and they are praying it will implode. that is a hell of a campaign strategy and overburdened taxpayers, at heckuva case as well. republiians will rule the day that they sold their souls to. welcome, everyone, i am neil cavuto. what about you? >> i absolutely agree that it was a huge blow to small government tea party folks. people who want less funding. because the strategy going forward is to play nice this year. let democrats do whatever they one to put the focus on obamacare. because that is on the top of the americans mind. what is going on with obamacare and since it is election year, republicans are hoping that they can just ride thhs year through and how democrats basically get in trouble with obamacare and then take over the senate and hopefully gain more control of the house. neil: it's an asinine strategy because anything can happen between now and then in the very

law that they hate could stabilize by then. it could to make americans think on it, it's not as bad as we think it is now. if they are hanging their hats on that and i am just saying when he wasserstein and resolve on everything else, yyu have kind of revealed yourselves to the american people as being the sort of baseless spineless totally clueless politician. >> exactly. this reminds me of met romney strategy during the election which was not the same thing and to lay low and look at how that ended up. so i think what they need to do is go forth a plan and show that you have a spine and obama is coming under trying to propose a billion dollar climate change fund. we need to have a strategy. we can't just put all of this in one basket which is the

anti-obama and hope that he screws up. neil: airplane into the point. when you are the opposition party you can never play it safe and that you can never hone your hopes on poll numbers that might presently will good but they don't last. he thought he was on easy street and we know what happened. what are her republicans who actually practice what they preach? let's focus on elections and more willingness to challenge conventional dc spending and if you look at polls, spending is out of control in washington dc. so they need to show that they have a spine and do something about it and they have shown the american people. neil: they are not doing it now but let's hope. happy valentine's day.

this is not really a happy valentine's day for republicans. the former republican leader knows full well by playing it safe that they could be safely assuring that they will always be the minority party. am i overstating things are what you think? >> i share your concern, by the way that they are playing it too cozy and to save. it is one thing to have enough awareness of the the vote numbers cannot go on a blind alley it to something like development. but the agriculture bill and even considering going along with president clinton on a billion dollars for climate control and he is leaving this pipeline hanging out there, these are quite safe than it should be making us than they could when in fighting these fights and losing these fights strengthens their position because of it is their policy. and i think they need to be back and have the courage to let's

get back to the job and we have to resist unnecessary and of government spending. neil: they signed on with a lot of the stuff in this bill. and when it comes at a time when they themselves have been saying that they cannot cease and desist on the this sort of thing the party leaders that says just that. would it have killed them to try to attach something even if they knew it would go down. at least they tried it. they didn't even try. >> they are so weary of being run up and then having to retrieve at the tail between their legs. they might've been wise to avoid a fight. but it's just unbelievable to me. you know, i started the arab

culture wars back in 1990 and nobody ever quarreled with whatever agriculture policy cannot because they thought it was a number of businesses. but it's not that hard to understand and arboriculture policy is counterproductive and there's nothing more destructive to the american environment than the american agriculture policy. neil: they now know that republicans are so afraid to give labels as obstructionist or risking shutting the government down to we can get any spending pass these guys and my prediction is that they are now going to ram through any type of spending another the republicans are going to be too afraid to try to stop it. >> that is where the leadership needs to differentiate. and any new spending bills have advanced the agriculture.

only people that pay taxes should get the vote and i very quickly said that everybody pays taxes of some kind, whether it is a sales tax or otherwise and he said oh, no, i meant income tax and it would elevate this above other kinds of taxes and i'm not sure that he believed that as well. that is a provocative point as well. >> i should have said that. let me take that back. neil: they are arguing that all this stuff is dangerous even though we all have free choice. they are saying apparently we're too stupid to make the decision for ourselves. they're going to make it for us. >> the government thinks that they know better than a. they thiik that they actually know what is good for us and what's not in the we are not capable of making these decisions. so you have this new labeling requirement which is completely unnecessary given that there are labeling requirements in california and the u.s. and we don't know how to make the right choices because of this. neil: it would essentially be that this stuff is dangerous to you and it will eventually kill you? but what i am curious about is why politicians are fast and furiously hanging onto this. senator chuck schumer was talking about that these days as

well. >> today we are calling on the fda to ban this harmful chemical from all foods in america. the subway chain has done it on its own and we are asking others to do it on their own. in the mud after that he ate hamburger. neil: to what is the goal here? we are very protective of their public image. is that right? >> yes, they are. senator schumer brought up a point which is companies will be doing this on their own. we need to go back to the market place we can address any potential issues that consumers have with the food. it's really scare tactics to get attention. that is why i think the politicians love this.

