not exactly a neutral observer. she has donated $6000 to the president's campaign through the national democratic party. that does not make her a bad person. but clearly, the abuses of an irs exist with a political witchhunt. let's try to keep the politics out of this. but politics is what really started august and was behind all of this. so the president in charge of fixing a, lets just say i'm not holding my breath or any progress getting to the bottom of this. so what do you make of this? >> i think this was a huge mistake. again, nothing to disparage the credentials or capabilities.

but the day that the appointment is one that is part of "the washington post" and the major donor of the obama administration is over saying the conservative groups and that is not a headline that you want. from a legal standpoint, just put the politics aside. this is not how you conduct an independent investigation. i have clients that the fbi will want to speak to and we know that's part of the process. so wait a minute, am i going to subject my clients to this kind of oversight and is this the right way to go? and also we are suing the irs. so the information that will come up in the course of investigation by someone who has a political motivation or even an agenda. this is not simply a question of tax deductibility. this is an acknowledged

targeting scheme that the president himself said was outrageous and that eric holder says maybe criminal and the end result is after waiting nine months, they've finally appointed a team to have this up and there is a political situation. neil: any appointee of the president by and large will have political loyalties to that president. but my issue is this whole scandal was driven by a political agenda in the first place. so a justice department spokeswoman issuing this statement to us. it prohibited personnel practice under federal law consider the political affiliation of factors in making personal decisions, removing a career or case due to political it affiliation and they could also violate the law.

what strikes me there is what we are dealing with here. that is what we are trying to address any way they choose someone who has a political agenda here. >> with all due respect to the department of justice, i worked with the treasury department before and let me tell you that the problem is barbara boxer accepted the assignment and she should have said no. it would be in the best interest of the department of justice for me not to talk about the announcement and i'm the person doing the investigation here. number two is that she's not up for a promotion in considering her political views. this is an irs investigation and criminal investigation by the justice department against the irs with a civil litigation pending.

1500 lawyers you can choose from and what happens one happens to be a maximum donor to the obama administration and again, she has the right to make donations but she should also step aside and have this kind of case. i just think that is bad form and it raises significant ethical issues and it has caused us to pause as the fbi is asking to talk with clients. >> so would you advise them not to talk to her or me with her? >> i will tell you that we just had a meeting on this moments ago and that includes two of the lawyers on the phone as well and we are sending a letter saying that we are concerned and we

have serious concerns with that. and we have to be because obviously this has changed the dynamic definitely. >> thank you very much. you find it at all surprising that this is developing? i bet you didn't even know it because there was a lot more attention being paid to chris christie and what anyone he knew it about bridge traffic a few months ago. herman cain is not at all surprised here. but what you think is going on here? >> here's what i think is going on. this is intentional distraction tactics. first of all if it were going to be an independent investigation, the first mistake was appointing someone from within the justice department. and the irs has rewritten the

rules they put out for public comment right before thanksgiving and they got over 10,000 comments already and they have rewritten the rules to try to put greater restraint on conservative antiparty groups. so when you take that along with someone from the inside rather than the outside, they're not trying to get to the bottom of everything in this investigation. allow me to give you another reason as to why nothing will come out of this. if you remember the bowles-simpson study were they made recommendations to the administration. this administration, the president didn't implement not just one of them's the ones you're talking about collecting dust? >> exactly. and alan simpson and erskine bowles, they had no skin in the game. they were trying to lobby for a political appointment. and so it gave the results much more credibility.

and so there is no way whenever she comes up with will have any credibility at all. this is a joke and they hope that the media pays attention to it for part of that distraction strategy. that is all. >> we now know where they like to be a part of this. whether it is criminal or whether it will doom the presidential prospects. i'm not interested in that. but i think it does reveal quite clearly where the media seems to be placing the interest right now. the very real and ongoing scandal and something at least that happened some time ago. >> yes. like you, i consider this whole irs scandal much bigger.

