don't forget to record the show if you cannot catch us live. have a great night. ♪ ♪ lou: the obama administration connection of scandals and lives have led to inevitable comparisons to former president richard nixon, and to the the "washington post" released a statistical analysis confirming the comparisons. nixon, the only 50 years -- this year president since world war two to post lower ratings in the polls than where president obama finds himself tonight. i'm lou dobbs. ♪ lou: good evening, everybody. the washington post survey released a damning poll of the obama administration. the presidential approval rating at the end of his fifth year in

office has fallen to 43 percent with a disapproval rating of 55%. the post riding of the findings, president bush had a 47% of parading at the end of the fifth year of his presidency, and all other post-world war two presidents had approval ratings above 50% with the exception of nixon. and the numbers get worse. when asked who they trust to do a better job with the nation's problems, respondents have the president now tied with congressional republicans at 41%. only one year ago the president had a 15-point lead, and now is gone, all gone. the president also trails republicans on the economy by four points. last year at this time president obama held an 18-point lead on economic issues. the revelations of scandal after scandal, the declarations that have turned out to be lives and

the failed rollout of the president's health care law have contributed mightily to his nose dive in the polls. mr. obama's spokesman, jay carney, today admitted that the president's thinking numbers are hurting his credibility and effectiveness with congress. >> does he really still have the clout to move the public, move the congress on these big issues and his approval ratings continue dissing? >> well, again, you will not hear an argument from me that everyone in washington is taking a hit. lou: and more port timing for the addinistration coming after the post nixon comparison. president obama himself today praised the fictional congressman frank underwood from hbo's hit show house of cards, a congressman and manipulates his

way to vice-president see by shady deals, lies demand ultimately murder. [laughter] >> i agree with kevin spacey. lou: our first guest voted in favor of the ryan-murphy compromise. he says without agreement we would face another government shut down and stresses that the deal eases the burden cost. joining us now a member of the budget committee as well as armed services committee. good to have you with us. i know that you and many of your colleagues in the house, particularly those whose style yourselves as conservatives russell mightily with how to vote on this. what was the deciding -- the deciding point for you in casting your vote? >> well, thank you for the opportunity to talk about the critical topic for our country. the alternatives before us were this.

five voted no we would have that continued, continuing resolutions where we find things that did not need to be funded and are not finding things that should be funded. i have been among, i think, the strongest advocates for returning to regular order where we have a tough line budget and have agreed to that in this agreement and then work through the appropriations bills. i told my colleagues -- go ahead it. lou: and if the senate approves -- then it is almost a certainty that they will approve and move on car regular order will be restored. we are talking about maybe $5 billion against a budget in excess of 3 trillion that does not amount -- this is not even really small potatoes, not even really short cotton in terms of the financial numbers. in terms of returning to regular order and establishing a budget for two years after successive continuing resolutions that make a mockery of the budget process

this is a big deal. >> it is really a big deal, and and i am in a season of public service, my first elected office , and this is the first time i felt like i could come home and come before this incredible district that are have the privilege to serve, more men and women in uniform that any congressional district in the country, a lot of defens. this is not just protect home base, but i have the privilege of working with our, not marine -- commandants marine corps general. i said, if you are inclined to vote no, come with me and meet these good men and find the direct and very real damage that continuing resolutions combined with sequestration are doing to our military. i said, let's get back on regular order and get on to mandatory spending is that is the principal driver of our fiscal situation.

lou: what is your reaction and your thoughts and concerns about the cuts in cost-of-living benefits for retired military persons under the age of 62, the provisions, the benefits. >> i answered questions today. the very last question was on this. i knew that this question was coming and all my colleagues that we were going to have to wrestle with this because it is a reduction. what is not being shared in the media more often than not is that when the service member does reach 62 that that cost of living increase where they did not participate in all these years potentially, they get caught up at age 62. for those who are wounded, our wounded warriors, there is no reaction whatsoever, but there is a reduction of 1%.

it is a difficult decision. that is why it was not easy for me to vote for this. i pull this voting card in my coat pocket out, and i have a choice green for red or yes or no. i wish i had a different choice but and there. i looked at the sum of all of this. what is so important is that now that we are going to return to regular order there is no excuse for any member of congress, republican or democrat to not get on mandatory -- lou: fair enough. is there any excuse for the republicans or democrats to put the country in a position to shut down the government after the new year as you move to the next issue, which is the debt ceiling? >> i struggle with this as a businessman. i am still an owner of a business.

it would deeply affect our business if we went into any kind of defaults, but at the same time i do not want to enable what i so despise which is washington spending more than we are taking in. lou: i understand, but people are just out right sick of seeing the republican party. the republican party that has had the choice to make here, shutting down the government. you guys have shown such great judgment, level, good headed, common sense in dealing with what is, as i said, symbolic numbers, but an important return to regular order. surely you're not telling me this is the republican that through that all away and the debt ceiling. why not go to the pole with your argument and stop this nonsense? >> you are right on track, and i think that every candidate, whether they are an incumbent or new candidate a's to be asked

this question. what specifically do you propose? mandatory spending. do not let those candidates get away from that difficult question that must be answered. lou: what question can we posen telmex november? i'm asking you right now, is your committed to avoiding a government shut down? >> yes, they are. lou: i will take what i can. the time that we are allotted. >> i understand. we should not shut the government down. lou: no, sir, we should not. >> we should not wrestle with mandatory spending. lou: i urge the republicans if they feel strongly about it, get out and get a ground game going and move voters to the bold because that is where the answers lie, not in the maneuvers that cost another shutdown of the government, and i applaud the republican leaders for moving forward.

