rare person-to-person chat. hear from the most feared man in america. >> good evening, everyone. president obama has lost the trust of the public on almost every significant issue facing the nation. and losing that trust he has even the republican party a great gift for the midterm elections. the white house today trying to deflect this trust issue and public opinion polling showing that the gop is now the majority view of the president. also the white house investigation into the irs targeting of tea party and conservative groups moving so slowly that one group filed an ethics complaint against elijah cummings, the ranking member of the house oversight committee.

catherine angle bracket is among our guests tonight. and the so-called hillary papers revealing a ruthless first lady, hillary clinton, and her somewhat complex analysis of the presidents infidelities. "a-team" on that. another delay in obamacare as well. senator kelly ayotte talking about republican distressed and the president and investor carl ichan surrendering in his battle with apple management. we will tell you who won. and we begin tonight with the white house in denial. press secretary jay carney today argued that distressed has nothing to do with immigration reform from their agenda. how speaker john boehner cited a lack of trust in the president to enforce the law. chuck schumer called upon republicans to pass a bill that

would take effect after president obama leaves office. here is here's jay carney's response to senator schumer's proposal. >> this is a tough issue for republicans. but nobody buys the republican reluctance to deal with and pass comprehensive immigration reform has to do with the issue. i think that that discussion highlights the fact that that excuse is bogus. and that the issues here have to do with a long-standing tension within the republican party about the need for immigration reform. lou: actually the numbers don't lie. the american public does not trust president obama. the most recent survey shows just 46% on the president trustworthy and 49% saying that he is not. the most recent fox poll almost

exactly the same. 45% find him on a and 49% say that he is not read and it shows an even wider gap. 46% of those polls find the president to be trustworthy. 53% say the opposite. before he you persist further in his argument. president obama on the employer talked about it being an imperial directive areas in this is to delay an employer mandate. the delay effects almost 8 million and those businesses with more than 50 employees by

fewer than 100. they now have an extra gear to phase in coverage for their employees to work more than 30 hours per week. house republicans tonight held a special meeting on capitol hill to determine how to move forward. house democrats have their retreat at the end of this week in the house is in recess all of next week. so they do not go quite as wednesday the debate is reduced to january 25, two days before the treasury department says it will no longer be able to pay all of the government's bills. a source in that room tells boxers that they couldn't get 218 votes for the necessary majority in a single proposal offered.

i would trust that the entire members of congress and the president. they knew about this and what it was going to happen and it had vacations and christmas break and the democratic majority, they want to go to the very end and then for some kind of deal for the american people and the american people deserve better. lou: i don't think a single one of us would argue. but i think that we are getting used what we got. congress has a 12% approval rating and a speaker who doesn't have any vision for his conference and we are looking at

another debt ceiling. the american people are absolutely flat opposed to shutting down the government. whether they call themselves to party members are conservatives or whatever they call themselves. it is a stupid idea and only stupid people will persist. >> well, this is pretty simple. and the members of congress were sent down there to do a job. the job includes if you have to work past 6:00 o'clock in order to catch a planeethey have an affirmative obligation to go into a room and just hammer it out until it's done in a way it's going to be done. and it is about compromising and you're going to have to find a way to work together and about

the next election cycle. lou: i don't know who you have been associated with. there are many folks like that but i am aware of. they are any position of leadership and leadership reform and they have the absolute leadership position and they hold the issue in their hands. secondly they have the issue going into the midterms. obamacare is a disaster posing as a unilateral action by this president. and they have beyond that the greatest strategic issue which is distrust of the president. something like the government

shutdown. >> by now there is distrust and mistrust. you do have obamacare which is a terrible thing, the cbo notes that. go into your local restaurant and it is a matter. and then you have the issue of immigration. and there are high skilled visas that are here that want to be contributing members of society. and i now have to wait 15 months to get their loved ones over from another country. including a complete lack of attention with his responsibility and is doing nothing except acting politically. holding of the immigration and focusing on his agenda and not the people who have done it and follow the rules.

lou: wall street today, stocks going slightly higher. the dow jones up eight points, the s&p. apple shares of 22% after carl ichan announced that he is %-and apple to increase its stok buyback. having a $4 billion stake in the company. his so-called activist campaign remarkably similar to the old green approach except that all shareholders are going long now. often only short-term appreciation and less capital for the company's situation. it means clearly other activist. but it works if you add the word collective to the strategy of the approach.

