year than the administration was. i was there we could see this crisis coming at us like a freight train, i came back, i could not interest in the administration in figuring out how to stop putin from pressures the ukrainians into walking away from the deal he agreed to sign. lou: ukraine is strategic piece of real estate. natural gas pipelines, transverse the, crane to europe. europe the ukraine itself dependent on russian energy. how can people be in this situation? it is just unthinkable, european union has been slow to act. they have you know perhaps the administration, obama administration can be criticized for being inept, but the europeans have been abouu 50% better. >> it should be and surprise?

such a tricky issue now. the crisis is fully erupted for this president, who did not think about it in advancement now he has very few options, he has very little leverage, economic military, he cannot do what the russians can do. lou: what is the outcome in. >> i don't think. i think we're all waiting to see whether or not the country will really support the protestors, whether or not they make it impossible for the president to stay on. and whether or not putin can replace the president with someone just like him. lou: yanukovych has persisted against considerable opposition already, and he has dealt severely with those ho opposed him. both publicly and -- well covertly. what will be the result here in your best judgment, you have been there you know the players, what will be the result? are those demonstrators doomed? >> i hope not.

>> well, i think i'm thinking the same way as the ukrainians are probably thinking in the way that president putin is thinking that president obama's lines whether they're red or whatever color he wants to draw them don't mean much. that is the reason why the pentagon, that is why the ukrainians are not answering calls from the pentagon right now because they don't believe they have to answer calls from the united states. i don't think it is going to do much. president obama should come out and say the violence is horrible, which it has, he need to the people perpetrating it, that is the president of the ukraine and president putin to talk about the fact that half the country wants to be geared toward western freedoms while the other half wants to stay under soviet rule. lou: i'm thinking, hank, the united nations comes out saying kim jong-un is a bad man, the human rights council. they dope have a word to say when there is extent crisis as in the ukraine now.

but, the president, the same rhetoric, the same ineffective rhetoric, is that what we're looking at again? >> we're looking at a very dangerous situation because of linkage to other parts of the world. maybe warning russians and ukrainian prime minister and government right now is not the proper move. maybe the proper move is go to another hot spot and put fleet there and say, hello, russia, here we r they don't believe you have any strength. that is why they're selling nuclear products to the iranians. that is why they destablized ukraine. that is why the pol is are afraid. they are putting former government in jail and executing people an abusing human rights. lou: we should point out why the assad regime is still in charge. >> no question about that. lou: let's turn to executive action. there is something happening that a lot of people in poll and poll they said wanted to see what happened. the supreme court monday will be reviewwng executive action, at

least as it pertains to this administration's interpretation of the clean water act. how important do you think it is? what are the, what is the likelihood, in your judgement that we'll see the supreme court actually do something about limiting what is now an imperial presidency? >> well the supreme court has ruled before on situations pertaining to the epa and their overreach when it cops to certain laws that are put in place but specifically when it comes to the epa trying to ache private property away from people in the name of protecting the environment. i think that when it comes to clean, the clean water situation i think the epa or the supreme court will probably look at that in a similar fashion. i would hope overall that their decision kind of bleeds into looking more of what president obama has done with his executive orders as we've seen with specific laws. i mean deciding not to enforce certain things, only because

they don't agree with them, not just they have been struck down by congress or changed. obamacare is obviously the biggest example of that. it will be interesting to see what arguments are made, especially from the obama side of the court, to say what about that. >> appropriate delegation of authority by the congress to create epa. frankly the epa is doing a lot of good things to rye to put that in -- lou: created by richard nixon. >> that's correct. and the original father was congressman who since passed from california named george brent. this is serious stuff. the overreach by government is one thing. trying to toss out watch of what epa has done in rule making protective citizenry of this country would be a great mistake. lou: is it a great mistake though, to give so much power to what is, we have seen in various presidencies, abuse of executive action, executive orders. we also look to section 2, the take-care clause, that is, to faithfully execute the laws of

the united states. president is as youing, they're signing orders or executive actions, executive orders. this is, this is tough stuff for an american president, katie. i don't care whether he is a republican or she is a democrat, down well for most americans. >> the problem too with president obama and even president bausch sometimes setting precedent for executive overreach, if you don't take a step back and put a halt to it as the supreme court will probably do on monday when they're looking at that set as precedent down the road for presidents in the future, democrat or republican to continue ausing that power. we have to look to the basic that our government is set up in a certain way to limit that pow you are an get back to limiting that power so we don't keep going down this road the executive branch becoming more powerful to the point we can't do much about it. lou: we have irony of republican

