today. back to you. dagen: the first legal recreational pot shops are open for business in colorado due to long lines of customers and strong demand in the new year. adam shapiro from denver, colorado, with more. adam: this is the largest in denver. i am in one of their burrows. 20,000 square feet in which they grow marijuana legally. they are doubling their space to 40,000 square feet by april. they cannot keep up with demand. $2 million investment because as he talked about, legal marijuana for recreational use in colorado has begun on this second day it is about investing. how can you make some money on this? an ounce of marijuana, look at the video of the people who bought marijuana legally for the first time yesterday, an ounce will cost you about $400, the

year, one thing he kept saying about this new law is if you like your doctor, you can keep your doctor, if you like your health plan can keep your health plan. we now know for many people, that was false. not only was it false, they knew it was false when he was saying it. this raises the issue of the president's credibility. not merely on obamacare but as the president generally. the american public begins to pull back and say i can't believe the american president anymore, that the presidency has serious problems with its agenda. i think that is within the democrats are going to be watching. barack obama's approval rating continues to stay under 40%, which is kind of a tipping point for presidential approval. if this rollout creates more problems, house republicans starts talking about putting up repealing parts of it to a vote, you will find democrats beginning to join the republicans to push back against

obamacare. dagen: do we get past the point of being in power?g"@ >> extraordinary display of saudi arabia basically pulling back at the long-term alliance with the united states saying we are going go at it alone. last week they said they would ship $3 billion of aid to lebanon to bolster the army, the fact we are not doing anything. and you are hearing this all over the world, we don't believe the united states is going to be there when we need them. the syrian rebels feel that way. this has a generalized effect around the globe.

dagen: an analyst at jefferies take a look at a few retailers. take a look at urban outfitters. lauren: this is certainly a stock we are watching today. upgrading urban to a buy. they see this as the turnaround story. doing well in multiple channels as you can see the stock is up about 4%. jefferies making moves for other retailers cutting both abercrombie and fitch as well as erol postel, both down one notc. moving down accordingly. as you can see, they are all moving sharply to the upside. 6.5% gain for ann taylor. they are getting upgraded and

price target getting upgraded as well. dagen: the first storm of the new year make his way to the northeast, a foot and a half of snow in some places. fox news meteorologist is live for us at the fox weather center. maria: you're right, i have foot of snowfall across southern new england. the higher accumulations. one of those right now in pace across the northwest with ohio, indiana and even into interior portions of the northeast. but there's also another piece of energy out across portions of the southeast, both areas merging later on tonight across parts of the northeast coast, it will conclude a lot of snowfall.

nevertheless it is reports and we will continue to watch this story. back to you. dagen: now take a look at the legalization of marijuana for medical purposes using it to relieve patients suffering with chronic pain. is this a legitimate use, a growing use? join me now, assistant professor at the nyu school of medicine. great to see you. i was just personally curious about this with the recreational use and sale of marijuana now okay and legal in colorado. is there a legitimate medical use for marijuana with 19 states of the lower 48 making it legal for that? >> there is a huge difference between recreational use and medical use. studies that show marijuana can be helpful for certain conditions, helpful in cancer, pain and nausea. but the danger here is that a

lot of people want to use it recreationally, but they may be trying to get it to the medical bypass route. if you get a prescription, take this much, take this off for this long. but now doctors don't have a guideline to be able to do that because there aren't enough studies, it is not fda approved so you don't have the risks and benefits to explain if it helped or not. dagen: is their attention and medical community before discovering better ways of using marijuana for pain management? >> some have been done in the past, and we had a prescription pill form of marijuana which people don't realize. there may be others in other countries, but those are already out there. it is a controversy in the

medical community because if you have the pills available only certain physicians can prescribe them. not everybody can do it. people who need it can get it. dagen: is it cancer related pain or aid related pain? is it the same way the smoking medical marijuana would? >> it is prescribed, but has more guidelines. the other thing to think about is different kinds of pains. think about if you come out of surgery for example, you will be better off probably with a shot of morphine than having somebody pass you a joint. we really do need the states to separate out what types of pain it can be helpful for and what may not be helpful for. dagen: which area of focus needs the most attention figuring out applications of drugs? is it lower back pain? most talked to treat form of pain?