payback may be the least of it. the fear is that investigations, as they continue, and the poll numbers likely drop, that his big backers will drawdown. i'm talking about the high rollers talking about maybe becoming president chris christie. just how likely is that? >> i think that a very disturbing narrative was painted of him where he barely mentioned mitt romney. this is supposed to be the explosive moment but it wasn't. >> i was nominating speech that we are 60 minutes in? >> yes. >> weeks before the election, and this scandal was another disturbing picture of him not being honest. i thought he was humbled and i thought it was her flushing.

so i found it that i liked him as i watch that. i saw a man who is humble and came and asked for acceptance by the american people and i like it. neil: he didn't say sorry and see later. he stuck around for close to two hours and i believe that is one of those longer ignore the longer press conferences that we have seen in so how do you think he comported himself? >> i think that he did pretty well and he took all the questions in a nearly two-hour press conference. the only question is will his story hold up and if it doesn't, this could really kill his political aspirations. because he didn't know his staff was during. and how he dealt with it was actually set one up putting it behind him.

and so this is an ongoing story and so if he really didn't know about it, i think you can survive it. but there are holes poked in the story in the weeks and months to come he's in trouble. neil: we were talking about how this affects the big money guys and they have a good shot at winning. chris christie was getting a lot of their money and not all of it, but a good chunk of it. so does they give some of them cause? >> i think he recovered very well. i would say i believe in this guy. particularly when paralleled next to obama. and this has been watered down and i think that that parallels

and if i was a done i would not be hesitant fter today if the story holds up. neil: comparing it we didn't see any heads roll. in the case of governor chris christie, at least two heads roll. so what does that mean? and does that actually sort of reinforce this image? >> this is clearly a test of chris christie. and it's easy when things are going well. this is a test and i think that he is past it. and we are having a press conference today and i think it was a good move. the problem for chris christie is that he has critics on the left and the right and i know you have interviewed mark levine who is not a big fan of him.

and this is following the example. former massachusetts senator scott brown on the message. it seems out of date now and i don't want to be jaded. but what happened? >> i don't think it's out of date. as a matter fact i remember reading that portion of that speech in the massachusetts statehouse and if you look back at what jfk said, he said that leaders will be measured by answers to questions and you noted them as courage and judgment and integrity and dedication and certainly he showed courage by coming out in accepting responsibility in dealing with that. and he showed a good way to handle it quickly and effectively important. he said he is exceedingly dedicated to his job through so many difficult challenges. so i think that what is relevant

is relevant today. and from whom he divorced himself, claiming and especially when he talks about how enraged he edits and scandalous and the justice department. chris christie started firing people because of this. but there is this line that the good lawyers tend to draw between deaths, saying that they are going to hold people accountable, but not necessarily all the way to themselves.

neil: how often do you hear that someone goofed? these day when it comes to the health care mess, not too many democrats. many are too busy blaming companies that work with the administration and congress on obamacare. but they don't mention secretary

sebelius or the four resigned state exchange executives were disloyal politicians who are actually in the kitchen cooking up these plots. blaming big business is an all too typical democratic fault, many say there is enough blame to go around. there's a lot of blame to go around, but i don't see it being spread evenly. so what would make me think that the democrats are more interested in pointing fingers? >> the democrats are being cut accountable to their constituents. and there is plenty of blame to go around. neil: you are saying that they are doing that? >> i'm not offended, they are actually blaming the people who actually built the website. neil: all of the promises that if you like your doctor and you can keep your doctor. >> record of his that there are

made sure that it rolled out in a better way and i don't figure thing there is enough blame to go around. but i think we should be surprised that some are not wanted to take the blame. neil: here's what bothers me. if we continue to feed the myth, all i remember is that when this was being debated the democrats had a full run of the house and they control the presidency and the senate and the house. they got it through and it was a monumental achievement and problems crop up saying that it's everyone's fault but their own comment strikes me as disingenuous remark yes, they not only had a huge majority in the house but a super majority and in the senate. sixty votes in the senate. so they didn't even get one to join him which was a big mistake.