congress, for crying out loud, speaker boehner urging, urging president obama to push for trade promotion authority, the tpa, which is fast track, which is basically a delegation of a constitutional, congressional power to the executive for the purpose of signing more so-called, free-trade agreements. we are in an era of madness when it comes to the constitution and checks and balances. i want to turn to -- >> exactly. lou: speaking of madness, the fcc that wants to intrude into newsrooms, television newsrooms across the country, doing so with at this studies, biased in various newsrooms wanting to understand how people in newsrooms, producers and editors, all, how decide what stories are selected and what kind of perceived bias there is. this is, i have never heard of an intrusion so blatant, there

is no question, this is trampling the first amendment. >> no question about it. it is an attempt to interfere with the first amendment and you know what? news organizations ought to be jumping up and down on the right, on the left, in the center, saying get out of our newsrooms. we can do our own job. we don't need you to regulate us. this is another form of regulation that is unnecessary. lou: katie, do you believe, we know a lot of journalists. some work in small newsrooms across the country, do you have a sense what reaction of their management, their owners will be? will they stand up and say, this is too far and it is not going to happen in our community and not to this station and this newsroom? >> well i work for a company, salem communications. we own a lost radio stations and we've been fighting the fairness doctrine for decades. this is similar to the fairness doctrine. we're, more going to be standing up and saying we're not going to stand for this and news agencies

around the country should lock the front door and al -- >> this is absolutely not related to the fairness doctrine. this is -- >> absolutely is related to fairness in the doctrine in the sense, excuse me, you interrupted me. >> not being, not allowing particular content is different than allowing democracy to flourish. >> not different at all. very similar in the sense senate fairness doctrine was all about making sure that the they controlled the kind of content, so it was balanced outlyally. this is similar in sense they're looking at bias. this is all about control. this is not about getting people information that they need. this about controlling what people say and intimidating -- >> you see as attack on right. i see it as attack on cogstution. >> i see it as attack on everyone. don't put in mywords in my mouth. i said it was attack on news agencies across-country. are you admitting fairness doctrine is attack on right. >> no i'm not.

lou: you know, just last monthh3 president obama asked the american people to give peace a chance as his administration engages iran in pursuit of a nuclear weapons agreement. my next guest however says when america sits across the table from rogue regimes and terrorist groups the result is seldom peace. joining us former ppntagon official, american enterprise institute scholar, michael rubin. he is the author of this new book, "dancing with the devil, the perils of engaging rogue regimes." congratulations on the book. >> thank you, lou. lou: michael, let's start with what we're watching right now in the ukraine. the president from mexico talking about another line,

threatening a government that it is certainly not clear he could do much about in the ukraine. >> certainly one of lessons we should have learned, should never give a red line if you're not prepared to enforce it but just can't look at this at the ukraine. what happens in kiev doesn't stay in kiev. president putin worries it could spread to the rest of russia, moscow. the pols, baltic states, azerbaijan are waiting to see if the americans step up to the plate. lou: what is your sense? i, i'm just curious, to understand why this administration is only now coming to the issue it seems? >> i'm not sure that the united states understands what an idealogical battle we are in. we look at allies as partners. we want to come to a win-win situation but vladmir putin sees international relations as a zero-sum game when neville chamberlain is up against machiavelli, chamberlain seldom wins. lou: chamberlain seldom won

period. >> true. lou: irrespective of the opponent that sat across from him. this president is having a very tough time working out a conclusion, whether it be in egypt, whether it be in libya which ostensibly was a, he achieved his result but the, what has transpired since is horrible, horrible. so are there any successes for this administration? >> i'm not sure that there are. one of the problems this administration has when it to diplomacy it often sees diplomacy as beginning of a process, rather than the end of the process. if you look at one the best examples of successful diplomacy, ronald reagan with mikhail gorbachev. yes he sat down to talk with an enemy but that was after years of a military buildup to set the right circumstances for success. president obama doesn't seem to understand that. lou: as you, as you look at what is going on in russia, you talked about putin's fear of

that, pro-western sentiment, moving from ukraine to moscow to russia but also he has interests ambitions offhis own which is, it seems to many, to reconstitute the old soviet union. >> you know, and this is a noxious brew. russians because of current stagnation inside the russian economy compare putin increasely to brezhnev. however when you have, you have great ambitions but preside over a weakening power, ultimately that can be a very dangerous mix. lou: you know, i once, off the record was in moscow to look to join in look at a number of things, gos bank and other entutioning in the fall of the old soviet union. one of the things that impressed me was at that point, president george h.w. bush's commitment to do business with russia, to do much to invest in russia. that went away under the clinton