>> other it was low back pain, arthritis, using treatments and cures for that, but we would not have found one so far. just things that can help with the symptoms. i think that is a little bit naive. we should do more studies, but i don't think you can expect that. one of my biggest concerns is because people are turning to medical community, it is sort of unfair. if you have a doctor who will prescribe you marijuana and get caught with it, you might be all right. but if you did it on your own, you might get arrested, that could change your whole future. see two very important point. the drug communities struggling with the abuse of legal legitimate painkillers on the market. >> that is my worry.

it has gotten so much bad publicity. we don't want them to go away, but at the same time because they have an harmful to others, you don't know what will happen. if people have severe pain, they are already on medications, this is not the first thing we are taking. dagen: it was great to see you. it is great to see you. congress may have passed the budget before getting out of town for the holidays, but lawmakers did not renew about 55 tax credits, lawmakers will likely receive the credit one by one, but for the meantime they could leave businesses and individuals in the lurch.

hi, peter. peter: more uncertainty in washington over the breaks. congress usually extends them, but did not get it this time. according to the tax foundation extending all 55 of them cost about $74 billion. a deduction for individual state and local sales taxes, deduction for certain college tuition payments, investing in new plant and equipment, and the ever possible research and development tax credit. >> keeping those provisions going. it is going to be a food fight on capitol hill as these things get voted on.

down slightly 339,000, that is better-than-expected 345,000, but the four-week moving average is the highest since late october. macy's and martha stuart living omni media have settled their breach of contract dispute over product branding. the terms are confidential and will not be disclosed but macy's says the settlement does not affect the outstanding claim against jcpenney. more than $8 billion came up on one of the first days of trading in 2014. they sell the stock on concerns of swollen profit growth with the t-mobile division. reporting fourth-quarter earnings next tuesday. that is a very latest on the fox business network giving you the power to prosper.

dagen: shares of fiat searching in european trading after the italian automaker announced it

will acquire the remaining shares of chrysler from the united auto workers union. so how much business does this cost the italian automaker company? jeff flock from chicago, right? jeff: not as much as you might think. i talked to the company said "i don't know how he does it, referring to the ceo of fiat and chrysler. how did he get this sweetheart deal. as you point out, how do we know it is a sweetheart deal? look at what the stock did in milan. up 13% today up 1 point, the largest gain it had in almost five years. investors take heart, they may call list as we go forward. take a look at the way you invest in it now, that also jumped today on this news. why is so excited about this deal? some people think they have a

sweetheart deal, what one analyst calls a spectacularly good deal. the deal is worth about $4.35 billion. fiat put up some cash. a distribution of chrysler money of $1.9 billion another $700 million of payment to the health care trust which owns the 41% of chrysler, so essentially they bought chrysler with chrysler's on money. a lot of people who helped, some have some concerns about that. dagen would say we have been working our hot off. we ought to derive some benefit from this. so i think they have.

>> got me off the street. dagen: standing out in chicago, watching the storm that is hitting that city in the midwest. i don't know how you're staying warm, but i hope you are not freezing to death. >> 20 degrees outside the with the wind chill, 80 miles per hour, feels a little bit more like six, this has been going on for about three days now. the snow has been a foot in many areas around the great lakes, the snowdrift building up to several feet, the snow plows are out on the road. entire fleet has been able to be out on the streets almost nonstop for the last three days and that is expecting to continue today into tomorrow as well as we expect to get much more snow. much more in a minute.

claiming microsoft reading their e-mails. the constant threat of hacks and questionable surveillance programs, is this a sector worth owning in 2014? should you stay away from the social networking stocks? chief investment strategist in black rock, we don't like the social networking stocks, is this one of the reasons? >> it is based on some other factors. social media, some of the more speculative names in the internet space, this part of the market has gotten very expensive with investors extrapolating a lot of news. net companies trading 35 times trailing earnings, roughly double the valuation of the market, at the highest trading with seen since before the financial crisis, and i am less concerned about the hacking than the optimism of that space, leaving you a little bit nervous.

dagen: you do like some areas of text, do you not? which areas? select companies? >> would like the parts of technology such as hardware, traditional service providers, that are tied to corporate spending and capital spending. corporations as you know are very flush with a lot of cash on the books. we are seeing an acceleration with spending. these are the companies that will benefit from more capital spending in 2014, the valuations look much more reasonable. it is worth pointing out technology stocks are no more expensive than the overall market. one quarter of tech i want to be cautious about. dagen: the overall valuation of the market, you are comfortable with that, but that is given a range you have on the ten-year r treasury or the longer-term interest rates. if they go higher, all bets are off.