the firm hired now under some criticism from previous clients that include the federal government and "the washington post" reporting that nearly 30 projects by the ireland-based contractor have encountered problems over the past decade. perhaps the obama administration might consider an american based contractor in the next round with healthcare.gov. you may have noticed talking about this we set its irish base and a spinoff on the arthur andersen accounting firm. it moved to ireland from bermuda a few years ago so we wouldn't have to pay so much in federal taxes to our government. that is, of course, paying this so much and contract funds from all of those taxpayer dollars. and yelp striking a partnership

every time the left wants to start talking, or for that matter, the right, chamber of commerce business round table. want to talk about immigration and the broken immigration system. well, let's exam that. what is broken and what is not,

and the fact is, they're trying this country admits more legal immigrants than any other nation in fact world. by far. we want to show you quickly. united kingdom, 490,000 permanent residents in 2010. italy 330,000. spain, 300,000. canada, 250,000, which is pretty good for a country that size. germany 220,000. australia 210,000. switzerland voted to eliminate immigration accepting 80,000 new visa a year. china naturalizing 1100 foreigners in 2012. the united states, on the other hand, we granted more than 1 million green cards in 2012. that's the latest here we have data. that doesn't count the 760,000 people who became naturalized american citizens. or the 4.-- almost 4.8 million students

temporary workers admitted to the united states that year. more than 6.5 million people compared to 1.8 million for all the rest of the country. that's an immigration policies that americans should be proud of. it doesn't fit the preferred narrative of the left, the chambers of commerce, the right. it's not our immigration system that is broken. in much of all of this, our public integrity is broken. our borders are broken, our ports and the integrity of those elected officials who refuse to face the fact. to credit the country for the expansive and generous policies. the question now is, why are so many interested in lies, and which will ultimately prevail? the truth, or the lie? for our part, we'll keep speaking truth to power. we don't mind a little discomfort. we're giving away free copy of my new book "uphe'll."

with, most of them, speak highly of petraeus, but you're putting forward, you know, straightforward statement that he's overstayed his welcome? >> well, be the tackiness of the way he bright -- brought himself down. and the cynicism with which the obama administration strung him along a couple of days after the election and dropped a boom on him with the news of his affair and let it break. it's clear from bob gate's book "duty." the administration didn't trust petraeus, didn't like petraeus. they saw moving him to the cia would sideline him. he had a sad affair with bill bow and brought himself down. and, you know, the thing is somebody like bill clinton can do a monicaly wean ski and rehabilitate himself. david petraeus was --

he was a hero and he rebelled in that -- reveled in that limelight. he surrounded himself with yes-men. got to the point as many ceo thought he was infallible, and turned out like the rest of us, he was very human. dave petraeus did his best for his country. but he ultimately did a great disservice to himself. watching him begging hillary clinton to give him a job when he elected to bring him back. it's just sad. lou: the administration itself, as you were saying i was thinking, there are some who might say it was a -- it's where they have another medal on his chest to be disliked by this administration. drones, the administration now waiting on -- on an american member of al qaeda undefined a terrorist in a country that refuses u.s. military action. what is going to happen here, if anything? >> well, the first question is, is the country canada?

because january yet yellen speaks tomorrow? really? >> well, the fed soul full of surprises, and you never know for sure if they're not going to pull another surprise on you. probably what she says is what she said before, and there won't be surprises. but we have seen this situation so often where the testimony catches the market offguard and you have to be prepared for anything. lou: and the market had to be prepared today for karl icon to say, hey, i love his word. i will not resist. he's run up a vender on apple. we'll take the money each and every way it broke for him. what did you think of icon other so-called activists investors when they weren't bringing everybody alone with them. they were called green mealers. when they took a public position. what is your thoughts? >> well, in principle, these

people are helping capitalism work the way it was supposed to work where shareholders in the company. the practical matter of this, though, that it isn't as if mr. icon of or any of these people were an elected official. and us shareholders are relying on a few extremely wealth individuals to tell a company what to do. >> sometimes can i go awrite. >> i think it went awry here. i have tremendous respect. he's one of the smartest guys operating, but when you start substituting stock buy back and dividends for investment by that company in the ideas and the plans, its vision of the future. you talk about a company that extensively is selling out to the short term, and has run out of ideas. and you talk about a company to short; right? >> well, you talk about a company in principle should know what to do with their retained

