but that was an intimidation tactic and we see and hear what the nsa. liz: larry, thank you for joining us. with programs on the nsa, no wonder americans are fuming. a new gallup poll shows that nearly three out of four americans say big government is the biggest concern in the country, easily beating out big labor and big business.

we have cranky we. >> or the department of justice tapping the phone lines of the associated press and other journalists and another situation where does the government can't even protect or help the people there. and you also have obamacare. not only for not providing people health care, but it's taking up the there with the people that already have it. i think the promise of big government under barack obama is proving to be a big lie. liz: here's the thing.

there's a lot of concern on the part of americans. >> we see the big growth of government and how individual liberty is being undermined because of it. and just take the smart phones. if i send an e-mail and i've got governmeet looking at it. if i make a phone call and do a google search. they are in danger. if i enroll in obamacare, and if i have kids with the common core, my kids information is in washington. so this is in violation of our rights and our privacy and as americans. americans are becoming far more aware of the dangers of a centralized power and big government. liz: you know, craig makes an

interesting point. that is that americans are becoming more aware. jennifer, here's the thing. i am not equating the united states and south american country. but i will say friends of mine in venezuela and other parts of south america have said that americans should wake up because we were the same as you and here comes the government encroaching upon us, we ignored it, we blew it off, we set it aside, and the government is on their back doorstep. >> i think that is correct. look at china. in 1949 from the communists came in and they started to take away this and said we're doing this to keep you safe. and enact programs and i'm not making a statement and what i am saying is that this idea that there is some type of government and the greater angel that is going to come and take care of you, whether it's the president or a bureaucrat or someone else, it is just not possible. the only program that can take care of you is yourself.

if you put your own freedom and power into the government, it will continue to amount to this for yourself, it will take away your rights by taking away your money. by undercutting economic power in and removing your other rights. that is exactly what we see happening. liz: americans don't want to live day to day worrying about what the government does. they just want to say, okay, the government should go do their thing. i'm paying my taxes. but what jenna as saying is that government is populated by human beings just like us. and we need to be on guard, watch out for them. what do you make of that? >> absolutely. it was said that government corrupts and absolute power corrupts absolutely. the fact is when you have bureaucrats, controlling without accountability.

and this is the danger of government and why it is so important that we have individual liberties. liz: it's interesting. because there's no downside to this. but as nicholas said, the czar nicholas said there are unaccountable clerks and there are a lot of them. but what you guys are talking about. it's of the regulators and government. >> it wasn't a happy ending. >> can you find the point quickly? >> absolutely, what we have to do is get control of the bureaucracy and downsize it, moving in the direction where we have the irs abuses, the potential government abuses. liz: next, cozying up to the

president obama a copy of this movie. so what do you make of this? >> i don't think anyone should beesurprised. hollywood has been the biggest backer for the last two election cycles both locally and also financially and i think it would be big news if barack obama actually turned down a meeting to hang out with leonardo dicaprio and martin scorsese. they have been hanging out with award-winning actors and directors and it's a lot easier and more fun than governing and so nobody should be surprised. liz: his character was a really bad guy. he was a really bad guy, he took money from little old ladies and dispense it on cocaine and anything that he wanted. really decadent, really hedonistic. you think the white house is making hay out of this? >> well, i wouldn't be

surprised. it's in the script for barack obama to paint himself the champion of the little guy. and so here is where hollywood lacks creativity. for the last three decades we have seen movies about how wall street is just a bastion of financial irresponsibility, that is nothing new. if martin scorsese wanted to be a vanguard and produce something out of the box, there would be a movie that focuses on how big government and big business work hand in hand to screw over the little guy and to have these crony type of connection so we have connections that we have seen ripley with the obama administration where taxpayers get a deal on those who have political connections benefit financially. but yes, again, that would put the obama white house under the microscope and hollywood is not going to do that again. liz: okay, so you're saying that cylinder the movie is not coming.