>> that is fair. i would describe myself as a nervous long. stocks will be higher, but a couple of assumptions. the first of which is better earnings growth. i think the economy is accelerating, so that is a reasonable assumption. the wildcard is interest rates. if the rise in rates is modest, the 10-year yield up 50 basis points, the market can live with that. a more pronounced backup rate not to hit for the stocks. dagen: i have talked about this, i want to know if it is legitimate or not. i worry about interest rates skyrocketing of individual investors don't want losses in the bond fund and people have laughed at me about saying the federal reserve is in control of it, but are they? something the federal reserve cannot control. >> this is an excellent point, this is what they should be concerned about. we know the fed will keep this

dagen: cold-weather the hot topic for energy traders at the cme. sandra smith is all over the natural gas story. sandra: it is worth mentioning they made it in today, but the streets of chicago everybody's complaining like where are the snow plows. we are heating up our homes even more, taking up more natural gas primarily what the midwest uses compared to heating oil which is mostly used on the east coast. 20 degrees in chicago today, temperatures expected to drop below zero by monday.

we've got and 16 inches of snow in some parts of chicago since new year's eve alone spiking natural gas prices. natural gas was already the top performing commodity of 2013 up 34% for the year. already offer spectacular start. the second-best performing strategy already only two silver getting a big pop in the trading session so natural gas $4.31 per british thermal unit. while gas prices were rallying on the coldest start to a winter in over 13 years, we're now seeing it rally what could be the coldest start to any year in quite some time. 49% of the country uses natural gas to heat their home, the rest uses heating oil. they are actually down a couple% today, the reason for that is we have inventory report out tomorrow from the government, it is delayed until friday because of the holiday expected to see those numbers selected to be up which will be for heating oil

back, taking a back seat, forget it, we don't like these laws, they are not working, concern too many miners are getting hold of this or concerned about gangs, things the fed said debris interested in and concerned about, the way these rolled out makes us more concerned than we have never been about these laws so to heck with it, we will start going after the dispensaries, the users, they can go after anyone and everyone they want to tomorrow. dennis: for the first time we have 19 states legalized marijuana so you have patient needs, millions of pot smoking customers that are registered with the government's. could the fed's goal after that? >> not only do you have those patient seems, the states in order to make the fed happy right now have to heavily regulated and one of the things they are supposed to do is create these tight regulations dealing with patient means so there is nothing to suggest that

the fed couldn't attempt to infiltrate those particularly with respect to the recreational users with a privacy related defuse are not going to be the same, raise some privacy concerns with respect to those using it for medical purposes and even though -- dennis: it is legal to light up in colorado, there are plenty of other parts of the system that haven't changed. for example the irs makes it illegal for a pot business to deduct the cost of business as every other business is allowed to do. >> they can't deduct anything at all, absolutely true, also talk about banking rags that exist federally make it very hard for people who deal in marijuana to intersect with the banking system at all, talking about cash business. these are dispensaries that will be holding lots and lots of money on a cash basis.

year? what is your overall forecast, phil? >> let's ring in lower prices for new year. it will be probably be a new year and new era for lower gas prices of the credit the u.s. energy industry. we're producing more oil and expanding refining capacity. we're able to produce more gasoline than we have than before and demand is getting weaker. the outlook for prices next year looks even better than next year. we can see the national average fall as low as 2.37. we're getting off to a new trading year at a good start. look at oil, down two dollars. that is good for oil prices. we're seeing a big drop in brent crude. that helps gasoline prices. we're seeing rbob futures down six cents a gallon. we're starting off way we ended with lower prices. back to you. cheryl: phil flynn, thanks, phil time for the west coast
