covered. here to lay it out to enjoy a little piece over holidays. john fund and radio talk show host and fox news contributor, monica crowleyly. ben, let me start with you, you were at white house with business leaders, insurance industry people. what is the administration doing to decouple, it is so complicated. make sense of this. a lot of us are just lost. >> i was at the white house last wednesday with about 50 business leaders and the overwhelming feeling from everyone in the room was the confusion and then the costs that this is going to either cost individuals or their and i can tell you this. that the administration, the first word out of that their mouth was, this rollout has been a disaster and they're doing everything possible to try to get things fixed as they can. adam: john, let me start with

you. if the administration is calling the rollout a disaster where do we go from here? titanic? they will not scrap it or i would say do you scrap it but they're not doing that? >> they're delaying on installment plan. they do have a plan. they don't want to admit for reasons of politics and humiliation, they're delaying it. piece by piece everyone will be a hardship case and everyone will not pay the penalty. it is inevitable. adam: monica crowley talk likes to talk power, truth to authority. i thought we were sar castingly glorious leader bequeathed everybody a delay. when i heard there was delay, what are the mandates now? who has to sign up? who doesn't? how can do, insurance companies have to pay for this. how can anyone make heads or tails on this? >> yob can. i'm not sure the white house knows what is going on. insurance companies don't know what is going on.

i spoke to two doctors last week. they don't know what is going on. certainly consumers don't. thissis the 15th unilateral change barack obama administration made to the law without congressional approval. is any of this legal? we don't even know. here is the picture, we were correct it was always a frankenstein bill and more of a patchwork and frank stein bill. they're making ad hoc changes on the fly. we can all agree it is sort of imploding on itself. what i think they're actually doing. you're seeing a controlled explosion here because the ultimate objective was always get to us single-payer, ull-on socialized medicine. there are things happening beyond their control or maybe not on the timetable they anticipated but i guaranty you what they will say is, we tried the private sector. we tried going through the private insurance. we tried going through the exchanges. it didn't work. now we have all these people sort of locked into the system. we can't let them down. there is only one way to go and that is single-payer.

adam: ben, i want to ask you a question. i think administration did something mo american could ever do, make people feel sorry for the insurance industry. at end of the day if you don't get young people and healthy people signing up to pay for this it can't work and insurance companies take a hit. eventually those of us who are customers of insurance companies we will take a hit, will we not? >> that's a great point. just a couple of things on that.is, number one we're expecting some of the largest increases for small group insurance plans in the colling year in 2014. then let me tell you what we'll be talking about in about two weeks. all individuals enrolling in obamacaree they enroll through the healthcare.gov but pay the first month's premium to the insurance company. what's going to happen on january 1st, consumers out there need to be aware, is that the first time they get a prescription filled, first time they try to go to the doctor or take their family to the doctor, that is where they run into the problem. maybe they haven't paid the first month's premium.

two weeks from now we'll talk about all the individual who have enrolled and having props now accessing care. adam: john, do you think given what ben just said and monica talked about is the grander strategy for single-payer down the road? is that where this is headed? >> no, because i don't think congress would go there because obviously single-payer doesn't work in britain and doesn't work in a lot of other countries. i think what they are going to do is stuff the mouths of insurance companies with cash. there is something called risk channels this basically subsidizes insurance companies with transition costs. without going to congress i think they will take several billion dollars earlier next year and say to the insurance companies, look, tteat these people. enroll these people. adam: is that legally? >> excuse me. the courts will tell you in three years. they're very short-term oriented right here. if the courts catch up and say unconstitutional the money will be spent. catch me if you can. >> that is the point, i agree

with you a certain extent but not wholly. they have done everything out of the box, extra constitutional without congressional approval. there is nothing stopping this administration moving us to single pay other outside of congress. >> they would say to people, you know, you're enrolled. unless there is absolute proof you're not, you're on medicaid. they can, i would not put anything past them. >> ben, i think numbers, and i was getting confused as often happens when you're me during the press conference president was talking about different numbers, million people enrolled. 3.9 million part of medicaid. at end of the day i was looking what y employer was paying for my insurance. i don't see that coming down. several thousands of dollars i contribute but twenty-first century fox contributes a much larger portion. none of the affordable care act brought that down. that is not going to change, is it? >> again, like i said we're expecting some of the largest increases, higherrer deductibles, narrower networks. access to care after