[laughter] >> it's not just well and drive. again, we have seen wall street as evil over the last three decades, and it's nothing new. but the real story underlines that theme is how big government is always the enforcer to make sure that those with political connections make out financially whether it is through eminent domain and there is example after example of of this and hollywood will always make wall street in general perceived as evil and villainous. so again, it is a pedestrian storyline that we have seen over and over again. liz: thank you so much for joining us tonight. we appreciate it. next up, five years and 10 billion bucks later. neil cavuto's warning about this that he gave five years ago today. see for yourself how his stunning production came true.

liz: president bush says this bankruptcy is not an option. the auto companies are still scratching their heads about what kind of a deal. >> every country. every country is doing it. the europeans are doing it. >> everyone seems to have abandoned their responsibility. and the banks said they are too big to fail. auto companies are too big to fail. everyone is too big to fail. liz: five years later, taxpayers

are out $10.5 billion a bad deal then come and an even worse deal now. matt, what do you say? >> well, i just think that it is okay to fail. in the economy when companies fail, it gives he gives us opportunities for other investments come in. and this includes company getting ready for the bad economic times. the person who loses is ultimately the consumer. liz: the treasury did invest the dice and it could've been said they structured it wrong. what do you make of that?

>> ford was a pprticipant in this is part of the tarp setup. liz: will hang on a second. >> ford took money because they were afraid of the competitive disadvantage relative to chrysler and gm. the government took their share and general motors. it's not alone. the government could've sold that and they could have sold them then or later. but the risk of not doing that, 2.6 million jobs. and you avoid having to pay unemployment benefits and pension benefits in excess of $50 billion. they have invested $10 million in infrastructure in this

country. this is a bipartisan program. >> i just want to make a point here before i get back to you. you want to save jobs and gm, with a net destroyer in capital between 1990 and 2007. and there's a lot of help from the u.s. government. so what do you make of that now that we have these jobs there into chinaa >> it was over $70 an hour, which is uncompetitive with this market worldwide.

and it made sure that those wages were not reduced. so literally the company with the obama administration's help, not able to compete on the global stage of its great that they have this. >> they are not always able to finish. >> let matt finish his point as well. go ahead. >> we saved a million jobs, here's what happens. competitors come in a move in and end up hiring one of those employees. so this is untrue. we made it harder for companies to compete in the marketplace. >> general motors has had 16 consecutive profitable quarters

and i will take my real 2 million american workers can you imagine the psychological impact that this economy if they let the automobile industry be a part of this? liz: you hit this important point very well. but this has been a part of decades. >> that's right, they really gave away the access to the company with these contracts. and over time the government did not allow the marketplace to work to make sure that they could be a part of this and this

we have 17 democratic seats up in the midterm. >> my guess is that the way that this sort without overtime, people who are eligible for subsidies or medicaid or have it with the existing condition where a catastrophic illness don't think that this can be popular. liz: may be to your point, let's get to another result. and 56% are saying that they are not going to get insurance by march 31 in what you make of that? >> if massachusetts is any indication, people did wait until the last minute, but ultimately those for whom will be a better deal than it may be

an economically smart thing so thee can kind of take their chances, the young folks, for them it's only a 95-dollar penalty. the cheapest insurance out there is two or three or $4000. and we will just have to wait and see on that. they will look at the senate, they will pick up the seats. but will they pick up enough to get control? liz: i asked my twitter followers about what they thought of michele obama. they said make a christmas tree dinner and talk about health care. there's a lot of cussing that could be goinn on is one of the responses. also, obamacare is one gift that could be rejected. and maybe we an change and maybe we could change the words to christmas carols to reflect

this. what the thing? >> people should talk about it. and folks are trying to get together to talk about this. by the end of year what they are trying to do is encourage these discussions because of an important decision. >> are they encouraging discussions? remark while, both, they are hoping to do both. the. liz: that by turning him into a potential government ensure that. >> well, i hope it hasn't hurt his album sales. liz: they apparently have a machine that can melt 600 tons of snow. >> everyone will say do it. >> how much power does the government have? >> of you declared an emergency and said don't do it i can't see it happening. and it's really just speculation that's not going to happen. the. liz: chris christie made a lot of commercials thing that we are stronger than the storm. >> plus, if there is any place they can do away with snow, ii is buffalo, new york. so i'm sure that they will take

