the same way as the ukrainians are probably thinking in the way that president putin is thinking at president obama's lines whether they're red or whatever color he wants to draw them don't mean much. that is the reason why the pentagon, that is why the ukrainians are not answering calls from the pentagon right now because they don't believe they have to answer calls from the united states. i don't think it is going to do much. president obama should come out and say the violence is horrible, which it has, he need to the people perpetrating it, that is the president of the ukraine and president putin to talk about the fact that half the country wants to be geared toward western freedoms while the other half wants to stay unr soviet rule. lou: i'm thinking, hank, the united nations comes out saying kim jong-un is a bad man, the humarights council. they dope have a wordo say when there is extent crisis as in the ukraine now.

butthe president, the same rhetoric, the same ineffective rhetoric, is that what we're looking at again? >> wre looking at a very dangerous situion because of linkage to other parts o the worl mayb warning russians and ukrainian prime minister and government right now is not the proper move. maybe the proper move is go to another hot spot and put fleet there and say, hello, russia, here we r they don't believe you have any strength. that is why they're selling nuclear products to the iranians. that is why they destablized ukraine. that is why the pol is are afraid. they are putting former government in jail and executing people an abusing human rights. lou: we should point out why the assad regime is still in charge. >> no question about that. lou: let's turn to executive action. there is something happening that a lot of people inoll and poll they sd wanted to see what happened. the supreme court monday will be reviewwng executive aion, at

least as it pertains to this administration's interpretation of the clean water act. how important do you think it is? what are the, what is the likelihood, in your judgement thate'll see the supreme court actually do something about limiting what is now an imperial presidency? >> well the supreme cou has ruled before on situations pertaining tthe epa and their overreach when it cops to certain laws that are put in place but specificallwhen it comes to the epa trying to ache private property away from people in the name of protecting the environment. i think that when it comes to clean, the clean water situation i think the epa or the supreme court will probably look at that in a similar fashion. i would hope overall that their decision kind of bleeds into looking more of what president obama has done with his executive orders as we've seen with specific laws. i mean deciding not to enforce certain things, only because

they d't agree with them, not just they have been suck down by congress or changed. obamacare is obviously the biggest example of that. it will be interesti to see what arguments are made, especially from the obama side of the court, to say what about that. >> appropriate delegation of authority byhe congresto create epa. frankly the epa is doing a lot of good things to rye to put that in -- lou: created by richarnixon. >> that's correct. and the original father was congressman who since passed from california named george brent. this is serious stuff. the overreach by government is one thing. trying to toss out watch of what epa has done in rule making protective citizenry of this country would be a great mistake. lou: is it a great mistake though, to give so much power t what is, we have seen in various presidencies, abuse of exetive acon, executive orders. we also look to section 2, the take-care clause, that is, to faithfully execute the laws of

the united states. presidenis as youing, they're signing orders or executive actions, executive orders. this is, this isough stuff for an american president, katie. i don't care whether he is a republicanr she is a democrat, down well for most americans. >> the problem too with president obama and even president bausch sometimes setting precedent for executive overreach, if you don't take a step back and put a halt to it as the supreme crt will probably do on monday when they're looking at that set as precedent down the road for presidents in the future, democrat or republican to continue ausing that power. we have to look to the basic that our government is set up in a certain way to limit that pow you are an get back to limiting that power so we don't keep going down this road the executive branch becoming more powerful to the point we can't douch about it. lou: we have irony o republican

congre, for crying out loud, speaker boehner urging, urging president obama to push f trade promotion authority, the tpa, which is fast track, which is basically a delegation of a constitutional, congressional power to t executive for the purpose of signing more so-called, free-trade agreements. we are in an era of madness when it comes to the constitution and ecks and balances. i want to turn to -- >> exactly. lou: speaking of madness, the fcc that wants to intrude into newsrooms, television newsrooms across the country, doing so with at this studies, biased in various newsrooms wanting to understand how people in newsrooms, producers and editors, all, how decide what storiee selected and what kind of perceived bias there is. this is, i have never heard of an intrusion so blatant, there

is no question, this is trampling the first amendme. >> no question about it. it is an attempt to interfere with the fst amendment and you know what? news organizations ought to be jumping up and dow on the right, on the left, in the ceer, saying get out of our newsrooms. we can do our own job. we don't need you to regulate us. this is anoth form of regulation that is unnecessary. lou: katie, do you believe, we know a lot of journalists. some work in small newsrooms across the country, do you have a sense what reaction of their management, their owners will be? will they stand up and sa this is too far andt is not going to happen in our community and not to this station and this newsroom? >> well i work for a company, salem commucations. we own a lost radio stions and we've been fighting the fairness doctrine for dades. thi is similar to the faiess doctrine. we're, more going to be standing up and saying we're not going to stand for this and news agencies around the country should lock

the front door and al -- >> this is absolutely not related to the fairness doctrine. this is -- >> absolutely is related to fairness in the doctrine in the sense, exce me, you interrupted me. >> not being, not allowing particular content is diffent than allowing democracy to flourish. >> not different at all. very similar in the sense senate fair doctrine was all about making sure that the they controlled the kind of content, so it was balanced outlyally. this is similar in sense they're looking at bias. this is all about control. this is not about getting people information that they need. this about controlling what people say and intimidating -- >> you see as attack on right. i see it as attack on cogstution. >> i see it as attack on everyone. don't put in mywords in my mouth. i said it was attack on news agencies across-country. are youdmitting fairness doctrine is attack on right. >> no i'm not.

threatening a government that it is certainly not clear he could do much about in the ukraine. >>ertainly one of lessons we should have learned, should never give a red line if you're not prepared to enforce it but just can't look at this at the ukraine. what happens in kiev doesn't stay in kiev. president putin worries it could spread to the rest of russia, moscow. the pols, baltic states, azerbaijre . >> what happens in kiev does not stay in kiev. president putin in the polls in the baltic states and azerbaijani wins. lo chamberlain seldom won

period. >> true. lou: irrespective of the opponent that sat across from him. this president is having a very tough time working out a concluon, whether be in egypt, whether it be in libya which oensibly was a, he achieved his rult but the, what has transpired since is horrible, horrible. so are there a successes for this administration? >> i'm not sure that there are. one of the problems this administration has when it to diplomacy it ofte sees diplomacy as beginning of a process, rather than the end of the process. if yo look at one the best examples of successful diplomacy, ronald reagan with mikhail gorbachev. yes he sat down to talk with an enemy but that was after years of a military buildup to set the right circumstances foruccess. president obama dsn't seem to understand that. lou: as you, as you look at what is going on in russia, you talked about putin's fear of

that, pro-western sentiment, moving from ukraine to moscow to russia but also he has interests ambitions ofhis own which is, it seems to my, to reconstitute the old soviet union. >> you know, and thiss a noxious br. russians because of current stagnation inside the russia economy compare putin increasely to brezhnev. however when you have, you have great ambitions but preside over a weakening power, ultimatel that can be a very dangerous mix. lou: you know, i once, off the record was in moscow to look to join in look at a number of things, gos bank and other entutioning in the fall of the old soviet union. one of the things that impressed me was at that point, president george h.w. bush's commitment to do business with russia, to do much to invest in russia. that went away under the clinton