neil: all right, let me be brave. this cheerleader has a case. she says she has proof that she was paid way less than the minimum wage and now she is doing and the team is scrambling. traveling and doing appearances on behalf of this count as promotional vehicles that help her career to help the team get off cheap. so the actually you are not buying it. why is that? >> i am not because this is her choice. this is almost a volunteer type of position. they have other jobs on top of this and the something that they do sort of in their spare time

she says she's not the only one, they are all agreeing to this what the endgame being that they may get a modeling contract out of it order a movie or i don't even know. ss why would they subject themselves to something that would be blatantly illegal? >> what they are doing is getting these girls to sign contracts. but they can't do these girls could hear to the contracts that are clearly against public policy. so the girls are going to say, this will give me exposure and i will get modeling gigs and there's a lot of perks. but at the end of the day that is going to be a very tough argument to make before a judge because he can sit here and debate the minimum wage should be lower or higher and that is a valid debate. but you can't really debate once this is on the book whether or not it should be enforced. neil: you should also flip it around. the young weevils at work in common in the hope that they

sort of earn their stripes so is this analogous to that are very different? >> it is similar because there's a lot of people that go to charity events and they are not compensated for that. and those are things that they have to do in order to do their job. >> but they have and then came to make a lot of money. >> because here's the thing. what you said was the perfect example. as a second-year law student i took a job as a summer associate to get exposure and to meet a partner so that they would see how great it was and they would offer me a job which they did. and i got the perks but that didn't mean that they didn't have to pay the minimum wage. because you can make that argument for any job. they're always going to be into incidental parts.

neil: when you pay for the hour a straight salary and you put in an 80 hour work week, there is a difference. >> yes, there is. it was an hourly job. and that's argument of these girls are going to make sure they're paying for their hand make up in what is the cost to the company? this is a billion-dollar franchise they will end up paying so much what the defense attorney and if they had complied with the law and pay these girls $7.85 an hour. >> i think the team will settle i just don't know the amount. >> i don't see this as an hourly type job. they have regular jobs during the week. something they do in their free time is something that's fun for them that they seemed to think that there are perks of. they go into this with how much money they are going to get paid. so they know and they are not required to do this and this is not something that is mandated or that they have to do.

is part of this. >> the faa hasn't ruled it out. they said that they're looking into it. one of the few regulatory agencies that do prevent people from getting killed her from killing other people. i think eventually you will see some form of it and they may not look like this with the blades that will chop your head off or lease your finger. all kinds of dangers with these things right now. but they make it to this point. so if i forget an anniversary i can call a drones. >> my anniversary is on my birthday. so that i never forget it. i don't forget my birthday and i don't forget my anniversary. and just a little bit older than that.

>> well it is unfair. >> i think there is a shelf life underinvestment. >> i think carl ichan cares more about this than anything else. some of the companies he stays with for years. otherwise it for his company and you can invest in his public company which makes money. but i think either for long-term? may be, but how long that long-term is, maybe it is just a year or less. that's a problem with a lot of these guys and frankly why there are so few retail investors in the market these days.

well. i'm watching for this relationship because of equities are right, commodities are right and we have a little bit of rough sailing ahead. neil: wouldn't they be more indicative of than nature? >> i'm worried that it's broader than that. because usually you have these elements incorporating this in the production process and that concerns me. >> i think this economy rests on three pillars. the fed, we know that although the tapering out. the jobs numbers and we know that that is flat, if you will and i think what really needs to kick in is the existing home sales and i'm afraid that the rise in housing has flattened off which is really going to affect this with people. >> people equate their sense of worth to their home. and a lot of people have sort of