liz: welcome back. if you shop at target, you could be the target. america's third-largest retailer, saying that 30 million accounts were hit in the second largest data breach ever in history. in ever in history. in all of it, 1800 stores impacted and every type of payment data was compromised. and it has all been happening since black friday, even since before the thanksgiving holiday weekend. we have consumer guru kristin fans to discuss how you can make sure that you are not hit next. let's just go through what we think happened so far and we will take it to you first, michael. and by the way, you are the former homeland security individual. this could've been now where that was in the point-of-sale swipe. it's not an internet problem. what you make of that? >> that means people online did

not happen to have a problem. the secret service is very involved with all of the financial aspects of this. >> has to o with all of the financial transactions. and this is scary. liz: we had t.j. maxx, citigroup, we've had other retail companies getting hacked.

and this is really going to make them wary about going through. and let me just back up. it could have happened right at the point-of-sale. is that what you are hearing at this hour? >> yes, that is what i am hearing, the same thing about possible now where happening. and how frightening is that? liz: and here's the thing. >> in new york this would definitely fall into that where they have gotten notified and the folks could've been having their information taken. but it's not really uniform across the nation. but what they should do is if you shop at target between the 27th of november through the

15th, call your financial institutions. colin freeze your credit. if anyone wants to take this out liz: who is liable here? is target liable? >> it depends on the unsettled law in terms of what happens. >> so if i am a customer and i go in and i get my debit or credit card hacked into, i can go to target and say that you have a problem with this and it's your fault? >> yes, there is insurance for that. the company help them fund these types of litigation. liz: what you say to the retail customer shopping for the holidays? they see this for a pop pop-up and they are like, holy mackerel? jug on the internet? shush up on the internet.

>> and it's part of a hassle and have you seen that retailers are out and saying to the world that we were hacked. the thing about retail right now they have very antiquated ways of dealing with the consumer, which is so counterintuitive. and they have this up-to-date data.

>> apple is a big headline. but they can do whatever the machine tells them to. soon do you think apple will risk the brand? >> as far as investing in apple, i think that this is a fairly valued product. the bigger problem is that it can't deal with the mobile market. and i think it's a by. liz: i'm a little worried about the web camera, though. [laughter] and here is the reality, it is really based on innovation and

the next product launch. we are going to react to that. >> so when you think of this? apple is looking great through the holiday season. and you know, this is kind of creepy though. >> they are dominating the consumer in the real problem is the business communities and the governments might actually be less reluctant to go into this market. >> it is frustrating. liz: we will put you down next

time. and new warnings, the u.s. economy is going to stall out. rising costs next year. things could get worse. should we be worried? >> port is a dollar maker. so they are saying maybe 3%. still moving in the right direction. and so this has been a healthy robust turnaround from the financial crisis and you have to be reasonable is a lot of cost

and that is one thing that needs to be a little bit. it's not going to be as good as 2013. liz: we have talked a lot about this. they are hoping to come back and make these big-ticket items. >> yes, they are taking the risk on that and that is fantastic, betting on their future. i think with the economy we know that the interest rates have been at zero. and so i think they might actually have this as well. liz: what about the other warnings? >> there are certain product lines from a non-robust recovery will affect the bottom line.

something liklly helps. because they didn't sell as many cars in last five years. but they could have if the recovery was stronger. so there's a lot of pent-up demand in those cars at some point are going to going to have to be bought another positive thing. liz: i hear his music. in the nightcap is with us. dominick, what are you looking at tomorrow? >> there are stock options and futures. in the programs are rebalancing and that is typically going to be a very volatile day. and we are doing it on a friday. and it's a slippery and rocky right now. and we won't see the dow jones hold about 1600. we are passing is and it will be smooth sailing.