the erin a war, eastern kentucky for example. lou: so why in the world is the industry putting up with it? there was a time when you saw people getting, i mean, just screwed, and they stood up for it. the politicians had a clear, loud voice. they're just getting rolled year. >> they are fighting back. trying to fight back in congress, but they have been somewhat dysfunctional. even if you win in congress he still have -- taking this deregulation process, using the epa with the standards that would affect the building codes, and he is getting ready to put out standards for existing coke plans. lou: and wearing just about everyone out with the epa. you guys have cleaned up your act. you are using it in a much cleaner fashion, and get the epa says, the hell with it.

them, basically, in idiots. they're seeing, a war has been declared. meanwhile, i don't see what the alternative was to what boehner and ryan did. and i support fully the tea party. i think they're one of the most vibrant and strongest expression of this country in decades. what is your view? >> i support the big tent. but i also understand and expect government to work, and i think that is what you saw. i think you will see that in the senate. it may be a little different process, but the american people want us to have a budget. lou: are you kidding? you have to be getting. there is nothing delivered in about this senate. it was once the case, but the is now in the wrong hands. the senate has screwed up everything that they touch. they are acting, i think,

the wash tone poct lou: the "washington post" fact checker released its list of the top-10 allies of the year which is a lot. we thought because it is television we would bring you the five worst. let's start with number five. five, president obama's claim that the day after benghazi he personally and knowledge to it was an act of terrorism, not so much. not -- number four, house oversight committee chairman, his p then secretary of state hillary clinton had signed a drawdown of security for the u.s. embassy consulate in libya -- libya. not so. number three, the president reasserting the claim that the capitol hill janitors would be getting a pay cut when the sequestered "chalk talk."

number two is the nra. this, again, remember, the "washington post," protected by armed guards at their school, the president's kids. well, the post disagreed with the security guards and said, in school do not carry guns. their security guards, but they are not arms -- arms. although the secret service protecting the children are, indeed, armed. i think they could have been somewhat more reasonable there. the worst light of the year, are you ready -- because he has been saying this for four years , president obama's oft repeated assertions that it feel like your health care plan you can keep it. we will take that up with the "a-team" joining us now.

>> well, i think they're inappropriate in any prison to have them and have people who committed relatively trivial crimes engaged with them. the fact is we all make that discrimination. convicted murderers are well behaved inside can be transferred to a part of the prison the you can see and mock the very idea of justice. lou: and a good time for a rapist, murderer. this is -- how does all of this began in? there was, you know, sheriff joe are pile out in arizona, he had, you know, pink jumpsuits or has pink jumpsuit for prisoners. he does not give them any meal beyond a bologna sandwich for lunch, and he is considered to be a very harsh and hard character for so doing. how do we get to the point that it has become an entertainment planned from many?

>> well, justice stops at the prison door. that is the irony. that is where it is supposed to start. we measure the seriousness of the punishment by the length. how many years in prison, but not what the experience is like. the essence of punishment is the daily experience of it. will we have our facilities that do not discriminate on the basis of the nature of the crime committed, but only upon how well you behave once you're there. lou: that put you in a context, the author of this book. do you believe in capital punishment? >> i do, but only for the worst of the worst of the worst. lou: what does that mean? based upon the number of people killed, how they were killed, the manner in which there were killed? >> it can be. aristotle first observed that evil is extremes. but fundamentally make someone the worst of the worst of the worst is the attitude with which he kills, and at one extreme there are this did -- sadistic

serial killers to take extreme pleasure in applying pain and torture. at the other end there are the cold, callous, 110, cool who don't take any pleasure. they don't care. i spent time with spray shooters, guys who would go on the corner and just mow down everyone. and there would be going after one particular guy that they want to go before we killed them. and i say, when you shot did you think about the fact that there was a group there and you would be killing people whose mothers and sisters and children with the grieving, people that you had no problem with? and the pause and the love between us was palpable. one of them i cannot repeat on air and the other one said, should have gone in a way of my bullet. that is a callousness, a coldness, a one mess. one of it is the measurement, the attitude, and the other is, as you point out, the consequence, those are multiple,

serial killers. lou: one person killed with intent, premeditation, capital punishment? >> premeditation is not the issue. it james stephen, an 19th century great thinker on this issue pointed out that an abused wife can mall it over. she cannot escape with her children. on the other hand she is beaten to a pulp repeatedly. she plans it out and kills her husband. someone else does down the road and sees a child fishing off the bridge and for no reason pushes him off to watch and struggle. the first one is a premeditated keller, the second is sudden and spontaneous. the premeditated killers is much less deserving of punishment than is the sudden and spontaneous. so premeditation is not the issue. the issue is beast sadistic satisfaction or the cold, callous once in this. the vulnerability of the victim.