earnings. and there's a conflict between a shareholders who wants their money now, and a management who can make better use of that money. and i think a shareholders is only so far we can go and i'm guessing what management thinks about the future. lou: apple has a pretty good track record. they have a lot of money. i understand karl wanting part of that and every inester have wanting. the same people talking about the short-term emphasis. you know, we don't want that. we want, you know, legendary collar i have i can't -- what we're watching with the icons and the other activists, i think it not necessarily a healthy moment in our investing history. they couldn't have gone too far. corporate america should be longing at -- looking at the longer term. if you have the icon on your

executive director of the american values institute, democratic strategies. great to have you with us. former reagan political director. great to see you. >> and national revue media editor, ileana johnson. great to have you with us. let's start, if i may, you. this is media. we've got the clinton papers. this is awfully juicy stuff, but from diane blair, you know, calling lee win ski a narcissistic loon any tune portraying hillary clinton as narcissistic. what is your reaction? >> i think it was a fantastic piece. a wonderful and ab sorting read, but, you know, the bottom line is learning hillary clinton was, you know, a real power player

that she played a huge role in the clinton white house. she obviously had tremendous disdain for monica give us new insight not character of milk? bottom line, no. what i think we do get to know insight in to she backed a single payer plan. that is something she is public disvowed more than once. and i think that is the one thing out of the drove of documents that may come back to haunt her should we see her run for president like we will in 2016. >> do you think that -- first, to what ileana said about single-payer plan. that's sported in one fashion or another by phones on both sides of the i'm. i still remember the health security act of 1993 when i had to read the whole thing. it was a pretty impressive body of work. >> it was. i think it was more thought through than the present law of

the land. lou: talk about -- >> i think the key thing that mrs. clinton has to understand, and her critics will be out there being a front run are for four years is not a good place to be. and my sense is she has a great record she's established herself over eight years in the senate being elected twice by overwhelming margins in new york. she ran a brilliant campaign. didn't quite overcome obama. but the end of the day she was a stronger candidate. she has four years of secretary of state. these things will be out there. but they're not going to be on what she runs on. what is significant is how does she project her vision for the future and my sense is by the time she gets finished here she'll be form candidate. >> the only thing i'm concerned about is the way some people are rehashing the story in a way to create the double standard as if, you know, men can be powerful and strong and, you know, when it is a woman perceived as ruthless.

i think that's something that i think we have to put a line in the sand and say we're going evaluate as ed said. on her record moving forward and if she's for sing -- single-payer. >> energizing democrats she's got a history of energizing folks across the political spectrum. i want to turn to immigration. the decision to withdraw in the immigration this year. and kelly ayotte, the senator today saying to the republicans, you have to get over your distrust of obama. that sounded like one of the most contradictory responses that ayotte could have come up with. what are your thoughts? >> look, i mean, so you kelly ayotte telling boehner in effect to go back to the gang of 8 bill, and she was saying to boehner, look, get over this enforcement issue you have on the issue is not john boehner but two-thirds of his conference. beyond that, it's the american

people who don't trust obama, i think, to enforce immigration laws. not it's an issue that resonates with them. but it's an issue with this conference, with four republican congressmen who are stepping on the national stage and would have been campaigning against the immigration legislation. so it's not a problem of what john boehner getting over this, but he's got a problem in his conference. lou: i don't see it as a problem but reflecting at this point in time the view of his conference. lou: right. >> as a leader he should do chap five said on the show before but the day that john boehner moves forward the immigration bill, the second vote will be for a new speaker. i think he's discovering that very quickly. it's not going happen this year. it may not happen for the foreseeable future. chuck's plan is not going -- lou: isn't that a funny thing he did? schumer, go forward in 2017 after obama's out of office. but he gets to shape it.

>> i think he was calling his bluff; right? lou: tough love. >> the president endorsed the law. he's over, like, 500,000 deportation of undocumented immigrants. i think the challenge is, like, i can't understand where the distrust is coming from. the distrust is, you know, you're distrusting somebody enforcing the law. i think -- lou: and i don't want to get in to a record of counting here, but it comes from four years of lying about keeping your doctor, keeping your plan, it comes from a president who you're talking about is he sorely disappointed because he hasn't kept his word or implied promises. it's not a president who has been -- >> i think the issue here, in all due respect, i think there is no trust to this president by republicans from day one. they have never felt he care what they said, and at this point in time, they get to control the issue. lou: i think i have to conclude. thank you and reminder to keep it fair and balanced.