what is value in your life, 50% off. you want 57% off discount. melissa: adam: bruce, let me ask you this question because kevin roberts brought up, if you discount products you ruin the brand. are retailers shooting themselves in the foot with all these discounts? >> they sure are, brian said it. once you think a price is only a price until you fet a discount the price doesn't mean anything. there is no price value continuum. i will wait for 30% off. i will wait for 40% off. i will wait for 50% off. products do not have any value. that destroys brand values. adam: what will happen between this moment and tomorrow? are we going to see a rush of shoppers going in thinking they're getting even better discount and they will get the discount? bruce first, then brian. >> they will think so because they will not go into the stores without them. that is problem. become as self-perpetuating cycle. i will only shop where i get a

discount. i will go to the store where they give me the most discount. you have to get going. you will grab the discounts. that is why they were email bombing you by the way, they're hoping in the last moment you will be desperate, you will take discount and run. adam: brian. >> no dice. here is real deal. inventories continue to rise. rising second week. clearance going up, lord & taylor, gab, 50%. >> they have one month and a week to liquidate the inventory and bring in new goods to hope the sales floor is amazing much. adam: banana republic had 50% off. is it bettory wait until after christmas? why not wait until the 26th. >> that's what we're seeing. holiday season is elongating. no longer about giving gifts on christmas. they're going day after christmas for people not part of the immediate family. adam: would it make sense not to buy the good and say, buy the gift card, you will get a better discount on the 26th, go at

it? >> it would make more sense for people to enjoy the holiday. actually spend the holiday together. have spirit why you're celebrating and then prices drop. go in and get these incredible discounts to buy whatever it is you want. adam: looking at this from the national retail federation predicted 3.9% increase in holiday shopping. are we anywhere close to that or is that pie-in-the-sky, bruce. >> we'll wait and see. what happens every year, you hear all the predictions and people saying there are no more sales. there are lots of sales but when you know it is almost the hour and kids will be up and opening packages the question is, are you willing to wait or not. adam: brian, are people willing to wait? >> those predictions are completely out of this world. mr. market, to bring investing angle, mr. market knows this, average retail stock is down 7% since last friday. sears down 30%. jcpenney down 20%. they're worried about profits. stock market knows this. adam: sears and jcpenney were troubled long best holiday season.

let's get into statistics here. sales for friday and saturday were down 7:00% compared to last year. this has to worry retailers of the especially inventories are rising, not depleting that will be trouble. good for us consumers but trouble for retailers and their stocks. >> absolutely. one name i tweeted out exclusive for fbn, picture from walmart. rising inventories in seasonal categories. that is not what you're supposed to see. out of stocks in wrapping paper and lights. look for massive earnings warning from walmart in february. adam: bruce, might we see the discounting disappear because they have cheapened brands they have to rebuild them? >> that would be the smart thing to do. one retailer will get nervous. they will up discounts. others will fall into line. this would have to be mass movement. i don't see that happening. adam: i will draw that analogy detroit. detroit bankrupted two car companies by offering discounts because people came to expect them. brian, if we come to expect the discounts where we started this%

discussion, brand and product don't have value, how do we as consumers know truly what we're paying for? if we caught up to the game, giving me 20% off but probably markedded up 20% before the sale. >> consumers will wait for discounts and not shopping stores. they're getting lowest cost price, allison. they don't need to go to stores. reality they're one and done. they're not buying. not going to the stores. it is more expensive trip to visit stores and buy something on line. adam: mr. johnson at jcpenney tried to do craziness of discounting to cheapen the brand and he failed. does that mean we'll never see a store do that? >> he failed miserably and he is not in the job. stores will continue to do it. discounts are a race to the bottom. what is ultimate thing? giving products away for free. that's where they're moving. this is big problem. adam: brian and bruce, thank you

for joining us. money is flying around the world today, first in the netherlands, they offered tiffany's to pay half a billion dollars to settle a lawsuit. that lawsuit was from accusations, tiffany was backing out after joint venture both companies entered into in 2007. it was a 20 year deal for swatch to make watches under tiffany brand. in addition to the 449 million bucks for compensation and they have to pay $9 million for swatch's legal fees and plus the cost of arbitration. in u.k., british retailer marks & spencer under fire after a worker in london store refused to sell champagne for religious reasons. according to the report the employee asked a customer to wait before calling another staff member to handle the sale. thousands of customers took to social media and threatened to
